SAJ Spud Barge 150 Ton Crawler Crane Requirements

DESCRIPTION OF ITEMS TO BE PROCURED:

General Description:

1. PURPOSE

The Army Corps of Engineers, Jacksonville District, is issuing this solicitation, for the acquisition of a new crawler crane. The crane will be placed in service on the deck of an existing barge in the South Florida operating area, primarily in and around the St. Lucie River, Lake Okeechobee, and Caloosahatchee River.

The crane shall be suitable for both heavy lift work and for clamshell operations with a bucket suited to the capacity of the crane, but in no case less than 3.6 cubic yards.

The crane shall be equipped with and capable of utilizing booms with a minimum length not greater than 90’, and a maximum length not less than 130’.

The ground pressure must not exceed 62psi for any operation while the crane is on the spud barge.

The crane shall have two hoists as follows: main hoist and a single part whip line. A two part auxiliary hoist shall be included in the offer. The crane shall have the ability to perform OSHA approved man lifts.

2. Specifications for One Crawler Crane

2.1 REGULATORY STANDARDS

The manufacturer shall construct the crane and certify its conformance with the following standards:

• ASME B 30.5

• ASME B 30.8

• US Army Corp of Engineers’ Safety Manual: EM385-1-1

2.2 CRANE INFORMATION REQUIREMENTS

The crane manufacturer is required to provide specific information on the crane, such as crane model, capacity tables, geometry, weight data and center of gravity location for all major crane components. All this information except the documents listed under “Additional Documentation” shall be submitted within 30 days of notice to proceed. The items under “Additional Documentation” shall be submitted prior to final acceptance of the crane.

The following information is required so that the Army Corps of Engineers - Marine Design Center, can perform calculations on intact stability and crane load handling stability to safely operate the crane on the deck of a barge.

The information is imperative to validate the adequate performance of the crane on an existing barge, and to predict the appropriate barge ballasting conditions. Note that this information is separate from and additional to the Proposal Technical Features Requirement of section C032.

2.2.1 Lower Works Weight and Center of Gravity:

The lower works shall be considered to be all non rotating components of the crane including the crawlers, carriage, and axles.

2.2.4 Crane Ground Bearing Pressure:

The Marine Design Center will perform calculations on the adequacy of the barge deck structural strength. For this purpose the crane manufacturer shall provide the ground bearing pressure estimating program and the instructions to calculate the crane ground bearing pressure and pressure distributions on “hard” and “soft” surfaces for the following:

• All possible boom lengths (specifically 90’, 100’, 100’, and 120’),

• All possible standard counterweight configurations,

• All possible boom angles or load radii and corresponding allowable hook loads,

• Clamshell operations.

• The Crane may not exceed 62 psi during any lift while on the barge

2.2.5 Additional Documentation:

Two (2) electronic copies of the following documents shall be provided. These must be a CD/DVD format due to hardware restrictions on government computers. In addition, printed and bound hard copies of the following manuals (quantity in parentheses) shall be provided:

• Crane Operator’s Manual (3),

• Crane Parts Manual (3),

• Crane Capacity Manual (3),

• Crane Service Manual (3),

• Crane General Arrangement Drawing with Weights and Centers of Gravity (1),

• Ground Bearing Pressure Estimator (1),

• Wire Rope Certificates (1),

• Any systems drawings not included in the above list (3).

2.3 Crane Required Capacities

2.3.1 Heavy Lift Capacities:

The main hoist of the crane shall be able to meet or exceed the mission lift capacities laid out below:

• 75,000 lbs @ 40’ radius with 90’ boom

• All spuds must be able to be lifted by the crane, review drawing 816-B298-01. Describe the minimum boom length required to accomplish the following in both the forward and aft spud wells:

o 30’ long spud; estimated weight – 4,600lbs; estimated pull out force 11,000lbs o 45’ long spud; estimated weight – 6,700lbs; estimated pull out force 15,000lbs

These lifts shall be performed in a floating service condition with an allowable out of level machine list/trim limit of not less than 3 degrees. The crane shall be able to handle a minimum 3 degrees of machine list and trim simultaneously.

