Section L
Price proposal Instructions
Pricing for the entire quantity must be submitted in Section B of the solicitation. Offerors must submit pricing for the entire quantity in order to be considered for award. Price offered must be unit prices which are clearly stated and which require no further interpretation by the Government in order to determine the actual offered price. Unit prices offered must include costs of compliance with all solicitation requirements. All pricing information should be contained in the solicitation document. Failure to submit proposed price in accordance with these instructions may result in rejection of the offer.
Certified cost and pricing data is not required at this time; however, the offeror may be required to submit certified cost and pricing data or data other than certified cost or pricing data during discussions, if held, to the extent deemed necessary by the contracting officer.
II. Technical Proposal Instructions In order to be considered for award, an offeror must take no exception to any of the terms of the solicitation and meet or exceed the acceptability standards for the following non-price factors:
Technical Technical Acceptability will be the non-price factor in the evaluation process and will be defined as an offeror that meets the minimum requirements of the solicitation and takes no exception to the terms and conditions of the solicitation.
Past Performance Past performance will be based on the offeror’s performance record relating to contracts of similar scope and complexity within the last 24 months. Based on the performance record obtained from the Supplier Performance Rating System (SPRS) and Contractor Performance Assessment Report System (CPARS), the Government shall have a reasonable expectation that the offeror will successfully perform the required effort based on the offeror’s quality and delivery track record indicating no major issues, or the offeror’s performance record is unknown. Past performance will be evaluated on an acceptable/unacceptable basis.
SECTION M - EVALUATION FACTORS FOR AWARD
Lowest Price Technically Acceptable in accordance with FAR 15.101-2 will be the source selection approach. The government will make award to the responsible offeror that offers the lowest priced technically acceptable offer. To be technically acceptable, an offer must meet the requirements of and take no exception to any of the terms and conditions of this solicitation, including any amendments.
I. TECHNICAL EVALUATION
Technical
Technical Acceptability will be the non-price factor in the evaluation process and will be defined as an offeror that meets the minimum requirements of the solicitation and takes no exception to the terms and conditions of the solicitation. Proposals being evaluated against the technical acceptability requirement will receive a rating of acceptable/unacceptable:
Acceptable: Proposal that meets the minimum requirements of the solicitation and takes no exception to the terms and conditions of the solicitation Unacceptable: Proposal does not meet the minimum requirements of the solicitation and/or takes exception to the terms and conditions of the solicitation.
Past Performance
Past performance will be based on the offeror’s performance record relating to contracts of similar scope and complexity within the last 24 months. Based on the performance record obtained from the Supplier Performance Rating System (SPRS) and Contractor Performance Assessment Report System (CPARS), the Government shall have a reasonable expectation that the offeror will successfully perform the required effort based on the offeror’s quality and delivery track record indicating no major issues, or the offeror’s performance record is unknown. Any instances of major quality discrepancies that have not been promptly remedied will be deemed unacceptable.

The Government may hold discussions with an offeror to rectify any deficiencies. If an offeror’s initial proposal is so deficient as to make the proposal technically unacceptable, the Government reserves the right to reject the offeror’s proposal as unacceptable regardless of the cost or price offered.
The competitive range will be determined after the initial evaluation of technical and price proposals and before negotiations are held with offerors. Offerors not determined to be in the competitive range will not be considered for an award and they will be notified in writing.
The Source Selection Authority will determine which proposals were determined to be the Lowest Price Technically Acceptable.

RQ032: EXPORT CONTROL OF TECHNICAL DATA
This item has technical data some or all of which is subject to export-control of either the International Traffic in Arms regulations (ITAR) or the Export Administration Regulations (EAR), and cannot be exported without prior authorization from either the Department of State or the Department of Commerce. Export includes disclosure of technical data to foreign persons and nationals whether located in the United States or abroad. This requirement applies equally to foreign national employees and U.S. companies and their foreign subsidiaries. DFARS 252.225-7048 is applicable to this data.
The Defense Logistics Agency (DLA) limits distribution of export-control technical data to DLA contractors that have an approved US/Canada Joint Certification Program (JCP) certification, have completed the Introduction to Proper Handling of DOD Export-Controlled Technical Data Training and the DLA Export-Controlled Technical Data Questionnaire (both are available at the web address given below), and have been approved by the DLA controlling authority to access the export-controlled data. Instructions for obtaining access to the export-controlled data can be found at:

To be eligible for award, offerors and any sources of supply proposed for use are required to have an approved JCP certification and have been approved by the DLA controlling authority to access export-controlled data managed by DLA. DLA will not delay award in order for an offeror or its supplier to apply for and receive approval by the DLA controlling authority to access the export-controlled data.
