SECTION C.1
General
C.1.1. BACKGROUND. Pound River Campground is located off Rt. 754 in Clintwood, Virginia. This area is a remote Class-A Campground which typically receives 70-90% occupancy rates. Camping opportunities include 23 campsites with electrical hook-ups. There is an additional 5 tent camping sites with no electrical hook-ups. In addition, a campsite at the front of the campground is set aside for the Park Attendant. That site includes electrical and water hook-ups and a sewage holding tank. All sites are lake front, boat-in sites with tie-ups to allow campers to dock their boats at their campsite. The campground has a bath-house with showers, a launch ramp available only to campers, playground, central water station and dump station. Facilities are ADA accessible. An emergency telephone is available at the gate house at the campground entrance.
Lower Twin Campground is located off Rt. 611 near Haysi, Va. This area is a remote Class-A Campground which typically receives 60-75% occupancy rates. This campground contains 27 campsites that offer electricity hook-ups, 7 of which are tent camping sites. There is a site set aside at the entrance of the campground for the Gate Attendant. This site offers electrical and water hook-ups and a sewage holding tank. A bath-house with showers is located in the campground as well as a playground. Facilities are ADA accessible. A telephone is located in the Gatehouse for the Gate Attendant to use.
Cranesnest Campground is located off Rt. 83 in Clintwood, Virginia. This area is a remote Class-A Campground which typically receives 60-75% occupancy rates. This campground contains 2 camping areas. Area 1 includes 16 campsites with electrical hook-ups and 4 sites with no hook-ups, 3 of which are tent sites. This area has a bath-house with showers, a water station, dump station, and playground. This area also has an additional site set aside for the Park Attendant that includes electrical and water hook-ups and a sewage holding tank. Area 2 is located approximately ½ mile from Area 1 and includes 12 campsites. Area 2 campers share the facilities at the Area 1 campground. The two campgrounds are located along a 3 mile graveled road which runs along the Cranesnest River.
Trout are stocked along the first section of the river and many fishermen frequent the roadway. Near the end of the road is a launch ramp open to the public. No telephone is available in this area. The Gate House is located at the entrance of Area 1 near the Park Attendant campsite. Facilities are ADA accessible.
C.1.2. SCOPE OF WORK. The Contractor shall furnish all necessary management, supervision, personnel, materials, supplies, fuel, and vehicles, except as otherwise provided herein, required to perform Park Attendant Services at the Pound River, Lower Twin and Cranesnest Campgrounds at John W. Flannagan Dam & Reservoir, as specified and in strict accordance with all terms, conditions, general, specific and technical provisions, drawings, attachments, exhibits, etc., contained herein. Contractor shall perform all related Contractor administrative services necessary to perform the work such as procurement, quality control, Contractor financial control, and maintenance of accurate and complete records and files.
The Contractor/Park Attendant shall be available to serve as live-in Contract Park Attendant. The attendant shall reside in a privately owned, self-contained camper or camping motor home and live in the park during their work assignment. Camping trailers or motor homes shall be approved in advance by the Park Manager. Pick-up campers, tents, home-built campers, such as restored buses or mobile homes shall not be used. Assignments include collection of user fees, logging reservations in computer system, posting reservations, making a status board of occupied sites and a register of visitors, furnishing visitor information and brochures, distributing customer comment cards, and assuring proper use of park facilities. All attendants will receive a thorough orientation of Corps regulations, operating procedures and fee collecting instructions and shall be responsible for performing the work in accordance with applicable regulations, procedures, and instructions.
Price Quotes are being accepted with the anticipated actual work days beginning and ending dates to be as follows:
- Base Period: 17 May 19 to 03 September 2019
- Option Period 1: 22 May 20 to 08 September 2020
- Option Period 2: 11 May 21 to 07 September 2021
Offers shall be made on a per day basis. The numbers of days are estimated and are not guaranteed. (For example, if the campround is closed due to flooding.)
a. Contract Park Attendants shall wear shirts with the words “Park Attendant” across the back shoulders. The front shall have the contractor’s name with the word “CONTRACTOR” under the name written in small letters on the left chest area. The contractor will be required to wear this shirt during times he/she is on duty. The contractor will be responsible for providing the shirts. The Contractor shall wear pants (or shorts) and ensure that shirts are in good condition, be kept clean and presentable at all times. Cut-off tee shirts or cut-off shorts will not be permitted. Shorts must be at least knee-length. Personal cleanliness and presentable appearance are required of all contract personnel when dealing with the public. Closed toe, comfortable shoes (not including high heels) shall be worn at all times.