The crane manufacturer is required to provide all crane load capacity tables for operation of all of the hoists (main, whip, and auxiliary) on the crane with all possible boom lengths (specifically 90ft, 100ft, 110ft, and 120ft), that can be considered up to a maximum boom length of 120 ft operating at a minimum 3 degrees of machine list or trim.

The manufacturer shall also provide the land based load charts for all boom lengths as well as the 1 and 2 degree out of level charts if available. The load capacity tables shall identify the proposed counterweight configuration that enables the crane to meet or exceed the mission lifts identified above with the 120’ boom. All load charts shall be in the English language using Imperial units (feet and lbs).

2.3.2 Clamshell Capacities:

The crane’s primary function will be floating service to Locks. The crane shall be suitable for 6-8 hours of work per day, 180 days per year.

The crane shall be fitted with a clamshell hoist system for a clamshell bucket not less than 3.6 cubic-yards in capacity. The clamshell bucket may have a capacity up to 6 cubic-yards, matched to the capability of the machine.

The crane shall be capable of performing floating service duty cycle work of at least 20,000 lbs at a radius of 40’ down to a depth of 85’ below the base of the crane crawlers.

The clamshell bucket will be provided by the contractor, and included in the proposal.

2.3.3 Orange Peel Rock Grapple Capacities:

The crane has a secondary function to provide floating service placement of rip-rap.

The crane shall be fitted with a 6-point Orange Peel Rock Grapple with a nominal capacity of 4 cubic yards. The grapple must be “orange peel” style, and not have significant openings between the tines when the grapple is closed.

The grapple shall be operated by two cable lines.

The 6-point grapple will be provided by the contractor, and included in the proposal.

2.4 CRANE ENGINE

The crane shall be powered by a minimum 300 hp diesel engine that meets the current EPA emissions CARB Tier 4f and 97/68 EC Stage IV.

A critical grade silencer shall be provided. The engine radiator and fan shall be mounted to move hot air out of the engine compartment.

The crane shall have battery starting and a charging alternator.

One (1) diesel fuel tank shall be provided, with an electronic level indicator located in the operator’s cab. The capacity of the fuel tank will have a minimum capacity sufficient to operate the crane continuously at 70% engine load for 10 hours.

2.5 CRANE CONTROLS

The following shall be provided:

• Modulating controls with infinite speed response directly proportional to control lever movements

• Drum rotation indicators

• Anti two block limit control for hoist and auxiliary lines

• Weather station similar to Furuno model 200 WX, to include wind speed and direction at a minimum

The contractor shall protect all controls and control systems (including the Load Moment Indicator) from both electro-magnetic and radio frequency interference.

2.5.1 Crane Load Moment Indicator (LMI)

The crane shall be provided with a programmable LMI system for the main boom, with function cut-out or warning operation selected via a keyed switch on the LMI console.

The LMI shall be able to have land operational load charts for three boom lengths, plus up to three user selectable floating service load charts input based off of naval architect approved floating load charts.

The LMI shall sense and at all times display: radius, boom angle, hook load, machine list and trim, and load chart selected.

The LMI shall provide alarm for near maximum load, and safety stop at max load.

The LMI shall record and store all of the required display data for two (2) hours of crane operating time. The LMI shall also record and store any instance of LMI over-ride.

The crane shall record and retain the stored data indefinitely in the event of a power loss.

2.6 CRANE DRUMS

The crane shall have the following drums:

• Main hoist

• Whip line hoist (15 ton single part)

• Auxiliary hoist (30 ton 2 part)

Hoist drums shall be individually controllable. Drum rotation indicators shall be provided in the cab. The operator in the cab shall be able to select the lowering mode (power down or free fall) of operation on the hoist drums.

The crane shall be equipped with a mounted rigging winch for exchanging wire ropes from the drums.

Bolt-on laggings shall be provided in order to allow the crane to perform duty cycle dredging with a 6 yard bucket.

The crane shall be able to perform OSHA rated man lifts off of one of the drums.

2.6.1 CRANE BOOM HOIST

The crane shall be equipped with a boom stop. It shall be provided with a dog and pawl lock arrangement on the boom hoist.

