SP3300-19-Q-5008

1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart FAR 12.6 – Streamlined Procedures for Evaluation and Solicitation for Commercial Items; as supplemented with additional information included in this notice, and in conjunction with the Federal Acquisition Regulations (FAR) Part 13 Simplified Procedures for Certain Commercial Items. This announcement constitutes the only solicitation;

quotes are being requested and a written solicitation will not be issued. This is a Request for Quote (RFQ) and the solicitation number is SP3300-19-Q-5008.

2. This notice incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2019-01 effective 22 January 2019 and Defense Federal Acquisition Regulation Supplement (DFARS) DFARS DPN 20181221 edition effective 21 December 2018 and Defense Logistics Acquisition Directive (DLAD) PROCLTR 19-03 effective 07 January 2019.

3. This RFQ is for Preventive Maintenance of air compressors and dryers located at DLA Distribution Red River. The air compressors are manufactured by Air Compressor Supply, LLC. This service will also cover parts and labor for required repair of the air compressors. Additionally, this cost will also include mileage and service call fees for the scale technician. The Government intends to award one contract as a result of this solicitation. Any award resulting from this RFQ will be issued on a Standard Form (SF) 1449. NOTE: SUCCESSFUL OFFEROR MUST BE LICENSED TO WORK ON AIR COMPRESSOR SUPPLY EQUIPMENT AND MUST PROVIDE COPIES OF

CERTIFICATIONS WITH THEIR BID SUBMITTAL.

This effort will be awarded as a Firm Fixed Price purchase order.

4. This RFQ is a 100% small business set aside. The North American Industry Classification System (NAICS) code for this acquisition is 811310. The small business size standard is $7.5M. The Product Service Code (PSC) for this acquisition is J043

6. PERIOD OF PERFORMANCE:

7. SYSTEM FOR AWARD MANAGEMENT – In accordance with FAR 52.204-7 System for Award Management (OCT

2018), (b)(1) An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the Offeror’s name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in the SAM.

(c) If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. Please reference the clause for more information.

9. INVOICING AND PAYMENT – Invoicing and Payment will be made via Wide Are WorkFlow (WAWF). Reference

DFARS Clause 252.232-7003 and DFARS 252.232-7006 of the RFQ.

10. PACKING AND MARKING REQUIREMENTS - All products shall be packaged best commercial practice in accordance with ASTM 3951. All shipments must contain proper shipping documentation. Contractor shall attach, in a water resistant envelope, to the exterior shipping container a commercial packing list. All documents must include at a minimum, contract number and document number for the item, stock number, quantity, and unit of issue. Omission of any data on the shipping documentation could cause a delay in receipt of goods and significantly delay payment.

11. MARK CONTRACT NUMBER ON ALL CORRESPONDENCE - The Contractor must mark the contract or purchase order number on all paperwork and shipments. The order number must appear on the exterior of the shipment. Failure to follow these instructions will hold up payment and could result in the return of merchandise at contractor’s expense.

12. WAGE DETERMINATION: This requirement is subject to the Service Contract Act. Wage determination No.

2015-5277, Rev 11, dated 12/26/2018. Pursuant to FAR 52.222-42, Statement of Equivalent Rates for Federal Hires, the following data is provided for informational purposes only and is not a wage determination. The Wage Grade (WG) equivalent to this position is as follows:

Electronics Technician Maintenance = $26.50 per hour (WG-08, Step 1)

13. INSURANCE – Any required insurance certifications must be submitted to the Contracting Officer within ten (10) days after the date of contract award.

15. Questions shall be submitted in writing via e-mail to:scott.1.estes@dla.mil. The suspense for question submission shall be no later than 10:00 AM Eastern Local Time, 08 February 2019. Offerors must submit any questions regarding this solicitation in writing to the Contract Specialist. Questions must be received by the Contract Specialist in adequate time to allow a written response prior to the quote due date. No remarks or written responses to questions by Government personnel shall change or qualify any of the terms or conditions of this RFQ. The solicitation can only be changed by a formal written amendment issued by the DLA.

FAR 52.219-6 Notice of Total Small Business Set-Aside (DEVIATION 2019-O0003).

NOTICE OF TOTAL SMALL BUSINESS SET-ASIDE (DEVIATION 2019-O0003) (DEC 2018)

(a) Definition. “Small business concern,” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.

(b) Applicability. This clause applies only to—

(1) Contracts that have been totally set aside or reserved for small business concerns; and

(2) Orders set aside for small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).

(c) General.

(1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected.

(2) Any award resulting from this solicitation will be made to a small business concern.

(d) Agreement.

(1) For a contract at or below the simplified acquisition threshold, a small business concern may provide the end item of any domestic firm. For a contract exceeding the simplified acquisition threshold, a small business concern that provides an end item it did not manufacture, process, or produce, shall—

(i) Provide an end item that a small business has manufactured, processed, or produced in the United States or its outlying areas;

(ii) Be primarily engaged in the retail or wholesale trade and normally sell the type of item being supplied; and

DFARS 252.232-7006 Wide Area WorkFlow Payment Instructions (May 2013)

(a) Definitions. As used in this clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow

(WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall—

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(4) Payment request and supporting documentation. (d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract.

If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

FAR 52.217-8 _ Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 Days.

FAR 52.217-9 -- Option to Extend the Term of the Contract (Mar 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

QUOTE SUBMISSION INSTRUCTIONS:

1. All quotes must be received electronically via email at scott.1.estes@dla.mil by 10:00 AM EST on 15 February 2019 to be considered for award. Facsimile and hard copy submissions of quotes will not be accepted.

