Justification for Other Than Full & Open Competition (November 2011)
6. The use of the authority cited in other than 10. U.S.C. 2304(c)(2) above is based on:

7. Efforts to ensure that offers are solicited from as many sources as practicable are:

This requirement will be posted to BetaSam utilizing solicitation number SPMYM3-20-Q-3056.

Sources sought notice SPMYM3-20-Q-5S02 was posted to BetaSam. No responses were received.
9. Additional facts supporting other than full and open competition are:
[X] As stated in the attached certification by the requiring activity, the Military Services will be seriously injured if contract award is delayed. The extent and nature of harm are detailed in the attached certification

The Portsmouth Naval Shipyard will continue to try to initiate the procurement process far enough in advance to allow for attempted competition on these type of requirements.
12. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
Previous acquisitions will be looked at for this material and an inflation analysis developing a should cost will be conducted. Negotiations will be held with MetalTek to obtain the best price possible for the Government.
13. Additional facts, if any, supporting this determination:
Information was provided to demonstrate the length of time that can pass between the initiation of a requirement to the time the material arrives on the Shipyard. Three examples provided by the Shipyard are as follows:
SPMYM3-11-C-3044: Awarded to Metaltek on 9/21/2011, received 9/2012.
SPMYM3-11-C-3047: Awarded to Metaltek on 9/21/2011, received 8/2012.
SPMYM3-11-C-3012: Awarded to Metaltek on 4/27/2011, received 9/2011.
