LETTER TO PROSPECTIVE OFFERORS

Dear Prospective Quoter:

Subject: U.S.-KENYA CREATIVE ECONOMY LEADERS NETWORK EVENT SERIES

Enclosed is a Request for Quotations (RFQ) for U.S.-KENYA Creative Economy Leaders Network Event Series. If you would like to submit quotation, follow the instructions in Section 3 of the solicitation, complete the required portions of the attached document, and submit it to the address shown on the Standard Form 1449 that follows this letter.

The U.S. Government intends to award a contract to the responsible offeror representing best value using comparative evaluation authorized under FAR 13.106-2(b) (3). A comparative evaluation is defined as the act of comparing two or more offers in response to the RFQ. The item-by-item comparison is performed by comparing each offer directly to one another to determine which provides the best value to the Department.

Comparative evaluation is NOT a low price technically acceptable (LPTA) or trade-off process.

Prospective offers must still meet basic standards for responsibility at FAR 9.104 and solicitation compliance to be eligible for award. We intend to award a contract based on initial quotations, without holding discussions, although we may hold discussions with companies if there is a need to do so.

The Embassy intends to conduct a pre-quotation conference at the site, The pre-proposal conference will be held on February 22, 2024, 2:00 pm (local time) at the U.S. Embassy Nairobi.

Prospective offerors/quoters who contacted the Contracting Officer within the presolicitation notice deadline have been granted access to the pre-quotation conference.

Quotations are due by March 6, 2024, 4:00 p.m. No quotations will be accepted after this time.

Proposals must be in English and incomplete proposals will not be accepted.

Your quotation must be submitted electronically to NairobiGSO-Contracts@state.gov. It is important to make sure the submission is made in specific size and format; in MS-Word 2007/2010 or MS-Excel 2007/2010 or Adobe Acrobat (pdf) file format. The file size must not exceed 30MB. If the file size should exceed the 30MB, the submission must be made in separate files and attached to separate emails with less than 30MB each.

SUMMARY

1. Introduction

U.S. Embassy Nairobi requires more direct engagement with key influencers in the Creative Economy Space. Recent developments in Kenya’s Creative Economy space, including the investment in Kenya by U.S. companies such as Hollywood studios, the Grammys, and the NBA highlight an opportunity to energize and empower capable entrepreneurs in the market in collaboration with established Creative Economy leaders. Local innovators cooperating with American partners can produce more films in Kenya, increase and internationalize Kenya’s music business, monetize Kenyan leadership in sports to build job-creating leagues and marketing initiatives, strengthen innovation in the food industry and agricultural trade, and combine the growing startup scene in Kenya with creators and tech entrepreneurs to build up new industries.

U.S. Embassy Nairobi is seeking a vendor to coordinate and help collaborate with creative economy space players in Kenya through leadership and networking events. The vendor is expected to leverage its contacts and resources per the following statement of work.

PERFORMANCE WORK STATEMENT

The purpose of this firm fixed price contract is to provide event coordination services for the Public Diplomacy Office (PDS) Nairobi. The contract will be for a one-year period from the date of the contract award.

2. Scope of Work

The vendor should effectively do the following:

• Gather and coordinate Kenyan and U.S. influencers in the Creative Economy field, with Embassy guidance.

• Facilitate four parallel Leadership Sessions and Networking Events in April, June, September, and December. Three events will be held in Nairobi and a fourth will be in Mombasa, coinciding with other large events as detailed below.

• Coordinate these Sessions and Events in connection with significant Cultural and Business Happenings. The venues for the networking events are yet to be determined.

Leadership Sessions These will be high-level stakeholder meetings between government, private sector, and creative industry leaders, in the Kenyan Creative Economy space and rising startups, as well as relevant government officials who can potentially support Creative Economy initiatives through regulatory or legislative action. Guests from government offices the level of Cabinet Secretary & Principal Secretary, business leaders at the level of CEO’s and Directors.

• Scheduled approximately two hours in advance of the Networking Event.

• Thirty participants; turnout at the event is the responsibly of the contractor. Guest list to be evaluated and cleared through the Embassy.

• Vendor to create, send invites and get RSVPs. Embassy to review and clear the draft invite. The invites could be electronic or invitation cards

• Partner with Embassy team to select and confirm participants.

• Vendor to coordinate with the presenters, prepare and make available any materials e.g.

presentations, videos required during this leadership session

• Venues: to be determined The Embassy will secure event venues for all programs. Event organization as well as guest hospitality will be part of the vendor’s package.

Networking Events Larger reception-style engagements in the evening and in conjunction with significant cultural or business happenings in Kenya.

• Timing: 6-8 p.m.

• Participants: 150 for the first event, then 50 participants for the other three events; turnout at the event is the responsibly of the contractor. Guest list to be evaluated and cleared through the Embassy.

