Justification for Single Source Awards IAW FAR 13.106 1 For

Over Micro Purchase Threshold but Not Exceeding the SAT ($250K)

1. Contracting Activity: The Department of Veterans Affairs, Veterans Integrated Service Network (VISN) 10, Louis Stokes Cleveland Veterans Affairs Medical Center (CLE VAMC) Network Contracting Office (NCO) 10.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Network Contracting Office (NCO) 10 intends to award a new, firm fixed price, brand name, purchase order to Cardinal Health, Inc., a large business, via Open Market. This request is for WaveMark cabinets.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies,M or services can be used: Per FAR 11.105 Items peculiar to one manufacturer and 12.4 Unique Requirements Regarding Terms and Conditions for Commercial Items, Cardinal Health, Inc., is uniquely qualified to provide the cabinets:

Identical cabinets are currently in operation in this medical center. WaveMark uses RFID and barcode enabled solutions as well as a robust cloud computing platform to help the hospital ensure patient safety, managers better control inventory, eliminate processes, reduce costs and streamline workflows. These Wave Mark cabinets must be the same system/brand to operate fully.

4. Description of market research conducted and results or statement why it was not conducted:

Market Research Findings: VetCert, MSPV, DSBS, SAM.gov, National Contracts, Interagency Contract Directory, GSA, ECAT, CM, BIC, and FPDS were reviewed with the following results:

In accordance with January 9, 2023, advisory for VetCert usage, VetCert was queried, as required, using NAICS 339113. The search provided 921 results. The SDVOSB and VOSB vendors in the market research were contacted to see if they can provide or are able to provide comparable equipment to no avail. Veteran Small Business Certification (sba.gov)

A search was conducted in the Medical Surgical Prime Vendor (MSPV) Contracts:

Equipment Home (dla.mil) using key words wavemark which resulted in no results.

A Sources Sought, RFQ 36C25024Q0445, was posted on SAM.gov, Contract Opportunities on March 9, 2024, with a response date of March 26, 2024, utilizing NAICS code 339113. No potential equals or vendor questions were received in response to posting to SAM.gov, Contract Opportunities.

A search was conducted in Small Business Administration (SBA) Dynamic Small Business Search (DSBS) SBA SBA Search Results under NAICS CODE 339113 and key words wavemark which resulted in no results.

A search was conducted on SAM SAM.gov | Search under key words wavemark which resulted with Cardinal Health, Inc.

A search was conducted on National Strategic Source Listing Medical/Surgical Prime Vendor (MSPV) Program Office of Procurement, Acquisition and Logistics (OPAL) (va.gov) using key words wavemark which resulted in no results.

A search was conducted on the Interagency Contract Directory Interagency Contract Directory Portal with key words wavemark which resulted in no results.

A search was conducted on GSA eLibrary Search Results (gsaadvantage.gov) with key words wavemark which resulted in no results.

A search was conducted in Federal Procurement Data System (FPDS) FPDS NG ezSearch with key words wavemark with several results showing Cardinal Health, Inc.

A search was conducted on Electronic Catalog (ECAT) DMMonline (dla.mil) with key words wavemark which resulted in no results.

A search was conducted on Category Management (CM) Quick Decisions Dashboard Equipment Home (dla.mil) with key words wavemark which resulted in no results.

IAWMB MemorandumM 19 13 Category Management: Making Smarter Use of Common Contract Solutions and Practices, this requirement cannot be satisfied through Best in Class contracting (BIC).

A search was conducted in The U.S. Food & Drug Administration (FDA) Search | FDA with key words wavemark which resulted in no results.

Fitara is not required.

The NMR does apply to NAICS 339113, and SBA has provided a class waiver for NAICS 339113.

There are no BAA/TAA issues. These cabinets are made in the USA.

Based on the market research conducted, no two or more VetCert verified and capable SDVOSBs or VOSBs or DSBS verified and capable small business were identified and appeared capable of performing the requirement. The VA and SBA Rule of Two cannot be met.

5.Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106 1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
