QUESTIONS AND ANSWERS
1.Per the material list there is 36,900 LF of #4/0 AL THHN black and 12,300 LF of #4 CU THHN black cabling. Per the NEC type THHN cabling is not compliant for use in a wet environment. The installation of cabling for this site is classified as a wet environment per the NEC. Please advise.
There is a typo in the material list, it should state “THWN” not “THHN” cabling.
Reference specification section S 01000 GENERAL Paragraph 2.1.2 GOVERNMENT FURNISHED
EQUIPMENT / MATERIAL (GFE/M):
“The Contractor shall use the Government Furnished Materials (GFM) detailed Appendix A for the water, sewer, and electrical system. Appendix A is the complete list of Government furnished materials available for use on this contract. However, it may not be a complete offering of the materials required to provide a complete and usable system for the bid items containing GFM. Any additional materials, either required for a complete and usable system or incidental to work must be provided by the contractor and included in his costs for the work. If the prospective offeror determines that through his own investigation that the
GFM available is not suitable for use in it require application, then the offeror must provide allowance for procuring and installing suitable material his bid.”
2.Will you provide the wastewater treatment plant drawings so we can price the install?
See attached drawings of the WWTP. The WWTP provider will deliver and install the unit. [Check on the contract with Gen360 to verify they deliver and install.]
The plant is physically located at 230 North Barrios Street, Lockport, LA 70374. This is a 30,000 Gal system. The contractor can physically verify dimensions prior to shipment and installation of pads, plumbing, etc.
3.Please confirm that a bid bond is not required for this bid.
A Bid Bond is not required.
4.Regarding financials, this bid is being submitted by a newly formed JV between two well established firms. While there is no financials for the JV itself, would the financials of each participating firm suffice?
Provide financials for each firm.
5.Will the contractor be responsible for delivery of government furnished materials to the project site?
Yes, refer to specification 01000, paragraph 2.1.2.
6.On previous MHU’s plans, finished grade elevations were provided on the plans. We do not see the finished grade elevation for McCloud so please state the drawing and the location on the drawing for the finished grade elevation or if missing please provide the elevation.
No final elevations are given. Refer to plan notes:
“THE EXISTING SITE IS AN AGRICULTURAL FIELD. ADJUST AS REQUIRED BASED ON ACTUAL
GRADE AFTER COMPACTION TO MAINTAIN POSITIVE DRAINAGE TO PERIMETER DITCHES
DO NOT ALTER GRADES IN SUCH A MANNER AS TO INCREASE CATCHMENT AREA OF EXISTING
DISCHARGES TO OFFSITE AREAS.
DO NOT ALTER GRADES IN SUCH A MANNER TO CREATE PONDING AREAS ON ADJACENT
PROPERTIES.”
The intent is to grade site to drain generally as shown. Actual elevations are subject to contractor’s discretion as to minimize waste without necessitating additional fill.
7. At some MHU sites, the spoil piles are left for the landowner and at others they are hauled off for disposal. Which is it at McCloud, spoils stay or spoils hauled?
Adjust final grades to minimize waste while maintaining positive drainage. Waste spoils on-site.
[FEMA is in the process of determining what to do with the spoil.]
8. Currently the McCloud site is covered in 4’ to 5’ cane on one side and soybean on the other, the plans say to remove vegetation to grade level but does not say where to put the spoil pile? Where is the spoil pile or does it have to be hauled off?

9. Currently the pads aggregate are 57 and 610 per the gravel typical section on Sheet ID5. 610 compacts better than 57 as demonstrated on the Triche Site, could we use 610 for all roadways and MHU pads on the McCloud Site?
610 stone is acceptable for use in lieu of #57.
10. On all the drawings it seems like there should be gravel under the MHU pads, yet there is no hatched patterns on the drawings indicating place aggregate. Please advise what is the material that goes at the parking and MHU pad.
Aggregate is used below MHU and Parking pad. Refer to Typ. MHU & UFAS lot layout detail as well as specification section 02300, paragraph 3.4.
11.Please confirm primary voltage will be from Entergy and who is the contact person (Name, Cell Phone, Email) at the office (Name, Cell Phone, Email) and field level (Name, Cell Phone, Email) for this project?

