SECTION 01 01 00

CONTRACTOR'S SITE OPERATIONS

PART 1 GENERAL

1.1 PERMITS AND RESPONSIBILITIES

The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, County, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons and/or property that occur as a result of the Contractor's fault or negligence, and shall take proper safety and health precautions to protect the work, workers, public, and property of others. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.

1.2 WORK AREAS AND ACCESS

The Contractor shall take steps reasonably necessary to ascertain the nature and location of the work, and investigate the general and local conditions that can affect the work or its cost. Any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expenses to the Government. The Government assumes no responsibility for any conclusions or interpretations made by the Contractor based on the information made available by the Government. Nor does the Government assume responsibility for any understanding reached or representation made concerning conditions that can affect the work by any of its officers or agents before the execution of this contract, unless the understanding or representation is expressly stated in this contract.

Site conditions that should be investigated include, but are not limited to:

(1) Conditions bearing upon transportation, disposal, handling, and storage of materials.

(2) The availability of labor, water, electrical power, and roads.

(3) Uncertainties of weather, river stages, tides, or similar physical conditions at the site.

(4) The conformation and conditions of the ground and equipment and facilities to be replaced and/or rehabilitated.

(5) The character of equipment and facilities needed preliminary to and during work performance.

(6) Amount of work space, accessibility, lighting, etc.

Though it is not required, prospective Contractors are encouraged to attend a pre-bid meeting to determine the extent of work required, perform field measurements as needed, and inspect the work area. The pre-bid meeting will be held at the time and date listed on the STATEMENT OF WORK located in the project's Solicitation document. Point of contact for questions regarding the pre-bid meeting is

1.2.1 Road Restrictions

No new access roads are required for this work. Any damage to existing roadways that are used for access purposes shall be repaired and the surface shall be restored to its "as found" condition. The Contractor shall comply with any special requirements of the State, County, Local authorities and Corps of Engineers for use of existing roadways. These special requirements include, but are not limited to, traffic regulations and load limits. The Contractor is responsible for investigating and understanding these restrictions. No time extensions or cost claims will be allowed due to road restrictions.

1.2.2 Access by Government Personnel

Clear access shall be maintained for Government personnel and equipment through all work areas.

1.2.3 Contractor's Staging Area and Employee Access

The Contractor's staging area shall be restricted to the area designated by the Government. The project areas off-limits to Contractor shall be all areas other than direct work areas.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

1.4 PROJECT SECURITY, HOLIDAYS AND WORKING HOURS

1.4.1 General

The security of the Contractor's property and items furnished under this contract are the Contractors responsibility, until accepted.

1.4.2 Site Security

1.4.2.1 Security Requirements

During contract work, it is possible that the Fort Randall Project may go to a higher Force Protection Condition (FPCON) threat level and increase security measures. Government activities during higher threat levels may cause delays to include, but are not limited to vehicle searches, requiring Contractor employees to provide identification, passport, and/or work visa, and issuance of access cards to the Contractor's site Supervisor. The Government Representative will document delays in agreement with the Contractor. If the threat level requires the Contractor to leave the site for an extended period of time, the contract may be modified to extend completion date and may address additional mobilizing and demobilizing costs, plus reasonable time on site with no penalty to the Contractor.

All Contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The Contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes. Directions for background check are as described below.

Submit a complete, updated and signed, list of all Contractor and subcontractor personnel, including their titles and intended working hours, who will be working on site prior to start of work. This listing shall be revised and resubmitted when personnel changes occur.

1.4.2.2 Personnel Risk Assessment

A minimum of 15 days prior to engaging in work, submit to the Project POC a Personnel Risk Assessment (PRA) for each employee requiring authorized unescorted access to the Jobsite. The Contractor employee will only be allowed authorized unescorted physical access after the PRA is shown to and approved by the Government.

