SECTION B – Supplies or services and prices /cost B-1.0 General Information

This is a Performance Based contract with provisions for firm-fixed price and minimal labor-hour rates. The contract life is a base period of one-year with four (one-year) option periods and 2 (two) 1 (one-year) performance based incentive periods. Local Area Network (LAN) relocation services are being procured on a fixed-price basis. Miscellaneous Relocation Tasks (“tasks”) will be priced using the fixed loaded hourly rates provided in Attachment I-Pricing Tables. Unit prices are provided for the base contract year and contract years one (1) through seven (7).

Services to be performed under this contract are to be performed by competent, experienced, and highly qualified personnel. For pricing purposes service personnel are divided into two categories:

Local Field Engineer: the first level of relocations and task support. The Local Field Engineer will assist in the deinstallation and reinstallation of LAN components, not involving a file server.

Local Technical Specialist: the second level of relocation and task support. The Local Technical Specialist performs reconfigurations, equipment setup, relocations involving a server.

B-2.0 Table B-1 Unit Pricing Table Instructions

Section B-2.1 provides instructions for the Unit Pricing Tables in Attachment I – Pricing Tables, Table B-1.

B-2.1 LAN Relocations – Deinstallation/ Reinstallation (Table B-1 LR01 – LR16)

The following Item Numbers in Table B-1 apply to LR01 – LR08 for 30+ day notice and LR09 to LR16 for 14 to 29 day notice.

Table B-1 for Item Numbers LR01 – LR08, the fixed prices for LAN relocations. Relocation is defined as the de-installation and reinstallation of a LAN (including all LAN connections) and bringing the LAN to an operational status. All services shall be priced on a fixed-price-per-LAN basis (not hourly rates), and shall include, but not be limited to, all labor, travel costs, material, parts, packaging, trash removal, other costs, overhead, G&A and profit. Shipping costs and cabling costs, however, are excluded. The Government shall reimburse the Contractor the actual shipping cost incurred. The shipping cost shall be a separate line item on an invoice. Shipping cost shall be limited to the costs for pick-up, transport and delivery from the existing location to a new location, (different building). Reimbursable shipping cost excludes preparation for shipment and unpackaging. Cabling effort, if required, will be separately priced outside of the relocation unit price.

B-2.2 Workstation Relocations-standalone workstations ( TABLE B-1 WR01)

The following Item Numbers in Table B-1 apply to WR01.

Workstation Relocations - the cost for standalone workstation relocations will be based on a fixed unit price per workstation and shall include but not be limited to all labor, travel costs, material, parts, packaging, overhead, G & A, and profit. Shipping cost however, shall be excluded. The Government shall reimburse the Contractor the actual shipping cost incurred. The shipping cost shall be a separate line item on an invoice. Shipping costs shall be limited to the costs for pick-up, transport and delivery from the existing location to a new location, (different building). Reimbursable shipping cost does not include preparation for shipment and unpackaging.

B-2.3 Miscellaneous Relocation Tasks Hourly Pricing (TABLE B-1 TO01 – TO04) The following Item Numbers in Table B-1 apply to TO01 – TO04.

Tasks Unit Price - The Government, at its option, may require the Contractor to perform tasks related to relocation, such as redressing of LAN cabinets and other tasks identified in Section C-3.3. These tasks will be priced using the fully loaded labor rates.

Enter the fixed loaded hourly rates. These rates are fully loaded and include travel, mileage, overhead, G&A, and profit. The cost for cable and other materials/supplies is not included and will be reimbursed only if pre-authorization is given by the COTR. The task order will be modified to include the additional cost.

Please Note: A task, at the discretion of the Government, may include a not to exceed amount of $2,500 for materials and supplies needed during the performance of that task. In these cases, the Government will only pay for the cost of the materials and supplies. Overhead, G&A, and profit are not allowable costs. Moreover, the Contractor must substantiate these material costs as part of their invoice.

