PART 1 GENERAL

1.1 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only or as otherwise designated. The following must be submitted in accordance with Section 01 33 00, "SUBMITTAL PROCEDURES":

SD-01, Preconstruction Submittals

Material Placement Plan; G

Submit the proposed methods, equipment and layout for placement of dredged material into designated placement areas.

Plan must include the location and design support (including any support calculations) of all unloading facilities. The plan must also include but not be limited to methods, equipment and layout planned operations for unloading and placing dredged material.

Included within the Material Placement Plan must be a Communication Plan that clearly identifies steps taken to ensure that Burke Lakefront Airport personnel are notified on a daily basis of planned operations Plan must be detailed enough to demonstrate compliance with contract requirements.

Schedule of Work

Contractor must submit a complete Schedule of Work.

1.2 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK

1.2.1 Spring/Summer 2015 Period

Commence work as indicated in the table below. Prosecute said work diligently, and complete the entire work ready for use not later than the date indicated below. Should the total quantity of material to be paid for and actually removed under the contract exceed the limit established in the clause entitled "Variations in Estimated Quantities--Dredging", additional time will be allowed at the rate of one (1) calendar day for each 3,000 cubic yards in excess of the established limit. A period of time between Notice to Proceed and the actual start of dredging will be allocated for submittal review and approval. The time stated for completion must include final clean-up of the premises. The Contractor must comply with the milestone schedule below. Time extensions will be granted based upon the quantity of material and the dredging rate indicated above, if any of the stated Options are exercised.

1.2.2 Fall 2015 Period

Commence actual dredging operations within thirty (30) calendar days after the date of receipt by the Contractor of the Notice to Proceed to prosecute said work diligently, and to complete the entire work ready for use within the period indicated below. Should the total quantity of material to be paid for actually removed under the contract exceed the limit established in the clause entitled "Variations in Estimated Quantities--Dredging", additional time will be allowed at the rate of one (1) calendar day for each 3,000 cubic yards in excess of the established limit. The time stated for completion must include final clean-up of the premises. The Contractor must comply with the milestone schedule below. b. The Notice to Proceed will be issued on or about 10/1/2015.

1.2.3 Environmental Window

The Cuyahoga River has no dredging limitations based upon Environmental conditions.

1.2.4 Schedule of Work

The Contractor must submit a complete schedule of work covering the period of time from the Notice of Award through the specified duration of the contract, including all private and Government work, and the plant intended for each project, to the Contracting Officer within ten (10) calendar days of receipt of the Notice of Award.

1.2.5 Contract Accruals

In conjunction with the schedule submittal requirements specified in Contract Clause (Section 00700) entitled "Schedules for Construction Contracts", submit a monthly listing of accruals. Accruals are used to provide projections of the incremental costs not yet paid for, but earned.

The accrual submittal must be made one week before the end of each month throughout the contract duration. The accrual information must be provided for each line item of the Bidding Schedule.

1.3 PROJECT/SITE CONDITIONS

1.3.1 Condition and Use of Project Site

The drawings indicate depths and elevations (see Section 00 01 15 on how to obtain the latest sounding information at the dredging site). A notification of at least five (5) calendar days must be given to the Contracting Officer prior to bringing any dredging/construction equipment or material to the work site. The Contractor must be responsible for damages that may be suffered due to his operations. The Contractor must note Clause entitled "Protection of Existing Vegetation, Structures, Equipment, Utilities and Improvements."

1.3.2 Airport Restrictions - Schedule C Only

Unrestricted Work Period. The Contractor will have full use and control of the work areas shown on the contract drawings; however, the Contractor is expected to be as responsible as possible to any special requests of the Airport Administrator during this period. The hours for work may become limited during the winter months and should contact the BKL Manager of Airport Operations, Dan Psimer, 216-781-6411. A copy of the proposed progress schedule and a request for additional hours of operation must be submitted to the Burke Lakefront (BKL) Manager of Airport Operations, Dan Psimer, 216-781-6411. Any on-duty BKL personnel required for these extra hours of operation must be paid by the contractor.

