1. PURPOSE: The purpose of this project is to provide professional design and construction services necessary to upgrade the POL diesel fuel pump station to more effectively accommodate the diesel refueling mission, specifically to refuel the C-301 refueling truck through a bottom feed apparatus in a safe and timely manner.
2. SCOPE: This project shall include the following items:
2.1. On-site review of existing systems and infrastructure.
2.2. The design and construction of an upgraded diesel fill station for the Maine Air National Guard, 101st Air Refueling Wing, Bangor, Maine. This work shall include any required equipment, modifications to existing systems, modifications and/or extensions of existing pavements, containment, canopies, lightning protection, fire suppression, lighting, signage, and connections to existing infrastructure as necessary to provide a complete and useable system.
2.3. Provide site adaptable design drawings, specifications and cost estimates to be customized by multiple locations across the Air National Guard for a similar installation. Provide working files (CAD, Word, Excel), in addition to PDF’s (electronically plus three hard copies).
2.4. Any new or improved paved surfaces shall be designed to accommodate vehicle types ranging in AASHTO classification from P (passenger), to WB-67 (large delivery trucks).
2.5. Provide the government with projected design and construction schedules with significant milestones identified (refer to ANG ETL 10-03 for more design guidance).

4. PERFORMANCE REQUIREMENTS:
4.1. General: Provide turnkey design and installation of a diesel refueling station, specifically to refuel the C- 301 refueling truck through a bottom feed apparatus. In accordance with all federal, state and local laws and requirements, provide labor, equipment and supervision to complete the installation of the above described system.
Proposals are to include all third party inspections including, but not limited to, soil boring compaction, concrete air and slump testing. Commissioning of the system shall be included in the proposal, as well as operator and maintenance training and manuals.
4.1.1. Shall have a flexible hose with quick-disconnect single point nozzle.
4.1.2. Shall have grounding capabilities.
4.1.3. Shall drain into existing Oil Water Separator.
4.1.4. Shall have ability to meter fuel discharged from bulk storage into fuel trucks.
4.1.5. Shall have shelter over exposed fill stand.
4.2. Site: Existing site layout and as-built drawings are provided for reference. Contractor is encouraged to utilize existing equipment and infrastructure to the extent possible. The contractor is responsible for final layout, integration, and site grading elements including erosion and sedimentation controls (if required). Contractor shall be responsible for all permitting requirements.
4.3. System: The system shall be capable of pumping rates of 100 – 125 gpm, and provide overfill protection / shut-off capability.
5. PERIOD OF PERFORMANCE:
5.1. Total Design and Construction Period of Performance shall be 180 days.
6. OPERATING CONSTRAINTS:
6.1. Contractor shall ensure minimal shut-down of existing fueling station in order to maximize availability of the fueling station to base occupants.
6.2. Contractor shall provide a minimum of 72 hours’ notice to the Government prior to closure of any roads, shut-down of any utilities, or closure of the existing fueling station.
6.3. Work areas shall be properly marked and cordoned off to prevent unnecessary entrance of base personnel into construction zone.
7. PROPOSAL SUBMISSION REQUIREMENTS: Offerors shall provide a detailed narrative explaining how the proposal meets, exceeds or deviates from the performance requirements provided in paragraph 4 above. If offerors desire to deviate from any of the project performance requirements, the specific deviations must be identified and justification provided.

52.204-7 SYSTEM FOR AWARD MANAGEMENT (OCT 2016)
(a) Definitions. As used in this provision--
Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.
Registered in the System for Award Management (SAM) database means that--
(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into the SAM database;
(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in the SAM database;
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and
(4) The Government has marked the record ``Active''.
Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.
(b)(1) By submission of an offer, the Offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in the SAM database.
(c) If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. The Offeror should be prepared to provide the following information:

(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL
EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and

Section 00100 INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS
1. SCOPE
1.1. You are invited to submit a proposal in response to our Request for Proposal W912JD-18-R-2002 for Project No. FKNN172315 at Maine Air National Guard Base, Bangor, ME 04401. As a result of this solicitation, the Government intends to award a single Firm Fixed Price (FFP) contract to the responsible offeror whose proposal represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.
1.2. This solicitation is set-aside 100% for small businesses.
2. NOTICE OF PRE-PROPOSAL CONFERENCE
2.1. A pre-proposal conference will be conducted on 10 September 2018 at 9:00 AM EST for the purposes of briefing on the proposal requirements and answering questions regarding this solicitation. This conference will be held at the Maine Air National Guard Base, Bldg. 486, Civil Engineering Squadron Classroom, Bangor, ME 04401.
Interested Contractors are highly encouraged to attend the pre-proposal conference. The site visit will be held following the conference.

2.3. This information must be provided in advance, not later than 3 business days prior to the meeting, in order to ensure access to the military base and conference site and ensure adequate seating for the conference attendees.

