15,000 Tons
1. Scope of Work: Riprap (stone)
36,000 tons of General Purpose Grade IL DOT RR 5 Riprap. Riprap will be placed at Riprap Island and Big Soupbone Islands (Upper Mississippi River Mile 540 to 543.5) by the Corps of Engineers personnel and floating plant assets.
2. List of Attachments:
Attachment A (Map of USACE Recommended Riprap Delivery Sites) Attachment B (ILDOT RR-5 Riprap Gradation Curve & Tally Chart)
3. Specifications: Total of 36,000 tons of General Purpose use riprap (400lb maximum size) well graded in accordance with specified gradation within the Scope of Work and Attachment B. The Contractor shall ensure the riprap is delivered as follows:
a. Base: 36,000 tons of riprap (Stone) for GENERAL PURPOSE USE (NOT Submerged
Use), to be delivered onto Government barges located on the Upper Mississippi River, in pool 13, between river mile markers 537 and 538.
b. Minimum Rate of delivery – 1,500 tons per 10 hour workday (7:00 a.m. to 5:30 p.m.)
Applicable to base and all options.
c. Option – 1: 5,000 tons riprap. The Government reserves the right to exercise Option-1 No Later Than (NLT) 30-Sep-2017. The delivery start date is to be NLT two (2) weeks after exercising Option-1, while maintaining a 1,500 tons / 10 hour workday delivery rate.
d. Option – 2: 10,000 tons riprap. The Government reserves the right to exercise Option-2 No Later Than (NLT) 30-Sep-2017. The delivery start date is to be NLT two (2) weeks after exercising Option-2, while maintaining a 1,500 tons / 10 hour workday delivery rate.
e. Option – 3: 15,000 tons riprap. The Government reserves the right to exercise Option-3
NLT 30-Sep-2017(different NLT date than above). The delivery start-date is to be NLT two (2) weeks after exercising Option-3, while maintaining a 1,500 tons / 10 hour workday delivery rate.
f. Loading Locations: There are loading sites in the vicinity of Riprap and Big Soupbone
Islands that potentially meet the U.S. Army Corps of Engineers (USACE) purposes. The loading sites are located in and around Savanna, IL; between River Miles 537 - 538 (see Attachment A). All costs incurred with the deliveries are at the CONTRACTOR’S EXPENSE. NOTE – at no time shall the loading site selected by the Contractor impede or otherwise interfere with the normal navigation of commercial barge traffic.
g. It is HIGHLY RECOMMENDED that all offerors coordinate all required approvals and/or costs associated with necessary agreements, permits etc., whether required by local city municipalities and/or privately owned businesses PRIOR to submission of offerors to USACE Rock Island District Contracting Office.
h. Barge Loading: Riprap (Stone) will be required to be placed on Government barges by a method that does not allow riprap to fall greater than four feet onto the barge deck surface. This will minimize damage to Government barges due to riprap impact.
(1) Regardless of the delivery method, riprap must be uniformly distributed on
Government barges. It will not be acceptable to simply dump riprap directly on the barge surface without a method of fully and evenly distributing (i.e., contractor provided wheel loader with operator).
(2) Securing Barges for Loading: Contractor will ensure that Government barges being loaded with riprap are securely tied off to the bank, ramps, or whatever structure is necessary to facilitate safe loading.
i. Delays by the Government to ensure a safe work environment may occur due to equipment maintenance, breakdowns, or any number of severe river or weather conditions that may arise during the course of deliveries. In the event that a delay occurs, the Government Contracting Officer Representative (COR) will immediately notify the Contractor and the Contracting Officer (KO) of the cause and the anticipated duration of the delay. The KO will then negotiate an extension to the contract completion date once the delay has been resolved. The COR will notify the contractor (within 24 hours) when deliveries can resume. Depending on the length of the delay, additional time (days) may be added to the duration of the contract.
j. Additional information: Specifications of the Government barges are 35 feet wide by
150 feet long. Average draft empty: 2 feet & average draft full: 6 to 7 feet. Load amounts of riprap per barge may vary between 400 – 700 tons depending on the loading arrangement, placement site water depth, and/or ramp configuration.
