3. Description of Supplies/Services:

These parts support systems used in Army aircraft to aid in tactical navigation. The AN/ARN-147 VOR/ILS/GS/MB Radio Receiving Set

Both the Radio Receiver, NSN 5826-01-444-0314, and the Control Radio Set, NSN 5826-01-444-0317 support the AN/ARN-147 VOR/ILS/GS/MB system.

The Receiver Radio, NSN 5826-01-293-4789, supports the AN/ARN-149 LF-ADF system. It is a receiver with and includes 28-volt .

The Radio Receiver, NSN 5826-01-600-6180, supports the AN/ARN-149 LF-ADF system. It has

The Control Direction F, NSN 5826-01-395-5325, supports the AN/ARN-149 LF-ADF system. It provides serial tuning and control inputs and includes 5-volt

The black Antenna, NSN 5985-01-446-2574, supports the AN/ARN-149 LF-ADF system and is a combined sense and loop antenna.

The Control Radio Set, NSN 5826-01-341-5089, supports the AN/ARN-149 LF-ADF system. It provides serial tuning and control inputs and includes 28-volt

The Radio Set, NSN 5826-01-386-8807, supports the AN/ARN-153 TACAN system and is also called a receiver-transmitter. It has both a digital-to-analog adapter and a MIL-STD-1553B interface, using 28-volt dc input power.

4. Authority Cited:

The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Reason for Authority Cited:

The only known manufacturing source of supply for all eight spare parts described above is Rockwell Collins, Inc., 400 Collins Road NE, Cedar Rapids, IA, 52498-0505, CAGE 13499. Rockwell is the original equipment manufacturer of the aforementioned systems. The LRU parts to be acquired were designed and developed by Rockwell, and have undergone continual hardware and software revisions by Rockwell in response to obsolescence and performance concerns.

The Government does not own the technical data for the AN/ARN-147/149/153 systems or these parts. If an alternate source could be found that could provide compatible parts, the Government would need to qualify the alternate parts, test them, revise all associated technical manuals, and procure the alternate parts.

As reported in WebFLIS, the Acquisition Method Code (AMC) and the Acquisition Method Suffix Code (AMSC) is shown in the table below for all eight parts.

The AMC for all of the LRUs is “3” meaning that the Army’s Design Control Activity has directed that the part “shall be acquired for the second or subsequent time directly from the actual manufacturer”.1

One NSN is coded with an AMSC of “D”. The AMSC “D” means that “the data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material.” Two NSNs are coded with an AMSC of “P”. The AMSC “P” means that the “rights to use the data need to purchase this part from additional source(s) are not owned by the Government and cannot be purchased, developed, or otherwise obtained”, and it “is uneconomical to reverse engineer the part”.2 Five NSNs are coded with an AMSC of “R”. The AMSC “R” means that the “Government does not own the data or the rights to the data needed to purchase this part from additional sources”, and it “is economical to reverse engineer the part”.3 In summary, both the AMC and the AMSC values indicate that the parts must be obtained from the manufacturer that owns the technical data packages, which is Rockwell.

6. Efforts to Obtain Competition:

Market research was conducted, details of which are in the market research section of this document. This effort yielded no other potential sources for this effort.

In accordance with FAR 5.201, this action will be synopsized in FedBizOpps at least 15 days prior to issuance of the solicitation.

7. Fair and Reasonable Cost Determination:

As the Contracting Officer, I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable based on price analysis. Certified cost and pricing data will not be obtained for these commercial items in accordance with FAR 15.403-1(b)(3). Information other than certified cost and pricing data will be obtained and analyzed as needed to support a fair and reasonable determination of prices.

8. Market Research:

Sources Sought Announcements and Responses In February 2015, the Army Item Manager only expected requirements for four of the eight NSNs on contract SPRBL1-13-D-0011. Contract SPRBL1-13-D-0011 was awarded to Rockwell Collins on April 19, 2013 as a three year firm fixed price, indefinite delivery indefinite quantity sole source contract under FAR 6.302-1.

Based on this projection, the Army Technical Expert posted a Sources Sought Announcement (SSA) to FedBizOpps (www.fbo.gov) on February 23, 2015, for the following four NSNs. The response date was March 26, 2015. Only Rockwell Collins responded on March 5, 2015 indicating their interest.

One response received: Rockwell Collins.

After a re-validation of projected future requirements, the Army Technical Expert posted a second SSA on FedBizOpps on August 12, 2015, for the following two additional NSNs listed below, which increased the acquisition scope. Two responses were received. Rockwell Collins responded and indicated interest and furthermore would extend the current contract SPRBL1-13-D-0011 by one year at the current year pricing.

Davenport Aviation (Davenport) responded stating that they are a reseller for Rockwell Collins parts and that they have a GSA schedule GS-07-328AA that includes these parts.

Two responses received: Rockwell Collins and Davenport Aviation.

In accordance with DFARS PGI 206.302-2(b), actions cited in the previous Justification and Approval for SPRBL1-13-D-0011 (solicitation SPRBL1-12-R-0022) to promote competition have been completed. As discussed in the market research section above, the Government continued to conduct market research.

10. Interested Sources:

Rockwell and the two resellers Davenport Aviation and MHP Electric have expressed interest in supplying these items.

11. Actions to Increase Competition:

Recent market research as described above has yielded three potential suppliers of the eight parts. The Government will continue to conduct market research to ascertain if additional changes occur in the marketplace that would enable future actions to have competition.
