Evaluation – Commercial Items, IAW FAR 52.212-2:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation and will be most advantageous to the Government, price and other factors considered.

Factors A and B are of equal importance. The remaining factors are listed in descending order of importance with

Factors A and B being significantly more important than factor C.

Notwithstanding any other provisions of these specifications concerning the method of award, the best value trade-off process will be used in this acquisition with award made, as a whole, to the offeror whose quote conforms to the solicitation and has been evaluated as most advantageous to the Government with appropriate consideration given to the evaluation factors: Personnel, Quality Control Plan, Experience, Equipment, Safety

Program, and Past Performance. Offerors will be cautioned that the award may not necessarily be made to the lowest price offered.

All non-priced factors, when combined, are more important than price. Thus, price is not expected to be the controlling factor in the selection of the Contractor for this solicitation. However, as the evaluated merit of competing technical offers becomes more equal, total price and other price factors will become more important in the selection. Total price and other price factors could become the deciding factor for selection, depending upon whether the most acceptable technical offer is determined to be worth the cost differential, if any.

The evaluation approach for all technical factors is as follows: The offer will be evaluated to determine the extent to which each requirement has been addressed in accordance with the terms and conditions listed in this solicitation.

Factor A – Experience:

Provide experience with relevant projects, current or completed for at least the past five years. At a minimum, the following information should be addressed:

Provide detailed information on prior experience of fabricating patterns/forms for complex castings. Provide detailed evidence of pouring castings of similar size and complexity of the work required in the attached Statement of Work, that includes a list of relevant projects within the past five (5) years that best demonstrate your experience with this type of work. Include dates, location, types of contracts, dollar values, a description of work and references.

Demonstrate the ability to perform or obtain certified Non-Destructive Testing.

Factor B - Past Performance:

Information on performance on recent and/or relevant performance within the past five years including names and phone numbers of references and type of work performed. Also, provide this information on any proposed subcontractors. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned an

“unknown confidence rating” and their quote will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the offeror and data obtained from other sources, including past performance information retrieval system (PPIRS) and data in Government files or and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services. Past

Performance will be evaluated for relevancy of similar service/support, complexity, dollar value, contract type and degree of subcontracting/teaming (very relevant, relevant, somewhat relevant, not relevant) and confidence

(substantial, satisfactory, limited or no confidence). An unknown confidence rating will be given if the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its quote for Past Performance. STATEMENT OF WORK

SLUICE GATES FOR JOHN W. FLANNAGAN DAM & RESERVOIR

HAYSI, VA

SCOPE. These specifications cover all work required to fabricate, paint and coat, test and deliver new sluice gates for John W. Flannagan Dam. The Contractor shall be regularly engaged in the manufacturing castings of equal or larger size. The Contracting Officer or their designated representative shall check this while completing the responsibility determination of the Contractor. The contract shall be for two (2) gates with removable bottom sections and two (2) gates with non-removable bottom sections.

GENERAL. This contract is for the supply of sluice gates only. The installation of the new gates and the removal of the existing gates will be performed by the Government.

Submittals

Government approval is required for submittals with a “G” designation; submittals not having a “G” designation are for Contractor Quality Control approval. Contractor submittals shall be in accordance with the specifications and as herein specified.

Work Experience / Past Projects

Submit examples of past projects that are of similar complexity and size at time of quote.

Shop Drawings

Submit detail drawings for metalwork and machine work, prior to fabrication, include within the detail drawings catalog cuts, templates, fabrication and assembly details and type, grade and class of material as appropriate.

Indicate methods of protecting the work during shipping, storage, field assembly, and installation.

Design Computations

Submit Design Computations prior to fabrication. The computations should be submitted with the shop drawings and should be of sufficient detail to show that the 212ft head requirement is met.

Provide Results of all NDT Results to the Government for approval.

Casting Repair Plan

Provide Casting Repair Plan for Approval prior to making actual repairs. Minor imperfections as defined in the specifications may be repaired without a formal plan.

PRODUCTS

Gates.

The existing gates were manufactured by Filer and Stowe of Milwaukee Wisconsin. The nominal dimensions of the gates are 5’ Wide x 9’ High and were rated for an operating head of 212 ft of water. The gates were fabricated of a

Cast Steel in accordance with Federal Specification QQ-S-681b and were a Class 2, medium material having a minimum yield strength of 35 KSI and a minimum Ultimate Tensile Strength of 65 KSI.

