SOLE SOURCE JUSTIFICATION FOR SIMPLFIED ACQUISITIONS

FAR Part 13.S01(a)(1)(ii)

1. Identification of the agency and the contracting activity:

The Department of State, Office of Acquisition Management is conducting this acquisition on behalf of the Bureau of Diplomatic Security for secure parking spaces for government vehicles assigned to the Boston Field Office (DS/BFO).

2. The nature and/or description of the action being approved.

The agency contemplates award of a Firm Fixed Price Purchase Order.

3. A description of the supplies or services required to meet the Department's needs.

The Bureau of Diplomatic Security has a requirement for a company to provide secure parking for Law Enforcement and Armored Vehicles in Boston, MA.

4. An identification of the statutory authority permitting other than full and open competition:

This request is made pursuant to the authority of FAR Part 13.501 (a) (1) (ii), in accordance with 41 U .S.C. 3304 (a) (I) "Only one responsible source and no other supply or services will satisfy requirement of executive agency."

5. A demonstration that the proposed contractor's unique qualifications or the nature of the action require use of the authority cited.

No other providers are willing to meet our standards of 2417 parking, reserved parking spots and implemented security measures.

6. A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable, include whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

This J &A will be publicized with a synopsis of the requirement.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Note: dollar amounts may not exceed statutory limitations for the commercial items test program identified in FAR 13.500.

The Contracting Officer will utilize the current monthly parking rates, historical contract cost, and other market research pricing data to ensure the cost is fair and reasonable.

8. A description of the market research conducted (per FAR Part 10) and the results or a statement of the reason market research was not conducted.

Utilizing a Technical Evaluation Team (TET) the field office reviewed all parking establishments within the prescribed .5 to 1 mile from the field office. In person meetings were conducted with several parking establishments that looked promising. Unfortunately the establishments did not want to contract parking since we are co-located next to the Toronto Dominion (TD) Garden, referred to as TD Garden. Being able to double and triple charge for parking spots during concerts and sporting events is causing these establishments to decline to provide us with dedicated, contracted, reserved parking.

Other establishments did not have appropriate security in place and were not 2417 parking. We did market research for 8 months prior to implementing the sole source paperwork.

9. Any other facts supporting the use of other than full and open competition such as:

N/A

10. A listing of the sources, if any, that express.ed, in writing, an interest in the acquisition.

Only one responded to the Request for Information submitted on FedbizOpps.com on May 8, 2019 through May 22, 2019.

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition before any subsequent acquisition for the supplies or services required.

Market Research will be conducted again prior to the award when this order expires in five years.

File details come from the government source that posted it.
