Justification for Other than Full and Open Competition
1. Summary/Introduction:
This justification is executed by the Defense Logistics Agency (DLA) Energy, Aerospace Energy Supplier Operations Division, as the contracting activity. DLA Energy Aerospace Customer Division, Support Branch, has requested the action being approved for an extension modification of three-months, for continued delivery of Liquid Helium to Holloman AFB as currently provided under SPE601-14-D-1530 which expires on February 28, 2016. The extended period of performance is for three (3) additional months, that is, from March 1, 2016, through May 31, 2016. Issuing this extension will achieve two benefits to the Government. First, with the end date coinciding with the expiration of two other helium dewars contracts there is an anticipated increase in competition for follow-on contracts. Second, a follow-on contract satisfying multiple liquid helium requirements will allow for greater efficiency in contract administration and thus avoid substantial duplication of cost to the Government. The estimated dollar value of this action is $9,875.
2.Nature and/or description of the action being approved (FAR 6.303-2(b)(2):
DLA Energy has a requirement for continued delivery of liquid helium in dewars supporting the 846th Test Squadron at Holloman AFB, NM. Contract SPE601-14-D-1530 was originally solicited as full and open competition. However, responses were limited to one source and the contract was awarded to Airgas USA, LLC. As stated, by extending the period of performance by a three-month period and then soliciting concurrently for future requirements, better competition and pricing is anticipated. Funds for any additional costs will be appropriated using FY16 funds.
3.Description of supplies or services required to meet the agency’s need (including estimated value) (FAR 6.303-2(b)(3)):
This three-month period of performance extension is for liquid helium, a commercial item, which is a mission critical element for the 846th Test Squadron programs at Holloman AFB, NM.
Without liquid helium, the squadron is unable to execute its mission; therefore, it is essential that they have a continuing and uninterrupted supply of liquid helium. The extension will cover 750 liters of helium, or one 250-liter and one 500-liter dewar.

4.Identification of the statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4)):
This J&A is based upon the authority of 10 U.S.C. §2304(c)(1), as implemented by Federal Acquisition Regulation 6.302-1. The supplies and services required by the agency are only available from one responsible source and no other type of supplies will satisfy agency requirements.
5.Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (FAR 6.303-2(b)(5)):
Although the solicitation was solicited in a full and open competitive environment, only one responsible offeror expressed an interest. The low estimated quantity and the type of container required was a possible deterrent for competition.
6.Description of the efforts made to ensure that offers are/were solicited from as many potential sources as is/was practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies (FAR 6.303- 2(b)(6)):
The original solicitation was synopsized in accordance with FAR Subpart 5. In addition, all future requirements will be synopsized on the Government Point-of-Entry, www.fbo.gov. All responsible sources may submit a capability statement which will be considered by DLA Energy Aerospace Energy.
7.Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable (FAR 6.303-2(b)(7)):
DLA Energy Aerospace Energy FEM will ensure that the anticipated cost to the Government will be fair and reasonable based on price analysis IAW FAR 15.404-1(b)(2)(ii), Comparison of proposed prices to historical prices paid. Any resultant prices will be firm fixed price. If DLA Energy is unable to determine proposed prices fair and reasonable when compared to historical prices, certified cost and pricing data may be obtained.
8.Description of the market research conducted and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)):
Based on historical market research data and current DLA Energy-FEM contracts, only large businesses have shown the capability of fulfilling the needs of this requirement. Since 2001, all of the contracts for liquid helium that DLA Energy FEM has awarded have been to large businesses. Extensive market research was conducted during the prior acquisition, but DLA Energy-FEM was not able to locate any responsible small businesses that produce or distribute liquid helium.
9.Any other facts supporting the use of other than full and open competition, such as (FAR 6.303-2(b)(9):

10.A listing of the sources, if any, that expressed, in writing, an interest in the acquisition (FAR 6.303-2(b)(10):
Airgas USA, LLC was the only source that expressed interest in the requirement.
11.Actions that may be taken to remove or overcome barriers to competition before any subsequent acquisition for the supplies or services are required (FAR 6.303-2(b)(11)):
Based upon the preceding, it is necessary to extend the Contract for three-months, from March 1, 2016 through May 31, 2016. The three months will allow the expiration date to coincide with other contracts supporting liquid helium in dewars. This requirement will expire at the end of this extension. A new requirement will be synopsized on www.fbo.gov and all sources who request a proposal package will be provided a copy of the RFP.