The new gates are be fabricated of Cast Steel (ASTM A148) Grade 80-40 or approved equal. The gate shall be designed for an operating head of 212 ft of water with a minimum Factor of Safety of 5.0 against yielding of the steel at the rated head. The material of fabrication, Design Computations, and Shop Drawings shall be submitted for approval prior to gate fabrication.

Each casting shall bear cast or stamped mark and stamped heat numbers. Dimensions of castings shown on approved shop drawings shall be finished dimensions. Castings that are warped or otherwise distorted, or that are oversized to an extent that will interfere with proper fit with other parts of the machinery or structure, will be rejected. The structure of metal in castings shall be homogeneous and free from excessive nonmetallic inclusions. Excessive concentration of impurities or alloys at critical points in castings will be cause for rejection. Repairs to castings shall not be made prior to approval. Minor surface imperfections not affecting the strength of casting may be welded in the "green" if approved. Surface imperfections shall be considered minor when the depth of the cavity prepared for welding is the lesser of 20 percent of the actual wall thickness or 1 inch. Defects other than minor surface imperfections may be welded only when specifically authorized in accordance with the following requirements:

a. The defects have been entirely removed and are judged not to affect the strength, use or machinability of the castings when properly welded and stress relieved.

b. A proposed repair plan, consisting of welding procedure, stress relieving procedure and re-examination procedure for the repair work have been submitted and approved by the Contracting Officer or his authorized representative.

The new gates must fit into the existing gate frames which are currently installed at the project. The frames are embedded in concrete at the bottom of the dam and are not being replaced. The gates shall be fabricated to the dimensions shown on the contract drawings, which are a duplication of the original contract drawings. The original contract drawings have also been included for reference.

The Contractor shall also supply horizontal and vertical leaf seats per the contract drawings. The seats are to be attached to the gate leaf using bronze caps screws per the contract drawings. The seats shall be fully installed to the gate leaf with the cap screw heads ground smooth, as indicated on the drawings, prior to shipment.

Removable Gate Bottom.

The gate shall be provided with a removable bottom as indicated on the drawings.

Gate Patterns.

Take care to avoid sharp corners or abrupt changes in cross section; ample fillets are to be used in the construction of patterns. Add, as required, draft and increases in pattern thicknesses to conform to the standard foundry practice applied and as necessary to ensure that all metal thicknesses of the finished castings conform to the dimensions shown and are within the tolerances specified in paragraph “Inspection of Steel Castings”. All patterns will become the property of the Government.

MATERIALS.

Materials shall be as specified. Materials not specified shall be the manufacturer’s standard for the application. The materials of construction for all replaced parts shall be new, manufactured within the time period not exceeding one year prior to delivery, and of kind, composition, and physical properties best adapted to its several purposes in accordance with best engineering practice. All materials and equipment proposed for use in the work shall be identified on the Contractor’s shop drawings or specifications and shall be subject to approval of the Contracting

Officer. The Contractor shall submit evidence satisfactory to the Contracting Officer that such material conforms to the requirements of the specifications.

Protection of Materials and Equipment. The Contractor shall be responsible for the proper handling, maintenance, storage and protection of all materials until delivered and accepted at the location shown in “Deliveries or

Performance.”

Quality Control The Contractor shall establish and maintain a quality control system to assure compliance herein and shall maintain records of his quality control of all operations covered by these specifications. Quality control records shall be made available to the Contracting Officer upon request.

Metalwork Fabrication, Machine Work, and Miscellaneous Provisions

Scope. This paragraph specifies the workmanship standards applicable to the various phases of metalwork fabrication, the general requirements for tests to insure conformance with the specifications, and miscellaneous requirements incident to the work.

QUALITY ASSURANCE

Tests of Materials. The Contractor shall, at his expense, perform analyses and tests to demonstrate that all materials are in conformity with the specifications. Should the Contractor desire to use stock materials not manufactured specifically for the work covered by these specifications, he shall submit evidence, satisfactory to the Contracting

Officer that such materials conform to the requirements of the specifications. Detailed tests of these materials may not be required, if so approved by the Contracting Officer. Tests, except where modified, shall be made as indicated in the respective detailed specifications or on the drawings and, unless otherwise authorized, in the presence of the

Contracting Officer. Certified reports in triplicate of all required analyses and tests shall be provided to the

Contracting Officer. The Contractor shall furnish the Contracting Officer, upon request, specimens and samples for independent analyses and tests. These specimens and samples shall be properly labeled and prepared for shipment.