The boom hoist system shall be capable to provide boom elevation from minimum to maximum elevation with or without load in less than 3 minutes. The boom hoist shall be provided with a dog and pawl type locking arrangement.

2.7 CRANE SWING SYSTEM

The swing system shall be capable of 2 rpm minimum continuous rotation speed (without hook load and with the boom up against the stops).

The crane swing drive function shall incorporate an internal brake. The brake shall provide 360 degree positive swing lock.

2.8 CRANE OPERATOR’S CAB

The crane operator’s cab shall be a fully enclosed and insulated module, equipped with sliding door, large safety glass windows on all sides and roof. The following shall be installed in the cab:

• Signal horn,

• Cab heater,

• Dome light,

• Front and roof windshield wipers,

• Sun visor and shade,

• Fire extinguisher,

• Air circulating fan,

• Air conditioner,

• Mylar window shades,

• Swing alarm,

• Control & Functions high resolution monitor (not less than 200 dpi)

• Load Moment Indicator,

• Weather station display

2.9 CRANE BOOM AND PENDANTS

The crane boom shall be suitable for heavy lift and for clamshell operations. The boom shall be provided with rope guides and a mechanical boom angle measuring device.

The boom configuration shall consist of the boom butt and boom tip along with the necessary inserts to make up boom lengths in increments of ten (10) to twenty (20) feet with a minimum length not more than 90’ and a maximum length not less than 130’.

Rigging pendants shall be provided for the boom insert lengths.

The boom segments shall incorporate alignment pads, and a pin connection system.

The crane shall have a duty cycle head with two sheaves for clamshell work.

The crane shall have an additional extended upper boom point of 10 ft minimum with one sheave with rope guard for the crane whip line and one for the two part auxiliary hoist line.

2.10 CRANE CRAWLERS

The center to center width between the crawlers shall be clearly identified in the offeror’s proposal, or in the operating/product manual. The crawler pads shall be suitable for travel on unimproved surfaces.

Each crawler shall be powered independently. Maximum ground speed shall be no less than 0.6 mile-per-hour either in forward or reverse operation.

2.11 CRANE LOAD BLOCKS

At a minimum, the following blocks shall be provided (note: alternative blocks may be provided as long as they are similar to the lift capacity of the blocks listed below):

• Two (2) x 15 ton swivel hooks with weight balls.

• 150 ton hook block with 30” sheaves.

• 100 ton hook block with 30” sheaves

• 30 ton two part (single sheave) travelling block (block sheave fleeting angle shall be matched to the boom tip sheaves)

2.12 WIRE ROPE

All wire rope shall be furnished with certificate stating its conformance to all of the standards referenced in this specification.

All wire rope required for rigging the crane with the 120 ft boom and the 150 ton block shall be provided.

In addition, all wire rope to rig the 120 ft boom with the extendable upper boom point and the 15 ton swivel hook and weight ball shall be provided.

Enough wire rope shall be provided to enable the crane to use the clamshell bucket at a radius between 25 and 60 feet, and dredging depths not to exceed 85 feet below the base of the crane crawlers. There shall always be a minimum of three wraps left on the drum.

The wire rope that is common to the rigging configurations described above shall be furnished only one time.

2.13 LIGHTING PACKAGE

A lighting package for proper night time operation of the crane shall be provided. This shall include at a minimum:

• Four (4) 400 watt lights on the boom (two on the mid section, two on the upper section)

• Four (4) 200 watt lights on the upper works (one on each corner)

• These lights shall be mounted on rubber shock resistant mounts.

2.14 CLAMSHELL WORK PACKAGE

The manufacturer’s package for duty cycle clamshell work shall be provided. Bucket shall be provided under this clause; all rigging shall be sized to accommodate a bucket appropriately sized to the machine, with a capacity no less than 3.6 yards and no greater than 6 yards. The crane shall be capable of performing floating service duty cycle work of at least 20,000 lbs at a 40’ radius.

The manufacturer shall provide and install a three barrel tagline (similar to Rud-o-matic) for clamshell operations.