2. Quotations may be submitted in contractor format and shall include:

(A) Company name, address, telephone number, e-mail address, FAX number, DUNS Number, Contractor and Commercial and Government Entity (CAGE) Code.

(B) Solicitation number.

(C) Unit Price and extended prices for all CLIN(S). Contractors shall use Attachments 1 and 2 to complete their pricing. Contractors are required to submit pricing for each CLIN. Each CLIN is a firm quantity (firm-fixed price CLIN). The resultant contract will duplicate the quantity and the quoted price by the successful offeror.

(D) A completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, or a statement that the offeror has completed the annual representations and certifications electronically via the SAM website accessed through https://www.acquisition.gov. 4. ORGANIZATION/NUMBER OF COPIES/PAGE LIMITS: The Offeror shall prepare the quote in the English language as set forth in the Quote Organization Table below.

Addenda FAR 52.212-2 -- Evaluation -- Commercial Items (Oct 2014) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government intends to award one contract to the responsive, award will be made to the lowest price that meets all the other requirements of the solicitation. Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. Award will be made on all or none basis.

Award will be made to the acceptable offeror with the lowest evaluated price, inclusive of options, which is deemed responsible in accordance with the Federal Acquisition Regulations (FAR), DFARS and DLAD, and which has submitted a quote conforming to the solicitation requirements. The requirements include all stated terms, conditions, completion of representations and certifications, and all other requirements of this solicitation. The initial offer should contain the offeror’s best terms from a cost and technical standpoint.

Contractors are reminded that a Request for Quotation is not a request for proposal and that a quote is not an offer that the Government accepts or awards. This competition is not being conducted using FAR Part 15 procedures.

The award decision process is being conducted under FAR Part 12 and FAR Part 13, wherein the Contracting Officer is permitted to engage in communications with individual contractors that do not rise to the level of “discussion” or “negotiations” as understood in FAR Part 15, evaluations of proposals.

The Government reserves the right to evaluate quotes and may seek to make an award without asking for revised quotes or entering substantive discussions. Accordingly, contractors are encouraged to provide their most realistic and competitive terms with their initial quotes.

If the Contracting Officer does determine it is in the Government’s best interest to conduct communications with offerors, and a contractor is given an opportunity to correct any clerical errors and/or obvious mistakes in a quote, and after correction the quote is still determined to be unacceptable, such determinations will be cause for rejection of the quote. No offeror will be given an unlimited amount of opportunities for correction of a quote. The Government reserves the right to make a final determination whether a quote is acceptable or unacceptable solely on the basis of the information submitted and proceed without requesting additional information.

The following non-price factors shall be used to evaluate quotes:

Factor 1 – Technical Capability

Technical capability will be evaluated based on the offeror's:

(i) Knowledge of the tasks and deliverables as stated in the solicitation,

(ii) Capability for transforming its understanding into successful performance under the resultant contract; and

(iii) A quality control plan to ensure that deliverables are met as demonstrated in the technical capability section of their submissions.

Failure to provide a complete, detailed, realistic, and reasonable quote may reflect a lack of understanding of the requirements and may result in a determination that the Offeror’s quote is unacceptable. The Government does not assume a duty to search for clarification data to cure problems or inconsistencies with an Offeror’s quote. Evaluations will be on a Pass/Fail basis. A failure in any one of the above requirements constitutes a failure for factor 1 and the quote will not be further evaluated.

Factor 2 – Past Performance

The offeror should identify other federal Government contracts, and should describe the past experience of their company in providing similar support services as specified in this solicitation within the past three (3) years. If the contractor has not held 3 previous federal Government contracts of this nature, then they may list state and local contracts, or comparable private experience. Provide a list of three (3) references pertaining to those contracts including the following:

• Offeror's Name

• Contract Number and Contract Type

• Original Contract dollar value and final contract dollar value (including options)

• Original and final completion date

• A description of the contract effort

• The relevance of this contract to the current procurement

• Point of contact including telephone number The absence of past performance data will be rated neither favorably nor unfavorably, and will be rated as "acceptable".

PRICE QUOTE

The offeror shall provide the following:

a. Completed Section B Schedule of Prices – The offeror must provide both a unit price and an extended price for each priced contract line item number (CLIN);

b. A price breakdown of the proposed total price of each performance period.

c. A total price to include the base period and the two (2) option periods.

Technically acceptable quotes found to have a satisfactory record of past performance will be evaluated for the lowest price.

The price offered by the Contractor will be evaluated for fairness and reasonableness utilizing price analysis techniques. If additional information is required, the Government may require a breakdown of the price offered.

Award will be based on the lowest priced quote that meets or exceeds the acceptability standards for the non-cost factors.

DLAD 52.233-9001 Disputes – Agreement to Use Alternative Dispute Resolution (ADR) (DEC 2016)

(a) The parties agree to negotiate with each other to try to resolve any disputes that may arise. If unassisted negotiations are unsuccessful, the parties will use alternative dispute resolution (ADR) techniques to try to resolve the dispute.

Litigation will only be considered as a last resort when ADR is unsuccessful or has been documented by the party rejecting ADR to be inappropriate for resolving the dispute.

FAR 52.212-3 -- Offeror Representations and Certifications -- Commercial Items (OCT 2018)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(a) Definitions. As used in this provision--

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service—

(6) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(7) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