Authorized Unescorted Access Requirements Perform a PRA on all Contractor personnel that require authorized unescorted access to the Jobsite. Costs associated with the execution of the PRA shall be at the expense of the Contractor. The content of the PRA is defined by the requirements as follows:

a. Criminal Check - Obtain a criminal background check, completed within the last seven years, on all Contractor personnel that require authorized unescorted access to the Jobsite. A minimum of a 7-year criminal background check with the state patrol office shall be performed from all states of residence and employment, for the past seven years. The COR through the Contacting Officer will approve, disapprove, or revoke

SECTION 01 01 00 Page 4 authorized unescorted access to the Jobsite as a result of the seven-year background check in accordance with Army Directive 2014-05 Enclosure 2.

b. Identity Verification - Contractor employees shall provide positive verification of individual identity prior to authorized unescorted access to the Jobsite. Acceptable forms of identity verification are documents issued by a federal Government agency that include: the individual's photograph, name, and date of birth, such as a passport or military identification (ID) card. Additionally, a state issued driver's license or ID card is acceptable for identity verification.

c. The Criminal Check and Identity Verification shall be updated at least every seven years for each employee requiring authorized unescorted access to the Jobsite.

d. Escort Requirements - Contractor personnel not cleared for authorized access to the Jobsite may be escorted by Government or Contractor personnel that have authorized unescorted access to the Jobsite. All costs related to the escorting of non-cleared personnel shall be at the expense of the Contractor. Additional burden shall not be placed upon the Government to provide these escorts. Prior to access, coordination with the Project Security Officer is required, including but not limited to:

(1) Verification of identity with photo identification

(2) Name of escorting individual and verification of unescorted status

(3) Time of entry into the Jobsite

(4) Time exiting the Jobsite.

All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas. There are NO classified materials at this project location.

1.4.2.3 Pre-Screening

The Contractor must pre-screen Candidates using the E-verify Program (http://www.dhs.gov/E-Verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to ensure the correct information is entered into the E-verify system. An initial list of E-verified Candidates, along with copies of their E-verify Certificates, must be provided to the COR no later than 5 business days after the initial contract award.

1.4.3 Federal Holidays

The following Federal legal holidays are observed by this installation:

1.4.4 Working Hours

The contractor will have access to the job site for work from 0700 to 1700 hrs Monday through Friday, excluding any federally recognized holiday that it is observed on and the contractor shall plan all work accordingly to this work schedule. These hours will be strictly adhered to unless government determines work outside this time is beneficial to the government.

Contractor will be required to coordinate Lock Out - Tag Out procedures with Government Officials and shall provide 48 hours notice of any required clearance.

1.5 VEHICLES

1.5.1 Use of Private Vehicles

Private vehicles of the Contractor and Contractor's employees shall use the gravel parking lot adjacent to work site. The Contractor shall maintain the designated parking areas.

1.5.1.1 Identification of Vehicles

All Contractor's vehicles shall display approved permanent identification of such size and color to allow Government personnel to identify the vehicle.

1.6 UTILITIES

1.6.1 Government Furnished Utilities

All utilities that are required for use in performance of the work under this contract shall be Contractor-furnished except as noted below:

1.6.1.1 Water

All reasonable amounts of non-potable water will be made available from existing outlets. The Contractor will be responsible for freeze proofing all accessed water sources. Full responsibility for care of water shall be borne by the Contractor until completion of work under this contract.

The Contractor shall provide the materials and equipment and perform all work necessary to facilitate construction and to protect the work from damage by water. The Contractor shall make his own investigations and determinations of conditions, both existing and anticipated concerning care of water. Facilities shall be removed upon completion of the work.

1.6.1.2 Electricity

Electric power may be obtained from existing sources located at various locations near the work areas unless otherwise approved:

(1) 120-volt

1.6.1.3 NEMA 4X Enclosure

There is currently 480/277 volt 3 phase power available in the lift station control enclosure, which is located on the same panel mounting structure as shall be used for CP#2. The contractor shall use this source to bring power into a government Provided/Contractor installed enclosure.