Reports of Material. The Contractor shall furnish the Contracting Officer two certificates; one shall be a list from the fabricator's shop showing what contract items are to be made from the material ordered from the mill, and the other shall be a list from the mill stating, for each article (sheet, plate, bar, shape, etc.) to be supplied to the fabricator, the heat number and the chemical and physical properties of the metal from which the article is to be made.

Inspection of Steel Castings

All Gate Leaf castings shall be inspected by the Contractor. Immediately prior to inspection, the casting surfaces shall be grit-blasted to white metal, conforming to SSPC SP 5. All steel castings shall conform to the requirements of ASTM A148 & ASTM A 781 and the supplemental requirements contained in Paragraphs S1. "Other surface discontinuities" as mentioned in ASTM A 781 781 shall meet the visual acceptance standards of ASTM A 802/A

802M, level II. The extent of the magnetic particle examination of supplementary requirement S1 shall be as indicated on the drawings, and the basis of acceptance shall be in accordance with ASTM A903 Acceptance Quality

Level III. Additional Radiographic and Ultrasonic testing shall be performed to the extent indicated on the drawings. Ultrasonic inspection shall be in accordance with ASTM A 609/A 609M to acceptance quality level 3.

Radiographic Examination shall be in accordance with ASTM E 94 and ASTM E446, ASTM E 186, or ASTM E

280 as appropriate. All inspection reports shall be submitted to the Government for Approval. Any defect or non-permissible indication discovered as a result of these inspections in accordance with the stated acceptance criteria shall be cause for rejection. Any casting rejected shall be replaced at the Contractor's expense, or at the Contractor's expense repaired (the repair of steel castings shall meet criteria of ASTM A 488/A 488M and retested to the satisfaction of the Contracting Officer or his authorized representative. The Contractor shall perform radiographic inspection of steel castings as designated and as described in the section of these specifications covering the particular item of work. The procedure for making, evaluating and reporting the radiographic inspection shall conform to the requirements of ASTM E 94. The castings shall be unacceptable if shown to have defects of greater severity than the applicable reference standard specified in the following table:

Perform the nondestructive examination of casting and the evaluation of examination tests as to the acceptability of the casting by a testing agency adequately equipped and competent to perform such services or by the Contractor using suitable equipment and qualified personnel. In either case written approval of the examination procedures is required and the examination tests must be made in the presence of a Government Representative as designated by the Contracting Officer. The evaluation of examination tests are subject to the approval of, and all records become the property of, the Government. Only individuals qualified for NDT Level II or Level III may perform nondestructive testing. The Level III NDT inspector who supervises all NDT must possess a currently valid

American Society for Nondestructive Testing (ASNT) Level III certificate for each of the processes for which they are qualified. Include copies of the NDT inspector certifications, including the ASNT certificate of Level III NDT

Technician that certified the Level II Technicians in the submittals.

Repair of Steel Castings

A casting repair plan shall be submitted to the Contracting Officer or his authorized representative for approval before repairs are made. The unsound area(s) containing the discontinuities shall be removed by chipping, machining, air-arc gouging, or grinding. Welding of defects shall be in accordance with paragraph WELDING OF

STEEL CASTINGS. Approval by the Government to repair the defects will not relieve the Contractor of the responsibility for the integrity of the casting and its performance within the structural unit.

Qualify and certify Certified Weld Inspectors (CWI) in accordance with the provisions of AWS QC1 and the CWI must be familiar with AWS D1.5M/D1.5 fracture critical member inspection as required in AWS D1.5M/D1.5

AASHTO/AWS Fracture Control Plan (FCP) for Non-redundant Members Clause. The laboratory and all personnel performing nondestructive testing must be qualified as specified.

SPECIAL TESTING REQUIREMENT

Additional Nondestructive Testing. When doubt exists as to the soundness of any material part, such part may be subjected to any form of nondestructive testing as determined by the Contracting Officer. The Government may choose to hire a third party inspector to perform verification of this work. The Government's third party inspection will occur at various times throughout the duration of fabrication. The Contractor will be advised that third party inspection must be coordinated with the Contracting Officer, and the Contractor for all verification inspections selected by the Government.

