ADMET Predictor Software License or Equal Renewal and Support In Accordance with FAR 52.211-6, Brand Name or Equal
Firm Fixed Price
1.0 Background
The Family Smoking Prevention and Tobacco Control Act of 2009 grants the Food and Drug Administration (FDA) authority to regulate the manufacturing, marketing, and distribution of tobacco products to protect public health and reduce tobacco use by minors.
The use of tobacco products poses for the consumers a significant exposure to Harmful and Potential Harmful Constituents (HPHCs) and flavors/additives that have not been adequately characterized in terms of their potential toxicity. It is vitally important for the Division of Nonclinical Science (DNCS) to understand all potential toxicological effects of tobacco ingredients, additive and chemical emissions to support the Center for Tobacco Products (CTP) regulatory mission to reduce harm and health risk from tobacco products. The access by the toxicology reviewers at DNCS to specialized (Quantitative) Structure-Activity Relationship ((Q)SAR) software will help to fill the data gap that exists in the current understanding of potential harmful effects of tobacco ingredients and constituents with toxicity data mining and prediction capabilities needed for the evaluation of hundreds of chemicals present in the tobacco products.
CTP will use the renewed ADMET Predictor or equivalent software licenses to predict 140 properties including physico-chemical properties. Those properties are critical in vivo pharmacokinetic properties including sites of CYP metabolism, and various toxicities including cardiotoxicity (hERG channel block), hepatotoxicity (elevation of liver damage markers), endocrine toxicity (estrogen and androgen receptor binding), reproductive/developmental toxicity, phospholipidosis, skin and respiratory sensitization, genotoxicity (Ames mutagenicity and chromosomal aberrations) and carcinogenicity (rat and mouse TD50). CTP will use ADMET Predictor or equivalent license renewals to create QSAR/QSPR models based on in-house data, and to perform advanced data mining, clustering, and matched molecular pair analysis.
2.0 Objective
CTPs objective is to renew CTP/OS/Division of Nonclinical Sciences’ ADMET Predictor software licenses.
This software will be used by CTP personnel during toxicology data mining and assessment of potential toxicity of chemicals used in tobacco products for which no or only limited toxicology data is available.
Eight (8) licenses are currently installed in FDA equipment. Equivalent renewals to function seamlessly with existing licenses are required, one (1) for each of the following modules:

3.0. Functional Specifications
The contractor shall provide AdMet or equivalent software licenses, software updates and maintenance, ongoing training and technical support including reasonable telephone, web-based or e-mail technical support during license term.
3.1 Salient Characteristics / Software Functional Specifications:
a.) The software shall perform all of the following chemoinformatics functions:
• Provide accurate prediction of physicochemical properties of query chemical structures based on models widely accepted by independent researchers.
• Provide prediction of multiple critical pharmacokinetic parameters, including fraction absorbed, bioavailability, and a mechanistic volume of distribution at steady state using in silico inputs only.
• Provide prediction of metabolism by multiple CYP isoforms displayed on metabolic trees. Provide also prediction of key metabolism kinetic parameters (e.g., Km and Vmax) and inhibition potentials for 5 CYP isoforms. Provide prediction of glucuronidation metabolism.
• Provide prediction using artificial neural network ensemble models of mutagenicity with and without bioactivation, chromosomal aberrations, skin and respiratory sensitivity, and endocrine disruption.
• Allow users to create models with an option to choose from multiple algorithms including artificial neural network, support vector machine, kernel partial least squares, and linear regression algorithm.
• Allow users to create customized rules to prioritize compounds based on the combination of the predicted risks for absorption, metabolism and toxicity.
• Assist users to perform structure-activity relationship (SAR) evaluation by providing matched molecular pairs analysis.
• Provide an automated procedure for creating regression and classification models using

b.) The computational models of the software to be purchased shall be compatible to screening tobacco product ingredients and constituents including those on FDA/CTP’s Hazardous and Potentially Hazardous Constituents list:

c.) The computational software models shall be compatible with existing Admet Predictor models installed on FDA computers and compatible with the FDA environment including current ADMET Predictor user interface, data files and analyses outputs.
d.) The software shall make predictions for various physicochemical properties, toxicological endpoints and pharmacokinetic parameters based on artificial neural network ensemble models, and 2) allow CTP to create custom regression and classification models. The software shall allow CTP to create the models https://www.fda.gov/tobaccoproducts/labeling/productsingredientscomponents/ucm20035927.htm using descriptors that are automatically computed and comparable to previous CTP analyses made using ADMET Predictor Software.
e.) The software shall allow CTP to predict the following physicochemical properties using artificial neural network ensemble models:
1) Multiprotic ionization constants (pKa)
2) logP and logD
3) Air-water partition coefficient
4) OATP1B1 inhibition
5) P-gp substrate
6) P-gp inhibition
7) Aqueous solubility
8) pH at “native solubility”
9) Aqueous solubility at specific pH
10) Intrinsic aqueous solubility
11) Salt solubility factor
12) Tendency for a compound to form a supersaturated solution
13) Human plasma protein binding
14) Human blood-to-plasma ratio
15) Rat plasma protein binding
16) Rat blood-to-plasma ratio
17) Volume of distribution
18) MDCK Transwell permeability
19) Blood brain barrier (classification model)
20) Log of the brain to blood concentration ratio
21) Permeability through the rabbit cornea
22) Permeability through human skin f.) The software shall provide CTP the ability to make predictions of toxicity using artificial neural network ensemble models for the following endpoints.
a. Bacterial mutagenicity for 5 strains with and without bioactivation condition
b. Chromosomal aberrations
c. Skin and respiratory sensitivity
d. Endocrine disruption potential g.) The software shall make predictions of substrate/nonsubstrate classification for multiple CYP and
UGT isoforms relevant to human xenobiotic metabolism based on artificial neural network ensemble models, and provide graphics for visualizing the data (e.g., metabolic trees). The metabolic prediction needs to include kinetic parameters (Km and Vmax) for CYP isoforms based on atomic descriptors.
h.) The software shall make predictions of pharmacokinetic parameters (e.g., fraction absorbed, bioavailability, and volume of distribution) using artificial neural network ensemble models.
i.) The software shall allow users to create custom computational models using multiple pre-configured algorithms including artificial neural network, support vector machine, kernel partial least squares, and multiple linear regression.
4.0 Delivery Location
4.1 The FDA anticipates online delivery of the AdMet equivalent software license renewals, as keys or codes transmitted via email or other electronic means. Contractor shall deliver all software maintenance and relevant documentation as listed above. The delivery location for this contract will be:

4.2 Inspection/Acceptance Criteria: The performance criteria for this task order shall be that all software with appropriate license keys, proof of entitlement certificates, maintenance support confirmation has been delivered to the FDA COR within 10 days after contract award.
5.0 Evaluation Method:
The FDA will evaluate quotes received in response to this Combined Synopsis / Solicitation on a lowest price-technically-acceptable (LPTA) basis.
The Contracting Officer will evaluate “equal” products in accordance with FAR Clause 52.211-6 Brand Name or Equal.
Failure to demonstrate meeting the requirements of this notice will result in a rating of technically unacceptable and will not be considered for award.
5.1 Award determination process:
The Government will award a fixed-price order resulting from this solicitation to the responsible Contractor whose quotation is determined to be technically acceptable and presents the lowest priced to the Government. Quoters' initial quote should contain the Quoters’ best terms from a price standpoint. The Government may reject any or all quotes if such action is in the best interest of the Government.
• In the unlikely event two or more quotes are priced exactly the same and are both deemed to be technically acceptable, the quoters with identical prices shall be allowed to offer a discount.
• The technically acceptable quote offered at the lowest discount price shall be awarded the Order.
5.2 Technical acceptability
A technically acceptable quote is one that offers to provide the FDA with the goods and services specified in this Statement of Work - or functionally equivalent goods that meet all the salient characteristics and requirements of this SOW – within the specified delivery schedule.

9.0 Contracting Officer Authority
The Contracting Officer (CO) is the sole person authorized to make or approve any changes in any of the requirements of this purchase order and notwithstanding any provisions contained elsewhere in the order, the said authority remains solely with the CO. In the event the Vendor makes any changes at the direction of any person other than the CO, the change shall be considered to have been made without authority and no adjustment will be made in the order terms and conditions, including price. The CO shall be the only individual authorized to accept nonconforming work, waive any requirement of the order and modify any term or condition of the order. The CO is the only individual who can legally obligate Government funds.
The Contracting Officer’s Representative (COR) or Project Officer is not authorized to make any commitments or otherwise obligate the Government or authorize any changes which affect the order price, terms or conditions. The COR/Project Officer is responsible for the technical aspects of the project and serves as technical liaison with the Vendor and is responsible for the final inspection and acceptance, and such other responsibilities as may be specified in the purchase order.
10. FAR/HHSAR CLAUSES AND PROVISIONS

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only because of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 12 months.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. FAR 52.203-19: Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements (Jan 2017)
(a) The Contractor shall not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).
(b) The Contractor shall notify current employees and subcontractors that prohibitions and restrictions of any preexisting internal confidentiality agreements or statements covered by this clause, to the extent that such prohibitions and restrictions are inconsistent with the prohibitions of this clause, are no longer in effect.
(c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312 (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive
Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015, (Pub. (a) Pursuant to Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d), as amended by the Workforce Investment Act of 1998, all electronic and information technology (EIT) supplies and services developed, acquired, or maintained under this contract or order must comply with the “Architectural and Transportation Barriers Compliance Board Electronic and Information Technology (EIT) Accessibility Standards” set forth by the Architectural and Transportation Barriers Compliance Board (also referred to as the “Access Board”) in 36 CFR part 1194. HHSAR 352.239-73: Electronic and Information Technology Accessibility Notice (Dec 2015)
(a) Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d), as amended by the Workforce Investment Act of 1998 and the Architectural and Transportation Barriers Compliance Board Electronic and Information (EIT) Accessibility Standards (36 CFR part 1194), require that when Federal agencies develop, procure, maintain, or use electronic and information technology, Federal employees with disabilities have access to and use of information and data that is comparable to the access and use by Federal employees who are not individuals with disabilities, unless an undue burden would be imposed on the agency. Section 508 also requires that individuals with disabilities, who are members of the public seeking information or services from a Federal agency, have access to and use of information and data that is comparable to that provided to the public who are not individuals with disabilities, unless an undue burden would be imposed on the agency.
