5. Description of Contract Action:
Approval is being requested for the procurement of two (2) John Deere XUV835M HVAC. This purchase is an Unfunded Request.
Section C: Justification for Soliciting from a Single Source or Brand Name
6. Authority Cited: Section 803 of the National Defense Authorization Act for Fiscal Year 2002 (Pub. L. 107-107), FAR 11.105(a)(1), DFARS 216.505-70, FAR 8.405-6. Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s need.
7. Rationale for Limiting Sources: The cited brand name John Deere is required in order to replace the existing John Deere Gators the WYANG owns. We replaced three (3) last year and would like to move forward with replacing the remaining two (2) old and outdated pieces of equipment with the same equipment from last years unfunded purchase. Purchasing new John Deere XUV835M HVAC equipment will allow for use of the existing John Deere tool accessory kits. These accessory kits are not compatible with other brand names. In addition the vehicle maintenance team is familiar with maintaining John Deere equipment.