Restricted Work Period. Access to the airport property and CDF may be prohibited during certain events, such as the week prior to and after Labor Day. Airport operations will waive no rights in prohibiting access if events occur during the operations. The contractor must contact the Burke Lakefront (BKL) Manager of Airport Operations to verify all restrictions.

Traffic on the airport grounds will be limited to the perimeter road used for all CDF traffic.

Access to site. The selected contractor must coordinate with BKL Manager of Airport Operations for security, access, and movement on the airport grounds. The worksite is accessible by water from the East Basin of the Cleveland Outer Harbor. By land, access road is adjacent to and east of Benjamin O. Davis Aviation High School. Access must be by East Memorial Shoreway, East 55th Street and North Marginal Road to existing North Marginal Road, located west of the marina and Municipal Light Plant. Access to the site is restricted from public use by security gates. During all construction operations, the Contractor must secure the inner gate once the work force is inside. The Contractor must provide a lock for the inner gate and must provide a key to the contracting officer. The lock must interlock the hasp with the existing locks to allow access for other gate users. The inner gate must remain locked at all times. If the gate is found open/or unlocked at any time, the Contractor will be required to provide a full-time security guard to be stationed at the inner gate to maintain security of the site. The outer gate will remain open at all times for access by others using the marina. Telephone service must be provided at the gate by the Contractor for communication between the security guard, Contractor's field office and the Burke Lakefront Airport (BKL) Operations Center. Security of airport access gates and keys will be maintained by the Contractor as required by Airport Security Regulations. The procedures to be followed will be mutually agreed upon by the Contractor and airport management. No separate payment will be made for any requirements associated with site security and all costs must be included in the payment items shown in Section 00010, "Solicitation, Offer, and award (SF 1442) and Bidding Schedule.

Marking and Lighting of Equipment.

(A) When not in use, all booms and similar unusually high equipment must be lowered to below the equipment's fixed highest point. Tips of booms must also be marked by a red light continuously lit day and night, and a high visibility, 4 ft x 4 ft white and orange checkered flag. The white and orange squares must be 3 inches squared. Contractor will coordinate specific marking requirements with Airport Operations Manager, Dan Psimer, at 216-664-4530.

(B) Top 15 feet of booms must be painted with fluorescent orange Federal Standard 595A, color 38903 or equal.

(C) All Contractor work vehicles must be identified by company name.

1.3.3 Physical Conditions

The physical conditions shown on the drawings are indicative of those that prevailed at the time of the site investigations and may be different than those at the time of dredging. Significant variations that would require changes to the plans and/or specifications must be reported to the Contracting Officer immediately.

1.3.4 Waterways Navigation, Traffic and Notice to Mariners

There is a heavy amount of traffic in the Cuyahoga & Old Rivers and Cleveland Harbor consisting of fishing boats, recreational boats, tugs, barges, and all classes of lake vessels varying in length to over 600 feet. To prevent any delays to the shipping industry, there must be no mooring of dredging equipment in any of the turning basins. The Contractor must acquaint himself with all information and regulations pertaining to

SECTION 01 35 13 Page 1026 navigation & vessel traffic within the waterways and must coordinate with the U.S. Coast Guard Offices indicated in paragraph entitled "Notifications" of this Section, to assure that a "NOTICE TO MARINERS" is issued prior to his work activity at the project site. A copy of the requisite notice form is an attachment to this solicitation. The completed form must arrive at the address (shown on the form) no less than two (2) weeks prior to the start of work activity at the project site. The Government will not undertake to keep the waterways free from vessels or other obstructions, except to the extent of such regulations, if any, as may be prescribed by the Secretary of the Army, in accordance with the provisions of Section 7 of the River and Harbor Act approved 8 August 1917 (see Title 33 U.S.C.A. Sec. 1). The Contractor is further required to conduct his work in such a manner as to obstruct navigation as little as possible and, in case, the Contractor's plant so obstructs a channel as to make it difficult or endanger the passage of vessels, said plant must be promptly moved on the approach of any vessel to such an extent as may be necessary to afford practicable passage. Upon completion of the work, the Contractor must promptly remove his plant, including ranges, buoys, piles, and other marks placed by him under the contract in navigable waters or on shore.

