Amendment 0004 under solicitation SPE600-17-R-0516, dated June 19, 2017 is hereby issued to provide response to offerors questions related to the Performance Work Statement (PWS) and to incorporate changes to the following within the solicitation:
A. Added Provision E-0006 E36 INSPECTION (STORAGE) (DLA ENERGY FEB 1970) The facilities to be provided hereunder shall be ready for inspection and acceptance by __________________________. The Contractor shall notify the Contracting Officer of the date such tanks and facilities are available for inspection and acceptance, and the Contracting Officer, or his designated representative, shall promptly thereafter inspect such tanks and facilities. No payment will be made for services performed or facilities provided prior to ________________________.
B. Relocated clause 52.204-16 COMMERCIAL AND GOVERNMENT ENTITY CODE REPORTING (JUL 2016) within Section K to Section L.
C. Added clause 52.232-17 INTEREST (MAY 2014) (IBR)

Is an asset inventory available for fixed and mobile equipment and what is the method of valuation if ultimately used by Contractor?? Government furnished equipment, if any, is listed in Appendix AF.
3 What is the number of personnel currently employed?
DLA Energy will not provide detailed information regarding to current contractor.
4 What are the current shift patterns?
DLA Energy is uncliear on the intent of this question.
Contractor believes that this contract is subject to European TUPE legislation, this requires that all employees will be transferred to the new contractor with their current employment rights and salary.This information will have to be made available to Offerors are expected to determine applicable country laws and comply with applicable laws accordingly.
Are you able to clarify what maintenance of buildings is undertaken by Contractor and
BCE.
The Contractor is responsible for general cleanliness and for calling in work orders to BCE for building maintenance and repair.
The Contractor shall provide, at Contractor expense without additional government funding, all personnel, supplies, materials, fuel, equipment, vehicles, services (routine or emergency),training and other items necessary for performance of the requirements of this contract not otherwise identified in the basic PWS or Appendix AF.This clause states that the Contractor is required to carry out any duties not listed at no extra cost.
The boundaries to such obligation need to be clarified.
IAW PWS C-3.1 General Scope of Work, "The Contractor will be responsible for providing the necessary personnel and resources to accomplish all tasks specified herein at Contractor expense unless otherwise specifically stated otherwise." The statement in Appendix F merely reiterates the earlier reference and is intended to stress the non-reimburseable, firm fixed price nature of the contract which is a change from previous contracts. Tasks to be performed are provided in the PWS. The Contractor is responsible for determining and providing all necessary resources to accomplish these tasks.
Is Contractor supplying operator vehicles for this contract? If yes, what specification would these need to be?
The Contractor is not providing special purpose vehicles for this contract. It is the Contractor's responsibility to determine the requirement for general purpose vehicles and propose accordingly.
We understand the contract is being let by the DLA but please can you confirm the contracting entity for this contract, is it US/German entity to ensure we as contractors can ensure all relevant taxes are understood and applied? As an example Penspen want to understand whether British Value Added Tax (VAT) is chargeable on invoices?
The contracting entity is the Defense Logistics Agency Energy, please refer to FAR 52.229-6 ( c), and remember that offerors need to disclose the taxes included in their price under K-0003 K86.
Contractor kindly request a native version of “Attachment_III_- _Contractor_Performance_Assessment _Qs” A copy of Attachment III - Contractor Performance Assessment Questionnaire is provided in Word for your convenience.
Contractor will be working to UK health and safety legislation, can we assume this will be universal for all bidders and we wont be penalised on cost. Offerors are expected to determine applicable country laws and comply with applicable laws accordingly.
Is DLA going to provide sponsorship for acquisition of Security Clearance for upcoming solicitations?
A security clearance is not required. Contract employees must be able to pass a NACI or equivalent background check meeting requirements to obtain a Common Access Card (CAC) for base entry and internet access.
Please provide the following information for all current employees working at Ramstein. Individual names are not required, but all detailed information for each employee to include, as a minimum:
1. his or her official role/position
2. annual salary,
3. any associated benefits package (including, for example, where appropriate, any bonus payments, pension and private health),
4. age and length of service
5. notice period, 6 any collective bargaining agreement or labour contract that is in force
DLA Energy will not provide detailed information regarding to current contractor.
Appendix AF states that average transfer volume is 205,000 gallons and this occurs twice a week. What is the average transfer duration? The transfer could take between 3 to 5 hours.
