TOTAL SMALL BUSINESS SET-ASIDE

DESCRIPTION: Perform annual maintenance dredging of an estimated 110,000 cubic yards of material, place dredge materials in the designated in-w ater placement site, and conduct pre- and post-dredge surveys at Dillingham Harbor in Dillingham, Alaska for the base and each option year (if aw arded). Dredged material is expected to be f ine-grained shoaled material. The Contractor is to furnish all labor, equipment, supplies, materials, supervision, and other items and services necessary to accomplish the w ork. The w ork period is from 15 May to 15 July 2017 (base FY17); 15 May to 15 July 2018 (option FY18); 15 May to 15 July 2019 (option FY19). Options for 2018 and 2019 are included in this solicitation. A fuel price adjustment provision for the dredging plant is included as Time and Material CLINs. Type of contract is f irm-fixed price.

The Davis-Bacon Act w ill apply.

EVALUTION OF BIDS

1. INCOMPLETE BIDS: Failure to submit a bid on all items in the schedule will result in an incomplete bid and the bid will be rejected. Unit or lump sum prices must be shown for each item within the schedule.

2. AWARD: Award will be made to the low, responsive, responsible bidder as determined in accordance with paragraph EVALUATION OF OPTIONS.

3. EVALUATION OF OPTIONS (52.217-5 JUL 1990): Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

4. EXTENSIONS: All extensions of the unit prices shown will be subject to verification by the Government. In case of variation between the unit price and the extension, the unit price will be considered to be the bid.

5. SPECIAL OFFER CONDITION: If a modification to a bid based on unit prices is submitted which provides for a lump sum adjustment to the total bid price, the application of the lump sum adjustment to each unit price in the bidding schedule must be stated. If it is not stated, the bidder agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the bidding schedule.

6. ARITHMETIC DISCREPANCIES

(a) For the purpose of initial evaluations of bids, the following will be utilized in the resolving arithmetic discrepancies found on the face of bidding schedule as submitted by the bidder:

(1) Obviously misplaced decimal points will be corrected;

(2) Discrepancy between unit price and extended price, the unit price will govern;

(3) Apparent errors in extension of unit prices will be corrected;

(4) Apparent errors in addition of lump-sum and extended prices will be corrected.

(b) For the purpose of bid evaluation, the Government will proceed on the assumption that the bidder intends their bid to be evaluated on basis of the unit prices, the totals arrived at by resolution of arithmetic discrepancies as provided above and the bid will be so reflected on the abstract of bids.

(c) These correction procedures shall not be used to resolve any ambiguity concerning which bid is low.

NOTE TO BIDDERS

1. Dredging and Disposal quantities shown in the “QUANTITY” column are “estimated” and based on historic maintenance dredging requirements for the project site. Actual quantities of available material to be dredged may vary year to year. Bidders shall reference the following:

2. Fuel CLIN’s 0003, 0007 and 0011 are Time and Material line items. The Not to Exceed (NTE) amounts for these CLINs are established in the Bid Schedule. Fuel CLINs will be non-evaluated factors. The prices in the fuel CLINs will be included to determine the total offered price.

3. Contractor’s shall reference payment for fuel CLIN’s 0003, 0007 and 0011 in Section 01 22

1. BUSINESS HOURS: Bids will be accepted in Room 30 during Alaska District Corps of Engineer business hours (7:30 AM to 4:30PM) Monday through Friday excluding holidays up to the date bids are due. On the date bids are due the business hours will be 7:30 AM up to the time bids are due.

Section 00 21 00 - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

INSTRUCTION TO BIDDERS

1. MAGNITUDE OF CONSTRUCTION

The magnitude of this project is between $1,000,000 and $5,000,000.

2. SOLICITATION

The solicitation in electronic format only will be available for download at www.fbo.gov. Reference synopsis for download instructions.

3. BOND AMOUNT REQUIRED (FAR CLAUSE 52.228-15, Performance and Payment Bonds-- Construction (NOV 2006) Section 00 72 00

Performance and Payment Bonds:

(1) The penal amount of the bonds shall be 100 percent of the original price.

