appropriate in situations such as the following (these examples are not intended to be all inclusive and do not constitute authority in and of themselves):

(1) When there is a reasonable basis to conclude that the agency’s minimum needs can only be satisfied by --

(i) Unique supplies or services available from only one source or only one supplier with unique capabilities; or,

(ii) For DOD, NASA, and the Coast Guard, unique supplies or services available from only one or a limited number of sources or from only one or a limited number of suppliers with unique capabilities….

(c) Application for brand name descriptions. An acquisition that uses a brand name description or other purchase description to specify a particular brand name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition regardless of the number of sources solicited. It shall be justified and approved in accordance with FAR 6.303 and 6.304. The justification should indicate that the use of such descriptions in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company. See 5.102(a)(6) for the requirement to post the brand name justification. (Brand-name or equal descriptions, and other purchase descriptions that permit prospective contractors to offer products other than those specifically referenced by brand name, provide for full and open competition and do not require justifications and approvals to support their use.)

5. Reason Authority Cited:

(State explanation describing circumstances preventing full and open competition and describe what harm will come to the Government if this action is not taken)

To maintain compatibility with present system on base, the fire alarm reporting system, security alarm reporting system and DDC reporting/control system are the only acceptable systems.

To maintain the current key inventory control system on base, the following manufacturers are the only options available: Best Access Systems and Knox Company.

If sole source is not approved, security and safety of base assets may potentially be compromised or damaged since operating duel systems may result in mechanical or human error.

6. Actions to Increase Competition: (Provide a description of the efforts made to ensure that offers are solicited to as many sources as practicable, including whether a notice was or will be publicized as required by FAR subpart 5.2 and, if not, which exception under 5.202 applies)

This will be awarded as a part of an IFB and set aside for small businesses.

7. Market Research: (Describe the extent of the market research conducted to identify all qualified sources and the results thereof or a statement of the reason market research was not conducted.

“Market Research” means collecting and analyzing information about capabilities within the market to satisfy agency needs)

The items listed in paragraph 3 above are a base standard for security, fire, and safety. Monaco, Advantor, and T.A.C. all report to a base system. The Best Access allows the base to have one keying system. The knox box is the standard for the fire department. Other systems may work, but would require additional hardware.

8. Other Interested Sources: (Provide a listing of the sources, if any, that expressed, in writing, an interest in the acquisition)

9. Subsequent Acquisitions: (Provide a statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services are required)

Based on the need for standard systems related to security, fire, and safety, future acquisitions will also sole source these brand names.

10. Procurement History:

Previous Contract or Purchase Order Number: Multiple task orders and construction contracts Previously Competed? Yes Previous authority for less than Full and Open Competition: 6.302-1

11. Fair and Reasonable Price Determination: IAW with FAR 13.106-3(a)(2), I have determined that the anticipated cost to the Government is fair and reasonable based upon one or more of the following: (Contracting Officer check as appropriate)

____ (i) Market research;

_X__ (ii) Comparison of the (anticipated) price with prices found reasonable on previous purchases;

____ (iii) Current price lists, catalogs, or advertisements. However, inclusion of a price in a price list, catalog, or advertisement does not, in and of itself, establish fairness and reasonableness of the price;

____ (iv) A comparison with similar items in a related industry;

_X__ (v) The contracting officer's personal knowledge of the item being requested;

_X__ (vi) Any other reasonable basis.

12. Certification: I certify that the information included in this mini-J&A is accurate and complete to the best of my knowledge and belief:
