Section 1.03 RFP Schedule established a Deadline for Submission of Questions and Objections. The responses, including any necessary amendments, are as follows:
Questions related to Section 2.01 Background Information:
1. Question: Have there been any historical concerns or challenges related to PRTF cost report data when establishing annual rates?
Response: Each of the six PRTFs located in North Dakota have different staffing structures and services. These differences across the six PRTF locations can be a challenge for cost analysis.
No amendment necessary.
2. Question: Is there a current vendor assisting North Dakota with PRTF rate setting?
Response: STATE currently contracts with Myers and Stauffer LC to provide desk reviews and rate calculations for rate setting, however, STATE does not have a current vendor for the scope of work as described in this RFP.

3. Question: Can you confirm if there is currently an incumbent for this scope?
Response: Please see the response to Question 2 above.

Questions related to Section 2.02 Scope of Work:
4. Question: In Task 1 of the RFP, the workplan deliverable requirements reference “Analysis of PRTF assessment outcomes, gaps in PRTF services, and goals of PRTF best practice and services and sustainability of this funding model.” Can the State please provide additional information on the assessment tools that are utilized and the outcome data that are currently available?
Response: STATE currently utilizes the Children’s Treatment Services Level of Care Outcome data and claims data. The North Dakota Children's Treatment Services LOC Provider (Program) Manual outlines criteria used for PRTF level of care.

5. Question: Are the PRTF cost reports available electronically? If so, are electronic cost reports available for the most recent 5 years?
Response: Yes, the PRTF cost reports are available electronically. STATE will provide the most recent five years of cost reports in Excel format to the successful offeror after the contract has been signed by both parties.

6. Question: Are there any quality or participant outcomes data collected currently?
Response: Yes, STATE currently collects Children’s Treatment Services Level of Care Outcome data and claims data.

7. Question: Are there specific states that the State is looking to compare to or use as a model for this project?
Response: No, there are no specific states the STATE is looking to compare to or use as a model for this project.

8. Question: Does the State have an existing public stakeholder group for PRTFs? Similarly, does the State have an established process for outreach to Medicaid members, custodians, and their families?
Response: No, STATE does not have an existing public stakeholder group for PRTFs or an established process for outreach to Medicaid members, custodians, and their families. STATE is looking for the successful offeror to establish both.

Questions related to Section 4.06 Cost Proposal:
9. Question: What is the State’s budget for this procurement?
Response: At this time, STATE is not disclosing its budget. The funds for payment of this contract are already appropriated and identified. An offeror shall provide a Cost Proposal that follows the same format as Attachment C based off the requirements of this RFP.

10. Question: Can you confirm if there is an anticipated budget for this scope?
Response: Please see the response to Question 9 above.

Question related to Section 5.03 Proposal Evaluation:
11. Question: To what degree, if any, does the submission of exceptions to the terms and conditions impact the scoring/evaluation of the respondent’s proposal?
Response: The submission of exceptions to the terms and conditions will not impact the total number of points used to score an offeror’s proposal. The Evaluation Tool, Attachment D of the RFP, will be the scoring tool used to score proposals. The technical proposal evaluation criterion scores and cost proposal evaluation score will be added together to determine the total evaluation score. The final evaluation score may consider information received by STATE, including, but not limited to, discussions with offerors, reference checks, and best and final offers. Please also see Section 6.13 Negotiations of the RFP.

Question related to Attachment B - Business Associate Agreement:
12. Question: The BAA requires the vendor to return or destroy all protected health information (PHI) within 30 days after the contract ends. The RFP, sample contract, and BAA are silent as to the retention period of non-PHI. We recommend before final contract signature that the State include a data retention period for the rest of the documents compiled as part of the project.
Response: Please see Section 26 Access to Books and Records in Attachment A – Sample POS Agreement.

Question related to Attachment C - Cost Proposal
13. Question: The cost proposal appears to be one value. Will the contractor be paid monthly?
Response: The Total Cost in Attachment C – Cost Proposal is the total amount to complete the work as described in the RFP for the contract term of October 1, 2025, through December 31, 2026. As stated in Attachment A – Sample Purchase of Service Agreement, Section 3. Compensation, the successful offeror shall submit its request for reimbursement to STATE monthly.