k. Delivery start date: Delivery shall begin no later than 4 May 2017.
l. Work Schedule: Contractor will be required to deliver riprap during a normal work week (Monday thru Friday) schedule. The contractor will (at its own expense) only be required to make deliveries during weekends or Federal holidays if daily delivery rates of 1,500 tons/day are not maintained during a normal week. The COR will verify rock receipts and notify the KO and Contractor of daily delivery rates and the running total by close of business Wednesday of each week that deliveries are in progress.
m. Delivery completion date: Based on contract award/start date and minimum Rate of
Delivery = 1,500 tons/day, the entire BASE quantity shall be delivered no later than five work weeks after first delivery. Additional time will be added to the contract completion date commensurate with quantity required and daily rate (min. 1,500 tons/day) for each option that is exercised (if exercised).
4. SCOPE OF WORK (cont.)
a. GENERAL
(1) These specifications cover the furnishing of all material, labor, equipment and all appurtenant facilities required to furnish, deliver and unload stone materials in conformity with these specifications. The stone shall be furnished “freight on board” (f.o.b.) Government barges.
(2) It is expected that all offerors will have acquainted themselves with all information concerning the existing conditions affecting transportation of stone materials from the quarry to the point of delivery and that adequate river depths exist which will permit access to mooring facilities and to the loading docks by Government barges. Failure to acquaint itself with all available information concerning roadways and other items affecting this ability to furnish and deliver the materials as specified will not relieve the Contractor from responsibility for making deliveries of materials at the rates prescribed. Examples of potential costs to be incurred to the Contractor could range from a cost for the use of a ramp or loader equipment, to a cost to the county for the use of the roadways and subsequent damage to such roads. These examples are not all inclusive and all costs should be reflected in the quote.
b. RIPRAP
(1) Riprap shall be supplied from a Rock Island District approved riprap source. Riprap stone shall be of a suitable quality to ensure permanence in the structure and in the climate in which it is to be used. It shall be free from cracks, seams, and other defects that would tend to increase unduly its deterioration from natural causes. The inclusion of objectionable quantities of dirt, sand, clay, and rock fines, as determined by the Contracting Officer Representative (COR), will not be permitted. Stone shall be reasonably well graded over the entire range of sizes conforming to the limitations specified to follow and further delineated on the chart included as Attachment B titled (ILDOT RR-5 Riprap Gradation Curve & Tally Chart).
(2) Neither the breadth nor the thickness of any piece shall be less than one-third of its length. All stone shall be processed to remove fine particles by loading over a vibrating screen with not less than 6 inch bar spacing or by other approved methods and equipment that will result in satisfactory removal of fine particles. No individual piece shall exceed the maximum gradation size by more than twenty percent, i.e. 480 pounds, and the total combined weight of all over-sized pieces for each gradation shall not exceed 15 percent of the total sample size.
(3) MEASUREMENT
All stone for riprap will be measured for payment by weighing on state certified scales. Scales shall have been certified by the state or calibrated by a company licensed by the state using certified weights, within 30 days prior to start of delivery of riprap. Scale certification documents must be presented to the COR during the first riprap gradation, prior to first riprap delivery.
(4) RIPRAP SOURCES
http://www.mvr.usace.army.mil/About/Offices/Engineering-and- Construction/Geotechnical-Branch/
(a) Riprap meeting the requirements of these specifications can be produced from the
USACE approved sources listed in the LINK above.
(b) Riprap for stone protection shall be furnished from the above listed sources.
(c) After the award of the contract, the Contractor shall designate in writing only one listed source or combination of listed sources from which it proposes to furnish riprap.
(d) Listing of a source of stone is not to be construed as approval of all material from that source. The right is reserved to reject materials from certain localized areas, zones, strata, or channels, when such materials are unsuitable for riprap as determined by the Contracting Officer or COR. Materials produced from a listed source shall meet all requirements of these specifications.
