Prices shall be quoted as firm for thirty calendar days from the closing date, with payment to be made in accordance with South Carolina Consolidated Procurement Code Section 11-35-45. Award will be made to the lowest responsible responsive bidder. The contractor must be licensed and bonded, provide commercial general liability insurance of one million dollars with the South Carolina Forestry Commission named as co-insured, and comply with South Carolina Workers' Compensation Law. Contractors must provide three references for completed work and comply with Title 8, Chapter 14 of the South Carolina Code of Laws regarding legal immigration requirements. The solicitation allows for claims of South Carolina resident contractor preferences and resident subcontractor preferences of two and four percent. All construction debris must be removed in accordance with Jasper County and South Carolina DHEC regulations. TERMS & CONDITIONS

INSTRUCTIONS TO OFFEROR

*Individual signing quote must be authorized to obligate the submitting vendor.

*Please quote lowest prices, exclusive of State and Federal Tax, on the below listed services.

*All items quoted shall be new unless otherwise stated herein.

*Award will be to the lowest responsible responsive bidder for all items requested.

*Quotation documents must be clearly marked with this "Quotation Number and Closing Date".

*If your envelope does not indicate Quotation Number and Closing Date, your quotation may be unidentifiable, lost or misplaced, and therefore not considered for award.

*Prices shall be firm for thirty (30) calendar days from Closing Date.

*Payment terms will not be a factor in award.

*The South Carolina Forestry Commission reserves the right to reject any and all quotations, and to waive any and all formalities and technicalities, and also reserves the right to reject any quotation where delivery time indicated by vendor will result in delay deemed unsatisfactory to the Department.

*Note to Vendor: By signing and submitting a quote, you are certifying under penalties of perjury that you do not have any liens as described in Section 12-54-120 of the S.C. Code of Laws 1976 as amended, relating to payment of taxes.

*Unit prices shall prevail unless otherwise indicated and shall be all-inclusive. The South Carolina Forestry Commission will not pay freight, unless previously stated herein. Offeror must consider all expenses when submitting quotes. No additional charges or fees will be allowed.

*Your company must be registered on SCEIS to do business with the State of South Carolina. If your company is not registered, go to http://www.procurement.sc.gov to do so.

If your company has registered with the State on the SCEIS website please make sure a contact name, phone number and email address are provided or your bid cannot be evaluated. Make sure you allow Surrogate Bidding or your response cannot be evaluated.

TERMS AND CONDITIONS Continued All amendments to and interpretation of this RFQ shall be in writing. The procurement officer shall not be legally bound by any amendment or interpretation that is not in writing.

Payment will be made in accordance with Section 11-35-45 of the South Carolina Consolidated Procurement Code and Disbursement Regulations. Delay in receiving invoices, as well as errors and omissions on the invoices, will be considered just cause for withholding payment without losing discount privileges. The Forestry Commission reserves the right to withhold payment or make such deductions as may be necessary to protect the Forestry Commission from loss or damage because of defective work, claims, damages, or to pay for repair of correction of materials furnished hereunder.

Quoted prices must remain firm for a period of thirty days beyond the RFQ deadline. Unit prices will govern over extended prices unless otherwise stated.

All materials and products offered must be guaranteed to meet and comply with the requirements of all specifications, terms, and conditions indicated in this solicitation.

Award will be made in accordance with Section 11-35-1550 of the South Carolina Consolidated Procurement Code.

The Forestry Commission reserves the right to: (1) reject any and all quotations and to cancel the solicitation; (2) waive any and all technicalities; (3) reject any quotation in which the delivery time indicated is of substantial length to cause disruption and/or delay in operation for which the item(s) is/are intended; (4) reject ambiguous quotations which are uncertain as to terms, delivery, quantity, or compliance with specifications.

