BASIS FOR AWARD
The Government will award one contract resulting from this solicitation in accordance with FAR 13.106 to the responsible offeror meeting or exceeding all solicitation requirements and representing the best value based on price.
TECHNICAL SPECIFICATIONS
1. General: The Corps of Engineers (Corps) is continuing a pilot program to fertilize Dworshak Reservoir to balance the nutrient levels in the reservoir and to enhance reservoir productivity. This will require weekly applications of liquid fertilizer to 3 areas or zones of the reservoir. The total amount and type of fertilizer for the 2016 program is 43,600 gallons of 32-0-0 (urea ammonium nitrate) fertilizer. The Government reserves the right to increase or decrease the fertilizer during the course of the contract at the set price per gallon. The Delivery Schedule (Attachment 2) shows the estimated amount of 32-0-0 fertilizer to be used weekly during the 2016 program. The actual amount of fertilizer applied to the reservoir during the course of the season may vary from this schedule depending on biological responses to the application.
Equal Opportunities for Veterans. In addition to complying with the requirements outlined in FAR Part 22.13, FAR Provision 52.222-38, FAR Clause 52.222-37, DFARS 222.13 and Department of Labor regulations, U.S.
Army Corps of Engineers (USACE) contractors and subcontractors at all tiers are encouraged to promote the training and employment of U.S. veterans while performing under a USACE contract. While no set-aside, evaluation preference, or incentive applies to the solicitation or performance under the resultant contract, USACE contractors are encouraged to seek out highly qualified veterans to perform services under this contract. The following resources are available to assist USACE contractors in their outreach efforts:
Federal Veteran employment information at http://www.fedshirevets.gov/index.aspx, Department of Labor Veterans Employment Assistance http://dol.gov/vets/, Department of Veterans Affairs-VOW to Hire Heros Act http://benefits.va.gov/vow/, Army Wounded Warrior Program - http://wtc.army.mil/modules/employers/index.html, U.S. Chamber of Commerce Foundation-Hiring Our Heros http://www.uschamberfoundation.org/hiring-our-heroes, Guide to Hiring Veterans – Reference Material http://www.whitehouse.gov/sites/default/files/docs/white_house_business_council_- _guide_to_hiring_veterans_0.pdf
2. Fertilizer Specifications: Dworshak Reservoir is extremely lacking in nitrogen. Hence the Corps will be adding nitrogen using 32-0-0 (urea-ammonium nitrate) fertilizer. This fertilizer shall be standard industry formulation for this type of fertilizer. This type of fertilizer shall be in liquid form for application to aquatic lake ecosystems. Of concern to the Government are the levels of arsenic, zinc, cadmium, and other trace metals or contaminants that may be contained in the liquid that is to be applied. The formulation for this fertilizer should have the lowest levels of these metals and other contaminants as possible. One week prior to the first delivery of fertilizer, the Contractor shall provide the Contracting Officer an independent laboratory analysis verifying the nutrient levels of the fertilizer (32-0-0) in percent of each nutrient and all trace metals in parts per million for the product. Laboratory analysis shall comply with analytical and sampling test methods described in the US Environmental Protection Agency publication “Test Methods for Evaluating Solid Waste, Physical/Chemical Methods", SW-846. Specific tests and maximum permitted levels of metals are described in Attachment 5. Only fertilizer meeting these ppm standards will be accepted. Alternate generally accepted test methods may be utilized as long as the required level of accuracy are demonstrated and achieved. Additional laboratory reports are required one week prior for each subsequent batch of fertilizer delivered. The additional laboratory report for a specific delivery may be waived by the Contracting Officer or the designated representative if documentation is provided that the material being delivered is from the same unaltered source (and pick up point) as a previous delivery.
3. Delivery Requirements: The Government has a rigid requirement to fertilize the reservoir on a weekly basis (see Attachment 2). The estimated amount of fertilizer required for the program may change as the program proceeds. The Contractor shall review the Government’s fertilizer usage requirements and deliver the required fertilizer to Dworshak Dam on a monthly basis or other schedule approved by the Contracting Officer.
Deliveries shall be made on Mondays through Thursdays between the hours of 7:30 A.M. and 4:00 P.M. The Contractor shall notify project personnel at least 48 hours in advance of any fertilizer delivery. The contractor shall pump the fertilizer into Contractor supplied storage tanks for the Government’s use. The first delivery of fertilizer shall be made the week of April 18 - 21, 2016. After the first delivery is made, the Contractor shall make subsequent deliveries on a frequent enough schedule so that the Government maintains one week of fertilizer usage on hand when the next delivery is made. The Government shall provide the Contractor two (2) weeks’ notice of changes in fertilizer usage that may alter the Contractor’s delivery schedule or delivery amount.
4. Fertilizer Storage: The Contractor shall provide one storage tank to hold delivered fertilizer at Dworshak Dam.
Fertilizer and storage tanks with pump delivery system shall be delivered five (5) miles west of Orofino, Idaho, on Highway 7. Pass Dworshak National Fish Hatchery. Turn right, and go 2 miles uphill on the “A” Road to Bruces Eddy. This location is accessible for large tractor-trailers for delivering the fertilizer. Storage tanks shall meet State of Idaho standards for fertilizer storage and shall be of sufficient size to hold one month’s supply of fertilizer or larger, but no larger than 10,000 gallons. The Government will provide secondary containment for the storage tanks by constructing earth berms with plastic lining. This secondary containment will be placed on earth, with a plastic liner laid down, and sand placed on top of the plastic. The storage tanks shall be placed on top of this.
Storage tanks shall be delivered by April 14, 2016. Maps illustrating the fertilizer storage/delivery location are included in Attachments 3 and 4.
5. Fertilizer Delivery System: The Contractor shall provide a pump delivery system to pump the fertilizer from the storage tank to the Government-owned application tank. The Government will be utilizing a 4,000 gallon truck mounted tank for the 32-0-0 fertilizer. The delivery system shall have a 2-inch gas driven pump, capable of pumping 1,500 to 2,000 gallons per hour, with 40 feet of 2-inch diameter delivery hose provided. No electricity is available at this site. The hose shall have industry standard cam-lock couplers so the Government can extend the hose if necessary. The delivery system will be used to fill two (2) Government-owned tanks. One tank is a 4,000 gallon stainless steel tank with an 8-inch lid on the top of the tank. The other tank is a 300 gallon polyethylene tank wdith a 4-inch diameter opening on the top of the tank.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.
Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