1.3.5 Navigation

The site of dredging in the Cuyahoga River is considered sheltered and not subject to wave action. The site of the open lake placement area is subject to wave action from lake storms. The site of the confined disposal area is subject to some wave action from lake storms. Information and regulations pertaining to navigation may be obtained from the current issue of the "United States Coast Pilot 6", issued annually by the U.S.

Department of Commerce, National Oceanic and Atmospheric Administration (NOAA). The "United States Coast Pilot 6" may be obtained from National Ocean Survey, NOAA, Distribution Division-C44, Riverside, Maryland 20840.

1.3.5.1 Hazards to Navigation

Maintain complete control of the movement of floating equipment and material. Loose floating equipment and material are not permitted. Keep in readiness at all times a powered craft capable of moving, securing and disposing of floating equipment which may get loose and become a hazard to navigation.

1.3.6 Existing Vegetation, Structures, Equipment, Utilities & Improvements

General locations of applicable existing utilities, vegetation, structures, equipment and improvements, based upon latest information available to the Government have been shown on the drawings. However, it is the responsibility of the Contractor to establish the exact horizontal and vertical location and size of all existing utility lines which are located within the required work area. The Contractor must confer with the owners of the crossings regarding their exact locations and elevations and will be held responsible for any damages done to them by the dredging operations.

Any utility lines that are not found by the Contractor, but are known to exist at the project site, must be reported to the Contracting Officer immediately. If the Contractor damages any existing utility line, vegetation, structure, equipment or improvement, a report thereof must be made immediately to the Contracting Officer. In any event, existing utility lines, vegetation, structures, equipment or improvements must be protected from damage, and if damaged, must be repaired by the Contractor at his own expense.

1.3.7 Condition of Channels

The channels are dredged totally, or in part, annually, depending upon sediment build-up over the year. Drawings showing the depths for the most recent survey are available on the web at http://www.lrb.usace.army.mil/Library/MapsandCharts.aspx. For surveys older than those shown on the website, contact the Survey Section at (716) 879-4429. Previous surveys are to be considered for information only, and should not be considered representative of current conditions.

1.3.8 Temporary Lights, Signals and Buoys Required by the Coast Guard

All temporary lights, signals and buoys required by the U.S. Coast Guard must be displayed during the project work. Information regarding required signals, lights, buoys and other requirements may be obtained from the Commander OAN), U.S. Coast Guard, Shore Maintenance Detachment, ATTENTION:

Aids to Navigation Branch, 1240 East Ninth Street, Cleveland, Ohio 44199-2060, Telephone (216) 522-3990.

1.3.9 Airport Traffic

There is a significant amount of air traffic using the Burke Lakefront Airport, adjacent the south side of the Government-furnished Confined Disposal Facilities. Contractor operations in the vicinity of the Burke Airport must comply with the navigational airspace penetration provisions stipulated on contract drawing C-104.

1.3.10 Acceptance Section Lengths

1.3.11 Datums and Benchmarks

The plane of reference of low water datum as used in these specifications is that determined by the following bench marks:

a. R 321 (PID MB1503), ELEVATION - 585.50 (feet), At the East End of Center Street Draw Bridge over the Cuyahoga River, set vertically in the southwest face of the massive concrete pier of the Superior Avenue Overpass Bridge, directly across Center Street from the northwest face of the State Fish Market Building, 21.0 feet northeast of the center of Center Street, 97.0 feet west of the center of Merwin Street, 49.0 feet east of the east end of the Center Street Bridge, 2.0 feet northwest of

The plane of low water datum is 569.2 feet above mean level at Rimouski, Quebec (IGLD-1985) (International Great Lakes Datum 1985).