This may include ultrasonic, magnaflux, dye penetrant, x-ray, gamma ray or any other test that will thoroughly investigate the part in question. The cost of such investigation will be borne by the Government. Any defects impairing the performance or proper functioning of the operating machinery will be cause for rejection and the rejected part shall be replaced and retested at the Contractor's expense

Tests. Waiving of tests, however, will not relieve the Contractor of responsibility for any fault in operation, workmanship, or material that may develop before the completion of his contract.

WORKMANSHIP

General.

Material must be straight before being laid off or worked. Perform straightening, if necessary, by methods that will not impair the metal. Sharp kinks or bends will be cause for rejection of the material. Material with welds will not be accepted except where welding is definitely specified, indicated or otherwise approved. Make bends using approved dies, press brakes or bending rolls. Where heating is required, take precautions to avoid overheating the metal and allow it to cool in a manner that will not impair the original properties of the metal. Proposed flame cutting of material, other than structural steel, is subject to approval and must be indicated on detail drawings.

Shearing shall be accurate and all portions of the work neatly finished. Make corners square and true unless otherwise shown. Fillet re-entrant cuts to a minimum radius of 3/4 inch unless otherwise approved. Provide finished members free of twists, bends and open joints. Tighten bolts, nuts and screws.

Dimensional Tolerances.

Measure dimensions using an approved calibrated steel tape of approximately the same temperature as the material being measured. The overall dimensions of an assembled structural unit must be within the tolerances indicated on the drawings or as specified in the particular section of these specifications for the item of work. Where tolerances are not specified in other sections of these specifications or shown, an allowable variation of 1/32 inch is permissible in the overall length of component members with both ends milled; component members without milled ends must not deviate from the dimensions shown by more than 1/16 inch.

Welding of Steel Castings

Remove unsound material from the surfaces of steel castings, to be incorporated into welded connections, by chipping, machining, air-arc gouging or grinding. Do not weld major connections designed for transfer of stresses if the temperature of the casting is lower than 100 degrees F. Preheat castings containing over 0.35 percent carbon or over 0.75 percent manganese to a temperature not to exceed 450 degrees F and conduct welding while the castings are maintained at a temperature above350 degrees F. Welding will not be permitted on castings containing carbon in excess of 0.45 percent except on written authorization. Castings requiring welding repairs after the first annealing and castings involving welding fabrication must be stress-relieved annealed prior to receiving final machining unless otherwise permitted.

MACHINE WORK

General. Unless otherwise shown on the drawings, all tolerances, allowances, and gages for metal fits between plain, non-threaded, cylindrical parts shall conform to ASME B4.l for "Preferred Limits and Fits for Cylindrical

Parts" for the class of fit as shown or otherwise required. Where fits are not shown they shall be suitable as determined by the Contracting Officer. Tolerances for machine-finished surfaces designated by non-decimal dimensions shall be within 1/64 inch. Sufficient machining stock shall be allowed to insure true surfaces of solid material. Finished contact or bearing surfaces shall be true and exact to secure full contact.

Finished Surfaces

Where surface finishes are indicated on the drawings or specified herein the symbols used or finishes specified shall be in accordance with ASME B46.1 for "Surface Texture (Surface Roughness, Waviness, and Lay)". Values of roughness height specified are specified in micro-inches as "Arithmetical Average Deviation from the Mean

Surface". Roughness specified is the maximum value and any lesser degree will be satisfactory. Compliance with specified surface shall be determined by sense of feel and by visual inspection of the work compared to Standard

Roughness of Specimens, in accordance with the provisions of ASME B46.1. Values of roughness width and waviness height are not specified, but shall be consistent with the general type of finish specified by roughness height. Flaws such as scratches, ridges, holes, peaks, cracks or checks which will make the part unsuitable for the intended use will be cause for rejection.

Where the finish is not indicated or specified, the type of finish shall be the type which is most suitable for the surface to which it is applied and shall be consistent with the class of fit required. Surfaces to be machine finished shall be indicated on the shop drawings by symbols which conform to ASME B46.1.

