(16) Description:
(i) This is a combined synopsis/solicitation Request for Proposal (RFP) for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
This requirement will be solicited as unrestricted.
(ii) Solicitation Number SP4709-19-R-0013
(iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95.
(iv) The North American Industrial Classification System (NAICS) code for this acquisition is 541519 (Size Standard: $27.5M).
(v) BASIS FOR AWARD: The Government will make an award based upon lowest priced technically acceptable offer under the current requirement. Vendor must provide a letter from the manufacturer confirming proof of designation as a certified reseller of Vertiv (formerly Emerson Network Power) / Liebert products and services. The Technical volume must delineate the firm’s ability to meet every aspect of the Government’s requirement. The package must attest to the fact that the firm can provide the required deliverables. The Government will review all proposals to confirm that they meet all items contained in the schedule of items identified for Data Center East (Dayton, OH) Uninterrupted Power Supply (UPS) Purchase and Demolition/Installation Services.

1. BACKGROUND: DLA has a requirement to demolish and replace the current 400 kVA Uninterrupted Power Supply (UPS) at the Data Center East (Dayton, OH) location. Upgrading the UPS is not possible due to the aging of this current technology and new UPS components are more efficient with a smaller footprint, and can be placed on computer room floor, closer to the equipment required to be supported. This eliminates the need for a separate room to support the UPS and batteries along with the required redundant AC units for those supporting UPS-Battery rooms. The current single UPS system is located in the basement of Building 207. The new location of the UPS shall be the first floor in Building 207.
2. OBJECTIVE: The contractor shall purchase and install two new UPS lithium ion batteries and cabinets at the Data Center East (Dayton, OH). This equipment shall be integrated and monitored with the current SiteScan software. The new UPS installation must provide site equipment with an uninterrupted power supply in the event of power failure, until alternate power comes online.
The new UPS systems shall be installed first (including new electrical wiring). Once the switch has been made from the old UPS to the new UPS, the contractor shall then demolish and remove the old UPS to ensure that there are no unnecessary or excessive power outages. If power outages are absolutely necessary, they are to be scheduled at least 2 weeks in advance.
The contractor shall furnish all necessary tools, parts/materials, transportation, equipment, and personnel to install UPS and accessory components, new electrical wiring necessary to the installation, connect the new UPS systems to the current electrical grid, and demolish and remove the old UPS.

4. TASKS: The Contractor shall be required to perform the following tasks:
4.1 Kick Off Meeting:
4.1.1. The Contractor shall attend an on-site kickoff meeting to review the contract, establish timeline, coordinate site access, and review site access requirements. DLA will provide (as needed) site drawings, coordinate/minimize power outage(s), and discuss other questions/topics, etc.
4.1.2. Meeting shall occur within two weeks of award.
4.1.3 Provide list of equipment and delivery dates for the arrival of equipment.
4.1.4 Feeder sizes shall be determined at time of the kickoff meeting.
4.1.5 Timeline of demolition, installation and rewiring shall be provided no later than two weeks after kickoff meeting.
4.2 Installation