Upon request, the Government may provide additional control. It is the responsibility of the contractor to verify all control prior to use.

1.3.12 Notifications

Within five (5) days of completing the notifications required under this contract, submit to the Contracting Officer, written verification of these notifications, including the date, time and the name of the point of contact with whom correspondence occurred. These verifications must be sent to:

b. Notify the Ohio Environmental Protection Agency, both the Section 401 Coordinator (P.O. Box 1049, 1800 Watermark Drive, Columbus, OH 43266-0149, Phone (614) 644-3020), and the Northeast District Office (2110 East Aurora Road, Twinsburg, OH 44087, Phone: (330) 963-2100, at least three (3) days prior to commencement of dredging, concerning the initiation of dredging.

c. The Contractor is advised that should he be required to dredge either 50 feet upstream or downstream of a British Petroleum Company

Gas Pipeline at approximate Station 770+15, he is required to contact either Mr. Norbert Bruening (216) 912-2573 or (216) 214-5905 (mobile), or Mr. Tom Coine (216) 912-2563, during normal business hours, two weeks in advance of anticipated dredging in the area. Coordinate his work in the vicinity of this pipeline with British Petroleum and the individuals mentioned above in this paragraph.

d. Advise the following U.S. Coast Guard Offices regarding the "Notice to Mariners" requirements of the contract:

1.3.13 Environmental Restrictions

The Contractor must adhere to all provisions set forth in the 401 Water Quality Certification documents and must maintain a copy of this document on the dredging vessel during the entire duration of dredging operations.

Additionally, no overflow dredging is permitted while dredging Cleveland Harbor and Cuyahoga River, during the duration of this contract. Overflow dredging is defined as any activity that results in the displacement and spillage of dredged material and/or water from the barge, hopper or other equipment or vessel into the water body.

PART 3 EXECUTION

3.1 ACCEPTABLE EQUIPMENT

Clamshell dredging is the only acceptable method of dredging. Placement using bottom-dump scows is the only acceptable placement method if material is placed in the Government-furnished open lake site. For material placed in either the Government-furnished confined disposal facility (CDF) or Contractor-furnished placement site (that is not an open lake site), any type of scow may be used.

3.2 SUBMITTAL PROCEDURES

Submittals must be made as follows:

3.2.1 Procedures

3.2.2 Deviations

For submittals which include proposed deviations requested by the Contractor, the column "variation" of ENG Form 4025 must be checked. The Contractor must set forth in writing the reason for any deviations and annotate such deviations on the submittal. The Government reserves the right to rescind inadvertent approval of submittals containing unnoted deviations.

3.3 ORDER OF WORK

The order of work for the dredging must be as follows:

A. Schedules A and C: The portion of the Cuyahoga River, upstream of Station 735+00 must be completed first, during both dredging periods, unless otherwise directed by the Contracting Officer. Additionally, all dredging must commence at the Upper Dredging Limit and proceed downstream, for both dredging periods, unless otherwise directed by the Contracting Officer

B. Schedule B: Dredging must commence at Sta. 735+00 and proceed downstream, unless otherwise directed by the Contracting Officer prior to the start of dredging. If any portion of the options are awarded after dredging has started, the Contracting Officer may direct the Contractor to stop dredging and relocate to a location upstream and resume dredging operations at that location.