2.15 SPECIAL TOOL & DIAGNOSTICS KIT

All specialized tools required to properly maintain and service the crane shall be provided.

This kit shall provide the tools required for the system diagnostics, and for scheduled service intervals out to at least 250 hours. A fluid test kit shall also all be provided.

2.16 CRANE TESTING

Crane load and operational testing shall be performed by the manufacturer at the manufacturer’s facility. Load and operational testing shall be repeated after the crane is assembled at the delivery location. The crane shall be operated by an authorized representative of the manufacturer at all times during crane testing. All testing shall conform to section 16.F.03 of EM 385-1-1. The contractor shall supply all test weights. The test weights shall be certified to the satisfaction of the government representative.

2.16.1 CRANE LOAD TESTING

2.16.1.1 Hoist Proof Load Test:

Proof load test the crane main hoist with the 120 ft boom, by lifting the certified test load and booming out to the corresponding maximum working radius.

• Demonstrate power down capability. Raise and lower the proof load, and smoothly stop and start hoist movement at least two times in each direction to demonstrate satisfactory operation of the hoisting system.

• With the test load suspended, the operator shall raise the boom to the maximum permissible boom angle, (minimum radius). During this maneuver, the operator shall smoothly stop the boom and hold the load at least two times booming up and two times booming down.

This test shall be repeated for each hoist individually to demonstrate functionality.

2.16.1.2 OSHA Man Lift Test

The capability to perform OSHA rated man lifts along with the emergency lowering system shall be demonstrated.

2.16.1.3 Loaded Swing Maneuver:

The contractor shall demonstrate the ability of the crane swing drive system to work against the maximum permitted crane inclination, uphill and downhill. The maximum permitted inclination shall be obtained by placing one crawler higher than the other.

The maneuver shall be started by positioning the 120 ft boom perpendicular to the crawlers (maximum allowable crane trim down towards the boom).

• Lift the certified test load and booming out to the corresponding maximum working radius for the maximum permitted inclination.

• Rotate the crane clockwise 90 degrees uphill and stop with the boom parallel to the crawlers, thus materializing the maximum permitted crane list to the left of the vertical.

• Proceed clockwise to turn the crane another 90 degrees uphill to place the boom again perpendicular to the crawlers (crane with the maximum amount of trim leaning back, up towards the boom).

• Proceed to turn the crane another 90 degrees clockwise, downhill, placing the crane with the maximum permitted machine list to the right of the vertical.

• Rotate the crane once again clockwise another 90 degrees downhill to the initial position

Repeat the test rotating the crane counterclockwise to test the performance of the swing drive system in the two directions of rotation.

2.16.2 CRANE OPERATIONAL TESTING

Test the exterior doors and windows, any exterior gaskets or seals and all hose, electric wiring or pipe penetrations into the crane using a water hose directed downward or horizontally (not upwardly). Water shall not be able to pass to the interior of the cab.

Demonstrate the proper function of the heating and air conditioning system in the crane cab. System shall be able to maintain 70 degrees interior temperature in all exterior conditions.

The contractor shall demonstrate the capability of the crane to crawl at or above the speed required by section 2.10.

This test shall be performed in both the ahead and reverse directions.

The contractor shall demonstrate the capability of the crane to swing unloaded at or above the speed required by section 2.7. This test shall be performed in both directions.

The contractor shall demonstrate the capability of the crane to elevate the boom from the minimum to maximum elevations in less than three minutes as required by section 2.6.1.

The contractor shall demonstrate:

• LMI calibration

• LMI user selectable load charts

• LMI power loss data retention

• LMI override log retention

The contractor shall demonstrate the functionality of all crane systems to include but not limited to: crane lighting, windshield wipers, horn, radio, alarms and gages, weather station, and fans. This shall be done to the satisfaction of the government inspector.

