PERFORMANCE WORK STATEMENT

1. INTRODUCTION

a. Unless otherwise specified herein, the Contractor shall furnish all personnel, management, supervision, properly trained labor, subcontractors, tools, transportation, equipment, supplies, products, materials to satisfactorily complete landscaping services at

Defense Logistics Agency Disposition Services (DLADS), Davis Monthan AFB, 7030 E.

Irvington Rd, Tucson, AZ 85707-4373.

b. Contractor personnel and subcontractors shall comply with applicable federal, local and host installation laws, safety regulations and procedures. Personal Protective Equipment

(PPE) shall be provided by the Contractor and must be appropriate for the task.

Contractor/subcontractors personnel and equipment are subject to safety inspections by government personnel.

2. SCOPE

a. Bushes along the front of Building 7818 should be pruned below the windows of the building quarterly or as directed by the site. Any unhealthy branches shall be removed.

b. Parking lots, sidewalks, gravel areas, etc. shall be weeded or sprayed once every month, or as necessary, to maintain a weed-free environment.

c. Fences shall be treated four (4) times every year (April, June, August and October), or as necessary to maintain a six (6) inch bare strip on both sides. Perimeter security fences shall be maintained with an eight (8) foot wide access clear of brush and trees.

d. Landscaping services shall be performed in such a manner as not to interfere with the normal activities and operations on and around the grounds. All supplies, equipment and machines shall be kept out of traffic lanes or other areas where they might be hazardous.

e. Methods specified that use equipment shall be supplemented by hand operations in locations inaccessible by equipment.

f. The Contractor shall perform service where specified in the plot plans. The Contractor shall repair damaged government facilities, government owned property and equipment caused by the Contractor personnel and subcontractors.

g. The Contractor shall control grass, weeds and vines growing around the sidewalks, paved areas/roadways, through cracks and holes, around scales, scrap bins, electrical poles, fire hydrants, buildings, and railroad tracks by mowing, weeding, trimming, or edging.

h. The Contractor shall pick up and dispose of trash, litter, and debris as part of each landscaping operation. Trash, litter, and debris will be disposed of in approved waste containers on or off site.

i. The Contracting Officer Representative (COR) may order additional landscaping maintenance depending on the growth. The Contractor shall complete the mowing, trimming, edging, and weeding service within five (5) business days of the date of request. The date of the request is considered day zero.

j. The government will supply electricity, hot and cold water at no cost to the Contractor.

3. HOURS OF OPERATION AND HOLIDAYS:

The service to be performed under this contract shall be performed during normal U.S.

Government (USG) business days. The schedule of service will be the 2nd Wednesday of every month. Mowing will begin no earlier than 7:30 A.M. on the workday and completed no later than 2:30 P.M. on the same day, and if not finished that day will return on the following workday to complete the task. Services will not be scheduled to be performed on a regular Federal holiday (see below), or one designated by Presidential proclamation.

*The holiday is observed on the preceding Friday or the following Monday when the holiday occurs on Saturday or Sunday, respectively.

4. BASE ACCESS AND SECURTIY:

a. The Contractor shall coordinate base installation access for all their employees. The

Contractor shall be familiar with and comply with all Base Command policies regarding security considerations for all Contractor employees.

b. Unscheduled gate closures by the installation security personnel may occur at any time causing all personnel entering or exiting a closed installation to experience a delay; this cannot be predicted or prevented. Contractors/Subcontractors are not compensated for unexpected closures or delays. Vehicles operated by Contractor/Subcontractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the Contractor/Subcontractor’s employee’s installation driving privileges.

c. Contractor/Subcontractor employees shall become familiar with and obey the regulations of the installation, including fire, traffic, safety, and security regulations while on the installation. Contractor/Subcontractor employees should only enter restricted areas when required to do so and only upon prior approval. All Contractor/Subcontractor employees shall always carry proper identification with them and shall be subject to such checks as may be deemed necessary. The Contractor/Subcontractor shall ensure compliance with all regulations and orders of the installation which may affect performance. The USG reserves the right to direct the removal of an employee for misconduct, security reasons, or any overt evidence of communicable disease. Removal of Contractor/Subcontractor employees for reasons stated above does not relieve the Contractor/Subcontractor from responsibility for total performance of this contract.

d. The Contractor/Subcontractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the COR. The

Contractor/Subcontractor and all associated employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation security personnel. The Contractor/Subcontractor shall ensure compliance with all personal identity verification requirements as directed by Department of Defense (DoD) and/or local policy. Should the Force Protection Condition (FPCON) change, the USG may require changes in Contractor/Subcontractor security matters or processes.

