153 CES JOHN DEERE UTV’S

W50S8W-23-Q-0010

1. PURPOSE: This is a Combined Synopsis/Solicitation Notice for commercial items prepared in accordance with the format in FAR 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation/notice; responses/quotes are being requested, further written solicitation will not be issued. This solicitation will be posted to the sam.gov web-site and will exclusively be set aside for Small Business.

The Wyoming Air National Guard is issuing this combined synopsis/solicitation as a Request for Quote (RFQ) using FAR Part 12, Acquisition of Commercial Item, & FAR Part 13, Simplified Acquisition Procedures. The North American Industrial Classification System (NAICS) code for this procurement is 336999, with a small business standard of 1,000 Employees. All provisions and clauses are in effect through FAC 2023-04 and DFARS Change Notice 07/20/2023.

The Government intends to award a Firm Fixed-Price Commercial Award.

"Notice to Offeror(s)/Supplier(s): Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs."

5. INSTRUCTION TO OFFERORS: To assure timely and equitable evaluation of quotes received, offerors must follow the instructions contained herein. Offerors are required to meet all requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of two (2) separate parts; Part I - Price, and Part II – Technical Capability ,Specific Instructions:

a. PART I – PRICE - Complete pricing showing total costs of all items to include shipping.

b. PART II – Technical Capability – Must be Brand Name item and meet model specifications

6. BASIS FOR AWARD: This is a Lowest Priced Technically Acceptable (LPTA) award. All technically acceptable offers shall be treated equally except for their prices.

Failure to meet a requirement may result in an offer being determined technically unacceptable. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

Initially, offers shall be ranked according to price, including any option or additive item prices if applicable.

a. Technical Acceptability. The Government shall evaluate the technical proposals on a pass/fail basis, assigning ratings of Technically Acceptable, or Not Technically Acceptable. The proposals shall be evaluated against criteria listed under section “PART II – Technical Capability” of paragraph 5 above.

b. Price Evaluation. The Government shall evaluate price in order to determine reasonableness and affordability of the overall total evaluated price.

7. The Government reserves the right to make a full and/or partial-award on any item(s).

8. The Government reserves the right to make an award without discussions. The Government, however, reserves the right to conduct discussions if deemed in its best interest.

9. All contractors are required to have an active registration in System for Award Management (SAM). Please visit https://sam.gov/SAM/ to create a new registration if you are not already registered or renew your registration if it is not expired.

10. APPLICABLE FAR CLAUSES:

Addendum to FAR 52.212-2: Evaluation - Commercial Items (Nov 2021)

Award will be made to the offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR) and whose offer represents the lowest priced technically acceptable offer using the following evaluation criteria:

(a) Technical Capability: Meets brand name item requirement/specifications as identified. For supplies the Government will consider offers/quotes only from "authorized resellers/distributors" of the offered manufacturers.

(b) Price: No additional information from the offeror will be required if the price is based on adequate price competition. In the event adequate price competition does not exist, the contracting officer will obtain information from the offeror to the extent required to determine the reasonableness of the offered prices.