2.17 CRANE DELIVERY

Following satisfactory completion of all tests and trials, correction of all deficiencies at the manufacturer’s facility, and receipt of all contract deliverables, the contractor shall prepare the crane for transport and deliver the crane to the following location:

South Florida Operations Office 525 Ridgelawn Road Clewiston, FL 33440

2.17.1 ASSEMBLY

The crane shall be assembled in the yard of the South Florida Operations Office. The contractor shall provide a technical representative(s) to direct and supervise unloading, assembly, and testing. The government shall provide the labor to assemble and test the crane as well as a support crane to assist with the assembly of the crane. The government shall provide operators for all of the cranes.

2.17.2 FINAL TESTING AND ACCEPTANCE

With the crane assembled at the delivery site, all tests required under section 2.16 shall be repeated to the satisfaction of the government representative. The contractor shall be responsible for providing test weights sufficient to repeat the testing accomplished at the manufacturer’s facility.

Final Acceptance of the crane shall be made at the delivery location, upon verification that the contractor has delivered the crane “Assembled and Ready for Service”.

Prior to Final Acceptance, the crane shall be clean inside and out and:

• All trash and delivery related material has been removed and disposed of by the contractor.

• All loose items of outfit are in their proper place.

• All electrical and mechanical systems are operational.

• All equipment has been properly adjusted and instruments and electronics are calibrated or aligned.

• All fluid consumable tanks are filled up.

• All paint damaged has been repaired.

• All manuals, special tools, maintenance tools, special adjustment tools and monitoring equipment have been delivered.

• The generator for the lights has been load bank tested according to NEC standards.

2.17.3 TESTING ON SAJ SPUD CRANE BARGE

Once assembled and tested on land and after final acceptance has been made, the crane will be crawled onto the Spud Crane Barge. The government will crawl the crane onto the barge.

Once the crane has been loaded in place on the barge, the crane shall be load tested through the entire range of the floating load chart for floating service operations on the Spud Cane Barge in accordance with section 16.L.03 of EM 385-1-1. Test weights shall be supplied by the contractor at the contractor’s expense.

The clamshell capability shall be demonstrated during this testing period using the contractor supplied clamshell. If the Government accepted the purchase of the 4-point rock grapple, the capability shall be demonstrated during this testing period using the contractor supplied grapple. These tests shall occur during the next two (2) business days following load testing and final acceptance.

The contractor shall supply a technical representative to provide troubleshooting and technical guidance during this process. The government will provide all of the labor necessary to operate the crane and perform these tests.

2.18 CRANE DEMONSTRATIONS & OPERATOR TRAINING

This training shall be provided by the contractor at the crane delivery address.

The contractor shall operate all equipment and systems on the crane, to demonstrate their features, characteristics, and capabilities to the operators.

The contractor shall provide hands on training and trouble shooting for all crane systems, all crane controls, and LMI, including routine maintenance and calibration.

The total duration of the training shall be 4 days, or the equivalent 32 hours.

2.19 LOCAL SERVICE PROVIDER

An approved service provider and parts supplier shall be identified within 600 miles of the location of final delivery.

The manufacturer shall indicate the name and location of the supplier along with a designated contact person in their proposal.

2.20 CRANE WARRANTY

The crane warranty shall extend for five year from the date when the contractor has delivered the crane “Assembled and Ready for Service”, and the Contracting Officer’s Representative has issued Final Acceptance.

During the warranty the contractor shall be responsible for repairing and/or replacing all items of equipment or systems that are found defective or that have become inoperative.

2.21 CONTRACT DURATION

The contractor shall have 365 days from the time of Notice to Proceed to construct, test, and deliver the crane in accordance with all of the provisions of this specification.

2.22 SCOPE OF WORK FOR CONTRACT LINE ITEMS

The Contractor shall provide a proposal for the crane, and itemized features and accessories as CLIN 0001. The contractor shall provide a proposal for the following three line items. The first is to provide a new, clamshell bucket IAW paragraph 2.3.2 and will be itemized as CLIN 0002. The second is to provide a new, 4-point rock grapple IAW paragraph 2.3.3 and will be itemized as CLIN 0003. The third is to provide testing on the Government Spud-barge IAW paragraph 2.17.3 and will be itemized as CLIN 0004. Should the Government be unable to provide the required spud barge at the time of delivery, testing, and acceptance the Contractor will be absolved of the requirement.