3.4 GOVERNMENT-FURNISHED CONFINED DISPOSAL FACILITY

3.4.1 Capacity of Placement Area & Material Placement Plan

Place dredged sediment in the Government-furnished confined disposal facility CDF 10B, as directed by the Government. CDF 10B is currently graded such that the CDF 10B weir will be used. Weir discharge monitoring requirements are detailed elsewhere in this Section. The Contractor will be responsible for providing the means and methods of placing the required contract quantities of material into the CDF and meeting specified weir discharge turbidity (Total Dissolved Solids) limits. Methods, such as recirculation of CDF water for pump outs, water reduction techniques, geotextile placement at weir structure (geotextile with a minimum ADS of 70 US Sieve and a minimum percent open area of 4-6% has been used in previous dredging events), and/or operation of the weir may be required, upon the direction of the Contracting Officer. The methods, equipment and layout of the Contractors' placement operations must be submitted to, and approved by the Contracting Officer, prior to the placement of any material within either CDF.

3.4.2 CDF Management Requirements.

Dredged material must be placed in a manner that will provide for quick runoff and promote rapid drying of the material. If material is placed hydraulically, during the above water phase of the placement operations, dredged material must be placed in a manner that prevents the formation of mud flats. This includes placing the dredged material with sufficient slope to facilitate rapid positive drainage towards the weir. Further placement restrictions are indicated on the Contract drawings.

3.4.3 CDF Weir Operation

The Contractor may operate the weir as part of their means and methods to maximize their ability to place material within the CDF sites, however, the physical operation of the weirs must be conducted in coordination with Government personnel only. The operation of disposing of material within the CDF must be conducted in a manner that will limit the concentration of solids discharging over the overflow weir or contained in any drainage or seepage from the CDF.

3.4.4 3.4.5 CDF Weir Discharge Monitoring

A. The Contractor must provide near real-time field turbidity measurements of the discharge water flowing over the weir. The discharge water must be maintained at a total suspended solids (TSS) level below 100 mg/L or parts per million (ppm). The contractor must include all TSS readings on daily reports. A separate TSS log must be maintained daily and submitted to the government weekly.

B. Laboratory and field testing must be conducted in accordance with the following instructions:

1. Laboratory Testing:

a. Laboratory test data must be used to establish a conversion between the Nephelometric Turbidity Units (NTU) measured by field monitoring devices and TSS levels needed to monitor weir discharges.

b. The Contractor must use Government-furnished and/or Contractor-furnished laboratory data. Government-furnished laboratory test data is included as an attachment. The Government-furnished test results are derived from in-place sediments from previous dredging activities in the harbor. The Contractor may supplement this data with Contractor-furnished testing, if the Contractor determines that the field conditions can be better represented with additional data. All Contractor-furnished supplemental data must be provided at no additional cost to the Government.

c. Contractor-furnished Laboratory Data. The Contractor must submit a procedure relating TSS in the weir discharge to Nephelometric Turbidity Units (NTU). The procedure must be developed based on U.S. Army Engineer Research and Development Center Technical Note DOER-E8 (June 2000), Improved Methods for Correlating Turbidity and Suspended Solids for Monitoring, Recommended Procedures: Containment Area Effluent. This Technical Note is included in Section 00100 "BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS" clause entitled "List of Attachments." Other test methods may be utilized by the Contractor if approved by the Contracting Officer prior to implementation. A homogenized representative sediment sample of the dredged material must be mixed with site water to a slurry concentration that approximates that of the dredge discharge operation. This slurry must be pumped into an eight (8") inch by six (6') foot laboratory settling column or large graduated cylinder that is six (6") to eight (8") inches in diameter, and allowed to settle. After settling, collect 50 ml water (supernatant) samples from the uppermost column sampling ports or from just below the water surface of the settling column. A large portion of the required samples must be collected in the beginning, with an increasing sampling interval as the procedure progresses. An initial sampling interval of one hour is required for the first 8 to 16 hours of the procedure, with increasing intervals of 2 hours, then 4 hours, then 6 hours, as necessary, until TSS in the supernatant clears such that the TSS concentration is less than 100 ppm. At least 20 water samples must be collected from the settling column during the first 2 days of the procedure. Each settling column water sample must be analyzed for both TSS and turbidity. This data must be used to plot a graph with TSS as the y-axis versus turbidity as the x-axis. For a linear relationship, the line of best fit must be calculated of the form y = ax + b and plotted on the graph. This TSS/turbidity correlation curve must be produced and submitted to the Contracting Officer.

