Any questions submitted and not addressed below have been determined to be exceptions to the Solicitation. Please submit them with your proposal for determination.

DLA Response: Customer account information must be protected by DFARS clause 252.204- 7012.

2. Page 16, I801.01 NOTE 2: In the “event of a drawdown, not simply exceeding the upper bound of the bandwidth, the contractor will be compensated in accordance with paragraph (c) below.”

[(A)] Does this imply a scenario for usage over the bandwidth, regardless of reason, may not be paid? [(B)] Please explain if there is any difference in costing Excess Energy, for any reason, beyond the Adder value.

DLA Response:

[(A)] I801.01NOTE 2 is in direct reference to a drawdown as opposed to usage above the bandwidth during times when a drawdown is not in effect.

[(B)] Yes. In accordance with I801.01, NOTE 4: For Excess Energy during a time when a drawdown is in effect, the price paid by the Government would be the price as reflected in the existing formula (i.e., the market price plus $.00075/kwh) PLUS a pass through of losses and ancillaries for the excess energy.

3. Our definition of ancillaries is inclusive of all non-utility charges, ancillary services arising from uplifts, services, congestion, and other ISO charges or administrative fees incurred in connection with delivery of energy. Is this consistent with DLA’s definition?

DLA Response: DLA’s definition remains solely with the ISO’s definition, in this case (ERCOT). We purposely do not identify all of the ancillaries because, a) they get reviewed annually, and b) they are not all applicable. It is the vendors decision which to consider applicable. In accordance with the solicitation, clause C800, paragraph (a) STATEMENT OF WORK. The Contractor shall supply electricity and any ancillary services required to deliver electricity to the point of delivery and for the scheduling and coordination of the delivery of electricity to the service point for each account under the contract. ERCOT defines Ancillary Services, as well as Regulation Services at http://www.ercot.com/glossary.