2.22.1 CLIN 0002 – PROVIDE CLAMSHELL BUCKET

The contractor shall provide a new clamshell bucket appropriately sized to the crane with a capacity not less than 3.6 cubic yards, and no greater than 6 cubic-yards. The contractor shall furnish all necessary rigging and attachments to the clamshell bucket that are needed to perform duty cycle clamshell work.

2.22.2 CLIN 0003 – PROVIDE ROCK GRAPPLE

The crane shall be fitted with a Orange Peel Rock Grapple not less than 3 cubic yards, and not more than 5 cubic yards in capacity. The grapple must be “orange peel” style, and not have significant openings between the tines when the grapple is closed. The grapple shall be operated by two cable lines.

2.22.3 CLIN 0003 – TESTING ON SAJ SPUD CRANE BARGE

Once assembled and tested on land and after final acceptance has been made, the crane will be crawled onto the Spud Crane Barge. The government will crawl the crane onto the barge.

Once the crane has been loaded in place on the barge, the crane shall be load tested through the entire range of the floating load chart for floating service operations on the Spud Cane Barge in accordance with section 16.L.03 of EM 385-1-1. Test weights shall be supplied by the contractor at the contractor’s expense.

The clamshell capability shall be demonstrated during this testing period using the contractor supplied clamshell.

The 4-point rock grapple, the capability shall be demonstrated during this testing period using the contractor supplied grapple. These tests shall occur during the next two (2) business days following load testing and final acceptance.

The contractor shall supply a technical representative to provide troubleshooting and technical guidance during this process. The government will provide all of the labor necessary to operate the crane and perform these tests.

2.22.4 PAST PERFORMANCE REQUIREMENTS

Each offeror shall provide the following past performance submittals as part of his quotation. Past performance pertains to how well an offeror has performed relevant past work that is an indicator of future performance. Past performance is not the same as experience information. Experience information pertains to what types of work an offeror has performed. Past performance pertains to how well an offeror has performed.

There are two aspects to the past performance evaluation. The first is to evaluate whether the offeror’s past performance is relevant or not relevant to the effort to be acquired by this solicitation. For the purpose of this evaluation, relevancy of the projects will be evaluated based on their similarity to the technical work required by this solicitation, the magnitude of the project, as well as the organizational and specialized technical experience required to deliver the system.

The second part is to determine how well the contractor performed on the contracts. The Government will consider the currency and relevance of the information, source of the information, context of the data, and the general trends in the contractor’s performance.

The offeror shall identify a minimum of two projects completed where the offeror provided a lattice boom crawler crane similar to the requirements laid out in this specification. The offeror shall provide a customer point of contact for verification purposes.

For each project, the offeror shall provide an overview listing:

• Project description

• Client or Government Agency

• Relevance to this solicitation

In lieu of the submitting the above, offerors may provide completed questionnaires from the Construction Contractor Appraisal Support System (CCASS) or from the Contractor Performance Assessment Reporting System (CPARS) on a “one for one” basis. In other words, one (1) completed CCASS or CPARS questionnaire shall satisfy the requirement for the above overview.

In addition, the offeror shall identify any projects that he was terminated for default in the last 5 years.

2.23 PROPOSAL TECHNICAL FEATURES REQUIREMENTS

Each offeror shall provide the following technical features submittals:

a. A complete listing of all equipment and components to be provided and the crane design criteria that was used.

b. Crane Load Capacity Charts

• Charts for boom lengths of 90’, 100’, 110’, and 120’

• Charts for the crane operating at 3 degrees of crane inclination as well as the land based rating for each boom length as well as 1 and 2 degrees if available

• Charts for duty cycle/clamshell operations for each boom length in a floating service condition. The minimum out of level list/trim capability shall be 3 degrees.

c. Crane Engine

• Manufacturer and model number

• EPA emissions tier

• Technical specification

• Size of fuel tank

d. Crane Controls

• Technical specification

• LMI make and model along with technical specification/description

e. Hydraulic System (if applicable)

2.23.1 ADDITIONAL DESIGN CRITERIA

The SPUD BARGE recently constructed by Metal Trades, INC requested by SAJ and contracted through USACOE Marine Design Center Philadelphia must have a Hydraulic Crawler Crane which will meet the following specifications in order to comply with marine safety standards.