2. Field Testing:

The Contractor must submit a Rapid Field Procedure for on-site determination of TSS levels in the weir water or effluent. TSS concentrations in the CDF effluent must be estimated directly from the field turbidity measurements using the TSS/turbidity correlation curve produced as stated above. The Contractor must monitor turbidity in the weir effluent on a continuous production rate and changes in placement position until a steady state flow over the weir is established. For steady-state flows, turbidity monitoring must occur at 6-hour intervals (maximum interval).

Monitoring is not required when CDF discharges are halted. If

SECTION 01 35 13 Page 1033 any turbidity measurement approaches or exceeds the NTU threshold that translate to a TSS concentration of 100 ppm, the Contractor must notify the Contracting Officer and 1) decrease production rate, or 2) increase settling time by moving the input discharge, or 3) increase the ponding depth, or 4) cease production to allow TSS in the CDF effluent to decrease. In such cases, the water effluent must be monitored hourly until the situation has been rectified and reports on the weir effluent monitoring must be submitted to the Contracting Officer on a daily basis. Any failed test must be reported to the government immediately.

Total Suspended Solids Report. The methods to be used for the above stated procedures must be submitted at least five (5) days prior to the operation of the weir. Additionally, any dredging/placement costs associated with the failure, by the Contractor, in submitting these procedures will be at the sole expense of the Contractor.

3. The Government may conduct confirmatory testing to verify compliance. In the event that the Contractor and the Government test results are conflicting, the Government test results must govern. The Contractor must also be responsible for all costs associated with curtailing or ceasing of placement operations due to the lack of placement volume effluent TSS failure or for not meeting any environmental requirements noted above.

3.4.5 Additional Requirements for Hydraulic placement of Dredged Sediment

CDF 10B does not have a pumpout facility available for the Contractor's use. The Contractor must adhere to the following requirements for placement of material within the CDF:

A. Work must be completed in conformance with the Contractor's approved Material Placement Plan. Joint Contractor/Government inspections must be performed periodically throughout the work (at the Government's discretion) to evaluate and document contract compliance.

B. Use a diffuser plate at the end of the discharge pipe.

C. Pipeline Inspection. The Contractor must inspect the pump out pipeline, if used, at 0800, 1200 and 1600 hours each day that material is placed into the CDF. Any leaks noted must be repaired within twenty-four (24) hours. Any leaks outside the CDF requires immediate shutdown of pumping operations until the pipe has been repaired. The Contractor must maintain a log and record of all pipeline inspections at the job site and submit them to the Contracting Officer at the completion of the contract.

3.4.6 Schedule C - Additional Requirements for Mechanical Placement of Dredged Sediment

Before any work begins at CDF 10B, a Joint Pre-Condition Survey of the area must be done. The COR or their representative will attend. The condition of all roads, structures, utilities, etc, must be recorded, by the contractor, in detail and photographed as directed by the COR or their representative. The results of the survey must be submitted within 2 days of completion of the survey. All information (written and photographic) from the survey must be in one document, and one hard copy and one electronic copy of the report must be submitted. The Government will

SECTION 01 35 13 Page 1034 respond within 2 days, providing either acceptance of the report or requesting more information to be entered. If more information is required, the Contractor has 2 days to re-submit the report and the Government will respond within 2 days. This process will continue until Government acceptance of the report. A hard copy and electronic copy is reqruired for every time the survey is submittes. No work will be allowed on-site until the report is approved.

