4. Statutory Authority Permitting Other Than Full an Open Competition: The statutory authority permitting other than full and open competition is 10 U.S.C. § 2304(c)(1) as implemented by (FAR) 6.302-1 – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited: The only approved manufacturer with the comprehensive knowledge and expertise necessary to produce and repair the required items for this action is Exlar Corporation, 18400 W 77th St. Chanhassen, MN 55317, Cage Code 1KHV0, the Original Equipment Manufacturer (OEM). Exlar is the only known source that has produced and serviced this item either as a direct supplier or sub-contractor. The Government does not own a Technical Data Package (TDP) for this item. Exlar is the holder of the TDP for these items.
The Acquisition Method Reason Code (AMRC) for the spare part being acquired through this acquisition is 4Q. The “4” means acquire, for the first time, directly from the actual manufacturer rather than the prime contractor who is not the actual manufacturer. The “Q” signifies that the Government does not have adequate data, lacks rights to data or both, needed to purchase item from additional sources.
Exlar, the manufacturer of the actuators, is the only known source with knowledge of the design that can meet the Government’s spare and repair requirements. Without the complete TDP for the actuators, it is anticipated that reverse engineering efforts would result in extensive delays in meeting the Government’s requirement and delivery expectation. The Government requires deliveries within 9 months after award of a delivery order.
6. Efforts to Obtain Competition In an effort to ensure that offers are solicited from as many potential sources as is practicable, this action was publicized as required by FAR Subpart 5.2 to Federal Business Opportunities (FBO).
A synopsis was posted to FBO on 25 October 2018.
Market research was conducted as described in the market research section of this document. This effort did not yield any additional sources that can meet the Government’s requirements. There is no competition anticipated for this acquisition.
7. Action to Increase Competition: The Government does not own the rights to the actuators identified for this effort. As such, there will be no opportunity to increase competition. The Government will not purchase these rights from Exlar Corporation, as it is be extremely cost prohibitive.
8. Market Research: Market Research was conducted on 25 October-15 November 2018 by issuing a Sources Sought Announcement (SSA) onto FBO website. An additional SSA, SPRBL119R0040 on 13 February 2019, was conducted by DLA Land Aberdeen which produced no responses. DLA then reached out to respondents from the previous sources sought yielding interest from one potential source and contacted a second potential source from a similar contract.