The contractor shall install this government provided, 20"x16"x6" stainless steel NEMA 4x enclosure. Within the enclosure, the contractor shall install a quick disconnect along with a breaker for the gate operator and a breaker for the flag illumination lights. The proposed panel can be mounted to the back side of the existing panel mounting board. Any modifications needed on the existing mounting board will need to be furnished by the contractor. At the contractor's option and pending government approval, a new panel board may be installed.

1.6.2 Temporary Utility Connections

All utilities provided by the Government shall be at no cost. Care shall be exercised in conserving all utilities. The contractor shall at his own expense and in a workman like manner satisfactory to the CONTRACTING OFFICER provide all necessary hoses, cords, couplings, plugs, GFI's and other appurtenances as required to connect to the system(s). All temporary connections shall be subject to approval. The location of all power lines and all temporary connections for electricity shall be coordinated with the Government's Representative. All temporary circuits and devices shall be provided, connected, and maintained and removed prior to final acceptance. Ground fault protection shall be provided for all circuits used, inside and outside, and shall be Contractor-furnished.

1.6.3 Use of Sanitation Facilities

1.6.3.1 Portable Toilets

Toilet facilities at the maintenance facility will not be available for Contractor use. Depending on the timing of this project work, a public use restroom may be available near the chapel site at Fort Randall. This restroom gets shut down seasonally for winter and, therefore, its availability is not guaranteed. It will be the Contractor's responsibility to verify this restroom's availability prior to the start of work. In the event that this restroom is not available, the Contractor shall provide and maintain one portable toilet with a portable hand washing facility.

The portable toilet shall be placed at the location directed by the Contracting Officer's Representative. To prevent overturning by high winds, the portable toilet shall be anchored down.

1.7 COOPERATION WITH OTHERS

The Contractor shall cooperate and coordinate his work with that of others as required for orderly completion of all work. In the event of disagreement between the Contractor and others, the decision of the Contracting Officer shall be final.

1.8 CONTRACTOR'S AREA LIGHTING

The Contractor shall provide all lighting necessary to perform his work and to provide a safe work environment.

1.9 GOVERNMENT FURNISHED TOOLS AND EQUIPMENT

Contractor shall provide all tools necessary to perform his work and to provide a safe work environment. Government tools and equipment at the project, i.e., wheel loaders, pumps, generators, hand tools, etc., are not available for use.

1.10 DAMAGED EQUIPMENT OR ABNORMAL CONDITIONS

The Government shall be informed immediately upon finding any damaged equipment or other abnormal conditions involving additional work. The failure or abnormality shall not be disturbed until witnessed by the CONTRACTING OFFICER. Prior to proceeding further with work, the Contractor and the Government shall agree in writing as to the responsibility for the damage or abnormality.

1.11 PROTECTION AND RESTORATION OF EXISTING FACILITIES

The Contractor shall be responsible for the protection of the work area from damage. All existing grounds, property and facilities shall be protected whether or not shown on the drawings. Upon completion of the work, all the existing grounds, property and facilities, not included as a portion of the work, shall be left in a condition equal to the original condition prior to the contract. Costs for repair and restoration of any facilities shall be considered to be incidental to and included in the contract price. All work, storage of materials, and construction plant shall be kept within the limits of the areas assigned. Prior to construction operations, the Contractor shall confer with the Contracting Officer's representative to determine the proximity of any possible obstructions, pipe or equipment which could be damaged as a result of construction operations. Existing utility lines shall be protected from damage, and if damaged, shall be repaired by the Contractor at no additional expense to the Government. In the event that the Contractor damages any existing utility lines report thereof shall be made immediately to the Contracting Officer. The Contractor will be responsible for the protection of structures from any structural damage during the construction operations. At all times the plant and work areas shall be kept in a condition conducive to safety of workmen and the public and neat in appearance. Waste or surplus materials shall not be allowed to accumulate in the construction areas.

