Questions : ENOPU Bathrooms Renovation / W912CL-17-R-0004:

1) We have experienced crews to do the work. Due to the Uruguayan building code and wait times / scheduling with local Uruguayan building authorities it makes much more sense to use local licensed electrician, plumber, and certified engineers/ architects. Question #1: If awarded this contract, I’m assuming I can sub this out, correct?

Answer#1 Please refer to FAR Clause in solicitation 52.236-1 PERFORMANCE OF WORK BY THE CONTRACTOR (APR 1984) states The Contractor shall perform on the site, and with its own organization, work equivalent to at least fifty (50%) percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.

2) In regards to Authorization to perform--page 8, section 5g) of the solicitation, Authorization to Perform---- The Offeror has been duly authorized to operate and do business in Uruguay. We need to be in compliance 100%. If awarded the contract, we would use local / licensed Subs and Professionally Registered Engineers to perform work, and (we) acquire the necessary local permits, insurance, and inspections required. We would register as the General Contractor of record with the local building authority, and would complete the vetting process, vaccinations, submit DNA samples called for, etc. The General Contractor has an impeccable clean record, and current passport. Question # 2: Besides the above listed--Is there something else required to satisfy the Offeror being duly authorized to operate and do business in Uruguay?

Answer #2 It is on the potential contractor to determine what other requirements there may be to conduct business in Uruguay. Please refer to PG 17 section 1.5.11 Key personnel of the solicitation.

3) Question # 3: Other than the venting for the bathrooms—there is no HVAC component required to SOW, correct?

Answer: No HVAC

4) The synopsis calls for demolition and removal of fixtures, tiles, electrical and plumbing. It also states that no lead based paint or materials with asbestos may be used… Is asbestos removal a component of the SOW ? Is it treated the same (a certified asbestos removal company would remove). I can call the local building authority if unknown, but thought I'd ask you first. Question #4: Is asbestos removal a component of the SOW?

Answer: No asbestos removal, but ENOPU Engineer needs to certify there are no asbestos present

5) Due to the project location, at the time of my submittal we have not conducted a site visit. If awarded the contract however, we would obviously make pre-construction site visits, and we understand that regardless--it is the Contractor’s responsibility to verify site conditions, quantities, etc. We understand conducting a site visit is always necessary. However our question #5 is: Is a site visit prior to bid submittal MANDATORY to being able to submit a bid?

Answer #5 No, however it is the contractor’s responsibility to verify site conditions and is highly recommended. Please refer to FAR Clause 52.236-27 of the solicitation for instructions to arrange a site visit.

6) In regards to performance period—the solicitation allows ample time, 180 calendar days. It also says “negotiable.” The solicitation does not mention liquidated damages. We are dealing with inspections, government agencies, and time elements in a foreign country. Our singular focus would be to complete this project on time. However—if at 180 days the project is 90% complete—and our biweekly reports to KO demonstrate good faith efforts—and that perhaps the 90% progress is due to long wait times between inspections, or elements outside the contractor’s control, etc. Question # 6: If Contractor has worked faithfully—are we subject to liquidated damages?

Answer: Liquated damages will not be sought as long as good faith efforts are used to complete the project on time and circumstances arising to the delay were unforeseen or not in the contractors control.

7) Page 11 Section 1.1 Scope of Work—This states that existing power, sewer, and are available, and that the Contractor must request and pay for these utilities during construction, and work with the ENOPU engineer to arrange for connections if needed. Question #7: In working with ENOPU engineer to arrange for utility connections—does this require establishing a “new” water service meter, and “new” electric meter, a “new” gas meter, etc?

ANSWER: There should not be a need for a new meter, because the utilities are available....unless is required as part of the permits by the pertinent building authority.

Question #8: If you already have a local Building Authority Contact, can you provide please ? I can read, write, and speak Spanish fluently.

ANSWER: ENOPU

In accordance with FAR 52.225-14 the United States Government is not responsible for the inconsistency between English version and translation of the technical exhibits.

Additionally please refer to PG 27 section 5.1 in reference to plan development by the contractor.
