(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. 52.217-8 Option to Extend Services.
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. OFFER SUBMISSION DOCUMENTS
1. One (1) original fully completed and signed SF 1449 Offer page (complete block 30), acknowledgment of all amendments by completing blocks 15a, b, and c of the Amendment SF30
2. Offeror pricing document. Document shall provide detailed pricing breakout of all costs, labor, equipment, supplies for the base year and each option year. This will be utilized for a price analysis to ensure the offered amount can physically be executed in the time proposed and supplies required. Offers that fail to provide this document will be considered non-responsive and not eligible for award.

4. Attachment 6 Pre-Award Survey Form. Offerors shall complete and submit Attachment 5 Pre-Award Survey Form. Also, The Contractor shall be responsible to write a Letter addressed to the Financial Institution referenced in Attachment 5 giving authorization release to the Contracting Officer and/or Government designee, USDA 1880 Kimball Ave Suite 300, Manhattan, Kansas. A signed copy of the Letter shall be submitted.
5. Technical Proposal. The offeror shall describe is proposed approach through the use of narrative, in sufficient detail for the
Government to understand and evaluate the nature of the approach regarding the contractor’s capability to provide elevator maintenance as required by the Performance Work Statement. The Technical Proposal shall incorporate the PWS timelines and the standard thresholds to ensure they understand the requirement. Offerors with a more comprehensive Technical Proposal will be evaluated higher, IAW with the evaluation terms.
6. Documentation that the contractor is a “Certified Elevator Technician”, and with the ability to provide maintenance on Kone elevators maintain without voiding any current manufacture warranty items.
7. Past Performance documentation- Offerors shall provide at least (2) past performance references for federally awarded contracts awarded within the past 3 years. The references must include similar maintenance and repairs for elevators in a federal facility. The past performance reference shall not be for one (1) time repair, but are for multiple option year service contracts of similar size and scope. Offerors with highly rated past performance will be evaluated higher than those offerors with no past performance or negative past performance.
FAR 52.212-2 -- Evaluation -- Commercial Items (Addendum).
Evaluation -- Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical Capability, Past Performance, and Price.
Technical Capability and past performance, when combined, are more important than price.
As stated in FAR 13.106-2, “If using price and other factors, ensure that quotations or offers can be evaluated in an efficient and minimally burdensome fashion. Formal evaluation plans and establishing a competitive range, conducting discussions, and scoring quotations or offers are not required. Contracting offices may conduct comparative evaluations of offers.”
The In accordance with FAR Part 13 the Government will award a firm fixed price contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1) Meeting all requirements as defined in the solicitation, to include Quote submission documents referenced in 52.212-1. Failure to submit ANY of the required document listed in “Offer Submission Documents (52.212-1 Addendum) will render your quote non-responsive and thus not eligible for award. Failure to acknowledge any and all amendments will render your quote non-responsive and thus not eligible for award.
2) Offers that fail to provide a realistic pricing approach for Submission Document #2 for this effort will be found not acceptable. The Contractor must demonstrate the price proposed will not lead to reduced services, reduced quality, etc because the proposed price resulted in a loss to perform the full Performance Work Statement.
3) Technical Proposal Evaluation. The Contractor shall provide a plan that address all the aspects identified in Submission Document #5. Offerors that fail to address any aspects or the proposed solution is not compatible with the PWS or laws will be found unacceptable. The Technical Proposal shall ensure that the Contractor demonstrates that PWS 0001 is for from 04/24/2021- 09/30/2021, and that PWS 0002 is from 10/01/2021-04/23/2026. This is necessary because there is only 1 elevator that requires coverage for the first few months of the contract. Offerors with a more comprehensive technical proposal will be evaluated higher.
4) Supporting documentation that the contractor is Certified Elevator who is authorized to perform maintenance on Kone elevators with the ability to maintain any current manufacture warranty items without voiding any warranty”. Offerors that fail to provide this Kone supporting documents will be found “Unacceptable”.
5) Past performance will be evaluated in accordance with FAR 13.106-2. Offerors with highly rated past performance in similar scope/service will be evaluated higher, than offers will minimal or no past performance. The apparent successful, prospective contractor must have acceptable past performance. System for Award Management (SAM.gov) exclusions list, Federal Awardee Performance and Integrity Information System, and Contractor Performance Assessment Reporting System (CPARS) shall be considered as part of the past performance evaluation process. Any past performance that is found to be “negative”, shall result in the entire Past Performance rating as “Unacceptable”. “Negative” is defined as any CPARS past performance evaluation rated less than “Satisfactory”, any Terminations for Default/Cause, or any negative performance references will be rated as ‘Unacceptable’. Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.
Reasonable inquiry has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended."Sensitive technology"— Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3)of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veteransor, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service connected, as defined in 38 U.S.C. 101(16).
Small business concern—
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
Small disadvantaged business concern, consistent with13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—
(i) One or more socially disadvantaged (as defined at13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
Subsidiary means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
Veteran-owned small business concern means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C.
