SCOPE OF WORK
Pollinator Plot Concrete Pad US Army Corps of Engineers – Fort Peck Project

1.0 Scope of Work. The scope of this project is to furnish all plant, labor, materials, and equipment to place a 36ft long by 36 ft wide, 4-inch-thick concrete pad. The work will include excavation and grading of sub-grade, installation of 4 inches of new compacted aggregate base course, and form and place new concrete section.
1.1 Period of Performance: All work shall be completed NLT 31 October 2023.
2.0 General
2.1 Standards and Regulations. The Contractor shall perform to the standards in the contract and comply with all Local, State, and Federal Regulations during the services performed. The Contractor is responsible for ascertaining the extent to which these regulations affect the operations resulting from this contract. The Contractor shall comply will all applicable regulations. Applicable regulations include, but are not limited to the following:
a. Engineering Manual (EM) 385-1-1 (USACE – Safety and Health Requirements Manual), dated November 2014;

b. Occupational Safety and Health Standards (29 CFR 1910);
c. See Specification Section 03 30 53 Miscellaneous Cast-In-Place Concrete for additional reference standards
2.1.1 Activity Hazard Analysis (AHA). The contractor shall prepare the AHA in accordance with Paragraph 01.A.14 or 01.A.15 of the EM 385-1-1. If using Paragraph 01.A.15, prepare the AHA IAW Figure 1-2.
Note: Contractors and other individual employer’s typically use Job Safety Analyses (JSAs), Job Hazard Analyses (JHAs), or similar Risk Management assessment tools. The government considers equivalent to, and acceptable substitutes for, the USACE’s AHA provided the data collected is the same as that required by the AHA, commensurate with the type of services the contractor is performing.
2.1.2 Abbreviated Accident Prevention Plan (APP). EM 385-1-1 in its entirety may be too complex for the type of work performed under these contracts; contractors may reference Appendix A, for abbreviated Accident Prevention Plan (APP). The contractor shall only need to submit items in Appendix A that are pertinent to the contract. The contractor shall use a qualified person to prepare the site-specific abbreviated Accident Prevention Plan (APP). The contractor shall prepare the APP in accordance with the format and requirements of the EM 385-1-1 and supplemented herein. The contractor shall sign and submit the APP for approval prior to the start of work onsite.
2.2 Measurement and Payment. Payment items for the work under this contract for which contract job or unit price payments will be made are listed in the BIDDING SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, are included in the listed job or unit item most closely associated with the work involved. The job or unit price and payment made for each item listed constitutes full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
2.2.1 Concrete – CLIN 0001
Payment will be made at the contract unit price. Price shall include all plant, labor, materials, and equipment for preparation of sub-grade, laying out the work, setting forms and steel reinforcement, pour, finish, cure the concrete, and final cleanup and backfill of the site. Cost of related materials and supplies shall include but no be limited to, those required for the work including formwork, reinforcing materials, isolation materials, cleaning, and chemical release agents, curing materials, or any additional items required for installation in accordance with the drawings and specifications.
2.3 Location. Work is located adjacent to the Ft. Peck Interpretive Center approximately 20 miles from Glasgow, MT. Exact location will be field staked by USACE personnel.
2.4 Staging Area. Location of staging area shall be coordinated with the COR.
2.5 Delivery, Storage, and Handling. N/A
2.6 Work Hours and Work Limits. The contractor is responsible for conducting business, between the hours of 0700 to 1800 Monday thru Friday except Recognized Federal Holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.
2.6.1 Recognized Federal Holidays: There are eleven (11) recognized holidays.

