FAR 52.212-2 - Evaluation -- Commercial Items (Oct 2014)
(a)The Government will award a contract resulting from this solicitation to the responsive, responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factor considered. Award will be made on all or none basis. Award will be made to the lowest priced technically acceptable offeror with the lowest evaluated price, which is deemed responsible in accordance with the Federal Acquisition Regulations (FAR), and which has submitted a quote conforming to the solicitation requirements. The requirements include all stated terms, conditions, completion of representations and certifications, and all other requirements of this solicitation. Any offeror who has been found to have a technically acceptable quote will then have the quote evaluated for lowest price.
To be considered acceptable and eligible for award, an offeror must address separately all the factors set forth in accordance with the instructions of this solicitation.
Contractors are reminded that a Request For Quotation is not a request for proposal and that a quote is not an offer that the Government accepts or awards. This competition is not being conducted using FAR Part 15 procedures.
The award decision process is being conducted under FAR Part 12 and FAR Part 13, wherein the Contracting Officer is permitted to have tailored communications with individual contractors about their quotes without engaging in "discussions" or "negotiations" under FAR Part 15.
The Government reserves the right to evaluate quotes and may seek to make an award without asking for revised quotes. Accordingly, contractors are encouraged to provide their most realistic and competitive terms with their initial quotes.
Communications: The Government reserves the right to evaluate quotes and may seek to make an award without asking for revised quotes or entering into substantive communication. Accordingly, contractors are encouraged to provide their most realistic and competitive terms with their initial quotes. No offeror will be given an unlimited amount of opportunities for correction of a quote. The Government reserves the right to make a final determination whether a quote is acceptable or unacceptable solely on the basis of the information submitted and proceed without requesting additional information. If the Contracting Officer does determine it is in the Government’s best interest to conduct communications with offerors, and a contractor is given an opportunity to correct any deficiencies in a quote, and after correction the quote is still determined to be unacceptable, such determinations will be cause for rejection of the quote.
Offerors are advised that submitting an unrealistically low price, whether initially or subsequently, may be grounds for eliminating a quote from competition either on the basis that the Offeror does not understand this requirement, or has made an incautious quote.
The factors shown below shall be used to evaluate offers:
https://www.sam.gov/
Factor 1: Past Performance
Factor 2: Technical/Business
Subfactor 2a: Project Management Plan
Subfactor 2b: Organization Structure and Qualifications

In the case of a supplier without a record of relevant past performance history in SPRS for the PSC of the supplies being purchased, the supplier will not be evaluated favorably or unfavorably for its past performance history. In the context of acceptability/unacceptability, “unknown” shall be considered acceptable.
FACTOR 2: Technical/Business
This factor relates to the project design and performance requirements described in the SOW and associated drawings. It concerns what the offeror proposes to do and how it will get done. It also includes the offeror’s capabilities, plans, key personnel, labor and equipment resources, and subcontracting efforts. The Technical/Business Factor has four subfactors: (1) Project Management Plan, (2) Organization Structure and Qualifications, and (3) System Layout/Design as described in FAR 52.212-1 Instructions to Offerors – Commercial Items.

The Offeror’s quote will be evaluated to ensure that subcontractors are properly managed and appropriately utilized in the performance of this project.
Subfactor (c): System Layout/Design
The Offeror’s quote will be evaluated on the quality of the equipment proposed, the commercial availability of individual components of the system, structural integrity of the design, enhancements to the Government design, and completeness of the layout.
PRICE QUOTE
If a quote has been determined acceptable under each of the non-price factors listed above, the Government will then evaluate the quote for the lowest price. The proposed total price, between offers that are determined to be technically acceptable will be the determining factor in the selection of a quote for award.
Price analysis shall not be conducted on offerors determined to be unacceptable for award, since the offeror will not be in line for award as the lowest priced technically acceptable offeror.
The Government will perform a price analysis to determine the reasonableness of proposed price in accordance with FAR 15.404-1(b). The Government will utilize a comparison of proposed prices received in response to the solicitation.
Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