5. HAND CARRIED PROPOSALS/INVITATIONS
5.1. A bid repository is provided for hand carried proposals and is located at: Maine Air National Guard, Base Contracting Office, 103 Maineiac Ave., STE 505, Bangor, ME 04401.
5.2. Hand carried proposals must be deposited in the repository prior to the time established for receipt of proposals.
5.3. Offerors are cautioned that approval to enter the base must be obtained prior to the closing date for receipt of proposals. Follow the procedures outlined above in paragraph 2.1.2. for entry. Delays are probable at the entry point and should be accounted for. Late receipt of proposals due to base entry delays may not be deemed excusable and the Contracting Officer may declare the proposal late and remove it from consideration.
6. WAGE DETERMINATION
6.1. The Construction Wage Rate Requirements formerly known as Davis Bacon Wage Rates are applicable to this project. Current prevailing wage determination(s) at time of issuance of solicitation are ME180093 06/01/2018 for Penobscot County, Maine.
In the event the current prevailing Wage Determination is changed by the Department of Labor prior to the closing date of the solicitation, the most current wage determination is in effect. Should the wage rate change after closing, but prior to award, the updated Wage Determination will be incorporated by amendment and issued to all offerors that have not been eliminated from the competition. If applicable, these offerors/contractors will be given a reasonable opportunity to provide revised proposals solely to amend proposals due to Wage Determination changes.
If the wage determination modification does not change any affected wage rates, then the provisions of FAR 22.404- 5(c)(4) will apply.

7. PROPOSAL EXPENSES AND PRE-CONTRACT COSTS
This RFP does not commit the Government to pay costs incurred in preparation and submission of initial and subsequent proposals or for other costs incurred prior to award of a formal contract.
8. REMOVAL OF SECTIONS AT TIME OF AWARD
Sections 00100, 00110, 00120, 00600 and all exhibits will be physically removed as a result of an award, but will be deemed to be incorporated by reference in that award.
9. DISPOSITION OF UNSUCCESSFUL PROPOSALS
In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful proposals. The Government will destroy extra copies of unsuccessful proposals. No destruction certificate will be provided.
10. INFORMATION REGARDING AVAILABILITY OF UTILITY SERVICES
It has been determined that all temporary utilities shall be the responsibility of the contractor. The contractor will pay all charges (hook up fees, metering, monthly usage, etc.) resulting from temporary utilities. The offerors shall take this into consideration when computing their offers. (FAR Clause 52.236-14, Availability and Use of Utility Services.)
11. BID BONDS
An Original Bid bond is required with submission of the proposal. The bid bond is due on the date as stated on the SF1442 block 13. The bid bond must be on a SF24 form. Rejection of a bid bond shall be in accordance with FAR 28.101-4 Noncompliance with bid guarantee requirements.
12. EXCEPTIONS
If the offeror takes exception to any of the requirements specified in this solicitation, the offeror shall clearly identify each such exception and include a complete explanation of why the exception was taken and what benefit accrues to the Government. All exceptions to the solicitation requirements (Sections 00010 through 00800) and supporting rationale shall be included in an addendum to the proposal and clearly labeled "Exceptions". An addendum is only required if the offeror takes exception to any requirement in the solicitation. (The Addendum does not have a page limitation, but shall only include information relevant to exceptions taken to the solicitation requirements.) The Government will assume an offeror takes no exceptions to any solicitation requirement if the offeror does not submit an Addendum identifying exceptions. Offerors are advised that solicitation requirements are not necessarily negotiable and such exceptions may render an offeror's proposal unacceptable and ineligible for award.

INSTRUCTION TO OFFERORS ON PROPOSAL PREPARATION AND EVALUATION OF OFFERS AND
AWARD
Instructions: Provide a Project Plan in any format with a Tentative NTP date of 30 September 2018. Additionally, provide a brief synopsis (NTE 3 pages) describing your technical solution to augment and support the Project Plan to meet the period of performance accordingly.
Evaluation: Low Price Technically Acceptable (LPTA). The offeror’s technical proposal shall be evaluated on an Acceptable/Unacceptable basis. Offerors who rate unacceptable in Technical will be removed from further consideration for award. Price will be evaluated to determine reasonableness of the proposed price. Unreasonable Offers cannot be selected for award.
a) A successful project plan will provide the Government confidence that the project is structured to be executable for the resources indicated. The Project Plan and products proposed should clearly demonstrate an adequate understanding of the tasks and resources necessary to necessary to design and construct a diesel fill stand in accordance with the attached Statement of Objectives.
b) Project Schedule. A successful project schedule will provide the Government confidence that the project is structured to be executable for the resources indicated, is task oriented and indicates dates on which milestones will be achieved, and shows a total completion date of NLT 180 days after issuance of NTP.
c) Submittal with cut sheets. Acceptable cut sheets will indicate that the equipment/products offered meet the minimum requirements as detailed in the Statement of Objectives and/or Specifications and Drawings.
d) Provide an AF Form 3052 or similar format that includes detailed costs associated with work.
Subcontracted work should also be submitted in the same format.

Past Performance: The Government will evaluate the quality, timeliness, management and safety of the offeror's past performance considering currency, relevancy, sources, context, and trends on recent (within the last 3 years) projects performed under open market projects performed in support of locations serviced by National Guard Contracting Offices and other agencies. Also, evaluations available through the Past Performance Information Retrieval System (PPIRS) may be used. Past Performance is being used as an evaluation factor within the LPTA process. Past Performance will be rated on an acceptable or unacceptable basis using the rating in Table A-1.
