Section B: Description of the Supplies/Services Required
809 Maintenance Support Squadron (809 MXSS) has a requirement for a one (1) year plus four (4) one (1) year options for five (5) years total service contract for their Electro Optical Systems (EOS) P450 and M290 3D Printers. Service shall include technical support, software updates, two (2) preventative maintenance (PM) visits per year and replacement parts including the Beam Delivery Systems (BDM) and will take place at building 205, Hill Air Force Base (HAFB), Utah.
Section C: Justification for Soliciting from a Single Source or Brand Name
The Original Equipment Manufacturer (OEM) for the EOS P450 and M290 3D Printers is EOS. In a letter dated 29 April 2022, EOS states that, Phillips Corporation Inc., Federal Division, is the sole and exclusive distributor of EOS of North America equipment, consumables and any associated factory certified service to United Sates Government facilities.
This includes any and all service related contracts or maintenance agreements on EOS equipment. Factory certified service is required on this equipment to keep the factory warranty effective and to procure factory authorized parts for repair.
Section D: Efforts to Obtain Competition
The government SME contacted EOS in an effort to locate other vendors capable of performing the required services.
They were told that Phillips Corporation Inc., Federal Division are the exclusive distributer authorized to perform factory certified service and repairs. Additionally, a source of sought was posted on SAM.Gov from from 22 Jun 22 to 7 Jul 22 that had two (2) responses. Phillips Corporation Inc. responded and was identified as being capable of providing the required services. Parker Construction Enterprise also responded, however a review of their capabilities statement and website did not provide sufficient information to determine that they are capable of providing the required services.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
The Government intends to evaluate any opportunities to remove barriers on future requirements. The Government will continue to perform market research to see if any new opportunities allow for competition. Currently the only option for servicing the EOS 3D Printers is to use Phillips Corporation Inc., Federal Division. The government will need to reengage with EOS for future requirements, to determine if new vendors have been granted access to their

Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
