JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
BRAND NAME PINTLES-KAMATICS CORPORATION
W912ES18B0002
1. CONTRACTING AGENCY: The Corps of Engineers St. Paul District, Contracting Division, 180 5th Street East, Suite 700, St. Paul, MN is the contracting agency responsible for this action.
2. DESCRIPTION OF ACTION: The St. Paul District has a requirement to supply miter gates leaves and associated ancillary equipment for Lock and Dam 5A, Lock 8 and Lock 10 via a firm-fixed-price contract.
3. DESCRIPTION OF SUPPLIES: Twelve self-lubricated pintles with failure critical bearings to support the gates are required to be delivered with the gates.
The self-lubricated material must be the sprayed polymer coating type. As required by USACE guide specification 35 05 40.17, the material must be tested in accordance with the standards outlined in CERL TR 99/104 with a performance score of 350 or above for both wet and dry testing. The evaluation must be completed by the USACE Hydro Electric Design Center (HDC) in Portland, Oregon, using the bearing rating system in CERL TR 99/104 Appendix F.
The Karon V material by Kamatics Corporation is currently the only sprayed polymer coating self-lubricated material that has achieved the required performance score for these failure critical pintles.
4. AUTHORITY CITED: The statutory authority permitting other than full and open competition is 10 U.S.C. 230(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, FAR 6.303, DFARS 211.105, and FAR 11.105(a)(1).
REASON FOR AUTHORITY CITED: The testing is required to certify that the self-lubricated pintles, which are failure critical bearings, do not fail. Failure of these pintles would result in excessive repair costs and the disruption of navigation for weeks to months leading to significantly increased costs for the shipping industry and those entities that rely on their services.
Failure of these components is not acceptable and no other supplies will satisfy agency requirements at this time.
The self-lubricated pintles are designed with sprayed polymer coating due to its ability to sustain higher loads than other types of self-lubricated materials. The successful performance of sprayed polymer coating has been proven in this exact application. There have been some known failures of other types of self-lubricated materials in similar applications.
The Karon V material is the only known sprayed on polymer material that has successfully passed the USACE required testing and approval and meets the other specified requirements.
Only the brand name Karon V-Bronze Backed pintles manufactured by Kamatics Corporation currently satisfies agency requirements.
5. EFFORTS TO OBTAIN COMPETITION/ACTIONS TO INCREASE COMPETITION:
Solicitation number W912ES18B0002 specifies that the Government will accept any brand of sprayed polymer self-lubricated pintles from any manufacturer that successfully passes the aforementioned test and meets the salient characteristics detailed. The first set of gates will not be delivered before May 28, 2021.
6. MARKET RESEARCH: Market research indicates that only Kamatics Corporation can provide the required pintles as of the date of this justification. No other firms have submitted its product for the required HDC testing since its inception in 1999.
7. INTERESTED SOURCES: Kamatics Corporation is the only known source that can currently satisfy agency requirements.
8. OTHER FACTORS: None.
9. TECHNICAL CERTIFICATION: I certify that the supporting data under my cognizance which are included in this justification are accurate and complete to the best of my knowledge and belief.
