DLA has a requirement to obtain eXtyles software and maintenance. eXtyles software and maintenance is a brand name item peculiar to one manufacturer, Atypon Systems LLC.
DLA has a requirement to obtain eXtyles software and maintenance. The contract will include a twelve-month base period, plus two option years. eXtyles software is key in the conversion of MILSPECs (Military Specifications) and MILSTAN (Military Standards) from word documents to XML (Extensible Markup Language) format, meeting MIL-961 formatting rules and is customizable. DLA needs to maintain support and maintenance on this software in order to maintain upgrades and customization. eXtyles is a requirement for the ASSIST application. The estimated total for base year and both option years is
FAR 13.106-1(b)- For purchases not exceeding SAT contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.
Atypon System, LLC is the sole source to provide eXtyles to DLA. Ayton System, LLC specializes in standards and specifications and is customizing their tool to meet MIL-961 formatting guidelines.
The Atypon Systems, LLC vendor for the eXtyles tool procured is to provide maintenance and upgrades to the eXtyles software tool that currently resides on DLA desktops and one server. The maintenance and upgrades will allow the customization of the eXtyles to meet conversion of word documents to XML in accordance of MIL-961 guidelines; and to maintain cybersecurity for the tool.
Atypon Systems, LLC has already provided first year training of their tool and started the customization of the tool. The contract number the tool was purchased on was SP7000-18-C-0002, under previous company name Inera.
The biggest cost was the original purchase of the tool, this new contract will be for the maintenance and upgrades of the eXtyles tool.

Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.
When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived.
• Include a copy of the previous justification.
• The approval authority shall determine whether the planned actions were completed. If the actions were not completed, the justification for the follow-on acquisition shall be approved by the approval authority one-level above the approval authority for the previous justification (see FAR 6.304). A notice was posted to FBO for 5 days.
The program office has done extensive research to see if any other vendors were able to provide the services. An RFP was submitted 2 years ago, there were no COTs products that performed the requirement. Atypon Systems, LLC is the developer of eXtyles and the only vendor that provides maintenance/upgrades/customization for eXtyles. The findings from this market research subsequently confirmed only Atypon Systems, LLC is the only vendor capable of providing the required support. There is only one vendor that provides maintenance or customization for the eXtyles software tool, Atypon Systems, LLC. Atypon Systems, LLC is the creator and vendor of eXtyles.
Only eXtyles brand name maintenance and upgrades meet the Government’s needs. No other vendor could provide the software tool or maintenance of the tool. DLA would incur higher costs to purchase a new tool.

9. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

At this time, the required eXtyles software maintenance is the only product that will support DLA’s requirements and meets the Government’s needs. However, DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and the Government. As a continuing effort, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure full and open competition.
