1. It is the offeror’ s responsibility that all offers submitted, regardless of method of submission, are received in this office prior to the time and date for receipt of the offer. All quotes/offers are due no later than the date specified in the solicitation.

1. Basis of Award: The Government intends to award a firm fixed-price (FFP) contract resulting from this solicitation. Award will be made on all or none basis. Award shall be made to a single contractor. Quotes must include prices for each item listed in order that quotes may be properly evaluated. Failure to do so shall be cause for the offeror to be considered non-responsive. Award shall be made to that responsive, responsible offeror, and will be based on lowest price meeting technical specification.

1. FOB Destination, Vendors must include CAGE code, Duns number, TIN, warranty terms. Quote should include FOB Destination pricing; freight should not be listed separately.

1. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

1. Quotes must include the following information: Price: pricing for each Line Item. Pricing must be submitted in the proper format. The proper format consists of QUANTITY * UNIT AMOUNT = NET AMT. In the event there is a difference between a unit price and the extended total, the unit price will be held to the intended price. If the offeror shows only the total price but fails to enter a unit price, the total divided by the estimated quantity will be held to be the intended price.

1. The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items necessary to provide the contracted supplies.

1. Contractors shall quote on all CLINS, (EXCEPT CLINS 0006, 0012, 0018, 0024 AND 0030, WHICH HAVE A PLUG IN NUMBER OF $3,000). CLIN pricing should be all inclusive of labor, labor burden, other direct cost (material, equipment, fees, licenses, etc), G&A and profit.

1. Line Item pricing should include all applicable taxes, fees, gratuities, commissions, services charges, etc. The federal government is tax exempt.

1. The offeror is reminded it must offer on any issued plans, drawings, and specifications as amended. Any deviations, conditions or attachments made by the offeror itself may render the offer non-responsive and may be cause for its rejection.

1. All representations and certifications to include provision of Dun & Bradstreet number are to be returned with the quote. Dun and Bradstreet information can be found by calling (800)-333-0505. A contractor that is receiving an award resulting from this request for quotation must be registered in the System for Award Management (SAM. 1. Due to restricted access to Fort Dix, contractors that will be hand carrying their quote are required to submit to the contracting officer a list of personnel planning to deliver the package not later than 24 hours prior to the due date. Contractors must also furnish the approximate time of arrival and the gate they will utilize. Contractors are cautioned that there may be delays at the gates and should allow adequate time for entering the installation to ensure packages are received prior to the time and date for receipt of quote. All individuals must have a picture id and no substitutions are authorized. Vehicles are also subject to search.

1. This project falls under NAICS 562991 with the business size standard of $7,500,000.00.

1. Quotes shall be valid for 120 days unless specified.

STATEMENT OF WORK

Scope: The Contractor shall pump out, inspect, service, and maintain septic systems, grease traps and catch basins at DRFTA. All septic, grease trap, and catch basin materials pumped out will be disposed of offsite in accordance with (IAW) all applicable federal, state, and local laws and regulations. All work shall be performed by qualified and appropriately licensed personnel IAW all applicable laws and regulations.

Grease Trap Pumping: The contractor shall pump out the entire contents of three 1,000 gallon outdoor grease traps located on the Main Cantonment of DRFTA on or before the 30th of September, December, March, and June of each year (TE-1, TE-2). The contractor shall dispose of the pumped out waste offsite IAW all applicable federal, state, and local laws and regulations. Following each pump out the contractor shall conduct a general visual inspection the grease traps and notify the COR if any deficiencies in the piping, tank, or other structural component is observed.

Septic Tank Pumping: The Contractor shall pump out the entire contents of at least three subsurface septic tanks per year (up to 20,000 gallons total per year) as directed in writing by the COR (TE-1, TE-4). The contractor shall dispose of the pumped out waste offsite IAW all applicable federal, state, and local laws and regulations. Following each pump out the contractor shall conduct a general visual inspection of the septic tanks and notify the COR if any deficiencies in the piping, tank, or other structural component is observed.

Septic System Title 5 Inspection: The contractor shall conduct formal Title 5 septic system inspections of at least three subsurface septic systems (to include the tanks, distribution boxes, and leach fields) as directed in writing by the COR (TE-1, TE-4). The contractor shall inspect the septic systems IAW 310 Code of Massachusetts Regulations (CMR) 15.302. Contractor personnel conducting inspections must be Massachusetts Department of Environmental Protection (MassDEP) approved Title 5 System Inspectors in full compliance with 310 CMR 15.340. The Contractor must submit the inspectors MassDEP Title 5 certification to the COR for validation prior to conducting inspections. Within 30 days of an inspection, the Contractor shall submit the results/reports of any and all Title 5 inspection(s) to the COR, MassDEP, and the Nashoba Board of Health on a current System Inspection Form approved by the MassDEP.