A. Crane Split Ramp Requirements:

• Crane Crawler with a 22 feet track max beam

• Crane Crawler overall length of 25 feet 10 inches

• Crane Crawler with 48 inch wide tracks

• Ground clearance of 1 foot 6 inches

B. Crane Tie Downs:

• Eight turn buckle tie downs in accordance with drawing 816-C420-02

• In accordance with the USACE Safety Manual EM 385-1-1 section 16.L.08.c.

• Tie Downs shall be accordance with safety factors defined in ABS Steel Vessel Rules for movable platforms (Decks) for vehicle loading (MOVDK).

• Crane crawler frames shall each have four tie downs two on the outboard side and two on the inboard side of the track frame.

• Rated capacity of each turn buckle shall be above 26,000 lb

• Turn buckle must be able to adjust

• Brackets attached to crawler must have clearance above brackets to avoid welding to top plates.

• Brackets attached to crawler frame must be positioned which does not interfere with the brackets on barge

• Brackets installed on Propel Motor Side of crane crawler frame must be at calculated points as specified in drawing.

• Brackets installed on Propel Motor Side of crane crawler frame must have rib-plates installed on the inside.

• Brackets installed on Idler Sprocket Side of crane crawler frame must be at calculated points as specified in drawing.

• Brackets installed on Idler Sprocket Side of crane crawler frame must have rib-plates installed on the inside.

• When using the translifters brackets must not interfere with the brackets on the barge.

• When using the translifters brackets must align to the correct position after use.

• Brackets on crane crawler frame must allow for the turnbuckle to remain at 40-50 degrees of angle to the crawler frame.

• Crane Frame Tracks must rest against “track stops” while turn buckle tie downs are in place.

3. DELIVERY INFORMATION:

3.1 Access and General Protection/Security Policies and Procedures All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes

3.2 Delivery Date:

Delivery is required within 10 months of award.

52.212-4 CONTRACT TERMS AND CONDITIONS-- COMMERCIAL ITEMS (JAN 2017)

(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights (1) within a reasonable time after the defect was discovered or should have been discovered; and

(2) before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(b) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.

(c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.

(d) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes'', as amended (41 U.S.C. 601-613).

Failure of the parties to this contract to reach agreement on any request for equitable adjustment, claim, appeal or action arising under or relating to this contract shall be a dispute to be resolved in accordance with the clause at FAR

52.233-1, Disputes, which is incorporated herein by reference. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.

(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.

(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement or any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(g) Invoice.

(1) The Contractor shall submit an original invoice and three copies (or electronic invoice, if authorized) to the address designated in the contract to receive invoices. An invoice must include--

(i) Name and address of the Contractor;

(ii) Invoice date and number;

(iii) Contract number, line item number and, if applicable, the order number;

(iv) Description, quantity, unit of measure, unit price and extended price of the items delivered;

(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on Government bill of lading;

(vi) Terms of any discount for prompt payment offered;

(vii) Name and address of official to whom payment is to be sent;

(viii) Name, title, and phone number of person to notify in event of defective invoice; and

(ix) Taxpayer Identification Number (TIN). The Contractor shall include its TIN on the invoice only if required elsewhere in this contract.

(x) Electronic funds transfer (EFT) banking information.

(A) The Contractor shall include EFT banking information on the invoice only if required elsewhere in this contract.

(B) If EFT banking information is not required to be on the invoice, in order for the invoice to be a proper invoice, the Contractor shall have submitted correct EFT banking information in accordance with the applicable solicitation provision, contract clause (e.g., 52.232-33, Payment by Electronic Funds Transfer—System for Award Management, or 52.232-34, Payment by Electronic Funds Transfer--Other Than System for Award Management), or applicable agency procedures.

(C) EFT banking information is not required if the Government waived the requirement to pay by EFT.

