SECTION 00010 - SOLICITATION CONTRACT FORM
The following have been modified:
PRICE SCHEDULE
SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS
The following have been added by full text:
RFI QUESTIONS & ANSWERS
Q1. Page 29 states that the Contractor perform at least 20% of the work on site with its own organization.
Is there any further definition of “with its own organization” ? For example VAAR (not applicable here) provides that work accomplished on site by laborers, mechanics, and foremen/forewomen on the Contractor’s payroll and under his/her direct supervision shall be included in the per cent of work performed by Contractor. The cost of material and equipment installed by such labor may be included in the 20% requirement. However, are salary payments to executive, supervisory and clerical forces excluded in establishing compliance with the 20% requirement?
A1. Intent is to provide a best value to the Government, while restricting excessive "pass thru" costs.
Q2. No geotextiles are shown being placed beneath the 2” mill and overlay, is any needed? The block cracking present is likely to propagate through to the new surface course very quickly without any.
A2. No geotextile needed. Areas where 2" mill depth isn't sufficient are intended to receive a full depth bituminous repair, as shown on drawings
Q3. Section 010100 para 1.8 states that the contractor is responsible for creating and E&S plan and submitting it to the government for approval. What is meant by government? Is it the COE or is it MD
A3. Government (Not MDE) Approval
Q4. Section 011000 Para 1.5 states that areas are designated as high or low priority however there a nowhere on the plans with these designations. Please clarify.
A4. Priorities are identified in the revised Price Schedule, Base Bid Items are prioritized over optional bid items.
Q5. The estimated quantities are not listed in the bid form for all items except 2. Item 0002B is listed as 727 LF however it is for paving which cannot be priced in this unit as it is not a uniform width.
A5. A revised price schedule will be provided.
Q6. Are permits from MDE required for the parking behind the Hazen Building or for the full depth replacement? If subgrade is exposed, it would be considered disturbance.
A6. This area has been deleted from this project.
Q7. For tree removal behind the Hazen building is anything related to Forest Conservation required with
MDDNR?
A7. This area has been deleted from this project
Q8. For the repaving near Drummond Airport site, how will the existing Air Force One mockup and helicopter be moved to allow for paving operations? Is the repaving to just go around those items or is the contractor responsible for temporarily relocating and reinstalling?
A8. Intent is to pave around existing equipment
Q9. At the Merletti parking lot, there is notes about replacing curb and sidewalk. The existing handicap parking spaces do not appear to be ADA compliant where the curbing and sidewalk is to be replaced, is the contractor to replace in kind or adjust as necessary to make an ADA compliant curb and walk. The existing ADA signage is also non-compliant, if the sidewalk is removed and signs with it, do they need to be replaced to current standards or should they be replaced in kind. 1.6.1 No work will be allowed during the period of 1 December through 31 March, and such period has been considered in computing time allowed for completion.
A9. For purposes of pricing, please provide only what is shown on the drawings, noted in the specifications and as stated on the price schedule. The Corps of Engineers is not aware of a restriction of work between 1 December through 31 March. The project duration factors temperature and scheduling restrictions (asphalt availability) during the Winter.
Q10. During the site walk it was eluded to that better bid quantities would be provided, is this to happen?
A10. An amended Price Schedule will be provided
Q11. Please clarify the exact seal coating method and material required by the owner for the PODC Driving Course Pad.
A11. See revised PODC Drawings and Specifications.
Q12. Please clarify the exact method for striping material, method and design required by the owner for the PODC Driving Course Pad.
A12. See solicitation amendment
Q13. Calendar Days listed on 1442-Item 11 Says 320 Days for completion after NTP. See Page 38 of 48 – Under Clauses Incorporated by full text under -52.211-10 it says 220 days. Which is the correct number of calendar days?
A13. The project duration is as noted on the Form 1442; 320 Calendar days from NTP.
Q14. Can we please receive a copy of the attendance list passed around at the site visit?
A14. Provided via amendment 0003.
Q15. Please provide quantities to be used as the basis for proposals for each CLIN line item. COE has the quantities according to site visit questioning of engineers present and this would provide for more consistent bid pricing from all bidders. Also adding area unit pricing will give the COE the opportunity to use + or - if needed during the contract duration.
A15. The updated price schedule will be more detailed and provide quantities for all unit price items. The only lump sum items will be Merletti parking Mill +overlay, PODC sealing, and New concrete pavement as these are easily quantifiable by bidders. All other features of work will have estimated quanties and will be unit price items.
Q16. Will an area on this site be made available to stockpile millings?
A16. A short term - Not to exceed seven days - area will be provided upon request.
Q17. Please confirm that Bid items BB 0003 and 0009 will be combined?
A17. A revised price schedule will be provided.

Offerors must quote on all items. Failure to quote on all items may be cause for rejection of the proposal.
Optional Items may be exercised at any time within 220 calendar days after the date of receipt of Notice To Proceed. The Contracting Officer may exercise the Optional Items by written notice to the Contractor, postmarked within the period specified above. The Government may exercise any, all or none of the listed Optional Items in any order.
Evaluation of Options:
Except when it is determined not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
VARIATION IN ESTIMATED QUANTITIES: If the quantity of a unit-price item in this contract is an estimated quantity and the actual quantity of the unit-price item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon receipt of a written request for an extension, the Contracting officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.