B-2.4 Initial (NEW) LAN Installation During Normal And Outside Normal Business Hours (TABLE B-1 ILI01-ILI16) The following Item Numbers in Table B-1 apply to Initial (NEW) LAN Installations during “Normal Business Hours”, ILI01 – ILI08. The following Line Items apply to Initial (NEW) LAN Installations “Outside Normal Business Hours”, ILI09 – ILI16. Business hours are defined in Section C-2.1 Definitions.

The fixed prices are provided for Initial LAN Installations during normal business hours and outside normal business hours. Installation is defined as the installation of a LAN using Government Furnished Equipment (GFE), (including all LAN connections) and bringing the LAN to an Operational status.

B-2.5 Emergency New LAN Installation During Normal – And Outside Normal Business Hours (TABLE B-1 ELI01-ELI16) The following Item Numbers in Table B-1 apply to Emergency New LAN Installation during “Normal Business Hours,” ELI01 – ELI08. The following Line Items apply to Emergency New LAN Installations “Outside Normal Business Hours,” ELI09 – ELI16. Business hours are defined in Section C-2.1, Definitions.

The fixed prices are provided for EMERGENCY LAN Installations during normal business hours and outside normal business hours. Installation is defined as the installation of a LAN using Government Furnished Equipment (GFE), (including all LAN connections) and bringing the LAN to an Operational status.

B-2.6 LAN Relocations – Deinstallation/ Reinstallation including VOIP Phones (Table B-2 LR01- LR09)

The following Item Numbers in Table B-2 apply to this section, LR01 – LR08 for 30+ day notice and LR09 to LR16 for 14 to 29 day notice.

All services shall be priced on a fixed-price-per-LAN basis (not hourly rates), and shall include, but not be limited to, all labor, travel costs, material, parts, packaging, trash removal, other costs, overhead, G&A and profit. Shipping costs and cabling costs, however, are excluded. The Government shall reimburse the Contractor the actual shipping cost incurred. The shipping cost shall be a separate line item on an invoice. Shipping cost shall be limited to the costs for pick-up, transport and delivery from the existing location to a new location, (different building). Reimbursable shipping cost excludes preparation for shipment and unpackaging. Cabling effort, if required, will be separately priced outside of the relocation unit price.

B-2.7 Workstation Relocations (Table B-2 WR01)

The following Item Numbers in Table B-2, applies to this section, WR01.

B-2.8 Miscellaneous Relocation Tasks Hourly Pricing (Table B-2 TO01-TO04) The following Item Numbers in Table B-2 apply to this section, TO01 – TO04.

The fixed prices are provided for Initial LAN Installations during normal business hours and outside normal business hours. Installation is defined as the installation of a LAN using Government Furnished Equipment (GFE), (including all LAN connections) and bringing the LAN to an Operational status.

B-2.10 Emergency New LAN Installation During Normal – And Outside Normal Business Hours including VOIP Phones (Table B-2 ELI01-ELI16)

Section C – Description/specifications/Statement of work C-1.0

PERFORMANCE BASED STATEMENT OF WORK

C-1.1 Introduction The Contractor shall provide all necessary personnel, materials, services, supplies and equipment except that specified herein as government–furnished to relocate Government-owned Ethernet local area networks (LAN), Voice over Internet Protocol (VOIP) telephony desktop equipment and associated peripheral equipment. This equipment is located in the Social Security Administration (SSA) and Disability Determination Service (DDS) offices throughout the United States, including its territorial possessions.

C-1.2 Background The Social Security Administration has approximately 2,300 local area networks located in the 10 SSA regions throughout the United States. These regions include the District of Columbia, Hawaii, Alaska, Puerto Rico, Guam, America Samoa, the Virgin Islands, and the Mariana Islands. Historically, there have been approximately 200 relocations under the current contract in a 12-month period. Most relocations are within a 50 mile radius of the proposed site.

C-1.3 Period of Performance

SSA is anticipating awarding contract with a base period of one-year with four (one-year) option periods plus 2 (two) 1 (one-year) performance based incentive periods. The total anticipated system life of the contract is seven years.

C-1.4 Contract Minimum and Maximum Amount

The contract minimum amount over the life of the contract, including options is $3,641,780.00. The contract maximum amount over the life of the contract, including options is $35,000,000.