12. Based on the plans, our calculations indicate it is 7,970V single-phase, 13,800V three-phase, please confirm so we can select appropriate available transformers.
Contact Entergy for available voltages.
13. The GFE transformers listed [Phillips Brothers, 34500X19920] can’t be used as they are ground transformers and not pole transformers, does the Government intend to provide the correct transformers?
Only the materials listed are available. Any materials needed that are not listed shall be furnished and installed by the contractor.
14. Power diversification for MHU’s is different than previous projects. We are assuming diversification per drawing chart shown on Sheet 3E, is that correct?
The chart shown on Sheet E3 was derived from the NEC. All work must comply with NEC.
15. Has the Government obtained a Flood Plain elevation waiver for this project?
The site elevation is above the BFE for this area.
16. Does the Government expect the contractor to commence site work prior to obtaining the necessary permits from Lafourche Parish?
The Contractor is expected to diligently prosecute the work in accordance with Section 01100, PERMITS and COORDINATION. The Contractor is expected to follow all requirements of the Authorities Having
Jurisdiction (AHJ).
17. Please confirm if we use any of the government’s materials, we will not have to replace it.
Materials installed as part of the work do not require replacement in kind.
18. Please confirm whether there are any tele/data requirements for this project.

There are no telephone or data circuits to be installed as part of this contract.
19. Will the existing sugar cane at the site be farmed by the current landowner/lease prior to mobilization or will the removal of cane be the responsibility of the awarded contractor?

20. Can you please verify bid bond requirements? 20% not to exceed $3,000,000?
As per page 1 section 13b. of the solicitation a bid bond is not required.
21. I am reaching out in regard to the subject solicitation. My concern is why there is only 5 days for interested parties to submit a bid? With a project of this scope, I feel like that timeframe is extremely unreasonable and would stand as solid grounds for protest. Is there any chance that the due date could be extended to a reasonable timeframe?
Extended to June 29, 2022, at 1:00pm cst.
22. Please confirm whether this project will qualify for sales tax exemption.
FAR Clause 52.229-3, FEDERAL, STATE, AND LOCAL TAXES (FEB 2013)
(a) As used in this clause-
After-imposed Federal tax means any new or increased Federal excise tax or duty, or tax that was exempted or excluded on the contract date but whose exemption was later revoked or reduced during the contract period, on the transactions or property covered by this contract that the Contractor is required to pay or bear as the result of legislative, judicial, or administrative action taking effect after the contract date. It does not include social security tax or other employment taxes.
After-relieved Federal tax means any amount of Federal excise tax or duty, except social security or other employment taxes, that would otherwise have been payable on the transactions or property covered by this contract, but which the Contractor is not required to pay or bear, or for which the Contractor obtains a refund or drawback, as the result of legislative, judicial, or administrative action taking effect after the contract date.
All applicable Federal, State, and local taxes and duties means all taxes and duties, in effect on the contract date, that the taxing authority is imposing and collecting on the transactions or property covered by this contract.
Contract date means the date set for bid opening or, if this is a negotiated contract or a modification, the effective date of this contract or modification.
Local taxes includes taxes imposed by a possession or territory of the United States, Puerto Rico, or the Northern Mariana Islands, if the contract is performed wholly or partly in any of those areas.
(b)
(1) The contract price includes all applicable Federal, State, and local taxes and duties, except as provided in subparagraph (b)(2)(i) of this clause.
(2) Taxes imposed under 26 U.S.C. 5000 C may not be-
(i) Included in the contract price; nor
(ii) Reimbursed.
(c) The contract price shall be increased by the amount of any after-imposed Federal tax, provided the Contractor warrants in writing that no amount for such newly imposed Federal excise tax or duty or rate increase was included in the contract price, as a contingency reserve or otherwise.
(d) The contract price shall be decreased by the amount of any after-relieved Federal tax.
(e) The contract price shall be decreased by the amount of any Federal excise tax or duty, except social security or other employment taxes, that the Contractor is required to pay or bear, or does not obtain a refund of, through the Contractor’s fault, negligence, or failure to follow instructions of the Contracting Officer.
(f) No adjustment shall be made in the contract price under this clause unless the amount of the adjustment exceeds $250.
(g) The Contractor shall promptly notify the Contracting Officer of all matters relating to any Federal excise tax or duty that reasonably may be expected to result in either an increase or decrease in the contract price and shall take appropriate action as the Contracting Officer directs.
(h) The Government shall, without liability, furnish evidence appropriate to establish exemption from any Federal, State, or local tax when the Contractor requests such evidence, and a reasonable basis exists to sustain the exemption.
23. Quantities shown on Sheet 3G under Proposed Cover heading do not correlate with actual quantity from drawing takeoff. Please clarify which quantities are correct. Examples below:
a. Sheet 3G Proposed Cover Stone Quantity – 18.12 Acres --- Quantity from plan takeoff –
12.7 Acres
b. Sheet 3G Proposed Cover Grass Quantity – 26.98 Acres --- Quantity from plan takeoff –
4.6 Acres
The values shown on 3G were in error. However, the information shown on sheet 3G is for information only and intended to provide an overall land cover summary for stormwater / erosion control permitting purposes. These values should not be used for bidding purposes. It is the contractor’s responsibility to determine quantities.
Revised land cover summary, for information only, is as follows:
Total Site / CWL: 54.35 Acres
Stone: 13.45 Acres
Grass: 5.88 Acres
Concrete: 0.08 Acres
Undisturbed: 34.94 Acres
24. Previous solicitations for similar projects (Rainbow & West Park) provided quantities and required unit prices. This solicitation (McCloud) only contains lump sum items. Section 52.232-5.1.i calls for an itemized list to be provided by the contractor for progress payments. Since this information is not a part of the solicitation how will progress payments for work performed be determined?
Contractor is responsible for preparing the itemization of amounts requested for payment. The amount of payment will be determined by the actual amount of work that meets quality requirements that is completed during the period in which payment is requested.
25. Regarding the Government Furnished Materials (GFM), in the event material to be provided by
Government is defective and/or unusable, at no fault of the contractor, will contractor be allowed to provide cost of material to be replaced and that cost be reimbursed by the owner? This scenario would apply if contractor understood that material would be provide by Government and is listed on Appendix A of specs and defect was determined upon pick up at Baton Rouge location.