• Vendor to create, send invites and get RSVPs. Embassy to review and clear the draft invite. The invites could be electronic or invitation cards

• Supplement existing invitations with recommendations for attendees, subject to Embassy approval

• Leverage existing relationships with VIPs to ensure maximum turnout.

• Venue: Nairobi location to be determined (for three of the four events). One other event in Mombasa; location to be determined.

• Embassy will secure event venues for all programs. Decorating the location and guest hospitality will be part of the vendor’s package (appropriate tents and lighting, chairs, tables, PA system)

• Vendor to procure food, and drinks (cocktails and heavy Hors d'oeuvres, not full dinner);

Embassy to select vendor and approve menu,

• Moderate program, videography (only for the Mombasa event), managed media presence etc.

• Entertainment element to be developed in consultation with the Embassy, for example a mini fashion show.

• Create meeting spaces throughout events venue.

• Execute Embassy-approved run of show on reception night; there will not be constant entertainment, but more “flair moments”.

3. Guest list criteria

The Embassy seeks a diverse mix of VIPs tailored to the context for each event. For example, the NBA event in September should include Kenyan Government contacts in the Ministry of Youth Affairs, Sports and The Arts, investors with a background/interest in sports, and industry professionals such as agents, coaches, players, etc. Other VIPs may include:

• Kenyan leaders and influencers in the specific themed fields

• Government officials at the level required to advance partnerships.

• Chief executive officers, directors, and top-level management

• Local innovators and tech entrepreneurs

• Investors

4. Place of Performance

Three of the four Leadership Sessions and Networking Events will take place in Nairobi as outlined below. The final program will take place in Mombasa.

U.S.-Kenya Creative Economy Connections 2024 – (Late April) – Nairobi Take place on the sidelines of the AmCham Summit, should be a mixed industries event, synergizing across different areas like film, fashion, sports, etc.

• Venue: Nairobi – Leadership sessions

• Venue: Nairobi – Networking Event

• Date: Late April 2024.

• Participants: 30 Leadership session and 150 Networking event

• Mini-fashion show during the Networking event.

U.S.-Kenya Food Innovation and Trade – (Mid-June) – Nairobi Take place on the sidelines of the Afmass Food Expo, East Africa's biggest food manufacturing and industry trade show.

• Venue: Nairobi – Leadership sessions

• Venue: Nairobi – Networking Event

• Date: Mid-June 2024.

• Participants: 30 Leadership session and 50 Networking event

U.S.-Kenya Sports Industry Elevation – (Mid-September) – Nairobi In coordination with the NBA, approaching one year anniversary of Nairobi-based operations.

• Venue: Nairobi – Leadership sessions

• Venue: Nairobi – Networking Event

• Date: Mid-September 2024.

U.S.-Kenya Creative Economy on the Coast – (Early December) – Mombasa Take place on the sidelines of the Mombasa International Film Festival to close us out for 2024.

• Venue: Mombasa venue to be secured by Embassy

• Date: Early December 2024.

The following table is provided for additional context to the event requirements. The table below describes the April event. Similar activities will be required for the other three events base on the excerpts 4 ii, ii & iv above.

4. Quality Assurance Surveillance Plan (QASP)

This plan provides an effective method to promote satisfactory contractor performance.

The QASP provides a method for the Contracting Officer's Representative (COR) to monitor Contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract. The role of the Government is to monitor quality to ensure that contract standards are achieved.

Key Tasks for Reference

Pricing notes

• Vendor to ensure all third-party costs are factored-in in their quote.

• Transport of people and equipment, to and from events is the responsibility of the vendor.

• The vendor shall be responsible for logistical aspects of the events planning.

• The vendor shall identify a Project Manager, proficient in English, who shall be responsible for the overall management of the series of events and shall represent the vendor during meetings with U.S. Embassy counterparts.

• The Project Manager shall attend all planning meetings, prepare Status Reports on the events, and submit them to all the U.S. Embassy Team. Status Reports shall contain meeting minutes, arising concerns and proposed solutions, any pending review comments, any proposed changes, and any other pertinent information required to report the progress of the project.

• All documentation produced for this project is property of the U.S. Government during or after completion of this project. No information is for public release without the U.S.

Embassy approval.

• All documents/photos provided by the Embassy shall be returned to the US Embassy counterparts and shall not be copied, retained by the Contractor, nor distributed elsewhere.

III. VALUE ADDED TAX

The Government will not reimburse the Contractor for Value Added Tax (VAT) under this contract. All taxable supplies (goods and services) to the United States Embassy in Kenya are exempt from Value Added Tax. See the VAT Act, 2013, 2nd Schedule, Part B ‘Zero Rates Supplies to Public Bodies, Privileged persons and Institutions’, para (3). Vendors are therefore required to present invoices without a tax element, i.e., indicate 0% VAT on all invoices. The Purchase Orders or Contracts issued by the United States Embassy will serve as the basis for Zero Rating when vendors are accounting for VAT with the Kenya Revenue Authority.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