C-2.0

DEFINITIONS AND REFERENCES

C-2.1 Definitions

2.1.1 Local Area Network (LAN) a system consisting of a set of nodes that are interconnected by a set of links. The nodes and links cover a relatively small geographic area, ranging from a few feet to a mile. The nodes may be terminals, microcomputers, minicomputers, mainframes, printers, hard disk, or workstations. The links may be coaxial cable, twisted-pair wires, or fiber-optic cable. A typical SSA LAN will include equipment such as workstations, LAN cabinets, file servers, bridges, routers, switches, patch panels, printers with stands, and etc.

2.1.2 LAN Drops are Ethernet connections that allow equipment such as workstations, network printers, servers, switches, etc. to connect directly to the network. Note: Local Printers which are connected to workstations do not require LAN Drops only network printers require LAN Drops

2.1.3 Local Field Engineer is the first level of relocations and task support. The Local Field Engineer assist in the deinstallation and reinstallation of LAN components, not involving a file server.

3 Local Technical Specialist is the second level of relocation and task support. The Local Technical Specialist performs reconfigurations, equipment setup, relocations involving a server.

2.1.5 Normal business hours are Monday through Friday, the hours of 8:00 a.m. to 5:00 p.m., local time.

2.1.6 Outside normal business hours are Monday through Friday, the hours of 5:01 p.m. to 7:59 a.m., local time, including Saturday and Sunday.

2.1.7 Replacement equipment is equipment that is used to replace equipment damaged in relocation activities. The replaced equipment must be functionally equivalent to the equipment it replace.

2.1.8 Shipping Cost is limited to the cost for pick-up, transport and delivery from the existing location to a new location (different building). Reimbursable shipping cost excludes preparation for shipping and unpacking.

3 Successful completion and successfully completed mean that equipment and software has been restored to full operation.

2.1.10 Voice Over Internet Protocol (VOIP) telephony desktop is the telephone instrument that is attached to a LAN cable and the computer. It is a traditional phone that is on a users desk.

3 CONUS (Continental United States) includes the 48 adjoining states, Alaska and the District of Columbia.

3 OCONUS (Outside Continental United States) includes but not limited to Virgin Islands, Puerto Rico, Guam, America Samoa and the Mariana Islands.

C-3.0

TASKS

The Contractor must perform the following tasks:

C-3.1 Relocation of Equipment

The Contractor must relocate equipment as directed in a relocation order issued by the SSA COTR and as specified below:

a) The relocation shall consist of certificating that existing equipment is operational prior to performing the relocation at no additional cost to the Government, de-installation, packing, shipping, reinstalling of LANs, bringing equipment back up into working order and proper disposal of packing material.

b) The Government will give the Contractor written notice at least 30 days prior to any relocation to be performed. Written notification will consist of: the old site, new site, equipment to be moved, move start date and time, move completion date and time, site contact and any other special requirement relating to the equipment to be moved. The Government is responsible for backing up data prior to a relocation. The Government and the Contractor may agree to a shorter lead-time upon mutual agreement of the parties.

c) Relocations shall be scheduled for and performed on evenings, weekends, and Federal holiday for occupied space. For unoccupied space relocations may be accomplished during the week day.

d) The Government reserves the right to change the move dates, site relocation dates and/or time frames given to the Contractor no later than seven (7) calendar days prior to the move. The Contractor may be reimbursed for actual expenses incurred as a direct result of such date/location/time-frame changes.

e) The Contractor shall perform a “site survey” of the move at least one (1) week prior to the relocation. This “site survey” will entail the Contractor surveying the existing space, new space, equipment to be moved, elevator access and loading dock access. The Contractor may also be required to meet with the Government representative for the move to discuss move logistics and time frames. (Does not apply to standalone workstation relocation). Seismic bracing is to be provided and installed by the contractor when required by state and local codes. When mutually agreed upon and in lieu of site survey the Contractor must participate in a conference call with SSA Relocation Personnel, at least once weekly. This shall be provided at no additional cost to the Government.

f) The Contractor shall develop and maintain a quality control report to ensure that it performs relocation activities in accordance with the terms and conditions of each relocation order. All written quality control report must be available for the Government to review and monitor anytime during the term of the contract.