(5) QUALITY CONTROL
(a) The Contractor shall establish and maintain quality control for the stone protection material and its operations to assure compliance with contract requirements and maintain records of its quality control for all operations including but not limited to the following:
i. Gradation of riprap - To assure compliance with the requirements of paragraph 4.b. (2), the Contractor shall determine the weight of each stone from the gradation sample. The weights shall be recorded on the tally chart, summed, and plotted on the gradation curve. The gradation test shall be conducted and approved before delivery of riprap.
ii. The Contracting Officer or COR reserves the right to direct the location and select the material for samples to be tested.
iii. Copies of these records and tests as well as the records of corrective action taken, shall be furnished to the Contractor, Contracting Officer and the COR.
The COR will ensure that copies of the records and tests will be distributed to CEMVR-OD-MM (Frederickson), and CEMVR-EC-G (Matt Stewart).
iv. A sample ILDOT RR-5 Riprap Gradation Curve & Tally Chart is included as Attachment “B”.
v. Upper Mississippi River Navigation Chart Map 67 as Attachment “A”
(with text box/arrow identifying recommended loading locations).
(b) Rock gradation (sample testing) shall be conducted by the contractor and observed and recorded by the COR prior to the first rock delivery. The Contractor shall make as many additional tests under the Contractor's quality control program as are needed to ensure gradation requirements are met. If materials fail to meet requirements, the Contractor shall adjust its operation and verify with tests that acceptable materials are being produced. Failure to meet requirements will result in removal of materials already in place which the failed test represents. A copy of these records and tests, as well as the records of corrective action taken, shall be furnished to the Government.
5. SECURITY
Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program website (http://www.uscis.gov/e-verify) to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. Documentation of company enrollment in E-verify, via a print screen of the company profile within the E-verify system, must be submitted to the Security Office no later than 3 business days after the initial notice to proceed.
*When contracts are with individuals, the individuals will be required to complete a Form I- 9, Employment Eligibility Verification, with the designated Government representative.
This Form will be provided to the Security Office after Notice to Proceed is given.
6. SAFETY
All work performed within the jurisdiction of this contract shall be performed in compliance of the Corps of Engineers, Safety and Health Requirements Manual, 30 November 2014, EM 385-1-1, which can be accessed on the below link.
http://www.usace.army.mil/Safety-and-Occupational-Health/Safety-and-Health- Requirements-Manual/

and
(2) Intended, by the gratuity, to obtain a contract or favorable treatment under a contract.
(b) The facts supporting this determination may be reviewed by any court having lawful jurisdiction.

In accordance with 31 U.S.C. 1352, the Contractor shall not use appropriated funds to pay any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the award of this contractor the extension, continuation, renewal, amendment, or modification of this contract.
(1) The term appropriated funds does not include profit or fee from a covered Federal action.
(2) To the extent the Contractor can demonstrate that the Contractor has sufficient monies, other than Federal appropriated funds, the Government will assume that these other monies were spent for any influencing activities that would be unallowable if paid for with Federal appropriated funds.
(c) Exceptions. The prohibition in paragraph (b) of this clause does not apply under the following conditions:
(1) Agency and legislative liaison by Contractor employees.
(i) Payment of reasonable compensation made to an officer or employee of the Contractor if the payment is for agency and legislative liaison activities not directly related to this contract. For purposes of this paragraph, providing any information specifically requested by an agency or Congress is permitted at any time.
(ii) Participating with an agency in discussions that are not related to a specific solicitation for any covered Federal action, but that concern--
(A) The qualities and characteristics (including individual demonstrations) of the person's products or services, conditions or terms of sale, and service capabilities; or
(B) The application or adaptation of the person's products or services for an agency's use.
(iii) Providing prior to formal solicitation of any covered Federal action any information not specifically requested but necessary for an agency to make an informed decision about initiation of a covered Federal action;
(iv) Participating in technical discussions regarding the preparation of an unsolicited proposal prior to its official submission; and
(v) Making capability presentations prior to formal solicitation of any covered Federal action by persons seeking awards from an agency pursuant to the provisions of the Small Business Act, as amended by Pub.L. 95-507, and subsequent amendments.