Unfinished Surfaces. So far as practicable, all work shall be laid out to secure proper matching of adjoining unfinished surfaces. Where there is a large discrepancy between adjoining unfinished surfaces, they shall be chipped and ground smooth, or machined, to secure proper alignment. Unfinished surfaces shall be true to the lines and dimensions shown on the drawings and shall be chipped or ground free of all projections and rough spots.

Depressions or holes not affecting the strength or usefulness of the parts may be filled in a manner approved by the

Protection of Finished Machined Surfaces.

Finished surfaces shall be thoroughly cleaned of foreign matter. Finished surfaces of large parts and other surfaces shall be protected with wooden pads or other suitable means.

Exposed machine finished surfaces shall be thoroughly cleaned of foreign matter. All unpainted machine finished surfaces shall be protected by a suitable rust inhibitor satisfactory to the Contracting Officer, for shipping and storage protection equal to E.F. Houghton’s Rust Veto 344. Finished surfaces of ferrous metals, which will be exposed after assembly, except as noted, shall be painted as specified in Section 09 97 02.

List of Materials. The Contractor shall furnish the Contracting Officer electronic copies of all purchase orders, mill orders, shop orders for materials, and work orders. Where mill tests are required, the purchase orders shall contain the test site address and the number of the testing agency.

Shop Inspection. The Government Representative shall inspect the gates during fabrication to determine compliance with these specifications in accordance with the section titled “Inspection and Acceptance”.

Painting. The gates shall be painted using an Impacted Immersion Coating System, Formula V-766e, in accordance with Section titled “Hydraulic Structures” of these specifications.

Quality Control. The Contractor shall establish and maintain a quality control system to assure compliance with the contract requirements and shall maintain records of his quality control of all operations covered by these specifications. Quality control records shall be made available to the Contracting Officer upon request at the

Contractor’s facility and shall remain in possession of the Contractor.

Field Installation

The new gates shall be installed at the Project Site by the Government.

Warranty. The gates shall be warranted for a period of two (2) years from the date of acceptance against any defect or failure. Upon receipt of notice from the Government of failure of any part of the warranted equipment during the warranty period, the affected part or parts shall be replaced promptly with new parts by and at the expense of the

Contractor. The Contractor shall acknowledge his responsibility under these warranty provisions by letter (written warranty) stating that the gates are warranted and the inclusive dates of the warranty periods, and stating that, upon receipt of notice from the Government of failure of any part of the warranted equipment during the warranty period, the affected part or parts will be replaced promptly with new parts by and at the expense of the Contractor.

Changes in Specification and Drawing. The right is reserved as the interest of the Government may require, to revise or amend the specifications and/or drawings prior to the date set for contract award. Such revisions and amendments, if any, will be announced by amendment(s) to this solicitation. Copies of such amendments will be posted to www.fbo.gov .

Payment. The contract price will include two (2) One for 2 gates with removable bottoms and one for two gates with non-removable bottoms, painting, delivery and all other costs in connection with that particular line item as described herein.

INSPECTION AND ACCEPTANCE

INSPECTION

The work will be conducted under the general direction of the Contracting Officer and is subject to inspection by Government inspectors to insure strict compliance with the terms of the contract. Materials furnished under these provisions shall be subject to inspection during and after the process of manufacture at the place of manufacture by authorized Government inspectors who shall be afforded proper facilities for determining compliance with these specifications. Any part of the equipment not in compliance with these specifications will be rejected and the Contractor shall promptly remedy or replace the defective part or parts to the satisfaction of the Contracting Officer, without cost to the Government. All final shop assemblies required to be performed will be witnessed by a Government appointed inspector. The Contractor shall keep the Contracting Officer informed as to the general progress of the work and shall notify the Contracting Officer in writing, fourteen (14) calendar days prior to the time when the equipment is ready for final assembly and testing. Electronic copies, in

.PDF format, of all transmittals are to be sent to the Huntington District, Corps of Engineers. The Point of

Contact will be provided once Contract has been awarded. When reporting an actual or potential delinquency, the Contractor-prepared DD Form 375c shall, as a minimum contain the following: (1) The problem - a statement of the difficulty, the reasons therefore, and whether caused by the Government or the Contractor, (2)

Items and quantities affected, (3) Date of commencement of the anticipated or actual delinquency, (4) Action taken by the Contractor to overcome the anticipated or actual delinquency, (5) Estimated recovery date based upon evaluation of the factors contributing to the delinquency, (6) A realistic schedule revision which can be met by the Contractor. No inspector is authorized to change any provision of the specifications without written authorization of the Contracting Officer, nor shall the presence or absence of an inspector relieve the Contractor from any requirements of the contract. The Contractor shall within thirty (30) calendar days after date of award, submit for approval of the Contracting Officer a description of this proposed inspection system. The equipment will be inspected for conformance with the specifications prior to loading for shipment.