g) The Contractor shall have a sufficient number of trained technicians onsite during the site moves/relocations that have obtained Suitability Determinations in accordance with Section H-1.0 of this contract. The names of the technicians performing the moves/relocations shall be provided to the Government COTR 10 days prior to the work being performed via email.

h) The Contractor shall provide a trained technician on-site the first working day after a move to ensure that equipment is operational and to handle any customer complaints or perform troubleshooting. (Does not apply to standalone workstation relocation).

i) The Contractor shall clean up and properly dispose of all relocation associated debris immediately following a relocation. This includes removing all boxes, bubble wrap, and trash resultant from the move of equipment.

j) The Contractor shall only employ movers, transport companies, or subcontractors that have specialized previous experience in the relocation of workstations and LAN equipment.

k) The Contractor shall be liable to repair or replace any component damaged during relocation.

C-3.2 Repair or Replace Damaged Equipment The Contractor must repair or replace damaged equipment within 24 hours of a service call from the SSA Remote Operations Control Center (ROCC), When the contractor replaces damaged equipment the following IPV6 Internet Protocol and Section 508 requirements must be adhered to on all replacement equipment.

C-3.2.1 IPv6 Internet Protocol

IPv6 capability is a technical requirement for procurements of relevant network devices, system hardware and software, applications, operating systems, etc.

An IPv6 capable product or system must be able to receive, process, and transmit or forward (as appropriate) IPv6 packets and should interoperate with other systems and protocols in both IPv4 and IPv6 modes of operation. Specifically, any new IP product or system developed, acquired, or produced must:

· Interoperate with both IPv6 and IPv4 systems and products;

· If not initially capable, provide a migration path and commitment to upgrade to IPv6 for all application and product features by June 2008; and

· Have available IPv6 technical support for development, implementation, and management of deployed products, components or systems.

C-3.2.2 Section 508 Requirements

Requirements for accessibility based on Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d) and additional agency specific accessibility requirements, hereafter referred in total as “SSA’s Accessibility Requirements”, are determined to be relevant for this solicitation. Please reference Attachment VI –SSA’s Accessibility Requirements for a specific listing of all applicable SSA Accessibility Requirements for all replacement equipment in accordance with Section C-3.2.

C-3.3 Miscellaneous Relocation Tasks

The Contractor must perform in accordance with task order issued by the CO. The scope of this work will include modifications to local area networks, component installation, performing network analyses, providing advice about efficient network usage, and the loading of additional drivers for servers or workstations. For tasks that involve relocations of workstations, the Contractor shall certify in writing that the existing equipment is operational prior to shipment at no additional cost to the Government.

C-3.4 Initial (New) and Emergency LAN Installations

The Contractor shall, as directed in the task order:

3 Install new Local Area Network (LANs) to include SSA employees into the existing Intelligent Workstation on a Local Area Network (IWS/LAN) infrastructure. These LANs will be known as “New LANs/Initial Installations.” The Government will provide a 30-calendar day written notice of intent to order an Initial Installation Order. The Government and the Contractor may agree to a shorter lead-time upon mutual agreement of the parties.

3 Create a substitute LAN on an Emergency basis, as a replacement when the existing LAN is destroyed and renders an SSA office inoperable; i.e., a fire, floor, other disaster, or in other circumstances when insufficient lead time is available. These LANs will be known as “Emergency LANs/Emergency Installations

(a) Both new and emergency LANs will fit into the existing structure for LAN requirements and will add to the existing platform for distributed data processing (DDP) applications within SSA. The Government anticipates 20 new and emergency installations per year.

(b) Network Topology: The existing base of SSA LANs installed nationwide are interconnected with a Wide Area Network (WAN) backbone called the SSANet. SSANet is a star network with the central hub in Baltimore, Maryland at SSA’s National Computer Center, (NCC). The Government has converted to a frame relay routed network. SSANet is connected to remote Regional Operations Control Centers (ROCCs), located in Philadelphia, PA; Jamaica, NY; Chicago, IL; Richmond, CA; Kansas City, MO; and Birmingham, AL. Baltimore’s NCC is also the site of a Baltimore ROCC.

