JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(JOFOC)

FAR SUBPART 6.3

I recommend the use of other than full and open competition for the acquisition of the following supplies or services. If this acquisition is to be made with only one source or a limited number of sources, negotiations will be conducted with the indicated proposed supplier(s).

1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY:

2. NATURE/DESCRIPTION OF THE ACTION BEING APPROVED:

This is a Brand Name requirement to establish an order on a Firm-Fixed-Price basis for IBM Interactive System Productivity Facility (ISPF) z/OS licenses and maintenance. The IRS requires maintenance on existing licenses and the ability to purchase and obtain additional licenses.

3. DESCRIPTION OF SUPPLIES OR SERVICES

This requirement is to purchase on-going maintenance and additional ISPF licenses and maintenance for the Internal Revenue Service (IRS). The IRS currently owns ISPF licenses that are operational in the IRS environment; this order would allow for the purchase of maintenance and additional licenses.

17. JUSTIFICATION (ADD PAGES IF NEEDED)

A. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR

THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED.

The IRS deployed IBM RACF for z/VM and in order to realize this deployments full capabilities the IBM ISPF tool is required in order for the IRS to configure, harden and monitor the z/VM LPAR on the Masterfile Mainframe Computer (GSS-21). ISPF tool will also be used to interface with other security tools (ie z/Secure) to help monitor and protect the access of taxpayer data. IBM is the developer of the Operating System Software and also the RACF component and as a result only the ISPF product will properly interface with the OS and RACF.

IBM is the only vendor that has the ability and expertise to support the software for the purposes of maintenance services, including software update, enhancements, bug fixes, and standard technical support issues because the software is proprietary property of IBM. In addition IBM does not have any authorized resellers for ISPF, which is considered a special offering. A product change is not feasible as it would require a complete change to the IRS IT environment.

B. DESCRIBE THE EFFORTS TAKEN TO ENSURE OFFERS W ERE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING W HETHER A NOTICE W AS OR

WILL BE PUBLISHED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, W HICH EXCEPTION

UNDER 5.202 APPLIES.

A notice of intent synopsis will be published on FedBizOpps (FBO). The original ISPF licenses notice of intent was also published on FBO in June 2015 and based on that posting no additional sources submitted a capability statement.

C. DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR

AND REASONABLE.

The Contracting Officer will determine the prices to be fair and reasonable based on applicable price analysis techniques.

D. DESCRIBE THE MARKET RESEARCH THAT W AS CONDUCTED AND THE RESULTS OF

THAT SURVEY. IF ACTIONS W ERE TAKEN BY PROCUREMENT PERSONNEL TO SATISFY

THIS REQUIREMENT SUCH AS A GPE SOURCES SOUGHT SYNOPSIS, PLEASE SPECIFY.

No other solutions were considered as this is the only software that will enhance the other IBM tools currently utilized.

However, market research was conducted via GSA to identify resellers, but based on communication with the OEM they do not allow resellers to offer special offerings, which include ISPF. In addition, based on the FBO posting for the initial procurement of ISPF licenses no source express interest.

The Government will continue to search the market place for IBM ISPF authorized resellers that can meet the Government’s requirement.

H. STATEMENT THAT REQUIREMENT DOES NOT RESULT FROM A LACK OF PLANNING OR

THE EXPIRATION OF FUNDS.

The program office was aware of the requirement as this is an expansion of an existing requirement and submitted the request in a timely manner, before expiration of funds. This requirement is required to ensure the IRS maintains the ability to utilize IBM ISPF licenses currently owned with no interruption and procure additional licenses.