4.2.1. All work is scheduled to be completed during normal duty hours, Monday through Friday between the hours of 0700-1700, except if outages need to be coordinated, as discussed in Section 2.
4.2.2. The DLA Technical Point of Contact (TPOC) will ensure the installation site is prepared and tagged out/facilities secured. The contractor will inspect the site to ensure safety requirements have been met and that the work is ready to start using Vertiv approved workers.
4.2.3. The contractor shall install and configure the new electrical wiring and equipment prior to starting the demolition portion.
4.2.4. Electrical:
4.2.4.1 Contractor shall install the two Liebert EXM UPS and supporting devices that will connect to Data Center East power.
4.2.4.2. The contractor shall install all conduit and wire as needed to install (2) new UPS systems and (2) Liebert FDC Power Distribution Cabinets
4.2.4.3. The contractor shall install locomotive cabling as needed for battery rack connections.
4.2.4.4. The contractor shall install Site-Link Cable
4.2.4.5. The contractor shall provide one (1) new 400A Automatic Transfer Switch
4.2.4.6. The contractor shall re-feed eight (8) existing Power Distribution Units
(PDU):
4.2.4.6.1. UPS 1 shall have the odd PDU numbers connected, i.e. PDU 1,3,5 and S-1
4.2.4.6.2. UPS 2 shall have the even PDU numbers connected i.e. PDU 2,4,6 and S-2
4.2.4.7. The contractor shall make all final electrical connections to the new equipment and provide fuses/breakers as needed.
4.2.5. The contractor shall connect the new UPS and accessory components to the electrical grid with the new wiring.
4.2.6. The contractor shall tie the four new Liebert units into the SiteScan monitoring system and reprogram SiteScan as required with new floorplans and the additional equipment purchased and installed.
4.2.7. When the contractor is ready to turn over the integrated UPS system, the contractor will coordinate the functional system operational test with the TPOC.
The TPOC will work with WPAFB CE to schedule on-site load test of system with generator. In addition, the TPOC will document System Acceptance, to the Government Point of Contact, and copy the contractor to authorize DLA’s concurrence with invoices.
4.2.8. The contractor shall complete start-up services by a Vertiv certified Engineer after the installation of all of the electrical and equipment. This start-up service shall include the new UPS, batteries, maintenance bypass cabinets, and power distribution units to ensure electrical and operational function.
4.2.9. The start-up service is also when the one (1) year LIFE Services shall begin. A contract modification shall be issued once the LIFE Services, one-year Period of Performance begins.
4.2.10. The start-up service shall include training. The training shall include an overview of the day-to-day operations of the new Liebert equipment. The basic training is what is commercially available/offered from the manufacturer. There are no extra training manuals needed, only what comes with the equipment.
4.2.11. Once the UPS(s) are installed, contractor will update the electrical one-line drawing to reflect the new equipment and electrical power wiring. Contractor shall supply the diagram in one (1) hard copy AND one (1) soft copy in a printable format, such as Visio or Computer-Aided design and drafting (CAD).
The soft and hard copy shall be turned into the DLA TPOC and they shall verify the soft copy format for operability.
4.2.12. The contractor shall demolish old UPS and battery racks.
4.2.13. The contractor shall remove all existing PDU feeders once new feeders have been installed.
4.2.14. The contractor is responsible for removing all trash and debris from the worksite.
The worksite shall remain in an orderly and neat appearance daily (i.e. trash and tools put away). At project completion, the work areas shall be free of all debris/dust and all old equipment. The contractor is responsible for taking all trash with them and is not permitted to use the trash receptacles on the Government premises.
4.2.15. All distribution power whips to remain in place as is.
5. KNOWN SITE CONDITIONS
A lift gate will be required, the Data Center does not have a loading dock to receive heavy equipment.
The basement, where the current UPS location is, is not wide enough to remove the UPS at one time. The UPS must be broken up and removed in sections, as the door width is 3’ 4”.
Due to ductwork and pipes, the basement ceiling height in some areas is 4’ 9”.
The basement does not have a direct exit and all demolished material shall be taken out through either the first floor (elevator or stairs). The stairwell also has an emergency exit between the basement and first floor that leads out to the back of the building which may be used.
• Qualified vendors may request a site visit or picture of the worksite. All requests must be received by July 26, 2019 by 3:00 p.m. (EST). Only one site visit per vendor is allowed.
6. DELIVERABLES

7. PERIOD OF PERFORMANCE:
The estimated PoP for the installation and demolition of the UPS systems is approximately sixteen to eighteen weeks.
The period of performance for the LIFE services shall be 12 months; the start time shall begin AFTER the start-up services are completed.
All purchased Liebert equipment will be warrantied for one year, and will be migrated into the current Enterprise Liebert maintenance at end of manufactured warranty.
8. HOURS OF OPERATION
The Contractor shall conduct the installation and demolition, Monday through Friday, except for Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. Work operation can begin as early as 7:00 a.m. and as late as 5:00 p.m. each day. The Contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks when the Government facility is not closed for the above reasons.
The Contractor will not perform services on the following federally observed holidays unless prior request, coordination and approval is obtained from the COTR:

9. SECURITY REQUIREMENTS:
No employee or representative of the Contractor will be admitted to the work site unless he/she furnishes satisfactory proof that he/she is a citizen of the United States. Security requirements apply to the prime Contractor and any Sub-Contractors the prime Contractor may employ during the course of this contract, as well as any temporary employees that may be hired by the Contractor. The Government retains the right to request removal of Contractor personnel whose actions, while assigned to this contract, are determined by the Contracting Officer (KO) to conflict with the interests of the Government. If such removal occurs, the Contractor shall assign qualified personnel to any vacancy.
The Contractor is responsible for employees and Sub-Contractors under their employment.
Contractors will ensure that employees are familiar with and obey installation traffic, safety, and security regulations. Contractor employees, including Sub-Contractors, are required to wear the Pass or Access Control Badge conspicuously on their outer clothing and above the waist at all times. Personnel are subject to challenge and removal from the work area if the Pass or Access Control Badge is not being worn. It is the KO or designee’s responsibility to enforce this requirement. Failure to do so may be just cause for ordering that work on a contract be stopped.
Firearms, Weapons, Alcoholic Beverages, Illegal Drugs, and Contraband are prohibited on federal property. Violators may be prosecuted. State issued/authorized concealed weapons permits are not valid on Federal property.
10. BASE PASS AND IDENTIFICATION / VEHICLE PASSES
All contractor employee(s) accessing any DoD installation shall be subject to a criminal history background check. Vehicle registration, proof of current and valid insurance and a current and valid driver’s license must be presented for vehicles and vehicle operator. Any passengers of the vehicle shall have a valid and current driver’s license.
Contractor employees must follow procedures for Installation Access (Non-DOD Cardholders/Visitors). Multi-day visits or access to Restricted Areas may require Personally Identifiable Information to allow for a local records check. Physical Security will run a criminal history check on Contractor employees as a condition of access to the installation. If entry is denied, the Contractor will be immediately notified. Physical Security may require updating or rechecking criminal history based on the duration of the contract. NOTE: The Vetting Official will deny access to any person who the Installation Commander has deemed unfit for unaccompanied access. Depending on the site, a Government escort may be required. Trusted Traveler Program (TTP): Contractors are not authorized to use the TTP to escort individuals on to the installation.
Expired, invalid, inaccurate, inoperative or terminated Pass or Access Control Badge shall be returned to the KO or his designee for disposition. These cards are the property of the U.S.
Government and shall not be retained by the cardholder upon expiration, replacement, or when the DoD affiliation of the employee has been terminated. The KO or his designee shall deliver all returned Contractor badges to the Welcome Center within 5 business days. If the Pass or Access Control Badge is lost or stolen, a police report will be completed and the Contracting Officer or designee will submit a new request. Compliance with this requirement is mandatory and certification thereof to the KO is required prior to submitting final invoices. Failure to return badges will hold up Contractor's final payment.
11. TRAVEL
Travel will not be reimbursed and should be included in the proposal.
12 PROPOSAL PREPARATION COSTS:
The Government shall not be responsible or liable for any costs incurred by any parties in the preparation and submission of any technical proposal or price quote in response to this RFP.
13 SUBMISSION OF QUESTIONS
Should the offerors have any questions with respect to this RFP, they should submit them, via email, to the Contracting Specialist and Contracting Officer referenced on page one of this RFP.
Offerors are strongly urged to follow-up the submission of any questions with a phone call to the Contracting Officer/Specialist to ensure that questions have been received.
All questions are due no later than July 26, 2019 at 3:00 PM (EST).

(vii) 12-Month Period of Performance (PoP): 12 months from date of award
(viii) The FAR provision, 52.212-1, Instructions to Offerors – Commercial, applies to this acquisition and the following addenda are added to this provision:
1. Addendum to 52.212-1(e) Multiple offers.
Alternative commercial items may not be considered for award on this instant acquisition, however, may be utilized for market research on future requirements.
2. Addendum to 52.212-1(g): Contract Award.
_X_ If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
3. Addendum to 52.212-1(h) Multiple awards.
The Government intends to make one award.
The Government may make more than one award.
Offers may be submitted for quantities less than those specified.
4. Addendum to 52.212-1(j) Data Universal Numbering System (DUNS) Number
The requirement to provide a DUNS number with the offer applies at all dollar values if the offeror is required to register in the Central Contractor Registration (CCR) Database in accordance with DFARS clause 252.204-7004.