The Contractor will be furnished all keys for necessary access to areas and buildings. There shall be no duplication of the keys by the Contractor. Key security shall be the Contractor's responsibility. Failure to provide adequate key security will result in a deduction from the payment due the Contractor in the amount of the current cost to replace lost or damaged keys and replacing any affected locks, plus the installation labor costs of a WG-9 Federal employee.
No unauthorized persons(s) shall be permitted inside the gate house. Authorized persons include Park Attendants, Law Enforcement Officers, and Corps employees who are on duty and have business inside the gate house. The Attendants shall secure and lock the gate house when it is unattended. Any money left in the gate house shall be properly secured when the gate house is unattended.
Government telephone lines are to be used primarily for authorized purposes only. Government telephone lines shall not be used for Internet access with personal computers. Personal phone calls made by the Attendant shall be kept to a minimum. Any long distance phone calls need to be approved by the Contracting Officer Representative (COR) prior to the call. Unauthorized long distance charges will be deducted from payments due the Contractor, or shall be paid by the Contractor, as determined by the COR. Only in emergency situations, members of the public may be allowed to use the gate house telephone.
House pets may be permitted with the approval of the COR. Pets shall be controlled as outlined in Title 36, CFR. Pets shall be under physical restraint or on a leash not to exceed six feet while not in the Park Attendants’ camper. Pets will not be allowed in the gate house at any time. No facilities for housing or raising pets will be permitted. Dog pens, horse corrals, poultry cages, or similar facilities for pets or rearing of animals are prohibited.
Children and/or adults visiting the Park Attendants shall not be allowed inside or around the gate house, nor shall they engage in any action causing distraction to those conducting business at the gate house.
The Park Attendant shall keep the gate house and a 100-foot radius clean, to include sweeping, cleaning windows, and keeping equipment clean. The outside of the building shall be kept clean and free from spider webs. The Park Attendant shall also maintain a clean and presentable campsite. The Contractor shall obtain prior approval from the COR before erecting any sign or barricade, or altering any facility. Any personal equipment shall have prior approval of the COR.
Smoking or other use of tobacco products in the gate house is strictly prohibited. Smoking or use of other tobacco products is prohibited during on duty hours. Smoking is not permitted inside any facility building on Government property.
The Contractor will be audited weekly or as deemed necessary by the COR. The Contractor shall guarantee payment to the Government, of all funds received. Random inspections will be conducted by the government according to the Quality Assurance Control Plan (QASP).
The Contractor shall be responsible for providing any additional personnel on peak visitation weekends, holidays, and in case of illness or emergency which causes the absence of the primary attendant, to maintain adequate uninterrupted service to the public. All contractor personnel must be at least 18 years of age.
The Contractor shall provide Park Attendant services twenty-four hours per day, seven (7) days a week for the contract period.
The Contractor shall cooperate with Corps of Engineers employees who are on duty and employees of those who have contracts with the Corps of Engineers.
The Contractor shall collect all designated fees, maintain records, transmit funds, distribute literature, greet visitors, distribute customer comment cards, check out recreation equipment such as life vests, and encourage compliance with regulations. Cash and checks shall be accepted. The Contract Park Attendant shall not inter-mix Government fees collected with personal funds.
The Contractor shall be required to open a new checking account in which to deposit Government funds as acquired and write a check to the government in the same amount. Personal funds are not to be submitted on this account. Bank statements shall be provided upon request.
No funds may be kept overnight in the gate house cash drawer. Final payment will not be made to the Contractor until all funds and permits are reconciled. Shortages of funds which are due to Contractor’s negligence or actions not in accordance with procedures may be deducted from the Contractor's final payment.
Tact, diplomacy and courtesy shall be exercised at all times in dealing with the general public (the Corps’ customers), including visitors and sightseers. During the hours the gate house is open, the Park Attendants shall greet everyone as they approach the gate house and give them a lake brochure and campground regulations.
Customers who wish to evaluate the facilities shall be allowed to drive through the campground once. At other times they can park at the fee station and walk through, unless they are disabled. Persons with disabilities shall be accommodated at all times and shall be allowed to drive through. Obvious potential violations shall be tactfully discussed to minimize corrective action. Park Attendants shall record the campsite occupied by each camping party and maintain a permanent record of the status of campsites. Customers selecting a site shall be allowed to enter the campground prior to registering.
