Justification and Approval for Other than Full and Open Competition
1. CONTRACTING ACTIVITY: U.S. Army Contracting Command - New Jersey
2. DESCRIPTION OF ACTION: This Justification for Other than Full and Open Competition seeks the approval to establish a Firm Fixed Price purchase order for license renewals, upgrades to Physical Universal Forensic Extraction Device (UFED) Dongles, license additions and upgrades, additional UFED Ultimate Rugged Kits, and Link Analysis software for the CelleBrite USA Corporation’s UFED Forensic System. The UFED system is approved by the U.S. Army Criminal Investigation Command (USACIDC) per Criminal Investigation Regulation195-1, Chapter 13-7. Fiscal Year 2015 Operations and Maintenance, Army (OMA) funds are provided for this procurement.
3. DESCRIPTION OF SUPPLIES AND SERVICES: This requirement is for license renewals, upgrades to Physical Universal Forensic Extraction Device (UFED) Dongles, license additions and upgrades, additional UFED Ultimate Rugged Kits, and Link Analysis software for USACIDC forensic equipment. The CelleBrite Touch Forensic Extraction Device system will quickly extract phonebook, pictures, videos, short message service (SMS) messages, call histories, electronic serial number (ESN)/International Mobile Equipment Identity (IMEI) information, and deleted SMS/call histories off the subscriber identity module (SIM)/ User Services Identity Module (USIM) for rapid analysis. CelleBrite supports all the major technologies: time division multiple access (TDMA), code division multiple access (CDMA), global system for mobile (GSM), integrated digital enhanced network (IDEN) including, Smartphone operating systems (Apple iPhone, Blackberry, Google Android, Microsoft Mobile, Palm, and Symbian) for over 95% of all handset models worldwide. The estimated total value is $542,000.00. The period of performance is 22 September 2015 through 21 September 2016.

4. AUTHORITY CITED: Federal Acquisition Regulation (FAR) 6.302-1(a)(2) “Only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements”, 10 USC 2304(c)(1).
5. REASON FOR AUTHORITY CITED: This equipment is solely manufactured by CelleBrite USA Corp. CelleBrite products have been deployed reliably and effectively throughout the world for both commercial data synchronization and forensic data analysis.
CelleBrite has exclusive agreements with over 55 mobile phone carriers in the U.S. and over 100 worldwide. This exclusivity allows CelleBrite to receive production handsets and source codes from cell phone manufacturers. It also allows them to be the exclusive providers of mobile synchronization systems like Verizon, AT&T, Sprint/Nextel, T-Mobile, Metro PCS, Western Wireless, US Cellular, Cricket Communications, as well as thousands of privately held cellular retailers six months prior to retail launch. This exclusivity allows the CelleBrite Touch Forensic Extraction Device to be compatible with over 2,000 mobile devices.
In addition, no extraction/analysis device can obtain all of the evidence, from every mobile device. It is for that reason the USACIDC requires an extraction/analysis device that has the capability of handling the widest array of different devices. CelleBrite has been tested and accepted for use within the forensic community, specifically the National Institute of Standards and Technology (NIST) and the UFED has been validated by the “American Society of Crime Lab Directors (ASCLD/LAB), the preeminent authority for accredited crime labs in the U.S.
The UFED system is the only authorized and mandatory system used by USACIDC for exploiting cellular phone technology. CelleBrite is the only manufacturer of the UFED system and related software and is the only known company that can provide the required licensing.
CID currently has 90 UFED devices of which approximately 45 are equipped with the Physical Analyzer Software. The existing 90 UFED’s cost approximately $7K each totaling $630K.
Currently there are approximately 650 agents that are trained to use the CelleBrite UFEDs for the extraction of data from mobile devices. If CID is required to change devices at this time it would take approximately 12 months to get all 650 agents trained to their current level in the use of the new device, which would have an immediate and extremely detrimental effect on CID's ability to obtain necessary data in current criminal investigations.
Furthermore, the estimated cost to USACIDC to train the agents in the new equipment would be approximately $2,500.00 per agent for a total cost of $1.6 Million, which is cost prohibitive.
Link Analysis is a new product, which allows an investigator to quickly and efficiently determine if there are any linkages between users of mobile devices. If there are linkages between users of mobile devices CelleBrite Link Analysis will show the type of linkage between, a phone call, text message, multi-media message, or email. CelleBrite Link Analysis is the only link analysis software that will work with data extracted by a CelleBrite UFED device.
6. EFFORT TO OBTAIN COMPETITION : Market research was conducted as discussed in paragraph 8 below and the capabilities of other potential sources and contract vehicles were assessed. In addition, USACIDC is continually testing other equipment and software as a possible replacement and/or contender to the Cellebrite UFED Touch. The primary criteria are the costs both in time and effort to retrain approximately 1100 CID Agents in a new device or software. To date, no other device or software has been found to be a viable replacement for the Cellebrite Touch UFED Device.
7. ACTIONS TO INCREASE COMPETITION: USACIDC-G3 routinely attends conferences and technical expositions to identify vendors and maintain awareness of available products. The USACIDC has established a relationship with the Defense Cyber Crime Institute (DCCI) that ensures the Department of Defense Criminal Investigative Organizations (DCIO) are aware of newly released products that have been forensically validated and the current re-validation of products. The USACIDC may also submit new products to Defense Computer Forensic Laboratory and DCCI for the purpose of validation which would encourage competition.
8. MARKET RESEARCH: Market research was performed beginning in February 2015 for the UFED Software upgrades, Physical Dongle Upgrades, new UFED Rugged kits, and Link Analysis software. Market research through the International Association of Computer Investigative Specialists (IACIS), The National Academy of Forensic Science, Google and GSA determined there are several forensic mobile solutions; however, the other solutions will not fill the current USACIDC requirements and/or were cost prohibitive. On 29 May 2015 a quote from the Manufacturer, CelleBrite USA, Inc was obtained for the Software upgrade. On 21 July 2015 Request for Information (RFI) number W15QKN-15-Q-0060 to identify suitable resellers of the CelleBrite software was posted on the Federal Business Opportunities (FBO) Website with a response date of 24 July 2015. Digital Shield, Blue Industries Inc., and Forensic Store responded to the RFI. All three small businesses were verified by Manufacturer Cellebrite as authorized resellers. In accordance with Army Regulation (AR) 25-1 and Department of the Army (DA) Policy memorandum dated 04 May 2009, Computer Hardware, Enterprise Software and Solutions (CHESS) is the primary source for commercial information technology hardware and software. The UFED Software was not available through CHESS and a Goal 1 Waiver was obtained on 10 July 2015 from Headquarters, Department of the Army Chief Information Office/G6.
9. INTERESTED SOURCES: Market research indicates there are other interested vendors.
Notices required by FAR 5.201 shall be published with appropriate rationale for Other Than Full and Open Competition.

ROOT9B, LLC is currently providing the licensing for USACIDC’s current inventory of Cellebrite Forensic Devices. Procurement history determined there were two potential sources Cellebrite and ROOT9B, LLC at the time of previous procurements. Current market research results indicate there is at least four authorized re-sellers including Cellebrite the original equipment manufacturer. The number of potential sources has increased since the last procurement from two sources to four based on RFI W15QKN-15-Q-0060 results.