6. Addendum to 52.212-1(l):
Special Instructions/Conditions/Notices to offerors for submission of Source Selection proposal information:
(1) Proposal Information:
a. This RFP will be posted to the Federal Business Opportunities (FBO) website under NAICS code 541519 ($27.5M).
b. Offeror shall submit a proposal with a total price for all CLINs. Within the proposal, the offeror shall provide a breakdown of the unit prices for each item listed in Schedule of Supplies/Services for this RFP.
c. Proposals shall be submitted electronically to:
i. patricia.1.kenneh@dla.mil & maureen.gushue@dla.mil .
d. Offers are due no later than 12:00 PM (Eastern Time) on August 12, 2019.
(i) The FAR provision, 52.212-2, Evaluation – Commercial Items, applies to this acquisition. The evaluation criterion for the technical proposal and price proposal is set forth in paragraph below.
The award shall be made to the responsible offeror whose proposal is determined to be the Lowest Price Technically Acceptable (LPTA).
The Government contemplates the award of a single firm fixed price contract based upon the successful offerors’s proposed solution. For LPTA proposals, this is done through the establishment of minimum requirements to be evaluated on an “acceptable” or “unacceptable” basis. Proposals are evaluated for acceptability, but not ranked using the non-price factors. In order to be considered awardable, the proposal must be deemed “acceptable.”
This LPTA evaluation includes the following non-price factors.

Only the proposals found to be technically acceptable will be further evaluated for award. Technical acceptable means a proposal is “acceptable” for all factors.
Price will be evaluated for fairness and reasonableness.
The proposal must demonstrate to the Government’s satisfaction that the offeror is able to provide the services that will ensure the successful accomplishment of the tasks outlined in the Statement of Work. The Government will evaluate the offeror on the basis of the information presented in the written proposal.
(ii) Offerors shall include a copy of the FAR provision at 52.212-3, Offeror Representations and Certifications – Commercial Items with their offer. Each offeror’s proposal will only be determined to be “acceptable” if it not only includes each item in the Schedule/SOW but also does not include any exceptions to the terms and conditions of this solicitation.
(iii) The FAR clause, 52.212-4, Contract Terms and Conditions – Commercial Items, applies to this acquisition and the following addenda are added to this provision.
The following clauses are incorporated in this solicitation and provided in full text:
FAR 52.224-1 – Privacy Act Notification (APR 1984)
(a) The Contractor agrees to --
(1) Comply with the Privacy Act of 1974 (the Act) and the agency rules and regulations issued under the Act in the design, development, or operation of any system of records on individuals to accomplish an agency function when the contract specifically identifies --
(i) The systems of records; and
(ii) The design, development, or operation work that the contractor is to perform;
(2) Include the Privacy Act notification contained in this contract in every solicitation and resulting subcontract and in every subcontract awarded without a solicitation, when the work statement in the proposed subcontract requires the redesign, development, or operation of a system of records on individuals that is subject to the Act; and
(3) Include this clause, including this subparagraph (3), in all subcontracts awarded under this contract which requires the design, development, or operation of such a system of records.
(b) In the event of violations of the Act, a civil action may be brought against the agency involved when the violation concerns the design, development, or operation of a system of records on individuals to accomplish an agency function, and criminal penalties may be imposed upon the officers or employees of the agency when the violation concerns the operation of a system of records on individuals to accomplish an agency function. For purposes of the Act, when the contract is for the operation of a system of records on individuals to accomplish an agency function, the Contractor is considered to be an employee of the agency.
(c)
(1) “Operation of a system of records,” as used in this clause, means performance of any of the activities associated with maintaining the system of records, including the collection, use, and dissemination of records.
(2) “Record,” as used in this clause, means any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, education, financial transactions, medical history, and criminal or employment history and that contains the person’s name, or the identifying number, symbol, or other identifying particular assigned to the individual, such as a fingerprint or voiceprint or a photograph.
(3) “System of records on individuals,” as used in this clause, means a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual.

FAR 52.212-3 - Offeror Representations and Certifications - Commercial Items (Oct 2018)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u)) of this provision.
(a) Definitions. As used in this provision--
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service—
(6) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(7) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror.
Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000- 9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
“Veteran-owned small business concern” means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
“Women-owned small business concern” means a small business concern --
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