(2) The Government may require additional bond protection when a contract price is increased. The increase in protection shall generally equal 100 percent of the increase in contract price. The Government may secure additional protection by directing the contractor to increase the penal amount of the existing bond or obtain an additional bond.

4. BID GUARANTEE (FAR CLAUSE 52.228-1)

The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000, whichever is less.

5. EQUIPMENT OWNERSHIP AND OPERATION EXPENSE SCHEDULE

Whenever a contract or modification of contract price is negotiated, the contractor's cost proposal for equipment ownership and operating expenses shall be determined in accordance with the requirements of SCR CW 080: EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE, contained in Section 00 73 00 Special Contract Requirements. Technical inquiries and questions relating to this solicitation are to be submitted via Bidder Inquiry in

ProjNet at (https://www.projnet.org) No Later Than (NLT) 7 Calendar Days prior to proposal submission. To submit and review inquiry items, prospective vendors will need to use the Bidder Inquiry

Key presented below and follow the instructions listed below the key for access. A prospective vendor who submits a comment /question will receive an acknowledgement of their comment/question via email.

Another email to the same address will notify the prospective vendor once the reply is available for viewing. All timely questions and approved answers will be made available through ProjNet. Approved answers to all timely questions will also be posted in an amendment to the solicitation in the form of a report generated from ProjNet as soon as the comment/question entering period is over and all answers are finalized. In the event of a conflict between the bidder inquiry responses and the solicitation, the solicitation shall govern.

Specific Instructions for Future ProjNet Bid Inquiry Access:

1) For future access to ProjNet, you will not be provided any type of password. You will utilize your

Secret Question and Secret Answer to log in.

2) From the ProjNet home page linked above, click on Quick Add on the upper right side of the screen.

3) Identify the Agency. This should be marked as USACE.

4) Key. Enter the Bidder Inquiry Key listed above.

5) Email. Enter the email address you used to register previously in ProjNet.

6) Click Continue. A page will then open asking you to enter the answer to your Secret Question.

7) Enter your Secret Answer and click Login. Once this is completed you are now logged into the system.

7. PRE-BID MEETING/SITE VISIT

Please reference 52.236-27 – Site Visit (Construction) (Feb 1995) for site visit information.

8. ACCESS TO JBER

All vehicle operators are required to wear seatbelts. Vehicle operators caught not wearing seatbelts will lose their driving privileges for 10 days on their first offense, 30 days on the second offense, and 6 months or longer on the third offense. In addition cell phone use while operating a vehicle is prohibited on JBER.

Please note that base entry procedures have changed. Offerors are now required to be physically sponsored on JBER by Contracting Division personnel.

If a firm does not have a current pass to obtain entry to JBER, the firm may request a day pass using the following procedures:

Forty-eight hours (48) prior to delivery of bid, the firm must contact Kimberly Tripp at kimberly.tripp@us.army.mil or Christine A. Dale at christine.a.dale@usace.army.mil and request a day pass. The firm must provide: a) the solicitation number; b) the names of all persons in the vehicle; c) the name of their employer(s); and a contact phone number. State that it is a request for a day pass.

After receipt of your day pass request, personnel from the Contracting Division will contact you and arrange a time to meet at the Visitors Center, Boniface Gate the morning of the bid opening date.

To obtain a base pass, you will need to provide the following information: a) valid driver's license; b) proof of current insurance; c) proof of current IM certificate; d) current vehicle registration.

Failure to follow the above procedure will prevent your access to JBER.

Offerors are reminded that as an alternative to physically attending the bid opening they can fax their bid and call in to the Bid Opening Conference Call as indicated below.

9. FACSIMILE BIDS

In accordance with FAR 52.214-31 FACSIMILE BIDS (DEC 1989), Facsimile bids and/or e-mail bids will be accepted. However the only bid guarantees that will be accepted by facsimile is a bid bond at bid opening. Any other type of bid guarantee will only be accepted in original format.

