LIMITED SOURCE JUSTIFICATION

1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY.

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEINGAPPROVED.

This limited source justification authorizes and approves the procurement of WebMethods

Version 9.6 Software Licenses and Maintenance Renewal. WebMethods version 9.6 Software Licenses and Maintenance are brand name products and services peculiar to one manufacturer, CGI Federal, Inc. (“CGI Federal”). This acquisition will be solicited on a sole source basis to CGI Federal, the only authorized provider of the required WebMethods Version 9.6 Software Licenses and Maintenance.

3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS/ESTIMATED DOLLARAMOUNT.

DLA has a requirement to purchase the following WebMethods version 9.6 Software Licenses and Maintenance Renewal listed in the table below:

4. THE AUTHORITY AND SUPPORTING RATIONALE (SEE 8.405-6(b)) AND, IF

APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR’S

UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR

SERVICE.

The statutory authority permitting this limited source (including brand name) acquisition is FAR 8.405-6(b)(1). In accordance with FAR 8.405-6(b)(1), this Limited Source Justification is required for the sole source (including brand name) acquisition of WebMethods Version 9.6 Software Licenses and Maintenance. WebMethods v9.6 is currently being used solely in the Momentum Software suite as a "Pass Through" Third Party software. The Momentum software suite is proprietary software that is solely managed by CGI Federal Inc., therefore the WebMethods v9.6 software licenses that currently working in conjunction with the Momentum software suite as a pass through third party software, can only be accessed, maintained and manipulated by CGI Federal Inc., as such, the required software license maintenance is not available through any other vendor. The unique integration of WebMethods Version 9.6 Software Licenses and Maintenance are brand name items peculiar to one manufacturer, CGI Federal, which is essential to the Government’s requirements, and no other companies similar products meet, or can be modified to meet, the agency’s needs.

The Department of Defense (DoD) Enterprise Funds Distribution (EFD) system is a multi-service/multi-agency solution established as a key initiative to provide full visibility of funds distributed through Echelon I and II for Military Departments and at all levels for all Defense Organizations receiving and distributing Defense funding. The goal of the DoD EFD is to improve and modernize the Office of the Under Secretary of Defense Comptroller (OUSDC) funds distribution process. Funds distribution, by its nature, is a key enabler of financial visibility within the DoD enterprise systems. The concept of a fully visible and auditable enterprise funds distribution process provides the capability for planned and coordinated funds development and execution and an auditable process as mandated by Congress.

The DoD EFD initiative was established in 2006 to provide visibility of funds distributed through and across the DoD and to harmonize service and agency funds distribution systems and in some cases replace antiquated capabilities. The intent of the DoD EFD support is to increase visibility, auditability, and efficiency in the management of distributed funds.

The Government requires continued use of the WebMethods Version 9.6 Software Licenses and Maintenance in order to ensure continued development and sustainment of the DoD EFD system.

Due to the proprietary nature of the software, no other vendor or manufacturer can provide, access, manipulate, or support the WebMethods v9.6 software licenses. WebMethods Version

9.6 Software Licenses and Maintenance is the only product that meets the Government’s needs and CGI Federal is the only source capable of providing the required products and services.

5. DETERMINATION BY THE ORDERING ACTIVITY CONTRACTING OFFICER

THAT THE ACQUISITION REPRESENTS THE BEST VALUE CONSISTENT

WITH FAR 8.404(d).

The Contracting Officer will determine that the acquisition represents the best value to the

Government consistent with FAR 8.404(d). In making his best value determination, the Contracting Officer will perform a price reasonableness analysis utilizing the techniques found at FAR 15.404-1, to include, but not limited to: (1) Comparison with proposed prices to historical prices, whether by the Government or other than the Government, for the same or similar items (FAR 15.404-1(b)(2)(ii)); (2) Comparison with competitive published price lists, published market prices of commodities, similar indexes, and discount or rebate arrangement (FAR 15.404- 1(b)(2)(iv)); and/or (3) Comparison of proposed prices with the Independent Government Cost Estimate (FAR 15.404-1(b)(2)(v)).

6. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AMONG

SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE

REASON MARKET RESEARCH WAS NOT CONDUCTED.

Market research was performed based on the unique requirement and use of WebMethods

Version 9.6 within the EFD Application. WebMethods v9.6 is a third party pass through software that works solely with the Momentum Software suite, therefore WebMethods Version 9.6 software maintenance can only be procured from CGI Federal.

Additionally, due to the unique use WebMethods v9.6, CGI Federal is the only company that can access and provide the required software maintenance.

7. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION.

8. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY

SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE.

At this time, WebMethods version 9.6 Software Licenses and Maintenance currently being used as a pass through third party software solely with the Momentum Software Suite are the only products that will allow continued development and sustainment of the DoD EFD application meet the DoD’s need for increased visibility, auditability, and efficiency in the management of distributed funds. However, the Government will assess the procurement environment to determine compatibility with DLA/DoD requirements and the ability to promote competition to the maximum extent practicable.
