PERFORMANCE WORK STATEMENT

FY15 CULVERT CLEANING AND VIDEO

INSPECTION FOR

JACKSON HOLE,

WYOMING

1. GENERAL: The location for the intended work is the Jackson Project Levees, in Jackson Hole, Wyoming.

The intent of this solicitation is to perform project culvert cleaning and to obtain video inspections of the interior of project culverts, as required every five years by Corps regulations.

1.1 SCOPE OF AGREEMENT

The intent of this solicitation and any resultant agreement is to acquire services for the culvert jetting (cleaning) of Project culverts, and to obtain video inspections of the interior of project culverts through the use of camera equipment capable of entering confined spaces. Woody vegetation in the immediate area surrounding the culvert inlet and outlet is to be removed. Any sedimentation deposited on the apron of the culvert or blocking flow to the culvert is to be removed and disposed of in a legal manner. Some project culverts will have water flowing through them, and will require temporary coffer dams in order to perform the required work. The Contractor is responsible for all equipment, materials, supplies, transportation, lodging, trained/certified personnel, and supervision and management of those personnel, necessary to meet or exceed the agreement specifications. The resources will be used to clean and video inspect culverts in project levees located on the Snake River, north of the highway 89 bridge, and south of the Moose Bridge, near the town of Jackson, Wyoming, as well as on the Gros Ventre River, downstream of the Grand Teton National Park. At the conclusion of work, the contractor will furnish a report on the condition of the inspected and cleaned culverts, as well as a computer disc containing the video files. The responsible Government Representative is authorized to administer the technical aspects of this agreement.

1.2 CONTRACTOR PROVIDED EQUIPMENT

Equipment shall meet all standards established by specification or incorporated by reference and shall be maintained in good repair by the Contractor.

1.2.1 Equipment Requirements

1. An audible reverse warning device (backup alarm) of 87 decibel or greater measured at 5 feet behind and in the center of the equipment.

2. A fire extinguisher, multi-purpose 1A 10BC that is securely mounted to the vehicle and accessible by the operator

3. Shovel

4. Approved spark arrester on all naturally aspirated engines

5. All factory guards shall be in place and in functional condition (i.e. engine compartment)

(applicable for heavy equipment)

6. Personal Protective Equipment. Contractor shall be responsible for ensuring all personnel arrive at the incident with the proper Personal Protective Clothing and Equipment as prescribed in the agreement. Contractor shall be responsible for ensuring the Personal Protective Equipment is operable and maintained in good repair throughout the duration of any assignment. Personal Protective Clothing will be cleaned at sufficient intervals to preclude unsafe working conditions.

All personnel shall be wearing Personal Protective Clothing, including boots, upon arrival at the work site.

Contractor shall be responsible for ensuring that all personnel arrive with the following:

1.2.2 Personal Protective Equipment (PPE)

1. BOOTS: All Leather uppers, lace-up type, minimum of 8 inches high with lug type sole in good condition (steel toed boots are not recommended).

2. HARD HAT: Hardhat meeting NFPA Standard 1977 is required.

3. GLOVES: One pair of heavy-duty leather per person.

4. EYE PROTECTION: One pair (meets standards ANSI Z87, latest edition).

5. HEARING PROTECTION: Use hearing protection whenever sound levels exceed 85 dB.

1.3 TRANSPORTATION

The Contractor is responsible for transporting the equipment to and from the work site. Transports shall have current Department of Transportation (DOT) certification and be of sufficient and legal weight rating to transport the equipment.

Contractor is responsible for:

1. Meeting all state and federal requirements for vehicles, such as weight restrictions and licensing requirements.

2. Any special permits required for the transport of equipment.

1.4 PERSONNEL REQUIREMENTS

All Contractor personnel shall comply with EM 385-1-1.

1.4.1 Training/Experience

Each person under this Agreement shall meet the following minimum requirements:

1. Commercial Drivers License (for transports, when required).

2. All operators shall be able to operate the equipment safely up to the manufacturer's limitations

(i.e., experience working in steep terrain, timber, etc.)

The government reserves the right to verify training at any time for all operators.

52.204-17 OWNERSHIP OF CONTROL OF OFFEROR (NOV 2014)

(a) Definitions. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Contractor and Government Entity (CAGE) Branch to identify a commercial or government entity, or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Contractor and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as an NCAGE code.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

52.211-8 TIME OF DELIVERY (JUN 1997)

(a) The Government requires delivery to be made according to the following schedule:

REQUIRED DELIVERY SCHEDULE

The contractor shall commence work under this contract at time of award, prosecute the work diligently, and complete the entire work ready for use not later than the dates listed below.

(1) The contractor shall complete all work under this contract no later than 13 November 2015.

(2) Place of performance for this requirement is Teton County, Wyoming, near the town of Jackson.

a. The Government will provide to the Contractor, without charge, one set of contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.

b. The Contractor shall--

(1) Check all drawings furnished immediately upon receipt;

(2) Compare all drawings and verify the figures before laying out the work;

(3) Promptly notify the Contracting Officer of any discrepancies;

(4) Be responsible for any errors that might have been avoided by complying with this paragraph b; and

(5) Reproduce and print contract drawings and specifications as needed.

c. In general--

(1) Large-scale drawings shall govern small-scale drawings; and

(2) The Contractor shall follow figures marked on drawings in preference to scale measurements.

d. Omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR

EXECUTIVE ORDERS—COMMERCIAL ITEMS (DEVIATION 2013-O0019) (MAY 2015)

(a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(b)

(1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.219-1 SMALL BUSINESS PROGRAM REPRESENTATIONS (OCT 2014)

(a) Definitions. As used in this provision--

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

252.236-7001 CONTRACT DRAWINGS AND SPECIFICATIONS (AUG 2000)

(a) The Government will provide to the Contractor, without charge, one set of contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.

(b) The Contractor shall--

(1) Check all drawings furnished immediately upon receipt;

(2) Compare all drawings and verify the figures before laying out the work;

ADDENDUM TO 52.212-2

Factor 1: Past Performance and Experience (PPE)

The Contractor to show a minimum of 3 years experience performing construction work in or adjacent to Class I and Class II waters, in accordance with state permits and Storm Water Pollution Prevention Plans.

The Contractor shall submit as part of their solicitation package, a list of at least three references that will be able to confirm the successes of their company in the performance of similar projects. The Government also reserves the right to use other information, such as past performance information systems etc. during the evaluation.

This evaluation criterion will be rated as “Acceptable/Unacceptable”. Any Contractor that does not provide this information, or does but does not get a satisfactory review, will receive a rating of “Unacceptable” and will cause the entire factor to be rated as “Unacceptable”. Contractors with no experience shall be rated as Neutral.

A new business without PPE information shall provide a statement in its proposal to this effect, otherwise their proposal may be disqualified. The rating for the company will be “Neutral.” Companies in this position shall submit Resumes of Key Personnel that demonstrates relevant PPE. The same information shall be provided as stated in the above paragraph for the key personnel. The Government may call references to verify PPE information for the key personnel. Subsequent to the research, this factor may receive a “Acceptable/Unacceptable” rating based on the evaluation of the key personnel (as opposed to the company).
