Source Selection Information See FAR 2.101 and 3.104
LIMITED SOURCE JUSTIFICATION
(For Acquisition Conducted Under the Authority of the Multiple Award Schedule
Program)
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY
Requiring Activity:

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED:
This action is planned as a sole source procurement of specialized software to Gurobi Optimization LLC. This justification and approval authorizes and approves the issuance of a contract to acquire the optimization package and annual maintenance and software upgrades of Gurobi Mathematical Programming System software from Gurobi Optimization LLC. This will be a twelve- month period of performance. Gurobi software is to be used by DLA Energy J62BG to incorporate in their technical refresh of the Bulk Fuels Bid Evaluation Model (BEM) application. This Justification seeks to provide for the purchase of this license for a 3-year period: a Base Year: December 12, 2019 to December 11, 2020, Option Year 1: December 12, 2020 to December 11, 2021 and Option Year 2: December 12, 2021 to December 11, 2022.
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS/ESTIMATED DOLLAR AMOUNT:
This requirement is for a 12-month Base Period and two 12-month option periods. The Base period of performance begins December, 12, 2019 and runs through December 11, 2022.

Limited Source Justification for FMD Software Maintenance programming system with a newer, faster, more robust package. This purchase is needed for the contractor to develop and upgrade this system.
Carroll Nelson & Associates requires the use of Gurobi Software in order to assist the Defense Logistics Agency (DLA), Information Operations (J62), in providing application maintenance and technical support to the Defense Logistics Agency Energy for their automated information systems Bid Evaluation Model (BEM). The estimated price for the base year is $ . The total with 2 option years will be . The Software is currently in possession by DLA Energy. However, this is the estimated price for the need to maintain a valid license agreement which requires the annual license fee purchase.
4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE (SEE 8.405-6(b)) AND, IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR’S
UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE.
The statutory authority permitting other than full and open competition is Title 10, U.S.C. 2304
(c) (1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source as referenced by the name brand citation, “Gurobi”. Gurobi is the fastest mathematical programming solver on the market, as has been consistently demonstrated through benchmarks against competing solvers. The algorithms used by Gurobi are more advanced than the competition. Gurobi also provides a Java API that is easy to learn and use. Gurobi will greatly reduce the time required to solve BEM models.
5. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION REPRESENTS
THE BEST VALUE CONSISTENT WITH FAR 8.404(d).
The use of Gurobi Mathematical Programming System software is essential to the Government’s requirement. EPST is a critical application used to manage and program in the Bid Evaluation Model (BEM) and Offer Entry Tool (OET), which are used by DLA Energy and maintained bu J62BG. The Defense Logistics Agency is the Department of Defense’s (DoD) largest combat support agency, providing worldwide logistics support in both peacetime and wartime to the military services as well as to several civilian agencies and foreign countries. In order to help to accomplish its mission, DLA has a need to provide and maintain automated data processing capabilities.
Although a lapse of maintenance does not prohibit use of the software, without a support agreement, DLA Energy does not have access to software patches, updates and upgrades as well as 24-hour a day, seven days a week software support. A software failure or issue would pose an unacceptable risk to the analysis of bulk fuel bids.
6. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AMONG
SCHEDULE HOLDERS AND THE RESULTS OR STATEMENT OF THE REASON
MARKET RESEARCH WAS NOT CONDUCTED.
This requirement is limited to one source because Gurobi owns the intellectual property rights to the Gurobi software for which DLA Energy has restricted user rights, and requires continued software maintenance and periodic software upgrades. Because Gurobi Optimization LLC is the sole provider for software upgrades and maintenance for Gurobi software, limited market research was conducted.
7. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION.
The Government will attempt to obtain offers from as many vendors as practicable. Proposals will be analyzed in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not necessarily limited to: 1) comparison of proposed prices received in response to the solicitation (reference FAR 15.404-1(b)(2)(i); 2) comparison with competitive published price lists (reference FAR 15.404-1(a)(2)(iv); and 3) comparison of proposed prices with prices obtained through market research for the same or similar items (reference FAR 15.404-1(b)(2)(vi)) in order to obtain a fair and reasonable price.
8. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY
SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES.
Gurobi Optimization LLC is the sole designer, manufacturer and reseller of Gurobi Mathematical Programming System and annual maintenance; therefore limited market research was performed. No sources were found on the DoD Enterprise Software Initiative and NASA Solutions for Enterprise-Wide Procurement websites.