The Contractor may make improvements to CDF10B to facilitate the placement of material. All work on the improvements and the actual improvements must be in accordance with all FAA requirements as stated and shown on the contract drawings. Any materials used for improvements that were not in the CDF at the start of the Spring Dredging, must be removed at the end of the Fall dredging. The contractor may, at their own risk, leave all improvements in place and all equipment on-site between the Spring and Fall dredging, providing that all FAA requirements are met.

A. Daily coordination of activities with Burke Lakefront Airport personnel

B. Placement operations will be as directed by the Contracting Officer.

C. Work must be completed in conformance with the Contractor's approved Material Placement Plan. Joint Contractor/Government inspections must be performed periodically throughout the work (at the Government's discretion) to evaluate and document contract compliance.

D. The Contractor must place all dredged material into the CDF without the addition of water.

E. The Contactor must conduct operations (and provide temporary site facilities as necessary) to prevent dredged sediment and runoff/discharge water from contacting the lake, shoreline and/or property outside the CDF any time the dredged material is moved/relocated/transported. Provisions may include but not be limited to:

1. Roadway improvements/modifications and wheel washing station for trucking operations.

2. Aprons, tarps or other protective systems to prevent spillage of sediment or water at the scow unloading area.

F. Cranes, conveyors, or other equipment and structures must comply with the adjacent Burke Lakefront Airport, FAA requirements (e.g., marking/lighting of equipment, radio communication with airport, potential lowering of equipment during airplane arrival/departure, etc.)

G. Perimeter roadways and CDF berms must be returned to their original condition (or better) at the completion of both spring and fall dredging operations.

H. Perimeter roads between the CDF and airport must remain passable for airport emergency vehicles at all times.

I. Sediments must be placed within the elevation restrictions provided in this section (and as shown on the drawings) in a manner that will ensure that placed material does not cause ponding of water. Positive drainage to the weir must be provided.

J. When work for all line items in Schedule C have been completed, all

SECTION 01 35 13 Page 1035 materials brought into the CDF for the improvements must be removed and the condition of all items documented in the Joint Pre-Condition Survey must be returned to their original condition or better.

3.5 GOVERNMENT-FURNISHED OPEN-LAKE PLACEMENT AREA INFORMATION

The designated Open-Lake Placement area is shown on the contract drawing.

The following guidelines must be adhered to when disposing of dredged material in the Government-designated Open-Lake Placement Area:

a. Procedure. Materials must only be discharged in the western half of the Open-Lake Placement Area, as indicated on the contract drawing.

Dredging must be conducted in such a manner which will prevent spillage or discharge of dredged material between the dredging location and the placement area. The placement area must be plainly marked, by the Contractor, with conspicuous buoys that must have reflective tape or markers, and comply with the requirements as set forth in paragraph entitled "Temporary Lights, Signals and Buoys Required by the Coast Guard" of this section. Buoys and/or markers must be periodically inspected/located as required to ensure that they have not drifted during the course of the project. Verification of proper location must be made at the request of the Government.

b. Limits on Open-Lake Placement. The maximum amount of material allowed to be placed is stated in the 401 water quality certification, and it is anticipated that all of the material dredged under this order will be discharged into the Open-Lake Placement Area. A copy of the 401 water quality certification will be provided at the pre-constrcution meeting.

3.6 CONTRACTOR-FURNISHED PLACEMENT AREA AGENCY COORDINATION

The Contractor must coordinate the use of the proposed Contractor-furnished placement area(s) with the appropriate environmental and/or regulatory agencies. Additionally, the Contractor must, without additional expense to the Government, be responsible for obtaining necessary licenses, permits, and/or approvals, and for complying with any local, State or Federal laws, codes, and regulations applicable for the use of the placement area(s).

See the Contract Clause (Section 00700) entitled "Permits and Responsibilities". Within ten (10) calendar days of notification, by the Contracting Officer, that the Contractor is the apparent low bidder, the Contractor must submit written approval of applicable agencies, as determined by the Contracting Officer, for the use of the placement area(s). These agencies may include, but are not limited to, the following:
