PERFORMANCE WORK STATEMENT
SECTION C:
DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C.1 STATEMENT OF GOVERNMENT OBJECTIVES
The BLM’s Wind River Bighorn Basin District in Wyoming is seeking a contactor to modify an allotment fence in the Cody Field Office.
Contractor shall provide all labor, equipment, tools, materials, transportation, management, supervision and other items and services necessary.
All communications with the BLM will be done using the English language. At a minimum, check in/update will be required every 7 days, from the contractor to determine progress.
C.2 DEFINITIONS
· CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.
· CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government. Note: The only individual who can legally bind the Government.
· CONTRACTING OFFICER”S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the Contracting Officer to administer the Contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
· DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement
· DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
· KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract ty the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
· PERFORMANCE WORK STATEMENT (PWS). Specific requirements the Contractor must meet in performance of the contract. The PWS contains required services (tasks/critical subtasks), performance standards, acceptable quality levels, and incentives/disincentives.
· QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
· QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
· SUBCONTRACTOR. One that enters into a contract with a prime contractor.
C.3 GOVERNMENT-FURNISHED PROPERTY
Government Furnished Equipment will include 4 miles of barb wire (in conformance to ASTM A 121); 4 miles of barbless wire (in conformance to ASTM A 121); staples; nails; replacement post for H-braces (as needed) post for gate construction and gate closure.
C.4 CONTRACTOR FURNISHED ITEMS
Equipment may include 4-wheel drive (4X4) vehicle for transportation. Contractor is responsible for all other equipment and incidentals necessary to complete contract.
C.5 TASKS/CRITICAL SUBSTASKS AND STANDARDS
Task 5.1: Remove approximately 4 miles of the existing net-wire fence and replace with a more wildlife friendly design such as four-strand barbwire with a smooth bottom wire that is raised at least 16 inches off the ground.
Task 5.2: Replace existing barbed wire that may be currently damaged or no longer serviceable with a more wildlife friendly design such as four-strand barbwire with a smooth bottom wire that is raised at least 16 inches off the ground.
Task 5.3: Install a new gate with a latch at the location designated on project map. The design of the gate will be the same type of wire and wire spacing as the fence. Line up the latch with the gate. Adjust latch assembly after installation so that the latch does not bind and the gate hangs properly.
C.6 SPECIFICATIONS
1) Fence Removal Furnishing labor and equipment to remove 4 miles of woven wire leaving existing top 2 wires and existing wood and metal fence posts, corners and braces.
2) Fence Modification Replace removed woven wire or other wires with 4 miles of fence consisting of 1 barbed wire and 1 smooth wire. Replace damaged or missing steel and wood posts as needed and approved by COR / CO. Repair existing wires as needed and as approved by COR / CO.
3) Removed Materials Debris consisting of wood posts, steel posts, and wire shall become the property of the Contractor and shall be removed from the work site. The Contractor shall be responsible for disposal of construction debris in a legal manner, and for payment of any fees required. Burning of debris is not permitted on the work site.
4) Gate Construction A rigid steel strap or 9gauge smooth wire loop 6 inches from the ground securely connected to the gate post and shaped so the gate stay shall be securely held in place. An adjustable cable or chain, or rigid steel strap fastened to a cam lever device located 6 inches from the top of the gate post. The closer shall be capable of securely holding the gate in place.
5) Access to the Work: See attached map.
1. Four-wheel drive may be necessary for access to the site. Access to the work shall be by existing roads, two tracks, and marked paths.
2. Access to the work shall be provided by and at the Contractors expense. No roads shall be constructed by the Contractor or off-road driving permitted without prior written permission from the Contracting Officer. Travel along the fence line is not permitted without prior written permission from the Contracting Officer. The Contractor shall not travel off road when the ground is wet.
3. Contractor shall exercise care to prevent unnecessary surface disturbance to existing grass, vegetation, and to existing roads and two-tracks.
4. Public, State, or private access roads damaged by the Contractor shall be restored, at the Contractor’s expense, to the same condition they were in at the commencement of work.
6) Environmental Considerations:
Cutting and clearing shall be by hand cutting (chain saws included). Dispose of cut brush by scattering it evenly along the side adjacent to the fence line.
7) SEQUENCING AND SCHEDULING:
Work Schedule: The schedule shall be submitted at the pre work conference. When requested, the Contractor shall submit an updated schedule within three calendar days. As a minimum, the estimated start and completion dates shall be shown in the schedule.
C.7 PERIOD OF PERFORMANCE
Contract will start in the fall of 2021 and be completed in the fall of 2022.
C.8 QUALITY CONTROL
Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s quality control program is the means by which the work complies with the requirement of the contract. The report shall be delivered at the beginning of the contract and will be reviewed by the Government for quality assurance. After acceptance of the quality control plan the Contractor shall receive the Contracting Officer’s acceptance in writing of any proposed change to his quality control plan.
C.9 QUALITY ASSURANCE
The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
C.10 POST AWARD CONFERENCE/PERIODIC PROGRESS MEETINGS
The Contractor agrees to attend any post award conference convened by the Contracting Officer in accordance with FAR clauses. The Contracting Officer, Contracting Officers Representative (COR, may meet periodically with the Contractor to review the Contractor’s performance. At these meetings the Contracting Officer will apprise the Contractor of how the Government views the Contractor’s performance and the Contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.
C.11 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK:
The Contractor shall supply a schedule that entails all phases of this contract to include start dates and completion dates.