Catch Basin Cleaning: The contractor shall vacuum out 240 catch basins located at the Main Cantonment of DRFTA (TE-1, TE-2) and 46 catch basins located at the 3400 Area of DRFTA (TE-1, TE-3) twice annually. The contractor shall conduct one catch basin cleaning in the Spring months of April or May and one in the fall months of October or November. The contractor shall dispose of all vacuumed materials offsite IAW all applicable federal, state, and local laws and regulations.

Contractor Manpower Data Reporting: The Contractor shall report manpower information (including subcontractor manpower information) required for performance of this contract. The contractor shall submit all the information required in the format specified at the following web address: https://ecmra.mil. The required data is reported for each federal fiscal year (1 October to 30 September) and must be reported by 15 October of each calendar year. If the period of performance of the contract crosses fiscal years, one entry shall be made for each fiscal year.

Other Special Services: A contingency amount of funds has been included in the contract for unscheduled services. The COR will provide the Contractor with a scope of work for any unscheduled services required, and the Contractor shall furnish a written cost estimate to include material and labor costs to the COR for approval. Any work required under this section of the contract that does not exceed the micro-purchase threshold as defined in the Federal Acquisition Regulation, can be approved by the COR. If the estimated cost of the unscheduled services exceeds the micro-purchase threshold, the requirement shall be referred to the KO for approval. Special services that may be requested by the COR include maintenance and repair of septic systems, sewer lines, grease traps, and catch basins including but not limited to:

a. Pipe and fitting replacements including baffles;

b. Clearing of clogged tanks/drains/pipes such as tree root removal and line jetting;

c. Pump station repairs such as slide rail repair and pump replacement; and

d. Leach field inspection/repair such as distribution box/percolation system repair.

Requirements Equipment Requirements.

All septic tanker trucks and vacuum trucks must meet all Massachusetts Department of Transportation (MassDOT) regulations and must be in good working order. All contractor personnel driving a tanker or vacuum truck must have the appropriate class of Commercial Driver’s License (CDL) to operate that truck. All suction hoses, pressure hoses, and pumps must be maintained in a condition to prevent the leakage of waste materials. Tankers must be securely mounted on trucks. They must be watertight, equipped with necessary odor controls, provided with a leak proof cover, and have tight discharge valves. Mobile tanks shall be provided with a vent constructed in a manner that will permit the escape of gas, but not the liquid contents of the tank.

The Contractor shall not use any equipment with an active hazardous material leak. If a leak or spill occurs, follow the requirements in paragraph 3.2 Environmental Environmental Requirements.

Under no circumstances is hazardous waste to be transported onto DRFTA property.

Where hazardous materials, including oils are needed for the operation of equipment, the Contractor will adhere to all applicable federal and State regulations regarding the management and handling of hazardous materials.

Any release of oil (including leaks from hydraulic hoses and equipment), hazardous waste, hazardous material, septage, grease, or wastewater on DRFTA shall be immediately reported to the Devens Fire Department at 978-772-2117 and the DPW Environmental Division at 978-615-6086/6096. This clause does not relieve the Contractor of any federal or State reporting requirements.

Oil, fuel, hazardous material/waste, septage, or wastewater released to the environment (including leaks from hydraulic hoses and equipment) by the Contractor in the performance of this work shall be the sole responsibility of the Contractor and shall be cleaned up at no expense to the Army. Any release shall be cleaned up without delay to the standards set forth in 40 CFR 260 and 310 CMR 30.00. Any vehicle found to be releasing oil or a hazardous substance shall be immobilized and spill contained immediately upon discovery of the leak.

Safety Requirements: All equipment used in the performance of this contract shall have safety design features to prevent injury to the operator and damage to persons or property. The Contractor shall ensure all workers are properly trained and understand how to safely operate the equipment. All Personal Protective Equipment (PPE) shall conform to the applicable OSHA standards. PPE shall be worn at all times during the operation of equipment.

Anti-Terrorism and Operations Security: Contractor and all associated subcontractor employees requiring access to the installation shall (1) provide all information required for background checks to meet installation access requirements to be accomplished by the Director of Emergency Services or Security Office, and (2) comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). Should the Force Protection Condition (FPCON) at any individual facility or the installation change, the Government may require changes in contractor security matters or processes.

The contractor must submit the inspectors MassDEP Title 5 certification to the COR for validation prior to conducting inspections. Within 30 days of an inspection, the contractor shall submit the results/reports of any and all Title 5 inspection(s) to the COR, MassDEP, and the Nashoba Board of Health on a current System Inspection Form approved by the MassDEP.

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that--

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Award will be made to the lowest responsible, responsive offer whose (i) technical capability/proposal meets the requirements of the PWS and solicitation (ii) past performance, which consists of the review of references and other documentation in obtained by the Government. Price is lowest evaluated price.

You must submit a technical capability statement/proposal and references with your proposal to be considered for award. The technical proposal should address if you are subcontracting the work, how much will be subcontracted, your ability to perform the work and equipment available for use.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2018)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u)) of this provision.

(a) Definitions. As used in this provision --

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