The Park Attendants shall inspect the campground a minimum of three (3) times during each day and inform Park Rangers of any safety hazards or violations they may notice. Park Attendants shall check the area immediately after coming on duty, at least once during high-activity periods in the park, and prior to official quiet hours. Park Rangers will contact individuals who refuse to comply with the regulations.
The Park Attendants shall keep written reports of criticisms of park facilities, and report situations that could affect visitor health and safety or any maintenance items needing attention. Record the times of contract law enforcement patrols through the campground and keep other records as required by the COR (i.e. the number of sites occupied each day, or the number of visitors turned away when the campground is full, etc.).
The Park attendants shall record the site taken and maintain a permanent record at the gate house of current status of sites occupied and the period of stay. Park Attendants shall post reserved sites daily.
The Park Attendant shall not sell any camping supplies to campers or engage in any other commercial activities on Government property unless approved by the COR.
It is emphasized that the work described in this contract is a critical part of the Corps mission. The work described will be performed in a public recreation area. The Corps is committed to "Customer Care" and providing quality professional services.
C-1.3. PAYMENT FOR SERVICES. Payment will be made for actual performance up to the maximum number of days in which services are performed each month (or billing period). All services provided under this contract shall be invoiced on a monthly basis. The contractor shall submit an invoice on the first working day of each month for all services provided during the preceding month.
C.1.4. SCHEDULE OF WORK.
a. The gate house shall be occupied during the following hours:

* The COR may modify working hours (change open and close times, but not increase hours) on Memorial Day, Independence Day, and Labor Day weekends. All times given are local (Dickenson County is in the Eastern Time-zone).
The contractor shall make at least one patrol during the morning shift. At least two patrols two hours apart shall be made during the evening shift each day.
The contractor is considered to be occupying the gate house if they are close enough to the gate house to be responsive to new arrivals and able to answer the telephone. If complaints are received about the gate house not being staffed and the Gate Attendant not being responsive to the camper(s), the COR may direct that the gate house be physically staffed during the above hours.
John W. Flannagan Dam & Reservoir Project normal working hours are Monday through Friday, 7:30 a.m. to 4:00 p.m.
b. Inclement Weather Work. The Contractor shall maintain the schedule of services regardless of inclement weather.
c. Emergency Work. During the course of work under this contract, situations may arise which constitute an immediate danger or health hazard to persons or a threat to property. When such situations arise, the Contractor may be required to respond. If the Contractor or their employee is on duty when the emergency is identified, they may be required to provide uninterrupted service until the emergency has passed. The Contracting Officer Representative (COR) will first notify the employee on duty, and will contact the Contractor or Contractor Representative as soon as possible
d. Training. The Contractor shall attend a pre-work conference, prior to the initiation of work under this contract. The Contractor's Accident Prevention Plan and all contractor submittals must be approved prior to this meeting.
The Contractor shall attend a one (1) to three (3) hour training session the week prior to the start of the contract period at no cost to the government. The actual length of time required will be based on the number of system changes and/or contractor experience with the various systems. This session will include training in the Corps' policies and pre-work orientation with the Corps’ Contracting Officer’s Representative (COR). This session will be given on dates supplied by the COR and prior to the campground duty. A campsite may be provided by the government during this period. The contractor shall contact John W. Flannagan Dam & Reservoir Project Office at least one week in advance of the training period to coordinate arrival time and location.
e. Changes to Schedule. The Government reserves the right to make changes to the schedule of work if necessary due to storm closures, budget restrictions, or other unforeseen circumstances. In the event of a schedule change, with the exception of short term emergencies as described in C-1.4.c, the Contracting Officer will process a Request for Proposal and negotiate changes in price with the Contractor.
f. TERMINATION CLAUSE. If a Park Attendant’s action negatively impacts the safety of the public, the operation of the park, or projects a negative image of the government, the park attendants may be re- moved immediately. Actions which could result in immediate removal include but are not limited to, the use or display of alcohol while on duty; excessive use of alcohol while off duty; use and/or possession of illegal drugs;
possession of a firearm; and/or behavior which endangers the general public or government employees.
C.1.5. SAFETY REQUIREMENTS.