(c) The Government-provided network topology shall be Ethernet with cat5e or better cabling. The Government workstations are using Windows XP operating systems or better. All Initial Installations (new) will be done in an Ethernet topology.

(d) Installation activities can occur before, during or after regular business hours, which may include weekends. Timeframes for installations work will be identified in the Installation task.

(e) Access to the installation site shall be provided to the Contractor only when a designated Government representative is present. In offices with public access, the Government shall make a representative available during agreed-upon hours.

(f) SSA will pre-load software and current build information to the File Servers and Workstations prior to shipment to the new installation.

(g) Specifically the Contractor shall:

1) Unpack the Government furnished equipment, (GFE), which will be shipped to the installation site by the Government prior to the install. The GFE will include hardware and associated software, including drivers and peripherals.

2) Install, fully test and implement as operational, all equipment which can include workstations, notebook computers, peripheral devices, network servers, etc., and assure connectivity and interoperability.

3) Modify server software as required so as to make it operational; i.e., connecting to the appropriate ROCC in the appropriate domain, using instructions provided by the Government. Modify and fully test all software as needed to make workstations and LANs operational, including Government-developed applications, e-mail, and personal productivity software, using instructions provided by SSA. Upon completion of each LAN, “turnkey” use and operation must result (i.e., no additional configuration should be necessary by SSA personnel or other Contractors).

4) Convert workstation topology if required.

5) Change network and printer identifications if required.

6) Make hardware additions if required.

7) Change system properties.

8) Change drive mappings.

9) Adhere to all SSA and industry standards.

10) Provide seismic bracing where required by State or Local regulations. This shall be provided at no additional cost to the Government.

11) Remove all trash from the premises of the installation site.

12) Ensure that the SSA or DDS office be fully functional at the regular starting business hours on the Monday morning following the install or as agreed to by both parties in the Installation Order.

13) Submit one copy electronically of the completed Service Incident Report to the COTR within 5 days of the completion of each task.

C-4.0

REPORTS

The Contractor shall prepare the following reports and submit them as specified.

C-4.1 Service Incident Report Prepare a Service Incident Report immediately upon the completion of each relocation and/or task. Sign the report and obtain the signature of the individual who requested the relocation or task service to indicate that the work was completed satisfactorily. Leave a copy of the report with the person who requested the relocation or task and electronically submit a copy to the COTR. Each Service Incident Report shall contain the following information:

· Date and time the service request was received,

· Date and time of Contractor’s arrival at the service site,

· Location of the equipment serviced,

· LAN Drop Counts for LAN Relocations

· Description of Relocation or task activity,

· The date and time, that service was successfully completed.

C-4.2 Security Screening Report

The Contractor shall maintain an electronic file of all cleared employees and provide the COTR with copies on a monthly basis via email. This report shall include all personnel who require entry onto Government Property. When inside access is required the Contractor personnel will need to be screened as indicated in Section H-1.0, Security Requirements Clause.

The report shall include the following:

· Employee name (including first name, last name and middle initial)

· Employee SSN

· Employee phone number

· Employee email address

· Status of screening (ie. Pre-Approved; Final Approval)

Note: Please refer to Section H-1.0 for the Security Requirements Clause.

C-5.0

PERFORMANCE REQUIREMENTS

The contractor shall ensure that all work meets the performance requirements in accordance with the Acceptable Quality Performance Levels in section C-6.0 Performance Standards.

C-5.1 Quality Control

The contractor shall be responsible for the relocation of Government-owned Ethernet local area networks and associated peripheral in accordance with acceptable quality performance levels. The contractor shall re-perform work that does not meet contract requirements at no cost to the Government, unless otherwise directed by the Contracting Officer. Re-performance of work shall not constitute an excusable cause to delay or extend any timeliness standards or deadlines. Failure to comply with the acceptable quality performance levels will affect the extension of the two (one-year) incentive periods.

