STATEMENT OF WORK

1. SCOPE

This Statement of Work (SOW) defines the effort required for the replacement of the exterior steel walkway at Building 116CC located at the Naval Undersea Warfare Center Division Newport (NUWCDIVNPT), Newport, RI. It includes the removal of the existing steel walkway, removal and provision of existing concrete landings and sidewalks, and provision of new fiber reinforced plastic (FRP) walkway.

1.1 Background. Building 116CC is a 20,000 sf single story, concrete building. An existing steel walkway passes over the south end of the building to connect Cunningham Street, on the west side (front) of Building 116CC, to Lay Street, on the east side of Building 116CC. This steel walkway has deteriorated to the point that it is no longer safe to use. Adjacent concrete landings have also deteriorated and will need to be replaced in order to accept new anchors.

The existing walkway is coated with paint containing lead. Lead safe work practices will need to be used during demolition.

3. REQUIREMENTS

3.1 General Requirements. The work required by this contract must be performed in accordance with the specifications and drawings listed in part 2 of this Statement of Work

(SOW).

3.1.1 Period of Performance. All work must be completed within 180 days from notice to proceed. Any modifications or extensions must be requested through the Contracting Officer for review and discussion.

3.1.2 Security Requirements. All contractor personnel coming to the site must be

United States of America citizens, will be required to present a valid identification (such as a passport or Real ID Act‐compliant state driver’s license) and will be subject to a background check. To access the site, a Visit Request must be submitted to NUWCDIVNPT Security and a SECNAV 5512/1 form must be submitted to NSN Security. Visitor badges require photo taken and fingerprinting. Visit requests take up to 15 working days for processing and must be renewed every 179 days.

3.1.3 Buy American Act. The Contractor shall use only domestic construction material in performing this contract, unless otherwise allowed by the Contracting Officer.

3.2 Detail Tasks

3.2.1 Hazardous Material Testing. Prior to demolition, test existing materials to confirm the absence of unknown hazardous materials. Materials that require testing, include: roof, exterior insulation and finish system, and soil.

3.2.2 Lead Abatement. The existing steel is coated with paint containing lead. Provide barriers to contain the lead during demolition. Perform the demolition of the existing walkway using lead‐safe practices described in specification section 02 83 00 Lead Remediation. At the completion of demolition, perform sampling to ensure the containment was successful. If the results of the samples indicate that the containment was not successful, addition abatement will be required to cleanup the area.

3.2.3 Soil Erosion and Sediment Control. Provide temporary soil erosion and sediment control measures in accordance with the Soil Erosion and Sediment Control (SESC) Plan to minimize negative effects of stormwater during construction and to control construction waste.

Existing soils are known to contain high levels of arsenic. Excavation must be performed in accordance with the Naval Station Soil Management Plan. Typically, this consists of: using dust control measures during excavation (i.e. watering), temporarily stockpiling excavated soil, testing soil for posible contaminents, and then disposing of soil a landfill off‐base.

3.2.4 Demolition. Remove the existing steel walkway, steel stairways, concrete landings, and concrete sidewalks as indicated on the drawings. Remove sections of the existing EPDM roof and EIFS siding to as necessary to access the anchors for the steel walkway and stairs.

Provide temporary measures during demolition to prevent rainwater from getting into the building through the openings in the roof and siding.

3.2.5 Design and Engineer. Provide engineered design drawings for new FRP stairways and a new FRP walkway to replace the existing steel walkway.

3.2.6 Construction. Provide new concrete sidewalks and landings as indicated. Provide new FRP stairways and walkways as indicated and in accordance with the engineered design drawings. Patch the roof, siding, and adjacent roads. Grade, loam, and seed adjacent areas to match adjacent existing vegetated areas.

SUPPLEMENTARY INSTRUCTIONS

This requirement procured using Sealed Bidding and award made to the lowest price, responsive, and responsible offeror.

4. DELIVERY OF PROPOSAL

7. BADGING

Allow five (5) business days for the badging process. Weekends, holidays, and the submission day of the badging request are not included in the five-day (5) timeframe.

All NUWCDIVNPT base access is governed by Homeland Security Presidential Directive 12. Anyone accessing NUWCDIVNPT must be a US citizen and submit a visit request as described below:

NUWCDIVNPT Security - Visitor Request Information:

A visit request is mandatory for all visitors to NUWC Division Newport, government and civilian, regardless of the duration or classification of the visit. Access to NUWC Division Newport will not be granted under any circumstances without a valid visit authorization request on file.

DUE TO THE NUMBER OF VISIT REQUESTS RECEIVED, SEVEN (7) DAYS PROCESSING TIME IS

REQUIRED FOR ALL VISIT REQUESTS WHETHER RECEIVED BY JPAS OR BY FAX.

Use of the Joint Personnel Adjudication System (JPAS) is the preferred method for submitting visit requests. For visits, the Security Management Office (SMO) for visits is 666045. Include the Solicitation Number or Contract Number in the space allocated for the POC Phone Number. Questions on visits may be addressed to the NUWCDIVNPT Division at 401-832-2551.