5. CHEMICALS

Chemicals used in the performance of the work shall be purchased by the Contractor and issued to the Contractor’s employees in the original manufacturer’s containers. All containers shall identify the type of chemical, instructions for use, dilution, and any hazardous warnings. Products shall be recommended by the manufacturer for their intended use and shall be compatible with other manufacture’s products used in conjunction with these products. Products must have been available in the market for commercial use for at least two (2) years. Manufacturer’s published data will be the only acceptable evidence of materials meeting this requirement.

6. CONTRACTOR FURNISHED PROPERTY AND SERVICES

The Contractor shall furnish everything required to perform this contract. The Government shall not be liable for loss or damage to the Contractor’s, subcontractor or employee’s property, equipment, or materials due to result of their actions. The Contractor shall use materials, tools, chemicals, equipment, and supplies that conform to the requirements listed in this contract. The Contractor shall use his own tools and equipment of a designed type, size, rating, and power for the intended use and shall be always kept in a safe and operable condition. No tools, equipment or fuel shall be stored on government property.

7. QUALITY CONTROL PROGRAM

The Government has the right to inspect all services always called for by the contract and places during the term of the contract. The Government will perform inspections in a manner that will not unduly delay the work. If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no cost to the government. The Government will notify the Contractor of any deficiencies within the next business day after completion of work. The Contractor shall have two business days from notification to correct the deficiencies.

8. ACCEPTABLE PERFORMANCE LEVELS (APLs)

a. APLs are the minimum performance levels of specific requirements which the

Contractor achieve or risk having the government consider performance unsatisfactory, which may result in monetary or other consideration from the

Contractor.

b. If performance falls below the specified performance level, consideration may be taken at the government’s discretion. Decisions will consider the impact on the government because of the failure to meet the performance requirement and the number of times the failure has occurred throughout the contract period.

c. Performance incentives for the Contractor will include, but are not necessarily limited to, favorable impact on option exercise decisions, future awards of the same requirement, and future awards of similar requirements by DLA Disposition

Services as well as other government and non-government entities that may review performance of this contract.

9. SPILL RESPONSIBILITY:

a. The Contractor is solely responsible for all spills or leaks during the performance of this contract, which occurs because of, or is contributed to by the actions of its agents, employees, or subcontractors. The Contractor shall clean up such spills or leaks to the satisfaction of the USG in a manner that complies with applicable

Federal, state, and local laws and regulations. The clean-up shall be at no cost to the USG. The Contractor shall report all such spills or leaks, regardless of their quantity, to the COR and Contracting Officer (KO) immediately upon discovery.

A written follow-up report shall be submitted to the COR and KO not later than twenty-four hours after the initial telephonic report. The written report shall be in narrative form, and as a minimum shall include the following:

1. Description of item spilled (including identity, quantity).

2. Whether amount spilled is EPA or state reportable, and if so, whether it was reported. Exact time and location of spill including a description of the area involved.

3. Containment procedures initiated.

4. Summary of any communications Contractor has with press or USG officials other than the KO.

5. Description of clean-up procedures employed or to be employed at the site including disposal location of spill residue.

6. Description of item spilled (including identity, quantity).

10. DLA DISPOSITION SERVICES ENVIRONMENTAL MANAGEMENT SYSTEM

DLADS implemented an Environmental Management System (EMS) in accordance with

ISO 14001:2015(E), DOD, and DLA requirements at all appropriate DLADS facilities. An

EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes, and resources for developing, implementing, achieving, reviewing, and maintaining the environmental policy of an organization. The DLADS EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact, are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the DLADS mission. The DLADS

EMS program is explained in the agency EMS Core Instruction. Site supplements may detail information required by EMS at a local level such as local, state and host environmental regulations as well as local emergency procedures and operating procedures unique to the location. Site supplements also contain information concerning the local interaction between the appropriate DLADS tenant facility and the DOD/DLA host facility

EMS program. Contractors and their personnel are required to be aware that each appropriate DLADS facility has an EMS and to be aware of EMS policies to perform work and/or gain access to an installation. Each DLADS facility maintains EMS awareness posters that identify the DLADS Environmental Management Representative (EMR) and host facility EMR for specific guidance concerning an individual facility’s EMS program.