(a) Definition. Data Universal Numbering System (DUNS) number, as used in this provision, means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities, which is used as the identification number for Federal Contractors.

(b)The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS+4” followed by the DUNS number or “DUNS+4” that identifies the offeror's name and address exactly as stated in the offer. 52.214-5 SUBMISSION OF BIDS (MAR 1997)

(a) Bids and bid modifications shall be submitted in sealed envelopes or packages (unless submitted by electronic means) (1) addressed to the office specified in the solicitation, and (2) showing the time and date specified for receipt, the solicitation number, and the name and address of the bidder.

(b) Bidders using commercial carrier services shall ensure that the bid is addressed and marked on the outermost envelope or wrapper as prescribed in subparagraphs (a)(1) and (2) of this provision when delivered to the office specified in the solicitation.

(c) Telegraphic bids will not be considered unless authorized by the solicitation; however, bids may be modified or withdrawn by written or telegraphic notice.

52.214-7 LATE SUBMISSIONS, MODIFICATIONS, AND WITHDRAWALS OF BIDS (NOV 1999)

(a) Bidders are responsible for submitting bids, and any modifications or withdrawals, so as to reach the Government office designated in the invitation for bids (IFB) by the time specified in the IFB. If no time is specified in the IFB, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that bids are due.

(b)(1) Any bid, modification, or withdrawal received at the Government office designated in the IFB after the exact time specified for receipt of bids is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late bid would not unduly delay the acquisition; and--

(i) If it was transmitted through an electronic commerce method authorized by the IFB, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of bids; or

(ii) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of bids and was under the Government's control prior to the time set for receipt of bids.

(2) However, a late modification of an otherwise successful bid that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(c) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the bid wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(d) If an emergency or unanticipated event interrupts normal Government processes so that bids cannot be received at the Government office designated for receipt of bids by the exact time specified in the IFB and urgent Government requirements preclude amendment of the IFB, the time specified for receipt of bids will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(e) Bids may be withdrawn by written notice received at any time before the exact time set for receipt of bids. If the IFB authorizes facsimile bids, bids may be withdrawn via facsimile received at any time before the exact time set for receipt of bids, subject to the conditions specified in the provision at 52.214-31, Facsimile Bids. A bid may be withdrawn in person by a bidder or its authorized representative if, before the exact time set for receipt of bids, the identity of the person requesting withdrawal is established and the person signs a receipt for the bid.

(a) The Government will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government, considering only price and the price-related factors specified elsewhere in the solicitation.

(b) The Government may reject any or all bids, and waive informalities or minor irregularities in bids received.

(c) The Government may accept any item or combination of items, unless doing so is precluded by a restrictive limitation in the solicitation or the bid.

(d) The Government may reject a bid as nonresponsive if the prices bid are materially unbalanced between line items or subline items. (a) Definition. "Facsimile bid," as used in this solicitation, means a bid, modification of a bid, or withdrawal of a bid that is transmitted to and received by the Government via electronic equipment that communicates and reproduces both printed and hand-written material.

52.204-3 TAXPAYER IDENTIFICATION (OCT 1998)

(a) Definitions.

Common parent, as used in this provision, means that corporate entity that owns or controls an affiliated group of corporations that files its Federal income tax returns on a consolidated basis, and of which the offeror is a member.

Taxpayer Identification Number (TIN), as used in this provision, means the number required by the Internal Revenue Service (IRS) to be used by the offeror in reporting income tax and other returns. The TIN may be either a Social Security Number or an Employer Identification Number.

(b) All offerors must submit the information required in paragraphs (d) through (f) of this provision to comply with debt collection requirements of 31 U.S.C. 7701(c) and 3325(d), reporting requirements of 26 U.S.C. 6041, 6041A, and 6050M, and implementing regulations issued by the IRS. If the resulting contract is subject to the payment reporting requirements described in Federal Acquisition Regulation (FAR) 4.904, the failure or refusal by the offeror to furnish the information may result in a 31 percent reduction of payments otherwise due under the contract.