A. General. Contractor shall comply with all Federal, State and Local safety requirements including those specified by the Occupational Safety and Health Act (OSHA) in 29 CRF 1910 General Industry Standard, 1926 Construction Standard and the U.S. Army Corps of Engineers Safety & Health Requirements Manual EM 385-1-1 as currently revised at date of solicitation. Where a conflict exists between safety standards/requirements the contractor shall comply with the more stringent requirement. If the Contractor fails or refuses to promptly comply with safety requirements as specified herein, any project employee may stop all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such work stoppage shall be made subject to any claims for extension of time or for excess costs or damages sustained by the Contractor. Also, the Contractor will not be paid for work not performed as a result of the stop order.
B. Contractor Abbreviated Accident Prevention Plan (AAPP). The Contractor shall prepare a site-specific Abbreviated Accident Prevention Plan as outlined in EM 385-1-1, Appendix A beginning with subparagraph 3.k on page A-10. Contractor must address each element/sub-element in the order they appear in the outline. Any element the contractor feels is not applicable to work under this contract must be listed and a brief explanation provided.
Plan must be accepted by the Contracting Officer prior to commencement of any work. Contractors are encouraged to contact the USACE Safety & Occupational Health Office for questions or information regarding the development of contract Accident Prevention Plans. C. Contractor Risk Management Process. Contractor may use Job Safety analyses (JSAs), Job Hazard Analyses (JHAs) or Activity Hazard Analysis (AHA) for the purpose of risk assessment. Before beginning each work activity Contractor performing that work activity shall prepare an initial assessment (AHA/JSA/JHA) listing each job step, anticipated hazards, site conditions, equipment, materials, personnel and control measures to be implemented. A Risk Assessment Code (RAC) shall be assigned to each step assessing the level of risk remaining after implementation of controls. Once this process is complete a RAC will be assigned to the activity as a whole (cannot be lower than the highest step RAC). Residual risk must be communicated to the proper authority for acceptance in order to proceed. It is the Contractor's responsibility to prepare the AHA/JSA/JHA. Analysis with RAC shall be accepted by the GDA and discussed with al engaged in the activity including Contractor, subcontractor(s), and on-site government representative prior to commencement of work. Names of Competent Person(s) and Qualified Person(s) required for a particular activity (e.g., excavation, scaffolding, fall protection, or other activities specified by OSHA and/or EM 385-1-1) shall be identified and included in the AHA/JSA/JHA and proof of their competency/qualification.

Work crews of two or more must have two people holding current qualifications in First Aid and CPR from the American Red Cross, American Heart Association or a licensed physician. Training must include a hands-on element and the contractor must maintain appropriate First Aid kit on site. Single individuals working alone must have current certification in First Aid as a minimum.
Contractor shall employ a minimum of one Competent Person at each worksite to function as the Site Safety and Health Officer (SSHO). The SSHO as a minimum must have completed the 30-hour OSHA Construction or General Industry Safety class or its equivalent as specified in EM 385-1-1 Section 01.A.17.b and have a minimum of 5 years safety experience relative to the work being completed. The SSHO must be on-site at all times work is being performed. (Note: SSHO qualification requirements may be waived at the discretion of the USACE District Safety & Occupational Health Office for extremely low risk operations.)
Crane operators, riggers and signal persons shall be trained, licensed and meet the physical and drug testing requirements specified in EM 385-1-1 Section 16.
All electrical work must be completed by a Qualified Person with verifiable credentials as specified in EM 385-1-1, Section 11.A.01.c. Electrical work will require contractor to submit a Control of Hazardous Energy Plan (LOTO) in accordance with EM 385-1-1, Section 12.
D. Accident/Mishap Reporting: The Contractor shall report all recordable mishaps to the GDA within 24-hours in accordance with EM 385-1-1 Section 01.D. Accidents shall be investigated to determine causal factors and corrective actions shall be implemented. Accidents resulting in: days away injuries, days away illnesses, restricted/transfer injuries, property damage of $5,000.00 or more shall be investigated and reported to the GDA using the USACE Accident Investigation Report Form ENG 3394 within 24 hours of the occurrence.
(1) Immediate notification to the GDA is required for all serious accidents:
a. Fatal Injury/illness;
b. Permanent totally disabling injury/illness;
c. Permanent partial disabling injury/illness;
d. One (1) or more persons hospitalized as inpatients as a result of a single occurrence;
e. $500,000 or greater accidental property damage;
f. Three (3) or more individuals become ill or have a medical condition suspected to be related to a site condition, or a hazardous or toxic agent on the site;
g. USACE aircraft destroyed or missing;
The Contractor shall maintain an OSHA Log of Work Related Injuries and Illnesses, OSHA Form 300 and comply with all accident reporting and recordkeeping requirements specified in 29 CFR 1904.39.