The successful bidder assumes sole responsibility and shall hold harmless the Forestry Commission, its directors, officers, employees, and agents from and against any and all claims, actions, or liabilities of any nature which may be asserted against them by third parties in connection with the performance of the successful bidder, its directors, officers, employees, and agents under this agreement..

Contractor agrees not to refer to award of this contract in commercial advertising in such a manner to state or imply that the products or service provided are endorsed or preferred by the user.

Upon award of a contract under this solicitation, the person, partnership, association, or corporation to whom the award is made must comply with the laws of South Carolina that require such person or entity to be authorized and/or licensed to do business in this State. Notwithstanding the fact that applicable statutes may be exempt or exclude the successful offeror from requirements that it be authorized and/or licensed to do business in this State, by submission of this signed quote, the bidder agrees to subject itself to the jurisdiction and process of the courts of the State of South Carolina as to all matters and disputes arising or to arise under the contract and the performance thereof, including any questions as to the liability for taxes, licenses, or fees levied by the State.

Scope of Work

Building A- (Caretakers Residence)

· Relevel sagging floor by adding blocking to existing peer.

· Repair roof leaks.

· Replace existing sliding glass door with new French door.

Building B- (Fuel Shed)

· Replace existing shingles with new 3 Tab shingles and install new ridge vent.

· Install eight (8) 4”x4”x36” corner braces. Attach with galvanized lag screws with washers or TimberLok screws.

Building C- (Chemical Shed)

· Replace existing shingles with new 3 Tab shingles and ridge vent.

· Replace the bottom section (4’x 8’) of existing siding with the same material.

· Prime all new wood and add 2 coats of finish paint to all wall area.

Building D- (Well House)

· Replace existing shingles with new 3 Tab shingles and install new ridge vent.

Specifications

· Paint Color to match existing maintenance shop.

· Shingles to be Charcoal 3 Tab 25 yr. Asphalt Shingles.

· French Door- 72” x 80” Blinds between the glass Primed Steel Inswing Double French Patio Door.

Energy Star Rated.

Predrilled double bore hole for lock w/ deadbolt.

15 Lite (Grids between glass).

Miscellaneous

· All construction debris to be removed per Jasper County and SC DHEC regulations.

· Upon notice to proceed, contractor shall have 10 working days to proceed with project.

· Contractor shall have 15 working days to complete project.

· Contractor to be licensed and bonded.

· Contractor to provide Certificate of Liability and Workman’s Comp information upon request.

· The Contractor agrees to comply with “The South Carolina Illegal Immigration Reform Act, 2008”.

· (An overview is available at http://www.procurementlaw.sc.gov/immigration/MMO-legal-immigration.phtm) By signing your offer, you certify that you will comply with the applicable requirements of Title 8, Chapter 14 of the South Carolina Code of Laws and agree to provide to the State upon request any documentation required to establish either: (a) that Title 8, Chapter 14 is inapplicable to you and your subcontractors or sub-subcontractors; or (b) that you and your subcontractors or sub-subcontractors are in compliance with Title 8, Chapter 14. Pursuant to Section 8-14-60, "A person who knowingly makes or files any false, fictitious, or fraudulent document, statement, or report pursuant to this chapter is guilty of a felony and, upon conviction, must be fined within the discretion of the court or imprisoned for not more than five years, or both." You agree to include in any contracts with your subcontractors language requiring your subcontractors to (a) comply with the applicable requirements of Title 8, Chapter 14, and (b) include in their contracts with the sub-subcontractors language requiring the sub-subcontractors to comply with the applicable requirements of Title 8, Chapter 14. · The Contractor must be able to provide proof of COMMERCIAL GENERAL LIABILITY insurance for the amount of ONE MILLION DOLLARS ($1,000,000) with the SC Forestry Commission named as co-insured.

· The Contractor agrees to fully comply with SECTION 42-1-10, also known and cited as “The South Carolina Workers’ Compensation Law”.

Contractor must provide at least 3 references for completed work in relation to job requested in Scope of Work.
