JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER $3,500 ($2,000/$2500 for Construction/Services) AND

UP TO $150,000

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

This contract is to provide broadband telecommunications services to a maximum of 1000mbps including the capability for phone service to NPS buildings at the Triangle X Concession area in Grand Teton National Park. All necessary information will be provided to secure Right of Way permits with the National Park Service and any other land management agency. Broadband service will be provided to 17 buildings to include the installation of any necessary equipment required to provide the service. This broadband service will be used to support day to day business operations by the concessioner operating the facilities and guest services. The service will serve visitors to the location as well as provide broadband service to employees operating the facilities. The service is anticipated to provide Voice over Internet (telephone) service as well. The work under this contract is anticipated to cost

Explain:

Market research including phone calls to potential service providers and internet research was conclusive in determining the sole availability and interest of Silverstar. Pricing from a previous solicitation indicated this source could provide service within the budget available for the project. This market research combined with a previously competed solicitation in which only one provider (Silverstar) was responsive has resulted in the determination of only one responsible source.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:

Procurement history shows that competition for broadband is limited depending on the location of the end point requirements. 140P1419P0076 was competed as a total small business set aside in May 2019 as RFQ 140P1419Q0007 resulting in one quote from Millennium Networks (dba Silverstar). This requirement was for broadband installation and 5 years of service for Grand Teton NP’s south boundary housing units. 140P1418P0009 was competed as a total small business set aside in October 2018 as RFQ P17PS02598 resulting in one quote from Millennium Networks (dba Silverstar). This requirement was for broadband/fiber optic installation and 5 years of service for Grand Teton NP’s Moran housing units.

Market research via discussions with the CO as well as internet searches indicated Silverstar, Diamond Communications, and Century Link may be able to provide broadband services to the desired location.

Satellite internet options are also available in the area but were determined as not able to provide the required level of service.

Market research was conducted with Silverstar, a telecommunications small business company servicing the local area around Grand Teton National Park. The research indicated interest and ability to provide the service necessary. Silverstar owns broadband infrastructure needed to provide the service that is located adjacent to the location of the future service. Future service long term monthly costs were in the range of $50 to $200 per month per connection based on service level and type (residential or business) provided.

Internet market research occurred to determine service that could be provided by Century Link (other than small business). Use of the tools online at Century Link’s website were used and the address of the location where the service is needed as well other local addresses were used. The notice that this location is outside of the service area was received along with the suggestion to use HughesNet, a satellite internet provider. Additional internet market research indicated satellite internet was not able to provide a high enough service level to meet the needs of this contract.

Market research was conducted with CenturyLink/Clearlink via telephone. A Clearlink representative indicated companies including Airspring, Windstream, and Lumen could be able to provide the necessary service. No information was available on where the nearest infrastructure existed that would be able to provide the required service. The representative indicated that more detailed installation information was able to be determined through a contracted effort with their company. Long term monthly service costs were indicated to range from $890 per month to $6,000 per month per connection depending on the level of service provide. This range would likely be cost prohibitive as a long-term solution for broadband services for the number of connections needed at Triangle X which would limit service needed across the facilities at Triangle X. The Clearlink representative was unable to provide any other point of contact that would be able to provide additional information specific to the location needed for service.

Market research was conducted with Diamond Communication (small business currently providing service to some locations within Grand Teton NP). The representative indicated that the work required for them to provide service to Triangle X Ranch would be over $1,000,000. This would be cost prohibitive and is not close to the available budget to accomplish this project.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