(2) In addition to the above, any mishap occurring in any of the following high hazard areas shall be reported immediately to the GDA, investigated and corrective actions implemented.
a. Electrical (includes Arc Flash, electrical shock, etc.);
b. Uncontrolled Release of Hazardous Energy (includes electrical and non-electrical);
c. Load Handling Equipment (LHE) or Rigging;
d. Fall-from-Height (any level or other than same surface);
e. Underwater Diving
C.1.6 SECURITY REQUIREMENTS.
All Contractors and subcontractor employee(s) working on this contract who require access in and/or around any Huntington District facilities shall receive authorization to be on site at these facilities based upon a favorable background investigation in accordance with “Homeland Security Presidential Directive 12: Policy for a Common Identification Standard for Federal Employees and Contractors” (HSPD 12). The Huntington District Security Management Office shall submit contractor(s) personal information in order to complete the basic background investigation in order to make a recommendation to the Contracting Office of an employee’s suitability for work on
Government property. The Procuring Contracting Officer (PCO) has the right to deny any contractor or subcontractor employee from working on the contract based upon the results provided by the Huntington District Security Management Office of the background investigation. The Government, Contractor, and subcontractors shall not permit any employee(s) access to drawings, blueprints, records, photos, sites, or projects until the Huntington District Security Management Office has completed an Operations Security (OPSEC) review of such items and determined they can be released.
Contractors shall submit a complete investigation packet for each contractor and subcontractor employee to the Huntington District Security Management office within 10 working days after award of any contract, or prior to the individual being permitted unescorted access in or on District facilities. The Contractor must also provide the following:
(1) Name of the Contract Specialist with whom he/she is working,
(2) Project Name,
(3) Contract Number and
(4) Task Order Number when applicable.
The documents listed below are required:
SF 85, Questionnaire for Non-Sensitive Positions (see http://www.opm.gov/forms/ to print form).
FD 258, Contractor Fingerprint Card (one card for digital prints, two for ink prints) (NOTE: a trained/qualified individual must take prints, ORI block on the FD 258 must be USOPM000Z) (Contractor Fingerprint Cards (FD-
258) may be obtained by Contracting Division by contacting the Huntington District Security Management office).
Contractor shall report any changes in personnel or at any time conditions change at least 5 working days prior to individual(s) need to have access to the site. The Contractor shall provide the same information as listed above for all new employees.
Following submission of paperwork, the Security Management Office will conduct an initial criminal check based upon the information provided. If there are no issues, Security Management Office will make recommendations to the PCO or their Designated Representative. The Security Management Office cannot give approval due to unfavorable report(s). The Security Management Office shall coordinate with Office of Counsel and will jointly make recommendations to the PCO and/or the Designated Representative should a background investigation come back with derogatory information. The PCO will make the determination whether to allow the Contractor personnel to work on the site based on Security and Office of Counsel recommendations, and the PCO will advise Contractor of the decision.
FOREIGN NATIONALS
The Contractor shall provide the package listed above, as well as additional materials noted below for all Foreign Nationals. The Contractor is to expect additional time in the approval process for all Foreign Nationals due to the level of review and elevation of the review to Headquarters Staff to accomplish. All Foreign Nationals must comply with the following paragraph:
In accordance with Engineering Regulation 380-1-18, “Technology Transfer, Disclosure of Information and Contacts with Foreign Representatives” dated 1 August 1996, Section 4, all foreign nationals who work on U.S.
Army Corps of Engineers’ contracts shall be approved by the Headquarters U.S. Army Corps of Engineers (HQ USACE) Foreign Disclosure Officer before beginning work on this contract; this regulation includes subcontractor employees. The Contractor shall submit to the Security Management Office, the names of all foreign nationals proposed for performance under this contract, along with documentation to verify legal admittance into the United States. Such documentation shall include at least one of the following a U.S. passport, Certificate of U.S.
Citizenship (INS Form N-560 or N-561), Certificate of Naturalization (INS Form N-550 or N-570), Alien Registration Card with photograph (INS Form I-151 or I-551), Employment Authorization Card (INS Form I-688A), etc.

