JUSTIFICATION FOR OTHER THAN FULL AND
OPEN COMPETITION
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY:

2. NATURE AND/OR DESCRIPTION OF ACTION(S) BEING APPROVED:
This justification authorizes the use of other than full and open competition for the procurement of brand-name specific Liebert Uninterrupted Power Supply (UPS) hardware and installation services in support of the DLA Data Center East in Dayton, OH (“Data Center”). The solicitation will be issued unrestricted via Open Market procedures as a combined Synopsis/Solicitation Request for Proposal (RFP) posted to the Federal Business Opportunities (www.fbo.gov) system.
The current Dayton UPS system is over 25 years-old and must be replaced to ensure power continuity to the Data Center should site power fail. The UPS provides transitional power for the time period between commercial power failure and when a battery, diesel-generator, or other power source(s) picks up the Data Center equipment loads. Without this brand-name Liebert UPS solution, Data Center switches, routers, servers, and monitoring equipment could lose their data or cause equipment failure for various internal and external DLA customers.
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS, INCLUDING AN ESTIMATED DOLLAR AMOUNT:
DLA has a requirement to procure the following brand-name Liebert UPS hardware and installation services in support of the DLA Data Center East in Dayton, OH:

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN
FULL AND OPEN COMPETITION:
The statutory authority permitting other than full and open competition is Title 41, U.S.C 3304 (a)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy the agency requirement.” The applicable authority is FAR 6.302-1(c), which concerns brand-name descriptions.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF ACQUISITION REQUIRES USE OF
CITED AUTHORITY:
In accordance with FAR 6.302-1, only one source – Liebert Corporation (subsidiary of Vertiv, Inc.) – can provide the required brand-name products and services for this acquisition effort because its products and services are unique and essential for the Government to satisfy its requirement to ensure power continuity at the DLA Data Center East. The brand-name Liebert UPS hardware and installation services comprising this requirement are integral to this effort because the DLA Enterprise currently employs a Liebert SiteScan monitoring system (sustained under contract SP7000-19-F-0028) which only works to its full potential with other Liebert-specific products. Furthermore, only installation services provided by authorized resellers of Liebert products will satisfy this requirement because only Liebert-authorized professionals have access to the proprietary information and programming data necessary to implement this brand-name solution.
A UPS functions to provide transitional power for the time period between commercial power failure and when a battery, a diesel-generator, or other power source(s) picks up equipment loads. The Data Center’s current UPS is over 25 years-old and must be replaced to ensure power continuity in the event there is a power failure.
Liebert Corporation (and its authorized resellers) is the only source that can provide a replacement UPS solution that can be properly monitored to ensure that a power failure does not cause an interruption to DLA’s mission and workload. Only a brand-name Liebert UPS system will interface with DLA’s existing Liebert software (SiteScan) at the level of quality required, as other solutions do not provide the necessary data, alerts, or usage reports of the UPS system. Without this brand-name Liebert UPS solution, there is an increased likelihood Data Center switches, routers, servers, and monitoring equipment could lose their data or cause equipment failure for various internal and external DLA customers.
Liebert’s SiteScan software is currently utilized as the DLA Enterprise-wide standard architecture monitoring system and only a brand-name Liebert UPS solution will directly integrate with the existing monitoring system in the detail that is required. While other UPS systems will work with SiteScan, only Liebert-specific UPS systems will provide reports that show live site data; usage reports for power, frequency, and capacity; degradation detection;
and a ticket tracking system that collects data for down equipment. If DLA were to procure a UPS that is not a brand-name Liebert UPS system, the only information received would be whether the system is functional or nonfunctional. Thus, the capabilities provided by this brand-name solution significantly decrease the possibility of power failure and interruptions to DLA mission and workload.
Additionally, only authorized resellers of Liebert products can provide the installation services required because only Liebert-authorized resellers have access to the proprietary information and programming data necessary to implement this brand-name solution. These services are vital to DLA ensuring its UPS system is properly configured and installed, and therefore, essential to ensuring power continuity at the Data Center.
In accordance with FAR 6.302-1, brand-name Liebert UPS hardware and installation services are essential to the Government’s requirement because only Liebert UPS systems interface with DLA’s existing monitoring system at the level of quality required and only authorized resellers of Liebert products possess the necessary proprietary information and programming data to implement this brand-name solution. No other source is capable of satisfying the Agency’s requirement.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:
The current action will be issued unrestricted as a combined Synopsis/Solicitation RFP SP4701-19-R- 0013 posted to the Federal Business Opportunities system (www.fbo.gov) via Open Market procedures in accordance with FAR Part 12.
Vertiv, Inc. is the Original Equipment Manufacturer (OEM) that provides Liebert UPS hardware and installation services. However, Vertiv, Inc. has numerous authorized resellers that are capable of providing the required brand-name Liebert UPS solution. All authorized dealers will be given an opportunity to submit an offer.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED
COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: (1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); (2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv));
and/or (3) comparison of proposed prices obtained through market research of the same or similar items (FAR l 5.404- l(b)(2)(vi)) in order to obtain a fair and reasonable price. The Contracting Officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS:
Market research actions were conducted amongst the OEM and one authorized reseller of the required products and services via Open Market procedures. The findings from this market research confirm that multiple vendors are capable of providing the solution required. Further market research was conducted on the OEM’s website for suppliers of brand-name specific Liebert UPS products and services within twenty miles of Dayton, OH. This market research confirmed that there is a reasonable expectation that three (3) or more businesses are authorized re-sellers of this product under NAICS 541519.

SUBSEQUENT ACQUISITION FOR SUPPLIES OR SERVICES:
At this time, the required Liebert UPS hardware and services are the only products that will give the detailed information required to support DLA’s requirements and meet the Government’s needs.
However, DLA has exercised, and continues to exercise, competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and the Government. DLA uses a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition to the maximum extent practicable.