C-5.2 Quality Control Plan

The Contractor shall develop, implement and maintain a quality control program (QCP) to ensure relocation and task services are performed in accordance with the terms and conditions of the contract. The QCP shall explain the manner in which the contractor requirements are being accomplished in accordance with the contract. The contractor shall demonstrate proactive efforts to improving its services to prevent unsatisfactory performance from repeating and to ensure unsatisfactorily performance is addressed and rectified in a timely manner. The contractor shall be responsible for the quality of services provided, including those provided by subcontractors. The contractor shall submit the OCP as part of the proposal. At a minimum, the Contractor shall include in the quality control plan procedures that address the following areas:

C-5.2.1 An inspection of the LAN system that enables the Contractor to identify and correct deficiencies in the quality of service before Relocation or task activities are performed and/or the Government points out the deficiencies.

C-5.2.2 A checklist to be used in inspections. The checklist shall include every area of the Contractor’s operations under the contract, as well as all tasks performed.

C-5.2.3 Procedures for documenting and responding to relocations or tasks.

C-5.2.4 A list of all inspections conducted by the Contractor, including records of corrective actions taken as result of the inspection.

The Contractor’s written quality control plan shall be available for the Government to review and monitor during the term of the contract.

C-5.3 Quality Assurance Surveillance Plan

C-5.3.1 Background

Federal Acquisition Regulation (FAR) 37.602-2 requires that agencies develop quality assurance surveillance plans (QASPs) when acquiring services. These plans shall recognize the responsibility of the Contractor to carry out its quality control obligations and shall contain measurable inspection and acceptance criteria corresponding to the performance standards contained in the performance based statement of work(PBWS). FAR 46.401(a) stipulates that QASPs should specify (1) all work requiring surveillance and (2) the method of surveillance. The Government will provide the QASP to the Contractor after contract award. The Contractor, not the Government, is responsible for management and quality control actions necessary to meet the obligations and requirements of the contract. The role of the Government in quality assurance is to ensure that contract standards are achieved.

The QASP has been developed to evaluate Contractor actions while implementing the PBWS of this contract. It is designed to provide an effective surveillance method of monitoring Contractor performance for each objective of the PWS and to evaluate the services the Contractor is required to furnish under this contract. This QASP is based on the premise the Government desires to maintain a quality standard in LAN Relocations, and Task efforts.

In this contract, the Contractor’s Quality Control Plan is the driver for ensuring service quality. The Contractor is responsible for developing and following a comprehensive program of inspection and monitoring actions to ensure that the contract work is accomplished effectively, efficiently, and economically. The first major step to ensuring a “self-correcting” contract is to ensure that the quality control program agreed upon by the parties at the beginning of the contract provides the measures needed to lead the Contractor to success. Once the quality control program is established, careful application of the methods and standards presented in the remainder of this document will ensure a robust quality assurance program.

C-5.3.2 Performance Objectives

The performance objectives of the performance based work statement (PBWS) and of this contract consist of the following four (4) categories:

1) Quality of Service

2) Timeliness of Performance

3) Business Relations

4) Customer Satisfaction

Contractor’s performance will be evaluated and rated based on the following:

C-5.3.3 Surveillance Methods and Schedule

Periodic inspections will be conducted to monitor Contractor performance. Inspections will be conducted by the COTR and/or those persons the CO or COTR designate as contract Inspectors. The Government will use any and all methods deemed necessary to ensure that the Contractor is in compliance with the terms and conditions of the contract. These methods may include, but are not limited to, periodic random inspections on services provided. All work and services performed shall be done in accordance with the terms and conditions of this contract and with the Quality Control Plan. In the event a serious deficiency is identified during a quality control exercise, the CO and/or the COTR shall immediately contact the Contractor to discuss the Government’s findings and the steps the Contractor will take to correct the problem(s).

Periodically, but not less than monthly, a COTR will visit appropriate work areas serviced by the Contractor and either observe the Contractor performing the task or review documentation, as appropriate. The COTR will notify the Contractor’s designated contract administration representative of any performance deficiencies either immediately or at least monthly depending on the severity of the deficiency. Performance deficiencies will also be subject to the terms and conditions of paragraph (a) of FAR clause 52.212-4, which addresses price reductions for services not rendered, improperly rendered, and/or for costs that result directly from the Contractor’s failure to perform.