8. MINIMUM INSURANCE REQUIREMENTS

a. The contractor shall procure and maintain during the entire period of performance under this contract the following minimum insurance coverage (also refer to FAR 52.228-5):

1. Comprehensive General Liability: $500,000 per occurrence.

2. Automobile Liability: $200,000 per person, $500,000 per occurrence, $20,000 per occurrence for property damage.

3. Workmen’s Compensation: As required by Federal and State workers’ compensation and occupational disease laws.

4. Employer’s Liability Coverage: $100,000 except in states where workers compensation may not be written by private carriers.

5. Others as required by State of Rhode Island.

b. Prior to commencement of work, the contractor shall furnish to the Contracting Officer a certificate or written statement of the above required insurance. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in the policies adversely affecting the interests of the Government in such insurance shall not be effective for such period as may be prescribed by laws of the state in which the contract, “Number Provided Upon Award” is to be performed, and in no event less than thirty (30) calendar days after written notice thereof to the Contracting Officer.

c. The Contractor agrees to insert the substance of this clause, including this paragraph (c), in all subcontracts hereunder.

Cancellation Language: The cancellation language must state, "Any cancellation or any change in the limits of liability shall not be effective (1) for such period as the laws of the state in which this contract is to be performed prescribe or (2) until 30 days after the insurer gives written notice to the Contracting Officer, whichever period is longer.” Wording such as "will endeavor to mail notice" or “failure to mail such notice shall impose no obligation or liability" does not comply with the contract requirements and therefore are not acceptable.

9. CONTRACTOR EVALUATION PERFORMANCE REPORTING SYSTEM (CPARS)

The Contractor is required to provide the Government with the name, telephone phone number, and e-mail address of the Contractor’s Representative who will be responsible for the receipt and review of draft performance evaluations prepared by the Government. It is the Contractor’s responsibility to keep this contact information current. Review CPARS requirements at https://cpars.csd.disa.mil.

10. EMPLOYMENT ELIGIBILITY VERIFICATION

If contractor is not enrolled as a Federal Contractor in E-verify at time of award, then the Contractor shall enroll a Federal Contractor in E-verify within thirty (30) calendar days of contract award. Refer to FAR Clause 52.222-54 for further instructions.

11. WIDE ARE WORK FLOW (WAWF)

The contractor will utilize electronic invoice processing. Refer to Defense Federal Acquisition Supplement (DFARS) Clauses 252.232-7006 and 252.232-7003 for further information.

52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (MAR 2020)

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 238190.

(2) The small business size standard is $16,500,000.

(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.

52.204-9 PERSONAL IDENTITY VERIFICATION OF CONTRACTOR PERSONNEL (JAN 2011)

(a) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24, and Federal Information Processing Standards Publication (FIPS PUB) Number 201.

(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:

(1) When no longer needed for contract performance.

(2) Upon completion of the Contractor employee's employment.

(3) Upon contract completion or termination.

(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.

(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor`s employees are required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.

(a) Definitions. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. 52.204-23 PROHIBITION ON CONTRACTING FOR HARDWARE, SOFTWARE, AND SERVICES

DEVELOPED OR PROVIDED BY KASPERSKY LAB AND OTHER COVERED ENTITIES (JUL 2018)

(a) Definitions. As used in this clause--

Covered article means any hardware, software, or service that--

(1) Is developed or provided by a covered entity;

(2) Includes any hardware, software, or service developed or provided in whole or in part by a covered entity; or

(3) Contains components using any hardware or software developed in whole or in part by a covered entity.

Covered entity means--

(1) Kaspersky Lab;

(2) Any successor entity to Kaspersky Lab;

(3) Any entity that controls, is controlled by, or is under common control with Kaspersky Lab; or

(4) Any entity of which Kaspersky Lab has a majority ownership.

(b) Prohibition. Section 1634 of Division A of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L.

115-91) prohibits Government use of any covered article. The Contractor is prohibited from--

(1) Providing any covered article that the Government will use on or after October 1, 2018; and

(2) Using any covered article on or after October 1, 2018, in the development of data or deliverables first produced in the performance of the contract.

(c) Reporting requirement.

(1) In the event the Contractor identifies a covered article provided to the Government during contract performance, or the Contractor is notified of such by a subcontractor at any tier or any other source, the Contractor shall report, in writing, to the Contracting Officer or, in the case of the Department of Defense, to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.

(2) The Contractor shall report the following information pursuant to paragraph (c)(1) of this clause:

(i) Within 1 business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; brand; model number (Original Equipment Manufacturer (OEM) number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the report pursuant to paragraph (c)(1) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of a covered article, any reasons that led to the use or submission of the covered article, and any additional efforts that will be incorporated to prevent future use or submission of covered articles.

(d) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts, including subcontracts for the acquisition of commercial items.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (OCT 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