1.12 DAILY CLEANUP AND DISPOSAL

All debris resulting from the work, such as waste metalwork, packing cases, scrap lumber, oil and grease, and other debris shall be collected, removed, and disposed of off site at least once per shift. Disposal shall be in accordance with Federal, State and Local regulations. The Government's trash cans, dumpsters, etc. shall not be used. All costs of removing debris shall be incidental to the work, and no separate payment will be made therefore.

1.13 DISPOSAL OF MATERIALS

Title to all materials and equipment to be disposed of, except salvage items and hazardous waste, is vested in the Contractor upon receipt of signed contract and such materials and equipment are designated scrap only as directed. The Government will not be responsible for the condition, loss or damage to such property after notice to proceed. The Contractor may retain these items in usable form and take possession of them providing that there is no subsequent cost or inconvenience to the Government. The Government does not guarantee that these items are complete or in working order, and the Contractor shall assume responsibility for any damages caused by their use immediately upon taking possession of them. Scrap materials shall be removed from the Government's property within 7 days. Scrap shall not be sold on the site.

1.14 FIRE CONTROL

All fire fighting equipment, supplies, and personnel shall be supplied in accordance with EM-385-1-1. Delays due to fire will not be acceptable as the basis of a claim for additional compensation.

1.15 CONTRACTOR'S AGENT, WORK SUPERVISOR, AND PERSONNEL

1.15.1 Contractor's Agent(s)

The Contractor shall give personal attention to the faithful execution and completion of this work and shall be present either in person or by duly authorized representative(s) on the site of the work continually during its progress. The agent shall be fluent in the spoken and written English language. The agent's qualifications and identification shall be provided. The agent shall be fully authorized to act for the Contractor and to receive such orders as may be given for the proper continuance of the work. Written notice to do any work, to alter any work, or to cease work which the Contractor is obligated to do, or concerning any imperfections in work or any material furnished, when given to the agent shall be considered as notice to the Contractor.

1.15.2 Site Supervisor(s)

At least one full-time employee of the Contractor shall be available at the work site anytime other Contractor personnel are working on the site to supervise and direct the work specified herein. The Contractor's Agent and Site Supervisor can be the same person, provided that all qualifications are met. The supervisor(s) shall be fluent in the spoken and written English language. The supervisor shall be technically qualified to supervise the site work and commissioning and all other aspects related to completing this work. The supervisor shall report immediately in writing to the Government any work not in accordance with the manufacturer's recommendations, or any special conditions which may result in an unsatisfactory job. A daily log shall be made of the accomplished work, and shall be submitted at the completion of the contract.

1.15.3 Contractor's General Personnel

All personnel employed by the Contractor shall be fully qualified in their respective fields to render the services necessary.

PRICE AND PAYMENT PROCEDURES

PART 1 GENERAL

1.1 OVERHEAD, PROFIT, BONDING, & INSURANCE

All costs associated with bonding and insurance, as required by this contract shall be included in the cost for mobilization/demobilization.

Costs associated with these items will not be paid for seperately.

The contractor's overhead and profit shall be included as part of each bid item listed below. The Government will not pay any standalone fees in relation to contractor overhead or profit.

1.2 SINGLE JOB PAYMENT ITEMS

Payment items for the work of this contract for which contract job payments will be made are listed in the SCHEDULE and described below.

All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, are included in the listed job item most closely associated with the work involved. The job price and payment made for each item listed constitutes full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, commissioning, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.

1.2.1 Mobilization/Demobilization

1.2.1.1 Payment

Payment will be made for costs associated with mobilization and demobilization, as defined in Special Clause PAYMENT FOR MOBILIZATION AND

DEMOBILIZATION.

1.2.1.2 Unit of Measure

Payment will be made for costs associated with removals. Removals shall include, but not be limited to removals of:

a. 1 cantilevered gate with 2 support posts (including concrete footings)

e. 1 gate operator

f. 1 gate latch post (including concrete footing)

Removals shall also include performing required excavation, backfilling, and other operations incidental to the removals. Contractor shall furnish his own disposal areas, except as specifically allowed for in the plans and the scope of work.