FINAL EXAMINATION AND ACCEPTANCE

The equipment will be inspected and the Contractor shall demonstrate that the equipment meets the contract specifications. Any failure to comply with the contract requirements or damage shall be remedied by the

Contractor at no additional cost to the Government. Upon completion of satisfactory inspection, demonstration of compliance with the contract specifications, and delivery to the Project, the equipment will be accepted on behalf of the Government.

The drawings and specifications will be furnished to the Contractor in PDF format without charge. At the request of the Contractor, four hard copy sets of half scale drawings and specifications will be furnished to the Contractor without charge, except applicable publications incorporated into the Technical Provisions by reference. Additional sets will be furnished on request at the cost of reproduction. For all modifications, the Contractor will be furnished prints of appropriate scale in electronic, PDF, format. The work shall conform to the following contract drawings, which form a part of these specifications and are available in the Office of the District Engineer, Department of the

Army, Huntington District, Corps of Engineers, 502 Eighth Street, Huntington, West Virginia 25701.

SUBMITTAL CONTROL DOCUMENT

Within ten (10) calendar days after receipt of notice to proceed, the Contractor shall complete and submit to the

Contracting Officer, in duplicate, SUBMITTAL REGISTER, ENG Form 4288, listing all submittals and dates. In addition to those items listed on ENG Form 4288, the Contractor will furnish submittals for any deviation from the plans or specifications. The scheduled need dates must be recorded on the document for each item for control purposes. In preparing the document, adequate time (minimum of thirty (30) calendar days) will be allowed for review and approval and possible resubmittal. Scheduling shall be coordinated with the approved progress schedule.

The Contractor's Quality Control representative shall review the listing at least every thirty (30) calendar days and take appropriate action to maintain an effective system. Copies of updated or corrected listing shall be submitted to the Contracting Officer at least every sixty (60) calendar days in the quantity specified. Payment will not be made for any material or equipment which does not comply with contract requirements.

Attached at the end of these Special Provisions is the submittal listing, in tabular form, of technical items the

Contractor shall submit to the Contracting Officer, as indicated in the various sections of these specifications. The submittal listing may not be complete and additional items may be required as determined by the Contracting

Officer.

TRANSMITTAL OF SHOP DRAWINGS, EQUIPMENT DATA, MATERIAL SAMPLES, OR

MANUFACTURER'S CERTIFICATES OF COMPLIANCE ENG 4025, is attached at the end of these Special

Provisions.

CERTIFICATES OF COMPLIANCE (1969 MAY OCE)

In addition to the certificates of compliance that may be required by the Technical Provisions of these specifications, certificates for demonstrating proof of compliance of materials with specifications requuirements shall be furnished for all other material. Each certificate shall be signed by an offical authorized to certify on behalf of the manufacturing company and shall contain the name and address of the Contractor, the project name and location, and the quantity and date or dates of shipment or delivery to which the certificates apply. Copies of laboratory test reports submitted with certificates shall contain the name and address of the testing laboratory and the date or dates of the tests to which the report applies. Certification shall n ot be construed as relieving the Contractor from furnishing satisfactory material, if, after tests are performed on specific samples, the materal is found not to meet the specific requirements.

FINAL PLANS

Before final payment is made, the Contractor shall furnish the Contracting Officer all approved submittals on a compact disk in Portable Document Format (PDF). The documents from which the PDF files are made shall be complete for reference purposes to effect repairs and shall contain a full and accurate repair parts list. All parts shown shall be referenced and numbered in order to facilitate identification of the various parts. Each drawing from which the files are made shall have a title in the lower right hand corner containing the name of the Contractor, title of drawing and the date. The files shall be legible when printed at their original full size.

52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (JUN 2016)

(a) Definitions. As used in this clause--

Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public Web sites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on

National Security Systems Instruction (CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices

(including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other

Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order

13556.