The COTR may also perform evaluations based upon the Contractor’s Quality Control Plan. The COTR may perform evaluations in any number of ways. For example:

a) The COTR may accompany the Contractor on scheduled inspections and observe the Contractor inspecting the services to ensure defects are corrected.

b) The COTR may immediately inspect the same area as the Contractor as soon as the Contractor has completed the quality control inspection to determine if any surveillance areas were overlooked.

c) The COTR may inspect an area prior to the Contractor and compare results. The COTR will record defects if the Contractor fails to record performance defects and defects are not corrected.

C-6.0

PERFORMANCE STANDARDS

No equipment is damaged during the relocation with 99% accuracy.

C-4.0 Reports
All reports provide the specified information, are understandable, legible, and timely with 99% accuracy.

Reports submitted in electronic format conform to SSA’s 508 Electronic and InformationTechnology Accessibility Requirements with 99% accuracy.

C.7.0 INCENTIVE OPTIONS

This contract includes a base year and six (6) incentive option years. Incentive Options are intended to reward a high level of Contractor performance with eligibility for additional option years. Conversely, use of incentive options effectively prohibits the Government from exercising options on contracts where Contractor performance is marginal.

The determination to award an incentive option, and the methodology used in making such determinations, are unilateral decisions made solely at the discretion of the Government. The exercise of incentive options will be accomplished by unilateral contract modification, in accordance with Federal Acquisition Regulation (FAR) Clause 52.217-9 -- Option to Extend the Term of the Contract.

The earned Incentive Option opportunity will be based on the Contractor’s performance during each evaluation period. Performance evaluation criteria are set forth in the National Institute of Health (NIH) Contractor Performance System (CSP) using the Contractor Performance Insert Form – Standard Evaluation, and amplified in the table above (see Section C.6.0). If the Contracting Officer (CO) does not provide specific notice in writing to the Contractor of changes to the evaluation criteria prior to the start of an evaluation period, the same criteria from the preceding period will be used in the subsequent evaluation period. Any changes to evaluation criteria will be made by revising the QASP and notifying the Contractor.

Annual Evaluations: The annual evaluation period concurs with the annual performance period of the contract. Contract Inspectors will submit their evaluation reports to the Contracting Officer’s Technical Representative (COTR) 14 calendar days after the end of the evaluation period. The COTR will reconcile the reports and document a summary report on a Contractor Performance Report – Standard Evaluation within 30 calendar days of the end of the performance period being evaluated. The COTR will then forward a copy of the Report to the Contractor for Comment. The Contractor has 14 calendar days to provide comments to the COTR. When Contractor Comments are received, the COTR will determine the overall grade and submit the report to the CO for approval. After CO approval, the COTR informs the Contractor (in writing) of its overall grade and the impact on available incentive option periods.

Interim Evaluations: Interim performance evaluations will be conducted when the Quarterly QASP evaluations indicate a significant decline in Contractor performance. If, as a result of this review, the Contractor’s performance is determined to have fallen from Outstanding or Excellent to Fair or below, or from Good to Unsatisfactory, the opportunity for all future option periods may be cancelled. However, if insufficient time remains in the performance period to competitively reacquire the required services, the Government may exercise its unilateral right under FAR 52.217-8 to extend services for up to six months.

One interim evaluation will be conducted at the end of the second Quarter of the base year of the contract. The availability of the first incentive option period will be based on this interim evaluation.

The following table represents the performance standards that must be met to enable the Government to exercise each incentive option. Note that the performance standards grow progressively higher over the potential life of the contract. For the base year the standard is “fair”. The Standard for Option years #1 through #4 is “good”, and the Standard for Option years #5 through #6 is “excellent”.

The responsibility of the contract inspectors include, but are not limited to: inspecting the work to ensure compliance with the contract requirements; documenting through written inspection reports the results of all inspections conducted; following through to assure that all defects or omissions are corrected; conferring with representatives of the Contractor regarding any problems encountered in the performance of the work; assisting in the preparation of performance evaluations; and generally assisting the COTR in carrying out his responsibilities.