1.2.2.2 Measurement

1.2.3 Install & Maintain Temporary Security Fence

1.2.3.1 Payment

Payment will be made for costs associated with furnishing, transporting, delivering, placing and maintaining temporary security fence in accordance with the project plans and the scope of work for the time needed as required by the contractor. Sand, sandbags, chains, locks, and keys will be incidental to this bid item. Returning temporary fence when the project is completed shall also be incidental to this bid item.

1.2.3.2 Measurement

1.2.4 Install Cantilevered Gate & Latch System

1.2.4.1 Payment

Payment will be made for costs associated with furnishing, transporting, delivering, and installing one cantilevered gate with latching mechanisms, all as specified in specification section 32 31 13. All rollers, rails, safety covers, cables, webbing, turnbuckles, and other items as called for in the specifications shall be incidental to the installation of the gate and latch system. All labor and testing required to fully commission the gate shall be included as part of this bid item.

1.2.5 Electrical Improvements

1.2.5.1 Payment

Payment will be made for all costs associated with furnishing, transporting, delivering, supplying and installing all materials, labor, and equipment as called for in the project plans. All conduit, mounting brackets, fittings, building entries, power cables, signal/data cables, saw cutting and removing existing asphalt, trenching, directional drilling, excavating, backfilling, compacting, asphalt patching, grounding, and construction of concrete footings shall be included in this bid item. Furthermore, the contractor will supply and install all following items including, but not limited to:

a. 2 LED flag pole illumination lights with concrete footings

b. 2 Card Reader Pedestals with concrete footings

c. 4 gate activation card readers

d. 2 gate activation push buttons

e. 1 underground traffic rated junction box with underlying pavers

f. 1 security door controller with validation modules as needed

Also included in this bid item is the installation of a government provided NEMA 4X enclosure with contractor supplied and installed breakers and a disconnect to be installed within the enclosure. The proposed enclosure can be mounted on the front or back of the same panel mounting board used by Fort Randall's lift station enclosure. If the contractor finds it necessary to construct a new mounting board, the cost shall be included as part of this bid item. 277/480V power residing in the existing lift station control enclosure shall be used as the source for 277V/480V power. This bid item shall cover all costs associated with connecting to and bringing power from this existing enclosure.

This bid item shall also include connecting power and/or signal/data cables to the following items including, but not limited to:

a. 2 LED flag pole illumination lights

b. 4 gate activation card readers

c. 2 gate activation push buttons

d. 1 cantilevered gate operator

e. 1 security door controller with validation modules as needed

In addition, this bid item will cover all costs associated with disconnecting power from the existing 25' light pole being planned for removal and will also cover the cost of splicing this cable so as to provide continued power to parking lot lights on the same circuit.

All labor and costs associated with testing and commissioning the proposed equipment shall be included as part of this bid item. While this bid item includes supplying, installing, and running cables between all proposed equipment, this bid item does not cover the cost of patching the new system into the existing Fort Randall Security system. The contractor will be responsible for making all connections to the proposed door controller, except for those connections that enable the controller to communicate with Fort Randall's existing powerhouse security system.

1.3 UNIT PRICE PAYMENT ITEMS

Payment items for the work of this contract on which the contract unit price payments will be made are listed in the SCHEDULE and described below. The unit price and payment made for each item listed constitutes full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for each of the unit price items.

1.3.1 Remove Chain Link Fence

1.3.1.1 Payment

Payment will be made for costs associated with removing chain link fence components including but not limited to line posts, corner posts, webbing, SECTION 01 22 00.00 10 Page 4 grounding components, concrete footings, bracing, rails, tension rods and all other incidental items required to fully remove a section of chain link fence. Removal of chain link fence shall also include performing required excavation, potholing, backfilling, and other operations incidental to such removal. Contractor shall furnish his own disposal areas, except as specifically allowed for in the plans and the scope of work.

1.3.1.2 Measurement

The removal of chain link fence will be paid for by the Linear Foot of fence removed. The quantity of fence to be removed will be as shown on the

BID SCHEDULE.

