Clause 52.212-1, Instructions to Offerors - Commercial Items, and whose proposal judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Price Technically Acceptable (LPTA) offer.
1.2. Trade-offs will not be used during the source selection process. The Government will evaluate prices for reasonableness, balance, accuracy, and completeness using price analysis techniques. Unreasonably high, unbalanced, inaccurate or incomplete price proposals may be the grounds for eliminating a proposal from competition. Statements that the Offeror understands, can, or will comply with the PWS (including referenced publications, technical data, etc.); statements paraphrasing the PWS or parts thereof (including applicable publications, technical data, etc.); and phrases such as “standard procedures will be employed” or “well known techniques will be used,” etc., may be considered unacceptable. Offerors shall assume that the Government has no prior knowledge of their facilities and experience. The Government will base its evaluation on the information presented in the Offeror's proposal.
1.3. The Government intends to award one contract as a result of this solicitation. Offers received for less than the stated number of items listed in the Pricing Schedule will be considered ineligible for award. The Government intends to solicit the requirement as a total Small Business set-aside.

The Technical Capability elements, Factor 2: Courseware, Knowledge Centers and e-Books, and Factor 3 Past Performance will be evaluated on an “Acceptable” or “Unacceptable” basis. In order to receive an overall “Acceptable” rating for Factor 1, each element must receive an “Acceptable” rating. Offerors must receive “Acceptable” ratings for the Factor 1, Factor 2, and Factor 3 in order to be considered for award.
Factor 1 – Mission Capability. The Government will evaluate the following three (3) Elements under Mission Capability as follows:

1.7 The Mission Capability factor will receive one of the rating defined below in Table 2.
Table 2. Technical Acceptable/Unacceptable Ratings Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
1.8 Factor 3 – Past Performance.
1.8.1 The Government will evaluate the Offeror’s Past Performance on the probability of meeting the solicitation’s requirements as indicated by that offeror’s record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offeror’s recent past performance and focusing on performance that is relevant to the services being procured under this solicitation.
1.8.2 Past performance information may be obtained from any other sources available to the Government, to include, but not limited to, the Contract Performance Assessment Reporting System (CPARS)/Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers; and the Defense Contract Management Agency. Past performance areas of evaluation include:
- Quality of Service
- Customer Satisfaction
1.8.3. Each offeror will receive a performance confidence assessment rating based on the Offeror’s recent past performance, focusing on performance that is relevant to the Contract requirements.
1.8.4 Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 3 years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.
1.8.5 Relevancy. To be relevant, the effort must be similar in nature of work, size, and complexity. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in nature of work, size, and complexity to the services/products being procured under this solicitation. Recent past performance is defined as not more than 3 years from the RFP release date; relevant in terms of similar nature of work, size and complexity.
1.8.6 A relevancy determination of the offeror’s (including joint venture partner(s) and major and critical subcontractor(s)) past performance will be made. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an offeror’s contract history would give the most confidence that the offeror will satisfy the current procurement. The past performance information provided in the proposal and obtained from other sources will be used to establish the relevancy of past performance.
1.8.7 There are four levels of relevancy as shown in Table 3 below.
Table 3 - Past Performance Relevancy Rating Method
Adjectival Rating Description
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
1.8.8 Past Performance Rating. In conducting a past performance evaluation, each Offeror shall be assigned one of the ratings identified in Table 4 below.
Table 4 - Past Performance Evaluation Ratings Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
1.8.9 In accordance with FAR 15.305(a)(2)(iv), offerors without a record of relevant past performance or for whom information on past performance is not available or so sparse that there is no meaningful past performance rating can be reasonably assigned; the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
1.9 Factor 4 – Price
1.9.1 The Price factor will not be scored or rated. The Government will consider the narrative, and the Total Evaluated Price from Attachment 3 4, Pricing Spreadsheet. The Government will evaluate the Offeror’s proposed prices to determine if it is fair and reasonable, balanced and complete using price analysis techniques at FAR 15.404-1, Proposal analysis techniques. The Government will determine whether prices are fair, reasonable, balanced and complete.
1.9.2 The Offeror’s narrative and Pricing Workbook submission will be used by the Government to analyze and evaluate each Offeror’s price proposal for the entire period of performance. Do not escalate labor category rates where the Offeror has identified a labor category as subject to the Service Contract Labor Standards (SCLS) statute.
1.9.3 Options. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the offeror’s final option period prices to the offeror’s total price.
Thus the offeror’s total price for the purpose of evaluation will include the Base Period, Option Year 1, Option Year 2, Option Year 3, and Option Year 4. Offerors are not required to enter a price for the six-month extension period. The Government will evaluate each offerors' total proposed price to determine if the offerors proposed prices are fair and reasonable and complete and/or balanced, utilizing one or more of the price analysis techniques in FAR 15.404-1.
1.9.4 Offerors responding to this solicitation are advised that, prior to award, the Government may request Offerors to submit substantiating information/data to support price reasonableness.
1.9.5 Definitions:
Reasonableness - A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.
Completeness/Accuracy - The offeror’s proposal is in compliance with the Price Volume instructions in the solicitation.
Unbalanced Pricing- Pricing that exist when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understand as indicated by the application of cost or price analysis techniques.