EQUIPMENT / MATERIAL (GFE/M) The Contractor must verify the quantity and condition of the GFM with a Government representative for patent defects prior to leaving the GFE Stockpile location and acknowledge receipt, in writing, to the Contracting Officer. The contractor shall be responsible for loading and the pickup site, transporting, unloading, and properly staging/storing GFM at the project site. The
Contractor shall report, in writing, to the Contracting Officer, within twenty-four (24) hours of discovery any latent damage to or shortage of the GFM. Any GFM lost or damaged as a result of Contractor’s actions shall be promptly replaced in kind at no additional cost to the Government. In the event latent damage not attributable to the contractor, is discovered an equitable adjustment may be issued pursuant contract clause 52.236-2 DIFFERING SITE CONDITIONS.
26. Can refurbished transformers be used?
Yes, with a minimum 1-year non-exclusive warranty.
27. No erosion control plan is included. Will erosion control measures be required? If so, which lump sum pay item should they be included in?
Contractor is required to comply with all Federal State and local requirements including Louisiana
Pollutant Discharge Elimination System (LPDES) required by LA DEQ. Permit compliance is normally included in the mobilization/demobilization line item.
28. Clarify that WWTP, to be provided by Government, is to be loaded, transported and unloaded by contractor. Provide weight of WWTP.
Government will be responsible for transport of WWTP to the site, offloading, installing, and commissioning of the WWTP. The site Contractor is responsible for placing the WWTP concrete slab and providing all of the sewer line stub-up to the WWTP in coordination with the WWTP supplier.
The approximate weight of the plant's sections is as follows:
EQ basin - 13,400 LB
Aeration basin - 24,200 LB
Clarifier - 13,000 LB
Total Weight - 50,600 LB
The WWTP is currently located at:
230 North Barrios Street
Lockport, LA 70374.
29. Could you please tell me what thickness gravel they require on the road area, I read the specs and the MHU and MHU parking is called out at 6” but nothing called out on the roads?
Reference plan sheet 5 detail GRAVEL TYPICAL SECTION for thickness.
30. Site is currently an active agriculture field with soybeans and cane planted. Will owner harvest and/or remove plantings before construction begins?
See answer to question 19.
31. Will access along private road to Northwest of site be available?
Road is within Current Working Limit (CWL) and available for use.
32. Are any improvements be required for private road to Northwest of site?
No improvements are required in the solicitation, however, any damage caused to the road by contractor operations will be required to be repaired at the contractor’s expense.
33. Is complete property shown on Sheet 3, Site Plan, to be grubbed and leveled OR only the areas located inside of the site fence?
Contractor will be responsible for clearing, grubbing, leveling and providing positive drainage for areas inside the limits of the silt fence and an area that extends 10’ feet outside the fence line.
34. Can material generated from grubbing and leveling be stockpiled and remain onsite outside of improved areas?
See answer to Question 7 & 8.
35. Can the Government provide the name plate information on the 6 transformers, Phillips Brothers #
34500X19920, indicated on Appendix A, Available Government Furnished Materials?

36. We are having issues getting pricing on poles and hardware for electrical and would like to request a bid extension.