Building of chain link fence will be paid for by the Linear Foot of fence installed. The quantity of fence to be installed will be as shown on the

This bid item shall also include supplying and installing all activation remotes, safety photo electric beam hardware, hardware mounts, cable, conduit,and any other safety devices or materials incidental to the installation of a gate operator for a powered cantilevered gate.

The installation of the cantilevered gate operator will be paid for per each unit properly installed. The quantity of units to be installed will be as shown on the BID SCHEDULE.

1.3.4 Excavate & Build Reinforced Concrete Foundation

1.3.4.1 Payment

Payment will be made for costs associated with supplying all materials, equipment, and labor to provide for sawcutting and removing existing asphalt, excavating, compacting, furnishing and placing rebar stands and rebar, and furnishing and finishing concrete in accordance with specification section 03 30 00.00 10. All formwork, finishing operations, curing compound, and other miscellaneous items required will be incidental to this bid item. Transportation of all excavated material as required by the plans shall also be incidental to this bid item.

Construction of the reinforced concrete foundation will be paid for per cubic yard (CY) of concrete placed.

SUBMITTAL PROCEDURES

PART 1 GENERAL

1.1 SUMMARY

The Contractor is responsible for total management of his work including approval, scheduling, control, certification of all submittals and compliance with all applicable Buy-American Act and Trade Agreement Act clauses. Compliance with all applicable Buy American Act and Trade Agreement Clauses is to be included in submittal review procedures The Contractor must provide the country of origin on ENG Form 4025 for each item submitted. Submittals that do not conform will be returned to the originator to be corrected. The Submittal Register (ENG Form 4288) will be utilized to log and monitor all submittal activities. No construction or installation activities are to be performed until required approvals of applicable submittals have been made. Check to assure that all materials and/or equipment have been tested, submitted and approved during the preparatory phase of quality control inspections.

The Contracting Officer may request submittals in addition to those specified when deemed necessary to adequately describe the work covered in the respective sections.

Units of weights and measures used on all submittals are to be the same as those used in the contract drawings.

Each submittal is to be complete and in sufficient detail to allow ready determination of compliance with contract requirements.

Contractor's Quality Control (CQC) System Manager shall check and approve all items prior to submittal; and stamp, sign, and date indicating action taken. Proposed deviations from the contract requirements are to be clearly identified. Include within submittals items such as:

Contractor's, manufacturer's, or fabricator's drawings; descriptive literature including (but not limited to) catalog cuts, diagrams, operating charts or curves; test reports; test cylinders; samples; O&M manuals (including parts list); certifications; warranties; and other such required submittals. Submittals requiring Government approval are to be scheduled and made prior to the acquisition of the material or equipment covered thereby.

1.2 DEFINITIONS

1.2.1 Submittal Descriptions (SD)

Submittals requirements are specified in the technical sections.

Submittals are identified by Submittal Description (SD) numbers and titles as follows:

Drawings, diagrams and schedules specifically prepared to illustrate some portion of the work.

Diagrams and instructions from a manufacturer or fabricator for use in producing the product and as aids to the Contractor for integrating the product or system into the project.

Drawings prepared by or for the Contractor to show how multiple systems and interdisciplinary work will be coordinated.

SD-03 Product Data

Catalog cuts, illustrations, schedules, diagrams, performance charts, instructions and brochures illustrating size, physical appearance and other characteristics of materials, systems or equipment for some portion of the work.

Samples of warranty language when the contract requires extended product warranties.

SD-05 Design Data

Design calculations, mix designs, analyses or other data pertaining to a part of work.

SD-06 Test Reports

Report signed by authorized official of testing laboratory that a material, product or system identical to the material, product or system to be provided has been tested in accord with specified requirements. (Testing must have been within three years of date of contract award for the project.)

Report which includes findings of a test required to be performed by the Contractor on an actual portion of the work or prototype prepared for the project before shipment to job site.

Report which includes finding of a test made at the job site or on sample taken from the job site, on portion of work during or after installation.

