KU TREE DAM W912CN-17-Q-0012

Questions:

1) In the event of bad weather (e.g. rain, wind, hurricanes, etc) if there is a downed tree in the parking or dam area, which exceeds 8-10 inches in diameter, will we be able to submit a change order?

In the event that extreme weather conditions cause an excessively large tree to fall down in the parking area, the matter will be handled by Department of Public Works in house and on a case-by-case basis.

2) Are there any quarterly penalties if we exceed the 3 month mark? i.e Double up 2 services in one month, or do not make it to property all 4 times in 1 calendar year?

The PWS has been updated to reflect the requirements as scheduled. Four services are required per calendar year, the first service occurring between Jan-March, the second occurring between April-June, the third occurring between July-Sept, and the fourth occurring between Oct-Dec. Not adhering to this schedule will be grounds for a termination for cause.

3) To clarify, the initial clean-up is only for the first year, and then we are to perform the 4 services soon after. So, in the first year we will visit 5 times, and 4 times in the years to follow?

Yes, the initial cleaning is only in the first year and No, the initial cleaning will be counted as the first cleaning. Example, should the period of performance begins January 1st then the initial cleaning will be done in January and subsequent cleaning will be scheduled in April (2nd cleaning), July (3rd cleaning), & October (4th and final cleaning for the base period). In January the following year by exercising the 1st option period the schedule cycle continues.

4) Will the contract allow for additional qualifications regarding heavy rains and excessive debris being washed down? How would the government or the contractor determine what is standard and what is excessive?

Branches, tree debris exceeding 12” in diameter will be considered excessive. Mud and debris build up depth in excess of 3 feet is deemed excessive. However, due to the circumstances and condition of the bottom of the stream we shall revise the location of the debris disposal to be 50’ downstream from the tower instead of 100’. Historically (within the past 5 years) the water has not risen to a point where debris located downstream reverts back to the tower.

5) What references and proof of insurance coverage do we need with our response?

Clause 52.228-500 requires submission of insurance prior to work commencement. RCO Hawaii Policy requires comprehensive general liability for the term of the contract at a minimum of $500,000 per accident. In addition automotive liability coverage at a minimum of $200,000 per person, $500,000 per accident, and $20,000 property is required.

6) What are the specific range control procedures to get the key?

The Contractor shall submit a work schedule to the COR at least 5 work days prior to performing the work. On the day of performance, the Contractor shall obtain the key from Range Control, Schofield Barracks Building 1198, Phone: 808-655-1434. The contractor is responsible for the safe keeping of this key and will be assessed any charges by Range Control for any lost key. The Contractor will notify Range Control each time they enter and exit the gate. The keys are issued on a day-to-day basis and shall be returned each day after use. The PWS paragraph 2.6 has been updated to reflect these procedures.