2.7 Facilities. Public vault toilet facilities are available nearby. The Contractor shall provide and maintain portable toilets for use by the Contractor's staff where public toilets are not available. Toilet(s) shall be placed at the location directed by the Contracting Officer. To prevent overturning by high winds, all portable toilets shall be anchored down. Electricity is not provided
2.8 Environmental Conditions. The contractor shall comply with all applicable Federal, State, Local, and Regional environmental laws and regulations.
2.9 Antiterrorism/Operation Security Requirements
2.9.1. General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures—this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
2.9.2 Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel will not require NCIC III checks. Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.
2.9.3 Suspicious Activity Reporting training (e.g. iWATCH, CorpsWatch, or See Something, Say Something):
All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.
2.9.4 Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements.
Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.
3.0 Submittals. Prior to commencement of work, the Contractor shall submit the following documents to the COR for review and approval (test reports and delivery tickets obtained during the progress of work shall be submitted within 24 hours of receiving the results):
a. Activity Hazard Analysis (AHA);
b. Abbreviated Accident Prevention Plan (APP)
c. Proof of Insurance for Contractors and Subcontractors;
d. Specific materials specified in the SOW
e. Product Data – Air Entraining Admixture
f. Product Data – Water-Reducing or Retarding Admixture
g. Product Data – Curing Materials
h. Product Data – Expansion Joint Filler Strips, Pre-molded
i. Product Data – Field Molded Sealants
j. Test Reports – Aggregates
k. Test Reports – Concrete Mixture Proportions and Test Data
l. Test Reports – Compressive Strength Testing
m. Test Reports - Slump
n. Test Reports – Air Content
o. Certificates – Delivery Tickets
4.0 Materials. All materials shall be in new unused condition meeting the requirements of the specification.
5.0 Execution. Perform work, in accordance with the Drawings and Specifications Section 03 30 53 Miscellaneous Cast-In-Place Concrete – See Attachment.
5.0.1 Concrete Placement. Concrete shall be placed to the lines and grades as shown on the drawings. Slight modifications may be necessary to match existing ground.
5.0.2 Site Cleanup. Backfill along edges of new concrete to match existing ground.
5.1 Quality Control: The Contractor shall designate, in writing, an employee who shall serve as the contact for matters involving quality and performance or nonperformance of the required work stated in this SOW. The employee(s) shall be qualified and fully competent with full authority to act for, and on behalf of, the Contractor as necessary to ensure that the required work is performed in accordance with the standards contained herein. The Contractor shall furnish the above written designation to the Contracting Officer’s Representative (COR) no later than the first day of work.
The Contractor shall include the name(s), address(s), and telephone number(s) of the responsible individual(s).
5.2 Quality Assurance: The Government has the right to inspect all work called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections in a manner that will not delay the work. If any of the work does not conform to contract requirements, the Government may require the Contractor to re-perform the work in conformity with contract requirements and at no increase in cost.
5.3 Protection of Existing Facilities and Works: The Contractor shall be responsible for the protection of the work area from damage and upon completion of the work shall leave existing works in a condition equal to that which existed when the work started. All work, storage of materials, and construction plant shall be kept within the limits of the areas assigned. Prior to construction operations, the Contractor shall confer with the Contracting Officer's representative to determine the proximity of any possible under-ground obstructions, pipe or equipment which could be damaged as a result of construction operations. Existing utility lines that are shown on the drawings or the locations are otherwise made known to the Contractor shall be protected from damage, and if damaged, shall be repaired by the Contractor at no additional expense to the Government. In the event that the Contractor damages any existing utility lines that are not shown or the locations of which have not been made known to the Contractor, report thereof shall be made immediately to the Contracting Officer. If the Contracting Officer determines that repairs shall be made by the Contractor, such repairs will be ordered under CONTRACT CLAUSES clause entitled "Changes." The Contractor will be responsible for the protection of structures from any structural damage during the construction operations.
Roads and surfaces shall be protected from damage by the work or if damaged shall be repaired with equal materials at no additional expense to the Government. At all times the work areas shall be kept in a condition conducive to safety of workmen and the public and neat in appearance. Waste or surplus materials shall not be allowed to accumulate in the construction areas.
5.4 Location of Underground Utilities: Contact local utility locating service a minimum of 48 hours prior to excavating, to mark utilities, and within sufficient time required if work occurs on a Monday or after a Holiday.
Verify existing utility locations indicated on contract drawings, within area of work.
6.0 Inspection and Tests. The government will provide inspection of all work in accordance with FAR 52.213-4 – Terms and Conditions – Simplified Acquisitions (Other Than Commercial Items).

8.0 Drawings and Specifications. Drawings may not reflect actual site conditions. Therefore, field verification by the Contractor is highly recommended to determine actual site-specific conditions. The following Drawings and Specs are included:

CLAUSES INCORPORATED BY FULL TEXT
Evaluation-Other than Commercial Items.
a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote is most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate quotations: Technical, Past Performance, and Price.
The tradeoff process shall be used for this acquisition because it has been determined to be in the best interest of the Government to consider award to other than the lowest priced Offeror or other than the highest technically rated offeror. All evaluation factors are listed below in terms of their relative importance. Factor 1 (Technical) is approximately equal to Factor 2 (Past Performance) and when Factors 1 and 2 are combined they are approximately equal to Factor 3 (Price).
Evaluations will be based on the demonstrated capabilities of the prospective Offeror in relation to the needs of the project. The Offeror must submit information sufficient to evaluate its quote based on the detailed factors below.
1. Technical - The quoter shall provide a technical narrative describing the approach to be used to accomplish the contract tasks. The technical narrative shall be detailed, concise, and shall cover every aspect of how the contractor will accomplish the Objectives (Part 1) of the Scope of Work (SOW) and tasks listed in Section 03 30 53 Miscellaneous Cast In Place Concrete. Experience will be based on projects they have completed as a prime contractor or as a subcontractor. The offeror shall provide details of the project and pertinent information to demonstrate their role in the project and how the project is comparable to this requirement in size, scope and complexity. The narrative should describe the contractor’s quality control program and how the contractor will implement it, in accordance with the SOW. The contractor shall describe their technical proficiency and unique qualifications for requirements described in the SOW.
2. Past Performance – The offeror shall provide two (2) references of projects completed within the past five (5) years that are equal to or greater than this requested work in size and are of similar scope. Similar experience consists of projects completed as a prime contractor or projects of qualified subcontractors that have the capabilities to perform this work. The contractor shall provide dates and pertinent information to demonstrate at five (5) years of experience, and how they are comparable to this requirement in size and complexity. The contractor shall include points of contact, titles, telephone numbers, and email addresses (if available) for all projects provided. If the quoter provides more than two (2) projects, the government will review only the first two (2) projects submitted.
Additionally, past performance may be based on the contracting’s officer’s knowledge of and previous experience with similar projects acquired and any information contained in the Contract Performance Assessment Reporting System (CPARS), contained at www.cpars.gov.
A rating of exceptional will be given for submitted past performance that demonstrates their successful completion of two projects and additional information retrieved from CPARS and from the Contracting Officer is favorable on both of those projects.
A rating of satisfactory will be given for submitted past performance that demonstrates their successful completion of two projects and one of the submitted projects has reference that demonstrates successful completion and the information from CPARS and the Contracting Officer is favorable.
A rating of unsuccessful will be given for submitted past performance that does not demonstrate any successfully completed similar projects and/or the additional information from CPARS and the Contracting Officer is not favorable.
2. Price – The quote shall be inclusive of all costs to provide the construction services specified in the scope of work and attachments.
Technical and Past Performance is approximately equal to Price.
*If the quoter fails to provide any of the information stated in Factors 1-3 above, the government may determine the quote to be unacceptable. If it is in the government’s best interest, the government may request additional information from the contractor, to make an award decision.
b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Submitting your quote. Submission of quotations. Submit quotations to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotations may be submitted on the SF 18, letterhead stationery, or as otherwise specified in the solicitation.
Quotations are due by August 24. 2023 by 12:00 PM CT. Send your completed quotation package to the attention of Lnne D. Reed at lynne.d.reed@usace.army.mil . Electronic quotations are preferred over paper responses, unless other arrangements have been made with the individual identified above. You may submit more than one quote. If you do, we will evaluate each separately.
We will not consider any quote that we receive after the deadline unless we receive it before we issue a purchase order and considering it will not delay our purchase. In case of an emergency that delays our operations and makes submission or receipt of your quote impossible, we will extend the deadline by one working day.
As a minimum, quotations must show-
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of quotations;
(3) The name, address, and telephone number of the quoter;
(4) A technical description of the items being quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.204-8 if applicable.
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the quotation is not submitted on the SF 18, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotations that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
Terms and content of your quote. Your quote must be based on the terms of this RFQ. We might reject any quote that is not based on these terms in every respect. Your quote must contain all of the information described below.
Small Business Status. In order to submit a quote, you must know whether your company is a small business. The small business size standard that applies to this purchase is stated in FAR 52.204-8, along with the North American Industry Classification System (NAICS) code on which it is based.
Issuance of purchase order. Your quote should contain your best terms. The Contracting Officer may reject any or all quotes. After the evaluation of quotes, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice before issuing a purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR Part 15.
The Contracting Officer may issue a purchase order to other than the quoter with the lowest price. We might issue multiple orders, purchasing various items or groups of items from different quoters. We might issue an order for less than the quantity on which your quote is based, at the quoted price, unless you tell us that you will not accept an order on that basis.
System for Award Management (SAM). Unless exempted by the Contracting Officer, you must register in SAM before we will issue a purchase order to you. If you do not register by the date set by the Contracting Officer, the Contracting Officer might issue the order to a different quoter. Once registered, you must remain registered throughout performance until final payment. Go to https://www.acquisition.gov for information on SAM registration and annual confirmation.
DUNS Number (Data Universal Numbering System Number). [This applies to all quote if the solicitation requires that you be registered in the System for Award Management (SAM).] Place the annotation “DUNS” or “DUNS+4” next to your name and address on the first page of your quote followed by the DUNS or DUNS+4 number that identifies the quoter’s name and address.

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