Investigation reports.

Daily logs and checklists.

Final acceptance test and operational test procedure.

SD-07 Certificates

Statements printed on the manufacturer's letterhead and signed by responsible officials of manufacturer of product, system or material attesting that product, system or material meets specification requirements. Must be dated after award of project contract and clearly name the project.

Document required of Contractor, or of a manufacturer, supplier, installer or Subcontractor through Contractor, the purpose of which is to further quality of orderly progression of a portion of the work by

SECTION 01 33 00 Page 4 documenting procedures, acceptability of methods or personnel qualifications.

E-Verify Certificates.

SD-10 Operation and Maintenance Data

Data that is furnished by the manufacturer, or the system provider, to the equipment operating and maintenance personnel, including manufacturer's help and product line documentation necessary to maintain and install equipment. This data is needed by operating and maintenance personnel for the safe and efficient operation, maintenance and repair of the item.

This data is intended to be incorporated in an operations and maintenance manual or control system.

1.2.2 Approving Authority

Office or designated person authorized to approve submittal.

1.2.3 Work

As used in this section, on- and off-site construction required by contract documents, including labor necessary to produce submittals , except those SD-01 Pre-Construction Submittals noted above , construction, materials, products, equipment, and systems incorporated or to be incorporated in such construction.

1.2.4 Work Plan

Submit no later than 15 days before the preconstruction meeting, the Work Plan. Construction will be permitted to begin only after acceptance of the Work Plan. The Work plan shall include the following:

a. An outline of major tasks associated with the project. Major tasks shall include detailed information regarding work done by any subcontractors being brought on site.

b. An estimate of task duration for the major steps in the project.

c. A detailed description of the means and methods that will be implemented to accomplish each major project task. This description shall include safety practices that will be implemented.

1.2.5 Quality Control (QC) Plan

Submit no later than 15 days before the preconstruction meeting, the Contractor Quality Control (CQC) Plan. Construction will be permitted to begin only after acceptance of the CQC Plan. The CQC plan shall include the following:

a. Contractor shall provide the name, qualifications (in resume format), years of experience, duties, responsibilities, and authorities of each person involved in this project.

b. Contractor shall provide the name of the appointed project superintendent who is responsible for the overall management of the on site work and who will be required to be on site at all times during

SECTION 01 33 00 Page 5 construction. This person shall be a construction person with a minimum of 5 years experience in related work. This person will be responsible for maintaining the project documents on site throughout the duration of the project.

c. Procedures for scheduling, reviewing, certifying, and managing submittals, including those of subcontractors, offsite fabricators, suppliers, and purchasing agents. These procedures must be in accordance with Section 01 33 00 SUBMITTAL PROCEDURES. The contractor shall provide the name of the person who will be responsible for certifying that all submittals and deliverables are in compliance with the contract requirements.

1.2.6 Environmental Protection Plan (EPP)

Environmental protection is the prevention/control of pollution and habitat disruption that may occur to the environment during construction. The control of environmental pollution and damage requires consideration of land, water, and air; biological and cultural resources; and includes management of visual aesthetics; noise; solid, chemical, gaseous, and liquid waste; radiant energy and radioactive material as well as other pollutants.

Minimize environmental pollution and damage that may occur as the result of construction operations. The environmental resources within the project boundaries and those affected outside the limits of permanent work must be protected during the entire duration of this contract. Comply with all applicable environmental Federal, State, and local laws and regulations.

Any delays resulting from failure to comply with environmental laws and regulations will be the Contractor's responsibility.

The Contractor will be responsible for clean up of any fuel, oil, or chemical spills generated by them at any point during the term of this contract. The Contractor will maintain a clean work area and will assume all responsibility for any remediation efforts needed to mitigate adverse impacts they cause to the environment or surrounding habitat. Furthermore, the Contractor will be responsible for the disposal of all waste, including scrap materials and equipment, and sludge removed from the bottom of the wet well. The Contractor shall comply with all applicable environmental Federal, State, and local laws and regulations.