(2) Invoices will be handled in accordance with the Prompt Payment Act (31 U.S.C. 3903) and Office of Management and Budget (OMB) prompt payment regulations at 5 CFR part 1315.

(h) Patent indemnity. The Contractor shall indemnify the Government and its officers, employees and agents against liability, including costs, for actual or alleged direct or contributory infringement of, or inducement to infringe, any

United States or foreign patent, trademark or copyright, arising out of the performance of this contract, provided the Contractor is reasonably notified of such claims and proceedings.

(i) Payment.--

(1) Items accepted. Payment shall be made for items accepted by the Government that have been delivered to the delivery destinations set forth in this contract.

(2) Prompt payment. The Government will make payment in accordance with the Prompt Payment Act (31 U.S.C.

3903) and prompt payment regulations at 5 CFR part 1315.

(3) Electronic Funds Transfer (EFT). If the Government makes payment by EFT, see 52.212-5(b) for the appropriate EFT clause.

(4) Discount. In connection with any discount offered for early payment, time shall be computed from the date of the invoice. For the purpose of computing the discount earned, payment shall be considered to have been made on the date which appears on the payment check or the specified payment date if an electronic funds transfer payment is made.

(5) Overpayments. If the Contractor becomes aware of a duplicate contract financing or invoice payment or that the Government has otherwise overpaid on a contract financing or invoice payment, the Contractor shall--

(i) Remit the overpayment amount to the payment office cited in the contract along with a description of the overpayment including the--

(A) Circumstances of the overpayment (e.g., duplicate payment, erroneous payment, liquidation errors, date(s) of overpayment);

(B) Affected contract number and delivery order number, if applicable;

(C) Affected line item or subline item, if applicable; and

(D) Contractor point of contact.

(ii) Provide a copy of the remittance and supporting documentation to the Contracting Officer.

(6) Interest.

(i) All amounts that become payable by the Contractor to the Government under this contract shall bear simple interest from the date due until paid unless paid within 30 days of becoming due. The interest rate shall be the interest rate established by the Secretary of the Treasury as provided in 41 U.S.C.

7109, which is applicable to the period in which the amount becomes due, as provided in (i)(6)(v) of this clause, and then at the rate applicable for each six-month period as fixed by the Secretary until the amount is paid.

(ii) The Government may issue a demand for payment to the Contractor upon finding a debt is due under the contract.

(iii) Final decisions. The Contracting Officer will issue a final decision as required by 33.211 if--

(A) The Contracting Officer and the Contractor are unable to reach agreement on the existence or amount of a debt within 30 days;

(B) The Contractor fails to liquidate a debt previously demanded by the Contracting Officer within the timeline specified in the demand for payment unless the amounts were not repaid because the Contractor has requested an installment payment agreement; or

(C) The Contractor requests a deferment of collection on a debt previously demanded by the Contracting Officer (see 32.607-2).

(iv) If a demand for payment was previously issued for the debt, the demand for payment included in the final decision shall identify the same due date as the original demand for payment.

(v) Amounts shall be due at the earliest of the following dates:

(A) The date fixed under this contract.

(B) The date of the first written demand for payment, including any demand for payment resulting from a default termination.

(vi) The interest charge shall be computed for the actual number of calendar days involved beginning on the due date and ending on--

(A) The date on which the designated office receives payment from the Contractor;

(B) The date of issuance of a Government check to the Contractor from which an amount otherwise payable has been withheld as a credit against the contract debt; or

(C) The date on which an amount withheld and applied to the contract debt would otherwise have become payable to the Contractor.

(vii) The interest charge made under this clause may be reduced under the procedures prescribed in 32.608-2 of the Federal Acquisition Regulation in effect on the date of this contract.

(j) Risk of loss. Unless the contract specifically provides otherwise, risk of loss or damage to the supplies provided under this contract shall remain with the Contractor until, and shall pass to the Government upon:

(1) Delivery of the supplies to a carrier, if transportation is f.o.b. origin; or

(2) Delivery of the supplies to the Government at the destination specified in the contract, if transportation is f.o.b.

destination.

(k) Taxes. The contract price includes all applicable Federal, State, and local taxes and duties.

(l) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole…