(2) Professional and technical services. (i) A payment of reasonable compensation made to an officer or employee of a person requesting or receiving a covered Federal action or an extension, continuation, renewal, amendment, or modification of a covered Federal action, if payment is for professional or technical services rendered directly in the preparation, submission, or negotiation of any bid, proposal, or application for that Federal action or for meeting requirements imposed by or pursuant to law as a condition for receiving that Federal action.
(ii) Any reasonable payment to a person, other than an officer or employee of a person requesting or receiving a covered Federal action or an extension, continuation, renewal, amendment, or modification of a covered Federal action if the payment is for professional or technical services rendered directly in the preparation, submission, or negotiation of any bid, proposal, or application for that Federal action or for meeting requirements imposed by or pursuant to law as a condition for receiving that Federal action. Persons other than officers or employees of a person requesting or receiving a covered Federal action include consultants and trade associations.
(iii) As used in paragraph (c)(2) of this clause, ``professional and technical services'' are limited to advice and analysis directly applying any professional or technical discipline (for examples, see FAR 3.803(a)(2)(iii)).
(iv) Requirements imposed by or pursuant to law as a condition for receiving a covered Federal award include those required by law or regulation and any other requirements in the actual award documents.
(3) Only those communications and services expressly authorized by paragraphs (c)(1) and (2) of this clause are permitted.
(d) Disclosure. (1) If the Contractor did not submit OMB Standard Form LLL, Disclosure of Lobbying Activities, with its offer, but registrants under the Lobbying Disclosure Act of 1995 have subsequently made a lobbying contact on behalf of the Contractor with respect to this contract, the Contractor shall complete and submit OMB Standard Form LLL to provide the name of the lobbying registrants, including the individuals performing the services.
(2) If the Contractor did submit OMB Standard Form LLL disclosure pursuant to paragraph (d) of the provision at FAR 52.203-11, Certification and Disclosure Regarding Payments to Influence Certain Federal Transactions, and a change occurs that affects Block 10 of the OMB Standard Form LLL (name and address of lobbying registrant or individuals performing services), the Contractor shall, at the end of the calendar quarter in which the change occurs, submit to the Contracting Officer within 30 days an updated disclosure using OMB Standard Form LLL.
(e) Penalties. (1) Any person who makes an expenditure prohibited under paragraph (b) of this clause or who fails to file or amend the disclosure to be filed or amended by paragraph (d) of this clause shall be subject to civil penalties as provided for by 31 U.S.C.1352. An imposition of a civil penalty does not prevent the Government from seeking any other remedy that may be applicable.
(2) Contractors may rely without liability on the representation made by their subcontractors in the certification and disclosure form.
(f) Cost allowability. Nothing in this clause makes allowable or reasonable any costs which would otherwise be unallowable or unreasonable. Conversely, costs made specifically unallowable by the requirements in this clause will not be made allowable under any other provision.
(g) Subcontracts. (1) The Contractor shall obtain a declaration, including the certification and disclosure in paragraphs (c) and (d) of the provision at FAR 52.203-11, Certification and Disclosure Regarding Payments to Influence Certain Federal Transactions, from each person requesting or receiving a subcontract exceeding $150,000 under this contract. The Contractor or subcontractor that awards the subcontract shall retain the declaration.
(2) A copy of each subcontractor disclosure form (but not certifications) shall be forwarded from tier to tier until received by the prime Contractor. The prime Contractor shall, at the end of the calendar quarter in which the disclosure form is submitted by the subcontractor, submit to the Contracting Officer within 30 days a copy of all disclosures. Each subcontractor certification shall be retained in the subcontract file of the awarding Contractor.
(3) The Contractor shall include the substance of this clause, including this paragraph (g), in any subcontract exceeding $150,000.
52.203-13 CONTRACTOR CODE OF BUSINESS ETHICS AND CONDUCT (OCT 2015)
(a) Definitions. As used in this clause--
Agent means any individual, including a director, an officer, an employee, or an independent Contractor, authorized to act on behalf of the organization.
Full cooperation—