Submit the EPP at least 15 days before the preconstruction meeting. The EPP shall include the following:

a. Provide the Government a list of all SDSs for all hazardous materials that will be brought on site.

b. Provide the name of the person who will be responsible for any environmental issues. This person shall be responsible for any spill cleanup and spill response procedures. This section shall also list the designated person's office phone number, cell phone number, and email address.

c. Provide a brief description of waste management practices, including methods and proposed locations for waste accumulation/storage. Explain procedures for removing waste from site along with the expected amount of time waste will be stored on site once it is removed.

1.2.7 Administrative Submittals

Unless directed otherwise by the Contracting Officer, administrative

SECTION 01 33 00 Page 6 submittals shall be submitted for acceptance via email to Evan Schmitz at evan.j.schmitz@usace.army.mil. Administrative submittals shall be submitted in PDF format.

In addition to the required preconstruction submittals (as shown on the submittal register) this contract will require the submission of the following Administrative Submittals:

Certificates of insurance

Surety bonds

List of proposed Subcontractors

Submittal register

Work plan

Quality Control(QC) plan

Environmental protection plan

Accident Prevention Plan (APP) as specified in 01 35 26

The process for submitting Administrative Submittals is specified in part 1.2.7 below.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only and will be labled "FIO". When a "PO" designation follows the "G" designation, the Project Office at Fort Randall will review the submittal for the Government. Submit the following in accordance with this section.

Administrative Submittals (see 01 33 00 - 1.2.7)

1.4 ELECTRONIC SUBMITTALS

Electronic format will be utilized for submission of construction submittal items required by the specifications, including ENG Form 4025 Transmittal Form, with exceptions noted below.

1.4.1 File Format

Electronic submittals may be submitted by any means readily accessible to the Government including, but not limited to, the following:

a. E-mails with text and all attachments less than or equal to 14MB in size. The Government IT system does not currently support e-mail transmissions of greater than 14MB. Should this e-mail transmission size limitation change during the course of the Contract, larger e-mail transmissions may become acceptable, but no time extensions will be granted for transmission errors resulting from oversized email attachments.

b. Mailed CD-ROM or DVD-ROM media (to be used only if submittal size

SECTION 01 33 00 Page 7 exceeds email size allowance).

Means of transfer must provide documents freely accessible to the Government. If the means of transfer is by e-mail,files shall be capable of being downloaded without errors or disruption. Regardless of the method of transfer, the files shall be able to be archived on Government IT systems without error or restriction.

Once provided, all submittal documents shall become Government property.

ZIP-file or similar archives requiring a password for access to the archive are permissible provided the password for the archive is static, permanent, not use-limited, and provided to the Government at the time of transmission. Any individual files provided electronically to the Government in 'SECURED' format, password-protected, or utilizing any other such method of file restriction shall be deemed defective and returned to the Contractor for correction. Regardless of errors encountered during the electronic submittal process the Contractor shall be responsible for delays resulting from the inadequacy of media delivery method, file-formatting, or file restriction issues. No time extensions will be granted for delays resulting from improper file formatting, file restrictions, or inadequate file transfer methods.

Discussion and decisions on a consistent Means of transfer throughout the duration of the project will be made at the pre-construction conference.

The format of electronic submittals is Adobe Acrobat Portable Document Format (PDF), compatible with Adobe XI Pro, unless agreed to and directed otherwise by the Contracting Officer's Representative.

1.4.2 Digital File Naming

Label and name electronic files delivered to the Government in a manner that is logical and consistent throughout the duration of the project. A file naming convention that clearly indicates the transmittal number, component of submittal, and revision number associated with the submittal will be discussed and confirmed at the pre-construction kickoff conference.

1.4.3 Content

Submit one (1) set of readily copied and legible electronic documents and associated matching ENG Form 4025 Transmittal Form. Duplicate copies of electronic submittals are not desired. Content and format of the electronic submittal shall conform to all requirements listed herein.