In order to assure forms are properly completed, and to minimize time delays, Contractor is encouraged to work closely with the Security Management Office. All Foreign National Visit Requests MUST be submitted to the Security Management Office 30 days in advance of the visit per Army Regulation 380-10, Foreign Disclosure and Contacts with Foreign Representatives. The Government will return for correction incomplete forms, illegible forms, etc. which will delay the contractor / subcontractor from beginning work.
Security requirements are subject to change in accordance with HSPD-12, Office of Personnel Management, regulation or policy changes, etc. The Government shall add any changes to security requirements by modification to the contract.

AT/OPSEC REQUIREMENTS
AT Level I Training. All Contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, controlled access areas, or require network access, shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Upon request, the Contractor shall submit certificates of completion for each affected Contractor employee and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training by all employees and subcontractor personnel. AT Level I awareness training is available at the following website: https://atlevel1.dtic.mil/at/; or it can be provided by the RA ATO in presentation form which will be documented via memorandum."
Access and General Protection/Security Policy and Procedures. All Contractor and all associated subcontractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The Contractor shall also provide all information required for background checks or background investigation and to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in Con- tractor security matters or processes.
For contractors who do not require CAC, but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something). The Contractor and all associated sub-Contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.

For Contracts that Require OPSEC Training. All new Contractor employees will complete Level I OPSEC Training within 30 calendar days of their reporting for duty. Additionally, all Contractor employees must complete annual OPSEC awareness training. The Contractor shall submit certificates of completion for each affected Contractor and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training. Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.
C.1.7. DAMAGE REPORTS. All instances where Government materials, supplies, property, and/or equipment are damaged shall be reported immediately to the COR. Where the damage was caused by Contractor employees, a written report of the incident and extent of such damage shall be submitted to the COR, within two (2) days (less weekends and holidays) of occurrence. For property damage accidents of $2000 or more, the Contractor shall complete and submit to the COR a copy of ENG Form 3394.
C.1.8. PERMITS AND LICENSES. The Contractor shall, at his own expense, obtain any licenses or permits required to perform the contract required to perform all aspects, requirements and work of this contract. The Contractor shall comply with all current Federal, State, and local laws and regulations and shall comply with any subsequent changes.
C.1.9. SUPERVISION. The Contractor or a Contractor Representative shall personally supervise the work, or be readily available by phone or other means of communication to respond to any contract issue that may arise when work is in progress. The Contractor Representative(s) shall conduct overall management coordination and be the central point of contact with the Government for performance of all work under the contract. The Contractor and/or Contractor Representative may be the same person, and may perform Park Attendant duties along with Contractor Representative duties.
Each Contractor Representative shall have full authority to contractually commit the Contractor for prompt action on all matters pertaining to administration of this contract, and shall be responsible for safety and quality control.
The Contractor shall maintain and review copies of contract work requirements, specifications, AHAs, etc., at the work site which relate to each person's work responsibilities, to insure employees’ comprehension of a job.
The names and telephone numbers of all individuals authorized to act on behalf of the Contractor as Contractor Representatives shall be submitted in writing to the COR before work is performed.
C.1.10. CONTRACT EMPLOYEES' CONDUCT AND COMPETENCY. All Contractor employees shall conduct themselves in a proper manner at all times. Since the majority of work shall be performed in the presence of the general public, the conduct of all employees is critical and will be closely monitored. Use of controlled substances or consumption of beer or alcoholic beverages by Contractor employees is strictly prohibited.
The Contractor expressly agrees to remove from the site any individual whose continued employment is deemed by the COR to be contrary to the public interest or inconsistent with the best interests of the U. S. Army Corps of Engineers; and, will not use such individual to perform duties or services under this contract.
The COR may require the Contractor to immediately remove from the work site any employee of the Contractor who is incompetent, or who endangers persons or property, or whose physical or mental condition is such that it would impair the employee's ability to satisfactorily perform the work. Notification to the Contractor shall be made in person or by telephone promptly and shall be confirmed in writing as soon as possible. No such removal, however, will reduce the Contractor's obligation to perform all work required under this contract, and immediate replacement shall be made as required.
C.1.11. MINIMUM PERSONNEL QUALIFICATIONS.
a. General. Only properly trained and qualified employees shall be used in the performance of any work under this contract. Only drivers with a valid state driver's license will be permitted to operate vehicles. All employees shall be subject to such Government or other regulations that are applicable during the time spent on Government property. Park Attendants shall have current First Aid and CPR certifications.
